Abstract

Abstrak:Tulisan ini bermaksud menjelaskan tentang hadis gair ma‘mūl bih, suatu istilah untuk menunjukkan adanya hadis Nabi yang meskipun dapat diterima sebagai sumber ajaran agama, tetapi ternyata hadis-hadis tersebut tidak aplikatif. Penelitian dilakukan pada matn dari hadis dengan menggunakan metode kualitatif deskriptif dengan mengandalkan sumber-sumber pustaka, berupa kitab-kitab hadis, buku, artikel ilmiah dan sumber pustaka lain yang dianggap relevan. hasil penelitian menunjukkan bahwa istilah hadis gair ma‘mūl bih berkaitan dengan 2 hal, yang pertama, tentang hadis mutashābih, yaitu hadis yang di dalam teksnya terdapat lafal yang tidak dapat diungkap maknanya secara pasti, sehingga harus ditangguhkan pengamalan hadis tersebut atau maknanya dialihkan ke pengertian yang lain yang sebenarnya bukan makna dari lafal tersebut, dan kedua, tentang mukhtalif al-ḥadith, yaitu hadis yang kandungan matannya kontradiktif antara satu dengan lainnya. Ada beberapa faktoryang menjadi penyebab terjadinya pertentangan antarmatan hadis, yaitu al-qalb, al-Idrāj, ziyādat al-thiqah dan taṣḥīf. Faktor-faktor ini adalah shudhūdh hadis, dan hadis yang dimasukinya menjadi shādhdh, sedangkan hadis yang bertentang dengannya yang lebih kuat disebut maḥfūẓ.Abstract:This paper intends to explain the hadith gair ma'mūl bih, a term to indicate the existence of the Prophet's traditions which, although they can be accepted as a source of religious teachings, are in fact not applicable. The research was conducted on the matn of the hadith using descriptive qualitative methods by relying on literary sources, in the form of hadith books, books, scientific articles and other literature sources that are considered relevant. The results of the research show that the term hadith gair ma'mul bih is related to two things, about the hadith mutashābih, namely the hadith in which the text contains a pronunciation whose meaning cannot be revealed with certainty, so that the practice of the hadith must be postponed or the meaning is transferred to the meaning. the other which is actually not the meaning of the pronunciation, and about mukhtalif al-ḥadith, namely the hadith whose contents contradict one another. There are several factors that cause contradictions between the matanhadiths, namely al-qalb, al-Idrāj, ziyādat al-thiqah and taṣḥīf . These factors are the shudhūdh of hadith, and the hadith that it includes becomes shādhdh, while the hadith that is contrary to it which is stronger is called maḥfūẓ.

Abstract

This is research on the prohibition of Menstruating Women Staying in the Mosque according to Imam al-Shafi'i and Imam Ahmad bin Hanbal. In Indonesia, the presence of menstruating women in mosques is still considered prohibited, because the Indonesian Muslim community generally adheres to the Shafi'i school of thought. However, this opinion began to be sued because it was considered to discriminate against women because it prohibited them from being involved in activities at the mosque. On the other hand, there is the view of Imam Ahmad who does not question the presence of menstruating women in the mosque. This study aims to compare the opinions of the two Imams to find which one is more appropriate to the times and not discriminatory. This research is library research that relies on data sources from written data, both in the form of books and journal articles. This study uses a comparative qualitative approach. The results of the study show that according to Imam Ahmad, there is no strong argument that prohibits menstruating women from entering and staying at the mosque. The hadith which prohibits menstruating women from entering and staying in the mosque is a daif hadith because there are majhul narrators. Meanwhile, Imam al-Shafii took an attitude of ihtiyath by continuing to practice the hadiths above, so that only menstruating women were allowed to pass inside the mosque, without stopping and remaining silent.

Abstract

This study intends to research the hadith of Aisyah ra. about the mosque is not lawful for menstruating women. This research is important because the need for women who are menstruating to enter and be in the mosque today is getting stronger, such as attending the Koran, studying and teaching, while there is an opinion that is still firmly held by the Muslim community to this day is that women who are menstruation are prohibited from entering the mosque. Some studies conclude that the hadith of 'Āisyah is daif because one of its narrators is considered majhūl. But is it true? This study attempts to re-examine Aisyah's hadith by using the methods and stages of research as described by M. Syuhudi Ismail, namely takhrīj al-ḥadīth, sanad research, matan research, and concluding. This is library research and analytical method using the theory of authenticity of hadith compiled by Ibn al-Ṣalāḥ. From the research conducted, it is known that the quality of the hadith 'Āisyah is Hasan. There is a problem with his sanad, namely with Aflat bin Khalīfah, because his personality did not get a perfect assessment from hadith critics, although it is not proven that he is majhul. From the perspective of hadith, there is no contradiction of this hadith with other traditions, because the traditions that are considered contradictory can be compromised through the al-jam'u wa al-taufīq method.

