Abstract

Since the terrorist events of World Trade Centre, New York and the tragedy of Bali October 12, 2002 is the biggest act of terror that resulted in civilian casualties in the world. As a result of terror arising pro-cons who are involved in this tragedy. Despite its pro-cons who the mastermind of this bombing, here the authors raised the issue of terrorism is approached through a policy of criminalization, criminal law involves two issues, namely whether the justification for criminalizing an act as criminal, and whether the criteria used to criminalize, this becomes especially important issue of terrorism because terrorism is closer to a crime of violence related to political offenses and human rights issues.

Abstract

In the digital era, online media plays a significant role in spreading Islamic teachings. Assajidin.com is one of the platforms used for da'wah purposes. This study aims to analyse the effectiveness of da'wah through Assajidin.com online media towards the congregation of Al Furqon Palembang study. This research method involves in-depth analysis of the content provided by Assajidin.com. The research approach uses qualitative methods, while the data collection techniques are observation, documentation, and interviews. The results showed that, the effectiveness of Assajidin.com online media is considered good because it fulfils the indicators of media effectiveness, in the form of attractiveness (media attractiveness), media clarity, and media completeness. Assajidin.com content attracts the congregation of Al Furqon Palembang study, and can increase religious understanding. While the ease of access, there are some elderly congregants who are not familiar with the use of online media but are more comfortable with face-to-face studies. Although Assajidin.com offers wide and easy access to useful da'wah material, there are several challenges that affect its effectiveness. Limited access to technology among the congregation, especially the elderly, as well as the lack of skills in using online media are the main obstacles.

Abstract

Islamic boarding schools (pesantren) play a significant role in character education and religious learning in Indonesia. Effective management relies on strong leadership and interpersonal communication between administrators and educators. Communication patterns influence decision-making, conflict resolution, and overall institutional effectiveness. In pesantren, the relationship between mudir (leader) and ustaz (teachers) is crucial for maintaining discipline and achieving educational goals. This study aims to describe the pattern of interpersonal communication between mudir and ustaz in Pondok Pesantren Darul Hadits Palembang and analyse its influence on the management of the pesantren. Using a sequential mixed method, the study started with a quantitative approach to identify communication patterns, followed by qualitative analysis for deepening. Results showed the dominance of open (64%) and assertive (63%) communication patterns, reflecting transparency, assertiveness, and clarity of instructions from the mudir. The communication structure is hierarchical, with mudir as the main authority. The implications of these findings suggest that open and assertive communication patterns, supported by the mulazamah-based education system, strengthen interpersonal relationships and the effectiveness of pesantren management

Abstract

This study explores the role of religious institutions through fatwas in the formation of public policy in Indonesia, particularly major institutions such as the Indonesian Ulema Council (MUI), Nahdlatul Ulama (NU), and Muhammadiyah. The main objective is to understand how fatwas are produced by religious organizations and how they impact the political process and government policy. The research problem stems from the phenomenon that fatwas, although they do not have formal legal force, are often used as moral references by the community and are even considered by the government in formulating public policy. The research approach uses qualitative field studies: interviews with fatwa figures, analysis of fatwa documents, and observation of the interaction between religious institutions and public officials in several regions. The findings show that fatwas serve as moral and social legitimacy as well as non-formal influence on the formulation of public policy. Although not legally binding, the influence of fatwas on policy guidance is quite significant, especially on moral and social issues, as well as the creation of a space for dialogue between the state and society. The implications of the research results show the importance of understanding the role of fatwas not only as religious products but also as social political instruments in the architecture of public policy.   Abstrak Penelitian ini mengeksplorasi peran lembaga keagamaan melalui fatwa dalam pembentukan kebijakan publik di Indonesia, khususnya lembaga-lembaga utama seperti Majelis Ulama Indonesia (MUI), Nahdlatul Ulama (NU), dan Muhammadiyah. Tujuan utama adalah memahami bagaimana fatwa diproduksi oleh organisasi keagamaan dan bagaimana dampaknya terhadap proses politis dan kebijakan pemerintah. Masalah penelitian berangkat dari fenomena bahwa fatwa, meskipun tidak memiliki kekuatan hukum formal, sering dijadikan rujukan moral oleh masyarakat dan bahkan dipertimbangkan pemerintah dalam merumuskan kebijakan publik. Pendekatan penelitian menggunakan studi lapangan kualitatif: wawancara dengan tokoh fatwa, analisis dokumen fatwa, dan observasi interaksi lembaga keagamaan dengan pejabat publik di beberapa daerah. Temuan menunjukkan bahwa fatwa berfungsi sebagai legitimasi moral dan sosial sekaligus pengaruh nonformal terhadap perumusan kebijakan publik. Meskipun tidak bersifat mengikat secara hukum, pengaruh fatwa terhadap panduan kebijakan cukup signifikan, terutama dalam isu moral dan sosial, serta penciptaan ruang dialog antara negara dan masyarakat. Implikasi hasil penelitian menunjukkan pentingnya memahami peran fatwa bukan hanya sebagai produk keagamaan, tetapi juga sebagai instrumen politik sosial dalam arsitektur kebijakan publik.

