Abstract

In a juridical-formal, firmly determined, that each agreement requires the agreement of the parties. However, the implementation of normative tools is not as easy as the textual sounds. Through a juridical approach, writing with the theme "Agree to the Agreement and its Relevance as a Prevention of Default", raised two interesting problems. First, how is the relevance of the agreement in the agreement as an effort to prevent default; Second, what is the ideal format for agreement in an agreement. The findings in this study confirm, that: First, the agreement is the key word in ensuring the implementation and fulfillment of the promises of the parties to the agreement. Therefore, in agreement in general, the agreement has relevance to prevent defaults. Second, ideally, in every agreement it is necessary to ensure that the parties truly understand what has been agreed both formally and materially (substantially).

Abstract

ABSTRACT Hypothetically-theoretical, almost certainly, without adequate understanding of the business relations agreement will not go well. So, every business person must understand the agreement. Departing from such needs, this article presents two fundamental issues as a material discussion. First, What are the elements that business people must consider in the preparation phase of the business contract? Secondly, What is the urgency of implementing a contract planning preparation phase by business people? Through normative and juridical studies, the explanation is obtained as follows. Business contracts are conducted through the following phases: Pre-contracted stages, contractual stages, and post-contractual phases. As an effort to make an ideal, systematic, and safe contract for the parties, it is necessary to maturation in the preparation phase of the contract drafting. The Implementation of the preparation phase of the business contract is very important so that the contract can be held accountable legally and can be understood by the parties.Keywords: Contract planning, business people, business relationships  ABSTRAK Secara hipotetis-teoretis, hampir dapat dipastikan, tanpa ada pemahaman yang memadai tentang perjanjian hubungan bisnis tidak akan berjalan dengan baik. Sebegitu urgennya, maka setiap pelaku bisnis harus memahami tentang perjanjian. Berangkat dari kebutuhan yang demikian, tulisan ini menyajikan dua masalah pokok sebagai bahan pembahasan. Pertama, apa saja unsur-unsur yang harus diperhatikan oleh Pelaku Bisnis dalam tahapan persiapan kontrak bisnis? Kedua, apa urgensi pelaksanaan tahapan persiapan perancangan kontrak oleh Pelaku Bisnis? Melalui kajian secara yuridis normatif, diperoleh paparan penjelasan seperti berikut. Kontrak bisnis dilakukan melalui tahapan seperti berikut: tahapan pra kontratual, tahap kontraktual, dan tahap pasca-kontraktual. Sebagai upaya membuat kontrak yang ideal, sistematis, dan aman bagi para pihak maka perlu pematangan dalam tahap persiapan penyusunan kontrak. Pelaksanaan tahapan persiapan penyusunan Kontrak bisnis sangat penting agar kontrak yang dibuat bisa dipertanggungjawabkan secara hukum dan dapat dipahami oleh para pihak.Kata kunci : perancangan kontrak, pelaku bisnis, hubungan bisnis

Abstract

Para pengusaha terkadang memulai atau menjalankan usahanya dengan meminjam uang dari bank, penanaman modal, atau penerbitan obligasi. Kegiatan pengusaha meminjam uang di salah satu lembaga keuangan tersebut telah menimbulkan permasalahan dalam penyelesaian utang piutang dalam masyarakat dan berakhir dengan kepailitan. Salah satu permasalahan dalam kepailitan, yaitu kehadiran kreditur fiktif dapat merugikan pihak-pihak yang terkait dengan kepailitan, yaitu debitur itu sendiri atau kreditur-kreditur sebenarnya lainnya. Akibat adanya kreditur fiktif tersebut, maka  peran Pengadilan Niaga sangat penting mulai dari proses permohonan hingga putusan kepailitan terhadap suatu utang.Kata Kunci : Kepailitan, Pengadilan Niaga, Kreditur Fiktif

Abstract

The Ki Ageng Gribig Tomb area is planned to be developed as a santri village that presents a village model that carries a religious theme. People come to travel or to trade around the area. Merchants who will sell around the tomb area of Ki Ageng Gribig will live on land. If it lasts for a long time, the merchant will use a vacant lot to sell and will harm the original owner. So it is necessary to have awareness of the indigenous people living in the area around the ki Ageng Gribig tomb area to have proof of land ownership rights. The purpose of the study was to find out and analyze related to evidence of land ownership owned by the community living around the Tomb of Ki Ageng Gribg. Another purpose is to describe the urgency of ownership of the legality of land or buildings for people living around the Ki Ageng Gribig Tomb area. This research uses empirical juridical research methods with a sociological juridical approach. The result of this study is that before the birth of uupa, residents who lived around the Tomb area of Ki Ageng Gribig already had proof of rights in the form of eigendom rights and had been converted into property rights. The ownership of evidence of land ownership is very important because residents will get their full rights if one day the development of the Ki Ageng Grbig Tomb Area takes place. The certificate of land rights will be strong evidence for those who hold it, so that when the development of the Ki Ageng Gribig tomb area becomes a religious tourism village, the surrounding community will get reimbursement by the provisions of the Land Acquisition.

