Abstract

Inheritance is one of the issues in family law, inheritance becomes a prolonged conflict in a family if there is no agreement, choice of law and clear division of the assets of the deceased. Different legal rules and different understandings of inheritance distribution can trigger family conflict. A person must have knowledge of inheritance itself. Almost all literature discusses inheritance related to assets, but we rarely find matters related to responsibility for the heir's debts or refusal to inherit assets. The obligations of the heirs relate to taking care of the corpse, managing the assets, and finally the heir's debts. The description of this matter is what makes the author interested in writing articles related to this matter, the issue is whether there is a clear Islamic legal basis regarding this matter, the regulatory aspects of inheritance receivables in Indonesia and whether there is an implementation of decisions regarding inheritance receivables that already exist in Indonesia. Method What the author uses in writing this journal is a normative legal research method by analyzing the comparative application of Islamic law and civil law rules to the issue of inheritance receivables and analyzing the implications of decisions relating to inheritance. This research was conducted with the hope of providing input in the development of family and inheritance law, especially in relation to inheritance receivables.

Abstract

A will is a legal document that outlines how a person's assets will be distributed after their death.   In some countries, the distribution of assets is regulated by law and not solely based on the wishes of the deceased. This is known as a mandatory will, which limits the amount that can be given to certain parties to no more than one-third of the total assets. Indonesia and Malaysia are countries that regulate the matter of mandatory wills. The purpose of this journal is to identify the similarities and differences in the provisions of mandatory wills in Indonesia and Malaysia, to determine the Islamic legal basis for mandatory wills, and to examine the development of mandatory wills in both countries.

Abstract

This research states that in Islamic law adopting a child is a good act, which helps adopted children get a proper education. The right to a proper education for adopted children is one of the main goals of adoption, this welfare is one of the rights that must be provided by adoptive parents. In general, implementing the above rights of children is an obligation and joint responsibility of the government and society. The phenomenon that occurs in Indonesia is that the educational rights of adopted children have shifted to utilization, due to several factors, one of which is economic. The aim of this research is to strengthen previous research, and examine further the shift in the educational rights of adopted children and look at the factors that result in non-fulfillment of adopted children's rights in Indonesia. This research uses an approachsociological normative  with the nature of the researchanalytical descriptive. The results of this research found several factors that resulted in a shift, even not being given the rights of adopted children, such as: f In fact, in Islam, adopting a child is a good act but over time it becomes exploitative.

Abstract

The sakinah family is the ideal marriage destination according to the Koran. Various ways were taken to achieve this goal. However, people understand the concept of the Sakinah family differently. Differences in views on the concept of the sakinah family are also found in the thoughts of experts in the commentator of the Koran. This article is the result of doctrinal law research with historical approach and conceptual approach. The results of this study indicate that the meaning of the sakinah concept cannot be separated from the socio-cultural background of the interpreters. Imam Qurtuby and Ibn Kathir represent the context of fiqh in interpreting the sakinah family. Abstract

This study explores the influence of hedonistic lifestyles on marital infidelity and relationship stability. Using a qualitative approach, data was gathered through in-depth interviews with two couples who have experienced the adverse impacts of such lifestyles on their marriages. The research findings highlight that a hedonistic orientation typically undermines both commitment and satisfaction within relationships, potentially leading to infidelity. Analysis suggests that hedonism distracts individuals from long-term relationship goals, fostering a culture of immediate gratification detrimental to marital cohesion. The study recommends integrating cognitive-behavioral therapy (CBT) techniques in couple counseling sessions to counter these effects. This intervention is aimed at helping couples develop healthier communication patterns and more effective impulse control, which are crucial for maintaining relationship stability. The implications of this research emphasize the importance of proactive therapeutic strategies that focus on enhancing interpersonal connections and managing detrimental lifestyle influences. These findings contribute to understanding how lifestyle choices affect marital dynamics and offer practical approaches for therapists working with couples facing similar challenges.

Abstract

Marriage registration is often a challenge for marriage registrars at the sub-district level because people often do not understand the laws and regulations related to marriage. One of the obstacles that often arises is the inconsistency of data regarding the status of guardians, even though administratively all requirements have been met during registration. This problem generally occurs when the bride-to-be is an adopted child, where the identity on the birth certificate and ID card includes the surname of the adoptive father. This situation causes difficulties in the recording process, especially related to the determination of the legal guardian as one of the pillars of marriage. If the adoptive father's name is included in the marriage book, this can cause problems later on, such as in terms of inheritance rights and other legal aspects. This research is a library research using a normative approach. There are several problem formulations in this study, including First, how is the perspective of Islamic law on the validity of the adoptive father as a guardian in marriage. Second, what is the juridical perspective regarding the adoptive father as the guardian of the marriage. The method of collecting legal materials used is the collection of library materials, because this method is in accordance with the type of research that has been described earlier. The results of the study show that in the view of Islamic law, nasab describes a strong kinship bond, especially in the relationship of descent between children and parents. The person who has the main right to be the guardian for a woman who is going to marry is the guardian of the nasab line. This is because the nasab relationship is considered the strongest and closest bond, thus providing special rights in terms of guardianship. Meanwhile, Article 6 paragraph (6) of the Law on Marriage and Article 20 paragraph (2) in the Compilation of Islamic Law regarding the position of the marriage guardian show that the adoptive father cannot be the marriage guardian for the Muslim bride. This is because the adoptive father is not included in the category of guardian nasab, because there is no blood relationship with the bride. Therefore, for the adopted children of Muslim women, the right as a guardian falls to the guardian of the judge.

