Abstract

Fokus penelitian ini adalah bagaimana pertukaran uang Japuik, juga dikenal sebagai uang jemputan, digunakan dalam pernikahan masyarakat pariaman di Kota Dumai dan bagaimana status sosialnya berpengaruh jika dilihat dari perspektif psikologis dan sosiologis. Untuk menentukan besar nominalnya uang jemputan ditentukan berdasarkan kesepakatan yang dibuat oleh kedua belah pihak sampai mereka menyetujui jumlah yang akan diberikan kepada pihak laki-laki. Dengan cara musyawarah dapat mengubah tradisi ini. Dengan berkembangnya zaman, tradisi ini tidak lagi seperti sebelumnya, yang mewajibkan bagi  perempuan menyerahkan uang kepada keluarga laki-laki berdasarkan status sosial dan gelar mereka. Penelitian ini menggunakan penelitian kualitatif deskriptif. Metode observasi, dokumentasi, dan wawancara mendalam digunakan untuk mengumpulkan data. Metode pengumpulan data meliputi survei langsung di lokasi penelitian (Kelurahan Jayamukti dan Kelurahan Tanjung Palas) dan beberapa sumber literatur. Teori pertukaran sosial Levi-Strauss digunakan untuk menganalisis data. Hasil penelitian menunjukkan bahwa Uang Jemputan di Kelurahan Jayamukuti dan Kelurahan Tanjung Palas di Kota Dumai disesuaikan dengan kebutuhan dan persetujuan keluarga saat proses pertukaran dilakukan, tidak selalu mengikuti standar konvensional. Sebagai contoh, di Pariaman ada sistem selo yang diperuntukkan bagi ninik mamak, tetapi di Kota Dumai hal tersebut belum bisa dterapkan, sebab kedua telah pihak telah setuju untuk tidak memberatkan pihak perempuan. Uang jemputan dianggap penting untuk pelestarian adat oleh sebagian masyarakat, tetapi ada juga yang menolak karena tidak etis. Bagi orang minang pariaman di Kota Dumai, uang jemputan dilihat berdasarkan status sosial si pria; jika tinggi status sosialnya pria tersebut, maka juga tinggi uang jemputan yang akan diterimanya.

Abstract

The study uses a comparative study approach to provide knowledge and information related to the certainty of the fulfillment of women's and children's rights after divorce in Indonesia and Malaysia, in accordance with the provisions stipulated in the laws and regulations of each country. The research method in this study is normative legal research, by analyzing library study materials and supported by other secondary data. The research findings show that the fulfillment of women's and children's rights after divorce in Indonesia is regulated in Law Number 1 of 1974 concerning Marriage and the Kompilasi Hukum Islam (KHI). Several rights are regulated which are the responsibility of the father. The child's right to receive maintenance and education is a manifestation of the parents' obligations, as regulated in Law Number 23 of 2002 concerning Child Protection and Law Number 9 of 1979 concerning Child Welfare. The amount of maintenance to be paid is determined by the Court. If the Court considers that the father is considered incapable, then the responsibility for the costs also shifts to the mother. In Malaysia, there are clearer regulations regarding the rights of women and children after divorce. This is seen through the establishment of Bahagian Sokongan Keluarga (BSK), a division that has full authority to handle cases of violations related to these rights. BSK operates as a special department under the Jabatan Kehakiman Syariah Malaysia (JKSM), which is under the auspices of the Jabatan Perdana Menteri (JPM). This institution has the authority to resolve various issues related to the provision of maintenance, in order to ensure justice for those who are entitled to receive it.

Abstract

This research is motivated by the rapid growth of the global halal industry, which continues to expand, including in Indonesia. The Governor of Riau has designated Riau as one of the national halal destinations due to its strategic location near Malay countries. The development of the halal industry in Riau is supported by government policies that implement Islamic standards from upstream to downstream sectors. Islamic boarding schools (pesantren) as socio-economic entities play an important role in the value chain of the halal ecosystem. Dumai City, known as the “City of Dreams,” has been declared a halal industrial zone. However, the city faces five major challenges: drug abuse, promiscuity, HIV/AIDS, LGBT issues, and the spread of heretical teachings. These challenges contradict the vision of establishing a halal city. This study aims to analyze the efforts and roles of pesantren business units as drivers of the halal ecosystem capable of creating social change and influencing community behavior. Using a descriptive qualitative method involving three pesantren in Dumai City, the findings indicate that pesantren can serve as exemplary institutions in applying Islamic values to economic practices through the principles of honesty, justice, balance, trustworthiness, and the avoidance of riba(usury). Interviews also revealed that pesantren administrators instill four main principles in managing economic activities—honesty, trustworthiness (amanah), public benefit (maslahah), and freedom from riba. In conclusion, pesantren can serve as role models for the community in integrating Islamic values into economic activities and implementing sharia principles in everyday life.