Abstract

Arikel ini bertujuan untuk membahas permasalahan komunikasiintensif dalam penyelenggaraan ibadah Umrah. Menggunakanmetode kualitatif, data diperoleh berdasarkan hasil; wawancara,observasi dan dokumentasi. Partisipan dalam penelitian ini adalahseluruh pembimbing jamaah umrah yang bertugas dalam naunganjasa tour PT. Aina WisataIman (AWI) Tour Travel Semende. Untukmenganalisa data yang diperoleh dari hasil penelitian, penulismenggunakan teknik analisis data Model Interaktif Miles danHuberman. Berdasarkan analisis data yang telah dilakukan penulisditemukan beberapa komunukasi intensif yang dilakukan; yaitu (1)menyampaikan mater dengan tenang, (2) mengggunakan bahasa yangmudah dipahami jamaah, (3) membangun suasana komunikasi yangmenyenangkan, (4) menggunakan beberapa media komunikasi guna  memperlancar komunikasi agar materi tersampaikan semua dan diterima dengan baik oleh jamaah, (5) memahami karakter jamaah yang akan dibimbing, dan (6) para pembimbing lebih membangu kedekatan dengan para jammah. Dan terdapat faktor yang mempengaruhi komunikasi yaitu (1) pendidikaan, (2) usia, (3) gender, (4) persepsi jamaah, (5) sifat atau karakter jamaah, dan (6) kondisi kesehatan jamaah.

Abstract

Water is a basic human need whose fulfillment is guaranteed by the constitution as part of human rights. Following the annulment of Law No. 7 of 2004 by the Constitutional Court, the enactment of Law No. 17 of 2019 concerning Water Resources marked the return of the spirit of state control over water to prevent excessive commercialization. However, in South Sumatra Province, the abundance of water resources has not fully guaranteed easy access to clean water for the community, especially with pressure from the industrial and plantation sectors. The main problems analyzed are how the local government's authority is regulated in Law No. 17 of 2019, how it is implemented in South Sumatra, what juridical and institutional constraints are faced, and what the review of Constitutional Law and Fiqh Siyasah is regarding this authority. This study aims to analyze the authority of local governments in fulfilling the right to water in South Sumatra based on the latest legal framework. This research is a juridical-normative legal study enriched with a juridical-empirical approach through a case study in South Sumatra Province. Data were collected through document studies of laws and regulations, court decisions, and related literature. The analysis was conducted using the welfare state theory, the concept of State Control Rights (HMN), and the Fiqh Siyasah perspective to evaluate the effectiveness and fairness in the implementation of regional authority. The results show that Law No. 17 of 2019 has provided a strong mandate to local governments as public trustees in water management. However, its implementation in South Sumatra still faces significant obstacles, including regulatory disharmony, limited institutional capacity, and conflicts of interest with the macro-economic sector. From the Fiqh Siyasah perspective, water management must emphasize the principle of maslahah 'ammah and the protection of life (hif? al-nafs). The recommendations of this study include the need for harmonization of regional regulations, reform of water utility governance (BUMD), and increased public participation in water resource supervision.

Abstract

This study analyzes the legal protection for whistleblowers in narcotics criminal cases in Indonesia through the perspective of Islamic Constitutional Law (Siyāsah Shar‘iyyah) and the theory of maqāṣid al-sharī‘ah. As an extraordinary crime, narcotics require active public participation, yet whistleblowers often face significant legal and physical risks. This normative legal research uses a statutory and conceptual approach to evaluate Law No. 35 of 2009 on Narcotics, Law No. 31 of 2014 on Witness and Victim Protection, and the 1945 Constitution. The results indicate a normative vacuum and regulatory fragmentation that fail to provide absolute immunity for whistleblowers. From an Islamic perspective, protecting whistleblowers is a constitutional-theological obligation to safeguard the five essential elements (al-darūriyyāt al-khamsah), particularly hifẓ al-nafs (protection of life) and hifẓ al-‘aql (protection of intellect). This study proposes a legal reconstruction that integrates constitutional principles with maqāṣid al-sharī‘ah to ensure comprehensive protection and legal certainty for those reporting narcotics crimes.

Abstract

This study examines the normative construction of the Indonesian Corruption Eradication Commission's (KPK) wiretapping authority, specifically concerning "wiretapping beyond the main case" or incidental findings. The analysis focuses on the tension between KPK's extraordinary powers in combating corruption and the constitutionally guaranteed right to privacy. Using a normative legal research approach, this study evaluates the conformity of extended wiretapping practices with human rights limitation principles, including legality, necessity, proportionality, and due process of law. Findings reveal normative ambiguity in existing regulations, which could lead to broad discretion and potential violations of constitutional rights. The research proposes an ideal formulation for wiretapping authority limits, emphasizing strict subject and object restrictions, judicial authorization, time limitations, and independent oversight. This framework aims to achieve a balance between effective corruption eradication and the protection of human rights within a democratic rule of law.

Abstract

Law No. 11 of 2020 concerning Job Creation, whose validity was later reaffirmed through Law No. 6 of 2023, has brought about a fundamental shift in labor law regulations in Indonesia. This legislation was designed within a deregulation policy framework with an emphasis on increasing labor market flexibility as an instrument to strengthen the investment climate and stimulate national economic growth. However, this policy direction raises normative issues, particularly regarding the certainty of protecting the rights of women workers, who are structurally vulnerable in employment relations. Within the framework of human rights, as affirmed in Law Number 39 of 1999 concerning Human Rights, legal protection cannot be understood solely as equal treatment before the law. Furthermore, legal protection necessitates the application of substantive justice that takes into account the differences in social, biological, and economic conditions inherent in vulnerable groups. Departing from this perspective, this research aims to examine the normative construction of women's rights protection in the Job Creation Law by positioning the human rights regime as the analytical framework and assessing the extent to which the regulation accommodates the principle of substantive justice in protecting women workers. This study employs normative legal research methods with a statutory and conceptual approach, complemented by a review of the Constitutional Court's ruling on the Job Creation Law. The research findings indicate that the provisions for protecting women's rights in the Job Creation Law still rely on a formal equality approach that tends to be gender-neutral. This approach fails to fully address the specific protection needs based on gender vulnerabilities, resulting in the suboptimal fulfillment of women workers' human rights within the national labor law system.