Abstract

Abstract One of the conditions for the validity of a hadith is that it is protected from 'illah. However, what is meant by 'illah in the hadiths and how to know if a hadith contains' illah or not, does not seem to have received much attention from hadith scholars, so the issue of' illah is still being debated among scholars and hadith researchers. This study intends to explain this problem. The research method is literature study using descriptive analysis. From the research conducted, it is known that 'illah does not get as much attention from the scholars of hadith, as it does for the validity of other hadiths. It is also known that the scholars use the word ‘illah’ in the sense of the language, namely something that enters something else, then causes what it enters to change. 'Illah is usually interpreted as a disease, because if the disease enters the body, the body will become weak, the same as' illah if it is entered into a hadith, it will change the quality of the hadith to become weak. The way to find out the existence of 'illah in this hadith is by doing mu'āraḍah, which is the matching of the concepts that are the main content of every hadith object so that the interconnection and harmony between the concepts and other shari'a arguments are maintained, namely with the explicit instructions of the Koran, other traditions, historical knowledge and common sense reasoning. Abstrak salah satu syarat kesahihan suatu hadis adalah bahwa hadis itu terhindar dari ‘illah. Namun apakah yang dimaksud dengan ‘illah pada hadis dan bagiamana cara mengetahui suatu hadis mengandung ‘illah atau tidak, tampaknya belum mendapat perhatian yang besar dari ulama hadis, sehingga masalah ‘illah ini masih terus diperdebatkan di kalangan ulama dan peneliti hadis. Penelitian ini bermaksud menjelaskan masalah tersebut. Metode penelitian bersifat studi kepustakaan dengan menggunakan analisis deskriptif. Dari penelitian yang dilakukan diketahui bahwa ‘illah tidak mendapatkan perhatian yang besar dari para ulama hadis, seperti perhatian pada syarat-syarat kesahihan hadis lainnya. Juga diketahui bahwa para ulama menggunakan kata ‘illah pada pengertian bahasanya, yaitu sesuatu yang masuk kepada sesuatu yang lain, lalu menyebabkan yang dimasukinya itu menjadi berubah. ‘Illah biasa dimaknai sebagai penyakit, karena jika penyakit masuk ke dalam tubuh, maka tubuh akan berubah menjadi lemah sama dengan ‘illah jika masuk ke dalam suatu hadis, maka akan mengubah kualitas dari hadis itu menjadi lemah. Cara untuk mengetahui adanya ‘illah dalam hadis ini adalah dengan melakukan mu‘āraḍah, yaitu pencocokan konsep yang menjadi muatan pokok setiap matan hadis agar tetap terpelihara kebertautan dan keselarasan antarkonsep dengan dalil syariat yang lain, yaitu dengan petunjuk eksplisit al-Quran, hadis yang lain, pengetahuan kesejarahan dan penalaran akal sehat.

Abstract

The examination of consumer protection laws in the parking sector in Ambon constitutes the primary focus of this study, emphasizing the breaches in service quality that result in customer discontentment and unfavorable perceptions of service provision. Employing the SERVQUAL framework, the study delves into the identification of the five pivotal dimensions of service quality pivotal to customers, encompassing tangibles, reliability, responsiveness, assurance, and empathy. Employing a qualitative research methodology, the investigation scrutinizes both customer and parking attendant experiences, endeavoring to discern the underlying factors contributing to service quality transgressions within the industry. The research findings underscore the pressing necessity for enhanced implementation and enforcement of consumer protection regulations, alongside the establishment of efficient complaint resolution mechanisms to address customer grievances. Furthermore, the study elucidates various factors contributing to service quality violations, including deficient training protocols, absence of licensing requirements, and ineffective regulatory frameworks. It advocates for proactive measures by policymakers and employers to rectify these issues, emphasizing the imperative of adequately training, equipping, and licensing parking attendants to ensure the delivery of exemplary service standards to customers.

Abstract

The increasing prevalence of veiling among female students is requiring urgent examination. Therefore, this study analyzes veiling during prayer, emphasizing four madhhabs to show varying perspectives and implications for student populations in Ambon State Islamic Institute. A comparative analysis of legal principles is adopted to integrate sociological perspectives using an interdisciplinary approach. Data collection includes interviews, documentation, and bibliographic studies, with emphasis on the influential novel turāś (classic book). The results show that there are three main issues, namely concerns regarding prostration perfection in hadith, debates on mouth and nose closure during prayer, and discussions on intimate body part boundaries for women. In addition, Jumhūr Ulamā (the Majority of Scholars) from al-Shāfi'ī, Hanafī, and Mālikī madhhab concur on visibility necessities in specific situations. Veiling is recommended during prayer unless there is concern for slander. In this context, students' awareness of feminist jurisprudence is stated, advocating for a nuanced understanding beyond a singular perspective. Veiling practices should also be comprehended during prayer among Muslims to urge respect for diverse Islamic opinions. This study reports the urgency of addressing the multifaceted issue and advocates for a comprehensive perspective.

