Abstract

The right to claim matrimonial property (jointly acquired property) is an exclusive entitlement of the husband or wife that could be pursued in the event of a divorce, polygamy, death or conversion to another religion. In cases where such claims arise following a death of either spouse, the Syariah Court has allowed heirs to continue the claim for matrimonial property on behalf of the deceased, provided that the deceased had initiated such a claim while the deceased was still alive. However, complications arise when heirs attempt to file such claims even though the deceased never pursued any claim during the deceased’s lifetime. This article explores the legal standing, or locus standi, of heirs who adduce claims on matrimonial property after the death of a relative, based on Syariah Court decisions in Malaysia. This qualitative study employed document analysis, presented descriptively through the case study methodology, involving Syariah Court proceedings. Findings indicate that, in principle, heirs, other than the husband or wife who is still living, do not automatically possess the legal standing to claim matrimonial property on behalf of the deceased, as they do in matters of inheritance under Islamic estate law, unless the deceased had explicitly delegated such authority to them. Nonetheless, it is essential to first determine why eligible parties had failed to file the claim during their lifetime. Given the absence of clear textual evidence from Islamic sources, either permitting or prohibiting such claims by heirs, and the lack of specific provisions addressing this issue in state-enacted Islamic family law, judges have exercised their discretion in varying ways when deciding these cases.

Abstract

The research was carried out in Boroko Village, North Bolang Mongodow Regency with the aims of: (1) collecting data on natural resources on the Batu Pinagut coastline (2) Describing the potential for developing natural resources on the Batu Pinagut coastline (3) Analyzing policies on damage control. Determination of the sample using purposive sampling technique. Data was collected using observation, interview, documentation and document recording techniques. The results of the research show: (1) Batu Pinagut Beach has coastal resource potential that has been developed, namely biological resources and non-biological resources (2) management of coastal resources in Pemuteran Village includes tourism coral reef conservation in terms of tourism service training (3) Resource policy needs regulations are enforced, so that there is balance, preservation and continuity of resources. The rules do not apply to all areas, but to areas needed for the spawning and breeding of marine biota. To manage this area, it is necessary to have a conservation area that is equally understood and recognized by every stakeholder, stakeholders, fishermen, government, community and government. The rules and policies that are implemented involve stakeholders which become a culture that develops in society so that protection/conservation areas become a necessity and are implemented consciously by the community.

Abstract

Pengabdian Masyarakat Fakultas Hukum Universitas Brawijaya kepada pihak dalam lingkup Kelurahan Karangbesuki, dilatarbelakangi atas tanggung jawab pelaksanaan Tri Dharma Perguruan Tinggi dan juga masih rendahnya pemahaman masyarakat khususnya terhadap Prasarana, Sarana dan Utilitas Umum (PSU). Kegiatan ini dilaksanakan dua tahap. Tahap pertama yaitu penginventarisasian dengan diskusi terbatas dari tim pengabdi dan juga lembaga yang berkaitan dengan PSU, kemudian dilanjutkan tahap kedua yaitu workshop. Tujuan pengabdian Masyarakat ini adalah memberikan gambaran secara jelas mengenai PSU dan melakukan inventarisasi PSU serta luaran modul yang dapat dijadikan sebagai dasar dalam penyelenggaraan PSU. Hasil dan kesimpulan yang didapatkan adalah masyarakat yang diwakili pihak Rukun Warga telah memahami mengenai PSU dan beberapa solusi dari persoalan PSU.

Abstract

The failure of the MPD to take the Notary protocol as stipulated in Article 63 paragraph (6) of the 2014 UUJN has legal consequences that could be detrimental to the parties. There are no further provisions regarding the mechanism for saving the protocol when the MPD does not take the Notary protocol, even though the Notary protocol is a collection of state archive documents that must always be stored and maintained. The UUJN only regulates the submission of the Notary protocol. The absence of complete regulations regarding the Notary protocol raises a legal issue, namely legal incompleteness. The method used is normative legal research. The results of the research are that the legal consequences of the MPD not taking the Notary protocol are 1. the loss of the rights of interested parties to obtain a grosse, copy, or excerpt of the deed. 2. the Notary protocol becomes neglected and is at risk of being damaged or lost. There are two types of legal protection provided to interested parties, namely preventive and repressive legal protection. Preventive legal protection refers to the MPD immediately taking the Notary protocol from the heirs who did not submit the protocol to the recipient so that the protocol remains stored and well maintained. Repressive legal protection refers to filing a complaint with the MPD so that the Notary protocol is immediately taken from the heirs and submitted to the Notary who received the protocol.