Abstract

The popularity of working from home or remote working is rising globally. In Indonesia, the existence of the internet underpins the trend of working from home since accessing this technology is effortless. However, existing regulatory provisions mostly govern matters regarding office work, while the rights and responsibilities between employers and employees in the remote working scheme have never been specifically regulated. This situation creates a huge gap between what is stated in a written law and law in action. This research aims to analyze the congruence of agreements with the fulfilment of rights of workers working from home from the perspective of legislation and the principles of labor development. This research employed sociological and legal methods. The research results indicate that the fulfilment of labors’ rights in both the agreement and implementation has not met the principles of labor development. The conflict of rights and criminal violations regarding this matter is obvious since workers’ rights governed in the legislation are not governed in the work agreement. Moreover, there is still incongruence between the regulations and implementation of the rights of workers regarding the portion of break/leave and overtime wages.

Abstract

This study aims to determine the role of the Department of Food Crops, Horticulture and Plantation in Malang Regency in supervising the conversion of agricultural land in Malang Regency. The research method used is a sociological approach based on field research and interviews as well as the rule of law. The results of this study can be concluded that the role of the Department of Food Crops, Horticulture and Plantation of Malang Regency in supervising the occurrence of the conversion of agricultural land is firstly involved in the governance of the permit process for the conversion of agricultural land with the Related Regional Work Units (SKPD), Second, increasing land productivity. agriculture and finally provide guidance to farmers so as not to convert their agricultural land. It can be concluded that people who want to convert agricultural land to other uses must follow the process of permitting land conversion by completing the required documents to the relevant agencies and increasing coaching activities for farmers not to easily convert their agricultural land. Abstrak Penelitian ini bertujuan untuk mengetahui bagaimana peran Dinas Tanaman Pangan, Hortikultura dan Perkebunan Kabupaten Malang dalam melakukan pengawasan alih fungsi lahan pertanian di kabupaten malang. Metode penelitian ini digunakan yaitu pendekatan sosiologis yang didasarkan penelitian lapangan dan wawancara serta peraturan keadaan hukum. Hasil penelitian tersebut dapat disimpulkan bahwa Peran Dinas Tanaman Pangan, Hortikultura dan Perkebunan Kabupaten Malang dalam melakukan pengawasan terjadinya alih fungsi lahan pertanian yaitu pertama terlibat dalam tata Kelola proses perijinan alih fungsi lahan pertanian bersama Satuan Kerja Perangkat Daerah (SKPD) Terkait, Kedua meningkatkan produktivitas lahan pertanian dan terakhir melakukan pembinaan terhadap petani agar tidak mengalihfungsikan lahan pertaniannya. Dapat disimpulkan bahwa masyarakat yang ingin mengalihfungsikan lahan pertanian ke peruntukan lainnnya harus mengikuti proses perijinan alih fungsi lahan dengan melengkapi dokumen yang dibutuhkan kepada instansi yang terkait dan meningkatkan kegiatan pembinaan kepada petani untuk tidak mudah mengalihfungsikan lahan pertaniannya.

Abstract

PT Shopee International Indonesia is a company that focuses on digital applications, especially e-commerce, and is one of the largest online marketplaces in Indonesia. This online shopping system offers the latest innovations in credit-based payment methods without collateral, such as pay later, along with the advancement of the digital world. This research seeks to find out the procedures for implementing transactions, resolving non-performing loans, and legal protection provided to Fintech Lending (financial technology) organizers in Shopee Pay-Later. This includes identifying the rights and obligations of the parties involved, as well as the legal consequences of the Shopee Pay-later credit financing agreement. The research uses an empirical legal research method, which uses a problem-solving approach to data collected from observations and study findings. The research findings show that in order to finance a Shopee Pay-later unsecured credit agreement, buyers must electronically sign an agreement confirming that they accept its terms. The parties are obligated by the terms of the agreement, under which they must not contravene the relevant laws and regulations and must fulfil their rights and obligations according to the financing agreement. The district court or arbitration can be used to sue either party if they commit a default, as specified in Article 1243 of the Civil Code, or violate the law, as specified in Article 1365 of the Civil Code.   Abstrak Shopee International Indonesia adalah perusahaan yang fokus pada aplikasi digital, terutama e-commerce, dan merupakan salah satu pasar online terbesar di Indonesia. Sistem belanja online ini menawarkan inovasi terbaru dalam metode pembayaran berbasis kredit tanpa agunan, seperti bayar di belakangan, seiring dengan kemajuan dunia digital. Tujuan dari penelitian ini adalah untuk mengetahui tata cara pelaksanaan transaksi, penyelesaian kredit macet, dan perlindungan hukum yang diberikan kepada penyelenggara Fintech Lending (financial technology) di Shopee Pay-later. Hal ini termasuk mengidentifikasi hak dan kewajiban para pihak yang terlibat, serta akibat hukum dari adanya perjanjian pembiayaan kredit Shopee Pay-later. Penelitian menggunakan metode penelitian hukum empiris, yaitu dengan menggunakan pendekatan pemecahan masalah terhadap data yang dikumpulkan melalui pengamatan dan temuan studi. Temuan penelitian menunjukkan bahwa untuk membiayai perjanjian kredit tanpa jaminan Shopee Pay-later, pembeli harus menandatangani perjanjian secara elektronik yang mengonfirmasi bahwa mereka menerima persyaratannya. Para pihak diwajibkan oleh ketentuan perjanjian, yang berarti mereka tidak boleh bertentangan dengan hukum dan peraturan yang relevan dan harus memenuhi hak dan kewajiban mereka sesuai dengan perjanjian pembiayaan. Pengadilan negeri atau arbitrase dapat digunakan untuk menuntut salah satu pihak jika mereka melakukan wanprestasi, seperti yang ditentukan dalam Pasal 1243 KUH Perdata, atau melanggar hukum, seperti yang ditentukan dalam Pasal 1365 KUH Perdata.

