Abstract

The ASEAN Trade in Goods Agreement (ATIGA) is a form of an agreement made by ASEAN member countries that is expected to create a coherent and integrated ASEAN economy through the free movement of commodities, while supporting the concept of minimizing and eliminating international trade barriers, both in the form of tariffs and non-tariff. -fare. As a lower tariff facility, ATIGA also requires imported goods to meet certain conditions contained in a package of provisions called the Rules of Origin, which consists of Origin Criteria, Shipping Criteria (Consignment Criteria), and Procedural Provisions. The research was conducted with a normative juridical approach with data collection techniques through library research, with the conclusion that there are still differences in the application of Operational Certification Procedures (OCP) to the imposition of preferential tariffs by the customs administration and the Panel of Judges of the Tax Court in resolving disputes regarding preferential tariffs. Thus, to provide legal certainty, fairness, and benefit to all stakeholders, it is necessary to make adjustments both to the legal product for the implementation of the imposition of preferential tariffs, as well as redesign in determining preferential tariffs through the application of advance rules.

Abstract

Smart Governance merupakan konsep tata kelola pemerintahan berbasis teknologi yang bertujuan untuk meningkatkan efisiensi, transparansi, dan partisipasi publik. Di Indonesia, penerapan Smart Governance difokuskan melalui desa sebagai unit pemerintahan terkecil dalam mendukung transformasi digital nasional. Artikel ini mengeksplorasi potensi desa dalam menjalankan program transformasi digital serta menilai kesiapan Indonesia dalam menerapkannya. Meskipun berbagai inisiatif seperti Desa Digital dan Internet Desa telah diluncurkan, tantangan utama meliputi keterbatasan infrastruktur, rendahnya keterampilan digital, dan regulasi yang belum sepenuhnya mendukung. Untuk mengatasi kendala ini, diperlukan strategi kolaboratif antara pemerintah pusat, daerah, dan masyarakat lokal, serta peningkatan kapasitas sumber daya manusia di desa. Kesimpulannya, desa dapat menjadi pusat inovasi digital yang mendukung pembangunan berkelanjutan jika didukung dengan regulasi dan sumber daya yang memadai

Abstract

The reform of Indonesia's judicial system is part of the ever-evolving legal political dynamics driven by public demands for greater transparency, accountability, and justice. Legal politics plays a strategic role in shaping the direction of judicial reforms, both in policy formation and implementation. Various factors, including legislation, political pressure, social influences, and economic conditions, contribute to this reform process. This article examines the role of legal politics in Indonesia's judicial reform by highlighting the factors influencing policy development and the challenges in its implementation. Using a normative juridical approach, this study analyzes post-reform legal policies, including regulatory changes and judicial institution restructuring, as well as their impact on the effectiveness and credibility of the judiciary. This study aims to provide a deeper understanding and recommendations to enhance the quality of the judicial system in the future.
