Abstract

The landscape of cryptocurrency asset investments in Indonesia is currently challenged by regulatory uncertainty, conflicting directives among interrelated state institutions regarding digital assets, and weak protection against critical vulnerabilities such as the profound risk of malicious hacking. Addressing these core issues, this study evaluates the legal safeguarding and regulatory oversight of crypto asset investments within the Indonesian jurisdiction . Utilizing a normative juridical methodology based on a documentary study of primary, secondary, and tertiary legal materials, and analyzed qualitatively, the findings indicate that: Ministry of Trade Regulation No. 99 of 2018 regarding the General Policy for Crypto Asset Futures Trading, and Commodity Futures Trading Supervisory Agency (Bappebti) Regulation No. 5 of 2019 on Technical Provisions for the Physical Crypto Asset Market establish the primary legal foundation. Transactional validity in futures trading relies on Indonesian contract principles under the Burgerlijk Wetboek (BW) and its foundational doctrines. Furthermore, these digital transactions hold legality under Law No. 11 of 2008 concerning Electronic Information and Transactions (ITE Law) due to their digital execution. Consequently, investors acquire juridical protection against cybercrime-induced detriments and civil damages originating from Unlawful Acts (Perbuatan Melawan Hukum/PMH), specifically fraudulent practices (bedrog). Bappebti’s surveillance mechanism, governed by Regulation No. 5 of 2019, addresses physical market traders, asset criteria, and reporting standards. However, while aligning with operational protocols, Bappebti's regulatory framework exhibits deficiencies in effectively mitigating the aforementioned systemic and cyber risks.

Abstract

Digital disruption has transformed the banking sector from conventional to digital services, driving new forms of collaboration between digital banks and fintech lending companies. This study aims to analyze the legal aspects and identify the risks involved in channeling financing schemes within these partnerships. With fintech lending dominating Indonesia’s fintech ecosystem, digital banks face heightened credit risks due to the unpredictable nature of non-performing loans in fintech. The legal framework governing these collaborations is built on a channeling financing cooperation agreement, highlighting power dynamics and responsibilities between the parties. The findings emphasize the importance of clear and robust regulations to provide legal certainty and protection in such partnerships.

Abstract

Artikel ini mengkaji permasalahan yang dihadapi oleh nasabah layanan pinjam meminjam perusahaan financial technology yang tidak bisa melunasi pinjaman tepat waktu pada masa pandemic covid-19. Penelitian yang bersifat preskriptif ini menggunakan pendekatan perundang-undangan (statue approach) dengan bahan hukum yang bersumber dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Pengumpulan bahan hukum dilakukan dengan studi kepustakaan dan dianalisis menggunakan metode silogisme beserta pola pikir deduktif. Kesimpulan akhir dari penelitian ini adalah Peraturan Otoritas Jasa Keuangan Nomor 77/POJK.01/2016 yang mengatur mengenai pinjam meminjam uang berbasis financial technology dalam tugasnya memberikan perlindungan terhadap konsumen ataupun masyarakat, diberikan sebuah kewenangan bagi OJK untuk melakukan tindakan pencegahan yang berujung pada kerugian dari konsumen pengguna layanan jasa keuangan. OJK sebagai suatu lembaga yang memiliki kewenangan untuk mengatur dan mengawasi lembaga pembiayaan harus mampu berpedoman dengan cita hukum, yaitu kepastian, kemanfaatan, dan keadilan hukum agar keberadaan dari peer to peer lending dalam financial technology mampu bersaing ditengah maraknya bisnis berbasis teknologi saat ini.

Abstract

This article aims to find out the legal steps that can be taken by the relevant party who is harmed by the existence of e-commerce agreements through an escrow with one of the minor subjects. The research methods used are normative juridical, research approaches through legislation, and with data analysis techniques that are deduction by syllogism methods. According to the results of the study, e-commerce activities have been protected by the Law No. 11 of 2008 on Electronic Information and Law No. 8 of 1999 on Consumer Protection. In addition to regulating legal protection of consumers also regulates how the responsibility of business actors if consumers experience losses. One of the legal protections is the arrangement of legal steps to resolve disputes. Legal steps that can be taken by relevant parties who are harmed by the existence of an e-commerce agreement through an escrow with one of the subject minors can be done through litigation and non-litigation.

Abstract

Artikel ini bertujuan untuk melihat penerapan prinsip kehati-hatian pada bankkhususnya Bank BUMN yang berpartisi dalam program Pemulihan EkonomiNasional (PEN) yang diatur dalam Peraturan Pemerintah Nomor 13 Tahun 2020tentang Pemulihan Ekonomi Nasional dan tanggung jawab bank yang berpartisipasiterhadap dana pemerintah yang dititipkan. Penelitian hukum ini merupakanpenelitian hukum normatif atau library legal research, sifat penelitian yangdilakukan oleh peneliti merupakan penelitian deskriptif. Jenis data yang dipakaiterdiri dari data primer dan data sekunder. Teknik analisis data yang digunakandalam penelitian hukum ini dengan wawancara dan studi kepustakaan. Teknikanalisis data yang digunakan dalam penelitian hukum ini menggunakan teknik analisis data kualtitatif dengan metode analisis deduktif. Hasil dari penelitian menunjukan bahwa penerapan prinsip kehati-hatian pada bank yang menjadi mitra dalam program PEN terus dilakukan dengan sedikit kelonggaran kepatuhan bank mitra akan prinsip kehati-hatian menjaga dana pemerintah dan dapat tersalurkan dengan baik.

Abstract

This article describes and examines the problems, first, what are the indicators of abuse of circumstances in a sale and purchase agreement. Second, how is the judge's consideration in deciding the sale and purchase agreement which contains elements of acts of abuse of circumstances in the Sukoharjo District Court Decision Number 19/Pdt.G/2015/PN Skh. This article is a normative legal research. The nature of this article is prescriptive using a statutory approach and a conceptual approach. This article uses literature study by collecting primary legal materials and secondary legal materials. The results of data collection were then analyzed using the deductive syllogism method. The results show that the indicators of abuse of circumstances in the sale and purchase agreement are divided into 3 (three) aspects, namely the first in terms of the position of the parties in the contractual phase, the second in terms of the formulation of the agreement, and the third in the aspect of morality. Misuse of conditions in the sale and purchase agreement as a new will has not been clearly regulated in the Civil Code. However, in practice the teaching of abuse of circumstances (misbruik van omstandigheden) contained in the Supreme Court Decision Number 2356 K/Pdt/2008 can be used by judges in the Sukoharjo District Court Decision Number 19/Pdt.G/2015/PN Skh as a reason for canceling the agreement. other than the defects of will that have been regulated in the Indonesian Civil Code, namely coercion (dwang), oversight (dwaling), and fraud (bedrog).
