Abstract

Human trafficking has become one of the most disturbing transnational crimes of the 21st century. Meanwhile, advances in information and communication technology have had a significant impact on the dynamics of this crime, with cyber space becoming a new place for perpetrators to carry out human trafficking activities. In this context, this research aims to dig deeper into the criminal act of human trafficking in the realm of cyber crime, highlighting the challenges faced by law enforcement and the prospects for combating it in the digital era. Research findings show that human trafficking in the realm of cyber crime has unique and complex characteristics, including the use of social media, websites and dark web platforms as the main tools for recruiting, promoting and selling victims. Challenges faced by law enforcement include difficulties in collecting legitimate digital evidence, complex cross-border collaboration, and limitations in technical capacity. Increasing international cooperation through more effective information exchange mechanisms, strengthening technical and legal capacity for law enforcement, as well as public awareness about the risks of human trafficking in cyberspace. With these steps, it is hoped that a safer and more sustainable cyber environment will be created, where human trafficking can no longer thrive.

Abstract

Perkawinan Campuran yang terjadi antara Warga Negara Indonesia (WNI) dengan Warga Negara Asing (WNA) berlaku dua sistem hukum yang berbeda. Indonesia menganut sistem kewarganegaraan tunggal. Kepemilikan warga negara tunggal memiliki banyak persoalan hukum mulai dari persoalan pelanggaran hak sipil, hak politik, hak ekonomi, dan hak sosial. Wacana pemberlakuan kewarganegaraan ganda terbatas bagi perkawinan campuran merupakan salah satu upaya untuk meminimalisasi persoalan hukum tersebut. Hal mendasar yang harus dikaji adalah apakah wacana kewarganegaraan terbatas bagi perkawinan campuran tidak bertentangan dengan nilai-nilai Pancasila sebagai Dasar Negara. Kajian tersebut dilakukan dengan metode normatif melalui penelitian kepustakaan yang bersumber pada data primer (bahan hukum) dengan menggunakan pendekatan perundang-undangan dan filsafat. Analisis dilakukan secara kualitatif dengan teknik penarikan kesimpulan secara induktif. Pancasila sebagai dasar negara memberikan patokan dalam nilai-nilainya yang pada dasarnya berupaya memberikan perlindungan yang utuh bagi setiap warga negaranya. Jaminan kesejahteraan dan perlindungan bagi warga negara menjadi dasar bagi dimungkinkannya keberlakuan status kewarganegaraan ganda terbatas bagi perkawinan campuran.

Abstract

The enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes (TPKS Law) categorizes child marriage as a form of sexual violence (Article 4 in conjunction with Article 10), allowing for criminal penalties against the perpetrators. However, the TPKS Law does not provide clear criteria for defining child marriage, making its implementation challenging. This research employs a normative method, utilizing a statute approach, conceptual approach, and case approach. In several urban cases, child marriage occurs due to extramarital pregnancies, which are often used as justification by parents to compel their children to marry-despite the child’s unwillingness. The primary reason given is to preserve the family’s honor. Judges typically approve marriage dispensation requests submitted by parents based on the notion of the common good. Such approvals reinforce the assumption that the marriage is consented to by the child, even when the child actually has no other options. In many instances of child marriage, husbands frequently abandon their wives after the marriage ceremony, as their primary motivation for marrying is not to assume responsibility as husbands and fathers. This situation exacerbates the wife’s condition, forcing her to bear the responsibilities of parenthood alone while facing societal stigma. This qualitative prescriptive legal analysis identifies variables that can be used to determine whether a forced marriage can be regarded as sexual violence. These variables also aim to provide certainty in the fair enforcement of the law, particularly for young women, who represent a vulnerable group.

