Abstract

Pasar modal adalah pasar yang memperdagangkan efek dalam bentuk instrument keuangan jangka panjang, baik dalam bentuk modal (equity) dan utang. Transaksi repurchase agreement (repo) merupakan salah satu bentuk kegiatan jual beli saham di pasar modal,yaitu transaksi jual efek dengan janji untuk membeli kembali dalam waktu tertentu.Permasalahan dalam transaksi repo ini terjadi manakala saat jatuh tempo pihak pembeli tidak dapat menjual kembali sahamnya kepada pemilik awal karena sahamnya tersebut telah dijual kembali(re-repo) kepada investor/pihak ketiga. Bagaimana kewajiban dari pemegang repo terhadap pemilik saham serta tanggung jawabnya terhadap investor/ pihak ketiga ? Pemerintah telah berupaya untuk terselenggaranya pasar modal yang transparan, adil, akuntabel yang dapat memberikan perlindungan kepada investor dengan menerbitkan Undang- Undang Nomor 8 Tahun 1995 tentang Pasar Modal dan Undang-Undang Nomor 21 Tahun 2011 Tentang Otoritas Jasa Keuangan serta Peraturan Otoritas Jasa Keuangan.

Abstract

Layanan Kesehatan diera digital merupakan pola baru dalam layanan kesehatan yang belum tersosialisasi di Indonesia tidak terkecuali di Kelurahan Sukamulya Kota Bandung. Hal ini terjadi oleh karena masih rendahnya pengetahuan keluarga dan masyarakat terhadap aspek hukum layanan Kesehatan diera digital. Temuan ini menjadi suatu kendala dalam mewujudkan layanan Kesehatan digital yang aman. Tujuan pengabdian ini adalah memberikan edukasi dan pemahaman kepada Masyarakat Kelurahan Sukamulya tentang pentingnya aspek hukum layanan Kesehatan digital. Pelaksanaan kegiatan berupa pemberian edukasi kesehatan tentang aspek hukum layanan Kesehatan digital yang dilakukan dengan menggunakan metode ceramah interaktif dan tanya jawab serta juga menggunakan media pembelajaran berupa leaflet. Hasil edukasi menunjukkan bahwa pengetahuan masyarakat menjadi meningkat setelah diberikan edukasi dan pembagian leaflet. Untuk itu disarankan kepada seluruh Masyarakat Kelurahan Sukamulya untuk berhati-hati dalam memilih aplikasi layanan Kesehatan digital. Pemberian edukasi tentang aspek hukum layanan Kesehatan digital perlu dilakukan secara kontinyu sebagai upaya penyebaran informasi tentang aspek hukum layanan Kesehatan digital kepada masyarakat luas.

Abstract

Water is a natural resource that humans need as a source of livelihood and shelter. Business actors address this as a way to earn income. However, the methods used do not or do not have permits by the terms and procedures specified in the statutory regulations. One of them is the independent water management business actor in Ciapus Village, which of course, this situation has attracted the interest of researchers to research how to protect consumers and producers/independent water management business actors and what the government's responsibility is regarding this situation and preserving the environment in Ciapus Village, Banjaran District, Regency. Bandung. To get answers to these problems, researchers used an empirical juridical approach, descriptive analysis research specifications, document study data collection techniques to obtain secondary data, and field studies to obtain primary data bymeans of observation and interviews. Based on the results of research in the Ciapus Village area, Banjaran District, it was found that independent water companies managed by individuals [3 entrepreneurs] do not yet have permits, but those managed by Bumdes Raksa Manggala have establishment permits, and business permits, and certificates of drinking water product test results from Bandung District Health Service Laboratory. The Regional Government of Bandung Regency has not yet supervised independent water management, so that independent water management entrepreneurs can take as much water as possible from their springs, without paying attention to environmental sustainability. This results in when the dry season arrives, the water flow decreases and even dries up.

Abstract

Transactions involving share repurchase agreements (repo) are one way for issuers to raise more money in order to boost the productivity of their businesses. The repo agreement, which is binding on both parties, is built on the idea of contract freedom. Even though the OJK has established repo transaction guidelines for financial service institutions, there are still some parties who don't carry out their commitments in accordance with what has been previously agreed upon in practice. The model for managing share repo transactions offers a sense of justice for shareholders, repo holders, and third parties. The obligations of repo holders in the event that the repo shares are sold to third parties. A normative-juridical approach is used to solve these issues, with the specification of analytical-descriptive research that examines facts and the implementation of repo transactions based on the provisions of the capital market laws and regulations. This research is supported by primary and secondary data obtained through document studies and interviews, which are then analyzed with kualitatif-juridical techniques. Based on the result of the research, it is possible to say that, although there are still some parties in practice who fail to uphold their obligations, the principle of freedom of contract has essentially been implemented for parties in share repo transactions between issuers in accordance with  the Civil Code and POJK; If the shares repoed to him are transferred to a third party before maturity, the share repo holder is subject to civil liability to the owner or a third party.

Abstract

The purpose of this study is to analyze the legal capacity of the parties in a digital online buying and selling contract and to determine the party that can be held accountable for the goods that have been purchased according to the laws and regulations in Indonesia. Technological developments have made developments in all sectors, including in the buying and selling system. Buying and selling now uses more of the internet or what is called online buying and selling. Online buying and selling falls into the category of digital transactions or contracts. The problem that can occur in a digital contract is the capacity of the parties in this case the subjects who make the agreement. It should be noted that digital contracts are the same as conventional contracts which must be subject to Article 1320 of the Civil Code concerning the requirements for the validity of an agreement. The agreement can be canceled if there is a party that does not meet the subjective requirements of Article 1320 of the Civil Code. The subjects in online buying and selling can be done by children who use their parents' or adults' cellphones. So when the party who makes the agreement does not meet the subjective requirements and should be canceled but is not done, the agreement is considered to remain valid. For online buying and selling that has been done by children, the parents or guardians of the child must be responsible. This research is of a normative legal nature by looking at the requirements for the validity of an Agreement from Article 1320 of the Civil Code.

