Abstract

Penelitian ini menjelaskan sejarah negara Kuwait, sistem hukumnya dan Peradilan Agama Kuwait yang tujuannya untuk mengetahui bagaimana pelaksanaan Peradilan Agama didalam sistem hukum campur yang dimiliki oleh Negara Kuwait. Penelitian ini menggunakan metode penelitian pustaka. Hasil penelitian menunjukkan bahwa sistem pemerintahan Kuwait adalah Monarki Konstitusional sistem pemerintahan yang dipimpin oleh seorang sultan atau raja (Kuwait menyebutnya Emir), yang dipilih seumur hidup oleh anggota keluarganya. Sistem hukumnya menggabungkan hukum sipil Inggris Raya, hukum sipil Perancis, dan hukum sipil Mesir. Peradilan Kuwait tidak mengikuti prinsip syariah sepenuhnya. Namun, pengadilan syariah, yang berasal dari al-Quran dan hanya berlaku bagi orang-orang yang beragama Islam, dapat menangani masalah hukum keluarga.

Abstract

AbstractKuwait is a country with a majority Muslim population and is one of the largest oil producing countries in the world. As a country rich in agricultural products. Kuwait is considered a strategic country so many foreign countries are trying to control Kuwait. The legal system in Kuwait currently is a combination of British common law, French civil law, Egyptian civil law and Islamic law (Shariah) by implementing Sharia Law for its civil law. This research aims to find out and understand the development of the justice system in the State of Kuwait. The method used in this research uses library research, which is a data collection technique by reviewing various library literature, including journals, books, magazines and other data sources, with the aim of connecting the results obtained from these various sources. The results of this research discussion are that, however, there are two separate legal systems in Kuwait. The first system is based on Sharia, or Islamic law originating from the Koran. Sharia courts handle family and personal matters, and laws are rarely codified. Within each of the three levels of courts, special boards or tribunals are created to adjudicate civil, criminal, commercial/financial, administrative, and personal status matters, and the courts may establish additional special councils or tribunals as needed.AbstrakKuwait termasuk negara dengan mayoritas penduduknya Muslim dan menjadi salah satu negara penghasil minyak bumi terbesar di dunia. Sebagai negara yang kaya akan hasil bumi. Kuwait dianggap sebagai negara yang strategis sehingga banyak negara luar yang berupaya untuk menguasai Kuwait. Sistem hukum di negara Kuwait pada saat ini merupakan perpaduan British common law, French civil law, Egyptian civil law dan hukum Islam (Syariah) dengan menerapkan Undang-Undang Syari’at bagi hukum perdatanya. Penelitian ini bertujuan agar dapat mengetahui serta untuk pemahaman mengenai perkembangan sistem peradilan yang ada di Negara Kuwait. Metode yang digunakan dalam penelitian ini mengunakan Studi Kepustakaan (Library Research) yang merupakan teknik pengumpulan data dengan melakukan penelaahan terhadap berbagai literatur-literatur pustaka diantaranya jurnal, buku, majalah,maupun sumber data lainnya, dengan tujuan menghubungkan hasil yang didapatkan dari berbagai sumber tersebut. Adapun hasil dari pembahasan penlitian ini yaitu Namun, ada dua sistem hukum yang terpisah di Kuwait. Sistem pertama didasarkan pada Syariah, atau hukum Islam yang bersumber dari Al- Qur'an. Pengadilan Syariah menangani masalah keluarga dan pribadi, dan hukum jarang dikodifikasi. Dalam masing-masing dari tiga tingkat pengadilan, dewan atau majelis khusus dibuat untuk mengadili masalah perdata, pidana, komersial/keuangan, administrasi, dan status pribadi, dan pengadilan dapat membentuk dewan atau majelis khusus tambahan sesuai kebutuhan.

Abstract

The development of National Strategic Projects (NSP) requires a substantial amount of land. However, the land acquisition process in Indonesia often encounters the complexity of legal pluralism, particularly in regions where customary law remains deeply rooted, such as West Sumatra, Jambi, and Riau. In West Sumatra, communal and sacred ulayat rights pose significant challenges to the implementation of land acquisition under Law No. 2 of 2012. Similarly, in Jambi and Riau, various forms of customary land rights remain fundamental to local decision-making, which often diverges from state law. This study examines the dynamics of interaction between state law and customary law in NSP land acquisition through a comparative approach. The findings reveal that disharmony between these two legal systems can trigger agrarian conflicts and social resistance, potentially obstructing development. Nevertheless, legal pluralism also provides opportunities for negotiation, adaptation, and the creation of more inclusive models of legal harmonization. This study emphasizes the importance of participatory and responsive approaches in national agrarian policy to ensure that NSP development proceeds in a just manner while respecting local wisdom.

Abstract

Islamic law in Indonesia experienced significant development during the New Order era, when the government began integrating various aspects of Islamic law into the national legal system despite maintaining restrictions on Islamic political activities. This integration was realized through the enactment of several important regulations, such as Law Number 14 of 1970 on the Basic Provisions of Judicial Power, Law Number 1 of 1974 on Marriage, Government Regulation Number 28 of 1977 on the Endowment of Owned Land, Law Number 7 of 1989 on Religious Courts, and Presidential Instruction Number 1 of 1991 on the Compilation of Islamic Law. These regulations demonstrate that Islamic law was no longer merely a moral religious norm but had gained legitimacy as an integral part of Indonesia’s positive legal system.This study employs a library research method with a descriptive qualitative approach. Data were collected from literature, journals, statutory documents, and scholarly opinions, then analyzed qualitatively to describe the processes, policies, and dynamics of Islamic law integration during the New Order era. The findings indicate that the integration of Islamic law in this period was pragmatic and state-controlled, with Islamic legal provisions accommodated as long as they supported national stability and development agendas. Nevertheless, this era became an essential foundation for the advancement of Islamic law in Indonesia, particularly in strengthening religious courts, codifying family law, and structuring national endowment (waqf) administration.Keywords: Islamic Law, New Order, Legal Integration, Religious Courts, Compilation of Islamic Law

Abstract

Civil law is a branch of law that regulates relationships between individuals in social life. In the Indonesian context, civil law has two main systems that operate side by side: Indonesian civil law, which originates from the Dutch Civil Code (Burgerlijk Wetboek) and national regulations, and Islamic civil law, which originates from the Qur'an, Hadith, ijma', qiyas, and the Compilation of Islamic Law (KHI). Indonesian civil law emphasizes legal certainty, codification, and the principle of secularity, while Islamic civil law prioritizes justice, welfare, and sharia values. Both cover family, marriage, inheritance, and property, but their regulatory mechanisms differ. District Courts are authorized to handle Indonesian civil law cases, while Religious Courts have jurisdiction over Islamic civil cases for Muslims. Thus, this comparison demonstrates that the two legal systems complement each other in legal practice in Indonesia, reflecting the distinctive legal pluralism and providing alternative dispute resolutions tailored to the needs of society.