Abstract

Economic globalization has an impact on the dynamics of adjusting the legal rules established in Indonesia. One of them is the legal unification format called the Omnibus Law on Job Creation. The Omnibus Law on Job Creation collects laws related to development and investment. The new thing in this law is the formation of a new institution called the Sovereign Wealth Fund. Various privileges are given to an institution called the Indonesia Investment Authority (IIA), ranging from not being held accountable for a loss to being audited only by a public accountant. This article discusses how laws and regulations build the construction of the Sovereign Wealth Fund Indonesia. The main problem that was analyzed is how the position of the Sovereign Wealth Fund in the structure of the Indonesian state institutions, besides that, it also discusses the issue of the authority and responsibility of the Sovereign Wealth Fund as well as the privileges provided by laws and regulations. All of these issues be the scope of discussion that provides an overview of Indonesia's Sovereign Wealth Fund. The discussion was conducted using a normative juridical method through qualitative analysis using a statutory approach and legal philosophy approach. The inductive conclusion is expected to provide input in strengthening IIA construction so as not to get demands for discriminatory treatment by other state institutions, and the goal of being established by the IIA to accelerate national economic development can be realized.Keywords: Privilege, Indonesia Investment Authority, Omnibus Law on Job Creation, Sovereign Wealth Fund. Keistimewaan Indonesia Investment Authority Dalam Omnibus Law Cipta Kerja Indonesia Abstrak Globalisasi ekonomi berdampak pada dinamika penyesuaian aturan-aturan hukum yang ditetapkan di Indonesia. Salah satunya adalah format penyatuan hukum yang diberi nama Omnibus Law Cipta Kerja. Omnibus Cipta Kerja ini menghimpun undang-undang yang berkaitan dengan pembangunan dan investasi. Hal baru yang diatur dalam undang-undang ini adalah pembentukan lembaga baru yang diberi nama Soverign Wealth Fund. Berbagai keistimewaan diberikan kepada lembaga yang diberi nama Indonesia Investment Authority (IIA), mulai dari tidak dapat dimintakan pertanggung jawaban apabila mengalami kerugian hingga hanya dapat diaudit oleh akuntan publik. Artikel ini membahas mengenai bagaimana peraturan perundang-undangan membangun konstruksi Soverign Wealth Fund Indonesia. Permasalahan utama yang dianalisis adalah bagaimana kedudukan Soverign Wealth Fund dalam struktur lembaga negara Indonesia, selain itu juga dibahas mengenai persoalan kewenangan dan tanggung jawab Soverign Wealth Fund serta keistimewaan-keistimewaan yang diberikan oleh peraturan perundang-undangan. Kesemuaan permasalahan ini menjadi ruang lingkup pembahasan yang akan memberikan gambaran mengenai Soverign Wealth Fund Indonesia. Pembahasan dilakukan dengan metode yuridis normatif melalui analisis secara kualitatif yang menggunakan pendekatan perundang-undangan dan pendekatan filsafat hukum. Kesimpulan secara induktif diharapkan dapat memberikan masukan dalam menguatkan konstruksi IIA agar tidak mendapatkan tuntutan perlakuan diskriminasi oleh lembaga negara lain, dan tujuan didirikan IIA untuk percepatan pembangunan perekonomian nasional dapat terealisasi.Kata Kunci: Keiistimewaan, Indonesian Investment Authority, Omnibu Law Cipta Kerja, Lembaga Pengelola Investasi Привилегии инвестиционного управления Индонезии по Закону Омнибуса о создании рабочих мест в ИндонезииАннотацияЭкономическая глобализация влияет на динамику регулировки правовых норм, установленных в Индонезии. Одна из них - это юридический формат унификации, который называется Законом Омнибуса о создании рабочих мест. Закон Омнибуса о создании рабочих мест включает в себя законы, связанные с развитием и инвестициями. Новым в этом законе является создание нового учреждения под названием Фонд Национального Благосостояния (Sovereign Wealth Fund). Учреждению, называемому Инвестиционным Управлением Индонезии (IIA), предоставляются различные привилегии, от отсутствия ответственности за убытки до проверки только государственным аудитором. В этой статье обсуждается, как законы и нормативные акты строят структуру Фонда Суверенного Благосостояния Индонезии. Основная проблема, которая была проанализирована, заключается в том, какое положение у Фонда Суверенного Благосостояния в структуре государственных учреждений Индонезии, помимо этого, также обсуждается вопрос о полномочиях и ответственности Фонда Суверенного Благосостояния, а также о привилегиях, обеспеченных законами и регулированиями. Все эти вопросы являются предметом обсуждения, который дает обзор Фонда Суверенного Благосостояния Индонезии. Обсуждение проводилось с использованием нормативно- правового метода посредством качественного анализа с использованием статутного подхода и философско-правового подхода. Предполагается, что индуктивный вывод внесет вклад в укрепление построения IIA, чтобы не получить требований о дискриминационном обращении со стороны других государственных учреждений, и цель, поставленная IIA для ускорения национального экономического развития, может быть реализована.Ключевые Слова: Привилегия, Инвестиционное Управление Индонезии, Закон Омнибуса о создании рабочих мест, Фонд национального благосостояния