Abstract

This paper aims to explore the urgency of reconstructing the institutional role of the Witness and Victim Protection Agency (LPSK) within Indonesia’s criminal justice system. Using a normative and empirical legal research methods, which is done by literature review, field exploration, and analysis, it builds an accurate and concrete model for implementing the construction of the position of the LPSK in the current criminal justice system. This study found that bureaucratic challenges—such as financial limitations, inadequate human resources, and institutional stagnation—have constrained the justice system’s ability to function equitably. These conditions often lead to the centralization of investigative power and a compartmentalized system in which oversight is limited and reactive. Within this context, LPSK holds potential as a horizontal oversight mechanism, offering checks on investigators’ authority and ensuring victim and witness rights are safeguarded during proceedings. This paper further analyzes how the Criminal Procedure Code anticipates horizontal supervision between law enforcement agencies, particularly between investigators and public prosecutors, and how LPSK can contribute to this oversight structure. However, limitations in institutional capacity and the centralized nature of LPSK pose challenges to its accessibility and effectiveness. Strengthening LPSK’s institutional capacity and expanding its regional presence are critical for responding to the growing demand for witness and victim protection, including in cases involving gross human rights violations. This study underscores the need for systemic reform and political will to ensure that protection of witnesses and victims becomes an integral part of a due process-oriented criminal justice system in Indonesia.

Abstract

Introduction: Capital markets play a crucial role in the economic growth of many countries, including Indonesia and Malaysia. Capital markets raise funds and serve as investment instruments. Through various instruments, such as stocks, bonds, and mutual funds, investors need information to obtain a clear portfolio that makes them confident in investing their funds in Indonesia or Malaysia.Purposes of the Research: This study aimed to analyze the legal positions and benefits of capital markets in Indonesia and Malaysia.Methods of the Research: This study was legalistic, doctrinal, or normative, using a comparative law approach to compare the legal position and benefits of the capital market in Indonesia with Malaysia.Results of the Research: Capital markets are crucial in Indonesia's and Malaysia's economies. To protect market players, Indonesia issued Law Number 8 of 1995 on the Capital Market and related instruments, such as Law Number 4 of 2023 on Financial Sector Development and Strengthening and Law Number 21 of 2011 on the Financial Services Authority (OJK). Similarly, Malaysia issued the Capital Markets and Services Act of 2007 to provide legal certainty and increase investor confidence. The capital market significantly impacts economic growth in both countries, serving as a crucial component of the economic ecosystem by providing investment opportunities through corporate actions, such as initial public offerings, secondary share issuances, and bond offerings.

Abstract

The holder of a Mortgage Right (Hak Tanggungan/HT) is granted the status of a preferred creditor under Article 1(1) of Law No. 4 of 1996 concerning Mortgage Rights (UUHT). HT is established through a Deed of Granting of Mortgage (APHT) and registered at the land office to obtain a Certificate of Mortgage Right (SHT). However, the enforcement of HT may be obstructed when third parties, particularly landowners, contest the object of HT in court, potentially resulting in cancellation decisions, as reflected in court rulings from Semarang, Cibinong, and Surakarta District Courts. This research aims to analyze the legal consequences and legal protection available to preferred creditors when HT is annulled by a court decision. The study employs normative legal research, which is grounded in the analysis of positive legal norms derived from statutory regulations (UUHT, KUHPerdata, HIR), reinforced by legal doctrines from scholarly literature, and jurisprudence from relevant court decisions. Utilizing a prescriptive analytical approach and secondary data sources, including legislation, books, journals, and verdicts, the findings show that HT cancellation leads to the reversion of land rights to third parties and alters the status of creditors from preferred to concurrent. Legal protection mechanisms available include filing a default lawsuit and submitting a request for asset seizure (conservatoir beslag) based on Article 1131 of the Indonesian Civil Code and Article 227(1) of HIR. Keywords: Cancellation ; Court;  Decision; Liability; Rights

Abstract

Introduction: Indonesia is an archipelago with an area of 5.8 million square kilometers of marine area and has a tremendous amount of fisheries wealth. However, fisheries in Indonesian seas are often the target of illegal fishing from foreign fishermen. To address this problem, the government has issued various very progressive policies. However, illegal fishing crimes still occur frequently.Purposes of the Research: This research aims to discuss the eradication of illegal fishing crimes in Indonesia from the perspective of Indonesian positive law and Islamic law. This research analyzes several illegal fishing cases that have been decided by the court by applying the ship confiscation penalty as a form of progressive punishment in combating illegal fishing.Methods of the Research: This study used a normative method with a comparative approach between Indonesian positive law and Islamic law.Results of the Research: The results showed that the government made a policy by setting up Task Force 115 based on Presidential Regulation Number 115/2015 on the Illegal Fishing Eradication Task Force, which is authorized to prevent and take legal action against illegal fishing criminals. The government issued Law Number 45/2009 on Fisheries jo. Law Number 11 of 2020 on Job Creation (Fisheries Cluster) by applying criminal penalties and administrative penalties. In addition, the government implemented a policy of destroying fishing equipment and foreign fishing boats by submerging them to the ocean. Regarding Islamic law, the policy of combating crime (jarimah) of illegal fishing is also mandated to the government or ruler in a country (ulil amri) because jarimah illegal fishing was classified as jarimah ta`zir. Similarly, the regulation for illegal fishing crimes in which the regulation of law enforcement mechanisms and the types of penalties to be applied are fully determined by the ruler or the state.