Abstract

This article discusses the issue of legal certainty of the practice of hajj substitution (badal haji) in Indonesia for the prospective pilgrims who have died before the pilgrim season or have suffered from chronic diseases hindering them from performing the planned hajj from the perspective of uṣūl al-fiqh approach. Despite the fact that Hajj substitution has been widely practiced, there are problems with regards to both legal basis and actual practices. From the fiqh point of view, the issue is subject to dissent between the scholars and jurists. As for its actual practice, there is a wide opportunity for abuse from irresponsible parties. Along with this background, in seeking for legal certainty, this article employs bayānī (textual), taʻlīlī (causation), and istiṣlāḥī (public interest) reasoning of uṣūl al-fiqh upon the relevant literature. Through bayānī reasoning, this article concludes that hajj substitution is obliged by some texts of hadith. Taʿlīlī reasoning reveals that the obligation applies only to the people who are at some point had reached the level of istiṭāʿa in their life. Finally, istiṣlāḥī reasoning unveils a number of adverse situations that one should take into consideration when planning for a hajj substitution on behalf of another, such as the issue of trust with the substitute of the hajj. Accordingly, this article argues that hajj substitution is allowed to be performed under the specific provision and trustworthiness.

Abstract

Artikel ini mengambil latar belakang fatwa Majelis Ulama Indonesia (MUI) dari sisi penggunaan hadis sebagai landasan fatwam tujuannya untuk menguji keabsahan dalil hadis yang digunakan dalam fatwa-fatwa abtara kurun waktu 1975 sampai 2003. Hasilnya ditemukan bahwa terdapat beberapa kekurangan dalam pemanfaatan argumentasi dalil tersebut dari sisi ketidak akuratan dan penggunaan hadis daif dalam berhujjah. Itu sebabnya, fatwa MUI terkadang menjadi sebuah masalah yang diterima dan tidak kurang yang ditolak. Semoga keberadaan artikel ini dapat menguatkan MUI dalam menggunakan hadis sebagai hujjah dalam fatwa mereka.

Abstract

The misunderstanding of the text "al-nikāḥ sunnatī, fa man ragiba 'an sunnatī fa laisa minnī" is the starting point of this research. This text is claimed by many to be a hadith text, whereas there is not a single hadith text that contains this text in the same wording. In terms of understanding, the word "sunnah" in the text is usually understood in the sense of fiqh, if done gets a reward, if abandoned is not sinful, the text "fa man ragiba" is understood as who does not marry, and the text "fa laisa minnī" is understood as who does not marry has left Islam. This research is descriptive qualitative which relies on its data sources from written data (library research). The collected data is analyzed using the theory of naqd al-ḥadīth to determine whether the text is a hadith or not and determine its quality, while to understand the text, the theory of fiqh al-ḥadīth is used. The question to be answered is how the misunderstanding of the text "al-nikāḥ sunnatī, fa man ragiba 'an sunnatī fa laisa minnī". This study found that the text under study is not a hadith text, but a riwāyat bi al-ma'nā of another hadith text. The understanding that the law of marriage is sunnatī in the fiqh sense is erroneous, because the word sunnatī in the Hadīth text means the actions performed by the Prophet; the text "fa man ragiba" should be interpreted as rejecting marriage, because what is prohibited is the notion of al-tabattul and gamophobia; while "fa laisa minnī" means that the person who does not marry does not perform the actions performed by the Prophet, not that the person leaves Islam.

Abstract

This study aims to understand the preferences of MSME consumers in Ambon City toward working capital and investment financing provided by Islamic Commercial Banks (BUS). Amid competition with conventional banks, BUS holds significant potential to offer financing aligned with Sharia values, though it has yet to become the primary choice for many business owners. This study identifies the factors influencing MSMEs' decisions to choose BUS, deemed relevant for the development of the MSME sector in Ambon City. The research method used is a qualitative approach involving in-depth interviews and participatory observation with MSME actors in Ambon City. Through thematic analysis, data is processed to explore perceptions, experiences, and factors influencing MSMEs' choice of Sharia financing. The results show that MSMEs' preference for BUS is driven by adherence to Sharia principles, the flexibility of profit-sharing schemes, and ease in requirements and application processes. The profit-sharing scheme implemented by BUS provides advantages in terms of flexible payments adjusted to business income, especially for businesses with fluctuating cash flows. Additionally, guidance from BUS in investment planning offers significant added value for MSMEs in long-term business development.