Abstract

Abstrak Undang-undang No.17 Tahun 2008 Tentang Pelayaran melepas kedudukan monopoli PT.Pelindo (Persero) sebagai pengusaha pelabuhanan. Peran PT.Pelindo (Persero) sebagai regulator juga dicabut dan dialihkan kepada otoritas pelabuhan. Hal mendasar adalah dibukanya peluang Badan Usaha Pelabuhan (BUP) Milik Swasta untuk berpartisipasi dalam pengusahaan pelabuhan yang akan bersaing dengan PT.Pelindo (Persero). Keterbatasan anggaran yang dimiliki pemerintah untuk pembangunan dan pengembangan pelabuhan menjadi salah satu alasan dibutuhkannya investasi swasta. Skema kerjasama antara pemerintah dan BUP dilengkapi dengan pemberian hak konsesi oleh otoritas pelabuhan. Ada 223 BUP di Indonesia dan baru 15 BUP yang telah mendapatkan konsesi. Artinya masih banyak BUP yang belum memiliki hak konsesi, padahal hak ini merupakan syarat utama bagi BUP untuk menjalankan kegiatan usaha kepelabuhanan. Persoalan pemberian hak konsesi ini menjadi masalah dalam menghadirkan BUP yang dapat mengoptimalkan persaingan usaha kepelabuhanan. Artikel ini akan membahas permasalaan tersebut dengan menggunakan metode yuridis normatif melalui pendekatan perundang-undanngan dan dianalisis secara kualitatif, sehingga akan ditarik kesimpulan yang bersifat induktif yang memberikan pemahaman tentang semakin banyak BUP yang mampu mengusahakan kepelabuhanan maka akan semakin terciptanya persaingan usaha kepelabuhanan yang dapat membantu percepatan pencapaian target pembangunan dan pengembangan pelabuhan di Indonesia. Kata Kunci: Persaingan Usaha, PT.Pelindo (Persero), Badan Usaha Pelabuhan, Hak Konsesi. Abstract Law No.17 of 2008 concerning Shipping relinquished the monopoly position of PT Pelindo (Persero) as a port operator. The role of PT Pelindo (Persero) as a regulator was also revoked and transferred to the port authority. The basic thing is the opening of the opportunity for Port Business Entities (PBE) to participate in the exploitation of ports that will compete with PT Pelindo (Persero). The limited state has for port establish and development is one of the reasons it was needed for private investment. The cooperation scheme between the government and PBE is complemented by granting concession rights by the port authority. There are 223 PBE in Indonesia and only 15 PBE that have obtained concessions. This means that there are still many PBE that do not yet have concession rights, even though this right is the main requirement for PBE to carry out port business activities. The issue of granting concession rights is a problem in presenting a PBE that can optimize port business competition. This article will be carried out using the doctrinal method, through a legislative approach and analyzed qualitatively, so that an inductive conclusions will be drawn which provide an understanding of the more PBE are able to work on ports, the more it will create port business competition that can help accelerate achievement of development targets and port development in Indonesia.

Abstract

Regarding the legal consequences of unilaterally canceling a power of attorney in the case of working capital loans for construction, special requirements must be met by the bank when lending working capital for construction projects so that it is not canceled and sued unilaterally. This can be done with a power of attorney if it can be proven that the person giving the power of attorney is not carrying out their duties properly. The legal consequences of unilaterally revoking the special authority law are administrative sanctions and judicial revocation of the special authority law. Special requirements for granting working capital credit are met with two-way verification, especially for parties who provide special authority. This is to avoid further legal problems and the principal has the right to take legal action if his representative does not meet the requirements.

Abstract

A bankruptcy petition is a legal step taken by creditors to demand repayment of debts if the debtor fails to fulfil their obligations. Simple proof in bankruptcy, especially regarding the existence of a second creditor, is often difficult to obtain. This study analyses how the two creditor requirements in bankruptcy petitions are met, as well as the legal consequences if these requirements are not met, which can lead to the rejection of the petition. The three decisions examined are Decision Number 30/Pdt.Sus.Pailit/2023/PN Niaga Jkt.Pst, Decision Number 15/Pdt.Sus. Pailit/2025/PN Niaga Jkt.Pst, and Decision Number 33/Pdt.Sus.Pailit/2020/PN Niaga Jkt.Pst. The method used is a normative approach with a legal case study. The results of the study show that simple proof does not mean without verification, but rather sufficient formal evidence showing two creditors. In two decisions, this requirement was proven, and the bankruptcy petition was accepted, while in one decision, the failure to prove the second creditor resulted in the petition being rejected. This study recommends improving bankruptcy law and creditors' understanding of the importance of simple proof to protect their receivables rights

Abstract

Google, as the largest application platform, exploits its dominant position by requiring the use of Google Play Billing (GPB) for all digital transactions on Android. Through normative legal research based on literature, relevant regulations, and KPPU Decision No. 03/KPPU-I/2024, it was found that Google LLC had engaged in monopolistic practices. The KPPU ordered Google to open up alternative payment methods within applications through the User Choice Billing (UCB) programme, provide incentives for a minimum 5% reduction in service fees for one year, and impose a fine of IDR 202,500,000,000. This case underscores that the policies of large-scale digital companies must adhere to the principles of fair competition and highlights the importance of the KPPU's role in overseeing business practices in the digital economy era
