Abstract

The Indonesian Health Law has experienced a tug-of-war of interests between the government, the medical profession, and the community. Historically, it has experienced a few problems. Initially, the government tended to emphasize aspects of efficiency and regulatory control, but the medical profession highlighted the issues of professionalism and autonomy, and the community emphasized health rights and public participation. The purpose of the study was to trace the dynamics of initiation, the substance of the omnibus law with changes in the fundamentalism of health law, issues of overlapping regulations, reduced role of professional organizations, low socialization in the community. The literature review research method combines a normative legal approach and empirical analysis based on journal articles, proceedings, and other sources. The study uses secondary data, namely scientific articles. The primary is the text of the law. The results of the first study, the responsibility of the hospital can be held civilly accountable. Second, the mechanism for medical disputes in law enforcement is not yet consistent, lack of socialization of medical personnel and patients, the need for integration of mediation technology and legal education. Three, technical challenges arise, low digital literacy, data leakage, limitations of remote diagnosis. Four, regulations for people with disabilities. five, the process of derivative regulations and socialization of legal materials must be followed up through PP, Perpres, Permenkes with careful planning. six, Attention to victims of sexual violence. In conclusion, an omnibus was born that integrated 11 previous health laws. but there are still findings of problems with mimin socialization, law enforcement and the capacity of health workers.

Abstract

The government program related to the health insurance policy managed by BPJS Kesehatan is not only focused on health aspects but also has a significant impact on social and religious matters, particularly for the Muslim community in Indonesia. This policy program aligns with the fundamental principles of Islamic law, which aims to protect life, wealth, offspring, and so on, in order to achieve the welfare of the family. The purpose of this writing is to analyze the integration of Islamic law in the National Health Insurance (JKN) policy and its impact on the resilience of Muslim families. This research uses a qualitative method with a descriptive analysis approach. Data collection techniques were carried out through literature studies, followed by thematic analysis to identify the convergence points between Islamic values and the principles of JKN. The research findings show that the JKN policy accommodates Islamic legal values, such as the principle of ta’awun (mutual help). JKN directly contributes to the protection of life, intellect, wealth, and offspring through maternal and child health programs aimed at shielding families from catastrophic healthcare costs. The impact of this is seen in the resilience of families, with a reduction in financial pressure due to illness, improved health quality of family members, and the realization of a sense of security, which is a pillar of a peaceful, loving, and compassionate family (sakinah, mawaddah, warahmah).

Abstract

Islam is a teaching that requires attention to those who are in poverty. Islam's desire to help and lift them from the brink of poverty is applied by paying zakat in the Islamic religion. Zakat, which has been interpreted traditionally, has been disrupted by Yusuf Qardhawi by creating many new categories regarding zakat. Among the new categories of the results of Yusuf Qardhawi's Ijtihad in the book of Fiqh Zakat are, Zakat on Honey and Animal Production, zakat on investment in factories, buildings and others, zakat on pursuits and professions as well as zakat on shares and bonds as well as zakat on marine products which includes amber pearls and others. other. The rule used by Yusuf Qardhawi in expanding the category of obligatory zakat assets is, relying on general propositions, in addition to adhering to the requirements for obligatory zakat assets, namely growth and development. Either grow and develop through effort or based on the substance of the treasure that develops.

Abstract

Latar belakang, kesehatan dalam Islam masih terbatas maknanya seiring dengan perkembangan dan kemajuan saman, padahal Islam merupakan konsep hidup yang memperhatikan masalah kesehatan dengan segala aspek kehidupan. Dalam kehidupan kontemporer perlu upaya dalam merespon kebutuhan terkait dengan ruang lingkup kesehatan dengan melihat labih jauh agar konsep kesehatan dalam kajian Islam semakin luas dan sesuai kebutuhan hidup manusia pada umumnya dan umat Islam pada khususnya. Tujuan penulisan ini mendalami dan mengembangkan konsep kesehatan dalam perspektif hukum hukum Islam melalui pendekatan maqasid syariah dengan melihat konsep kesehatan lebih mendalam agar semakin terasa dalam kehidupan. Selanjutnya, Metode yang digunakan dalam penulisan ini adalah liberary riseach yakni merupakan metode kajian pustaka yang bersumber pada buku-buku, jurnal dan yang terkait dengan bahan kajian ini. Hasil kajian ini terkait kesehatan dalam pendekatan maqasid syariah yang sangat diperhatikan, sebab kemaslahatan manusia, baik buruknya kehidupan manusia, berakitifat atau tidak akan ditentukan oleh kesehatan. Oleh karena itu, makasid syariah sangat memperhatikan kesehatan. Tujuan hukum untuk menjaga eksistensi kehiduapan manusia, dengan mewujudkan kesehatan lahir dan batin. Kesimpulan, maqasid syaraih merupakan konsep dari hukum Islam yang menjaga kesehatan manusia dari segala kerusakan. Lalu bukti maqasid syariah sangat memperhatikan kesehatan, terdapat pada prinsip hifz nas, dan hifz yang lainnya yang sangat erat dengan kesehatan.