Abstract

Imam Nawawi berpandangan bahwa kewajiban mengerjakan tugas pekerjaan domestik dalam rumah tangga adalah mutlak dibebankan kepada suami. Sebaliknya, Yusuf al Qardhawi berpandangan bahwa tugas pekerjaan domestik tersebut adalah kewajiban seorang istri. Penelitian ini menjadi menarik, sebab kedua pandangan yang berbeda tersebut akan dilihat melalui lensa teori mubadalah yang tengah berkembang dan dianggap sebagai pendekatan yang berparadigma progresif hari ini, dengan rumusan masalah: Bagaimana pandangan imam Nawawi dan Yusuf al Qarhawi prihal kewajiban pekerjaan domestik dalam rumah tangga jika dilihat dalam perspektif mubadalah? Penelitian ini berjenis library research yang dianalisis secara deskriptif-analitis dengan menggunakan teori mubadalah. Hasil penelitian menunjukkan bahwa tugas pekerjaan rumah tangga atau domestik dalam perspektif teori mubadalah adalah tanggung jawab bersama atau kewajiban bersama antara suami dan istri yang bersifat fleksibel, alih-alih dominan. Oleh karena itu, pandangan imam Nawawi yang menjadikan suami, secara dominan, sebagai pihak yang berkewajiban mengerjakan tugas-tugas domestik dan istri hanya berkewajiban semata dalam memberikan layanan seksual kepada suaminya adalah tidak selaras dengan pandangan mubdalah. Demikian halnya dengan pandangan Yusuf Al Qardhawi yang menjadikan tugas domestik sebagai kewajiban dominan istri sedangkan suami memiliki kewajiban dominan untuk mencari nafkah adalah tidak sejalan dengan pandangan teori mubadalah.

Abstract

This research aims to explore the rules and regulations of mut'ah marriage in Iran and Indonesia and analyze the practice in both countries. This research is library research using qualitative methods with a descriptive-analytic approach. The results of this research found that mut'ah marriages are officially regulated in marriage regulations in Iran, specifically in The Civil Code of The Islamic Republic of Iran 2000. These temporary marriages are recognized and equivalent to permanent marriages in general, and stipulate provisions that must be complied with in its implementation. However, in this modern era, the practice of mut'ah marriage in Iran is starting to be abandoned. In contrast to Indonesia, where there are no rules governing contract marriage law, it is not even recognized in regulations in Indonesia. However, in reality, the practice of contract marriage is increasingly common among Indonesian people.

Abstract

Harta bersama salah satu berasal dari benda tidak berwujud, benda tidak berwujud tersebut ada yang berupa Intellectual Property Rights atau Hak Kekayaan Intelektual. Dalam praktik dilapangan adakalanya terdapat kekosongan hukum, tidak adanya sinergitas antara Undang-Undang, dalam hal ini Nomor 1 Tahun 1974 tentang Perkawinan dengan rezim undang-undang yang mengatur perihal Hak Kekayaan Intelektual terkait pembahagian harta Bersama jika terjadinya perceraian. Merujuk pada problematika di atas, maka perlu mendudukkan secara jelas hak kekayaan intelektual sebagai harta bersama. Penelitian ini menggunakan pendekatan yuridis normative. Hasil Penelitian melihat bahwa Intellectual Property Rights merupakan obyek harta bersama dalam perkawinan selama obyek dari Harta Bersama tersebut sudah jelas wujud dari benda materiilnya atau kongkrit, tidak abstrak (belum diwujudkan), telah memiliki nilai ekonomis misal karya cipta lagu, dan karya tulis yang sudah memiliki royalti ia diwujudkan ketika dalam masa perkawinan; Mekanisme pembagiannya dilakukan lewat gugatan di Pengadilan Agama, baik gugatan kumulasi dengan perkara perceraian maupun gugatan harta bersama dengan status gugatan yang berdiri sendiri. Pengalihan HKI sebatas pada hak ekonomi dan tidak menyentuh hak moralnya si pemilik Hak Kekayaan Intelektual. Pembagiannya tetap mengacu pada ketentuan Pasal 97 Kompilasi Hukum Islam, dimana pada prinsipnya bagian masing-masing suami-isteri adalah ½ bagian. Berhubung obyek yang dibagi berupa benda bergerak tidak berwujud, maka yang dibagi royaltinya saja.

Abstract

Maqashid Sharia plays a crucial role in shaping parenting patterns that align with Islamic values. The hadiths of Prophet Muhammad (peace be upon him), as a primary source of Islamic teachings, provide normative guidance for parents in protecting and educating their children and families. The urgency of this research lies in the pressing need to integrate the principles of Maqashid Sharia into parenting practices amid the challenges of modernity and social change, while simultaneously strengthening the foundation of Islamic family law in Indonesia to remain relevant to Sharia values. This study aims to examine the hadiths of Prophet Muhammad (peace be upon him), particularly those related to child education and parenting from the perspective of Maqashid Sharia, and to analyze their implications for Islamic law in Indonesia. The research adopts a qualitative approach using thematic analysis of relevant hadiths. The primary sources include Law No. 1 of 1974 and its amendment, Law No. 16 of 2019, as well as the Compilation of Islamic Law (KHI) and the Hadiths of Prophet Muhammad (peace be upon him). Data were collected through documentation and literature study techniques. The findings indicate that parenting practices based on Maqashid Sharia contribute positively to fostering an Islamic, happy, and harmonious family environment. Furthermore, the study highlights the importance of integrating Maqashid Sharia principles into family law policies and emphasizes the need to enhance parental education to ensure the implementation of parenting practices in accordance with Islamic teachings.