Abstract

A dispute over the location of a land plot is a dispute caused by confusion in the designation of land plots or boundaries. This dispute can cause losses for parties who have an interest in the land plot. Land dispute resolution, one of which is a dispute over the location of land parcels, can be resolved through non-litigation channels through mediation. Mediation as an alternative to dispute resolution is considered more profitable for the parties because it uses a win-win solution method. This research is an empirical juridical research, using primary and secondary data sources. The location of the research is at the Kediri Regency Land Office. The result of this study is the implementation of mediation at the Kediri Regency Land Office through several stages guided by Article 6 paragraph (1) of the Regulation of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 21 of 2020 concerning the Handling and Settlement of Land Cases. The implementation of mediation at the Kediri District Land Office has obstacles including the parties to the dispute not being present at the time of mediation and having a bad faith. In this case, the solution that can be provided by the Kediri District Land Office is to advise the parties to resolve the dispute through litigation at the Kediri District District Court. Abstrak Sengketa letak bidang tanah merupakan sengketa yang disebabkan oleh kekeliruan dalam penunjukan bidang atau batas tanah. Sengketa ini dapat menyebabkan kerugian bagi pihak yang memiliki kepentingan atas bidang tanah tersebut. Penyelesaian sengketa pertanahan salah satunya sengketa letak bidang tanah dapat diselesaikan melalui jalur non litigasi melalui mediasi. Mediasi sebagai alternative penyelesaian sengketa dinilai lebih menguntungkan bagi para pihak sebab menggunakan metode win-win solution. Penelitian ini merupakan penelitian yuridis empiris, dengan menggunakan sumber data primer dan sekunder. Lokasi penelitian berada di Kantor Pertanahan Kabupaten Kediri. Hasil penelitian ini adalah pelaksanaan mediasi di Kantor Pertanahan Kabupaten Kediri melalui beberapa tahapan yang berpedoman pada Pasal 6 ayat (1) Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 21 tahun 2020 tentang Penanganan dan penyelesaian Kasus Pertanahan. Pelaksanaan mediasi di Kantor Pertanahan Kabupaten Kediri memiliki hambatan diantaranya adalah para pihak yang bersengketa tidak hadir pada saat mediasi serta beritikad tidak. Dalam hal ini, solusi yang dapat diberikan oleh pihak Kantor Pertanahan Kabupaten Kediri adalah menyarankan kepada para pihak untuk menyelesaikan sengketa melalui jalur litigasi di Pengadilan Negeri Kabupaten Kediri.

Abstract

Sexual Harassment in Indonesian is defined as sexual harassment, which often occurs in society. This kind of condition can be carried out by the community directly or indirectly, physically or verbally, towards the victim. Sexual harassment is an act of a sexual nature that makes the victim feel uncomfortable and disadvantaged, so legal action needs to be taken to take action against the perpetrator. Because there are so many forms of sexual harassment, it seems necessary to examine which acts of sexual harassment qualify as criminal acts according to positive criminal law in Indonesia. In this research, the formulation of the problem raised concerns about how the legal construction of sexual harassment is in criminal law in Indonesia. This research uses a normative juridical method that will analyze acts of sexual harassment that are associated with elements of criminal acts based on criminal law in Indonesia, both based on the Criminal Code and in connection with other related laws and regulations.

Abstract

Land in Malang City which is a land asset of the Malang City Government has not been registered which has resulted in some land being controlled by other parties without the knowledge of the Malang City Government. knowing the urgency of land certificate ownership of Malang City land assets and will not lose regional assets which when used by Third Parties will be a source of Regional Original Revenue. The problem to be researched is what are the legal consequences. The type of research used in this study is empirical juridical research with a sociological juridical approach. The Malang City Government is important to register its land as a city land asset, either with the right of use or the right of management. Land certificates that are already owned by the Malang City Government are able to provide legal certainty and legal protection to the Government and can increase the Regional Original Revenue of Malang City.
