Abstract

Political Dynasty and Corruption are like two inseparable things. In Indonesia, political dynasty has been growing since the era of reformation, right after the implementation of regional autonomy system which enables the continuation of local politics succession directly. At 2018 regional election, there were five provinces with candidates from political dynasties such as: Banten, South Sumatera, West Java, East Java, and West Kalimantan.As a causality relation, corruption is the outcome and permissive behavior is the cause. In the Province of Banten, corruption occurs due to the permissive behavior stemmed socially ad structurally in the society. One of the influence of the permissive behavior towards corruption is the level of education. The lower it is, the higher the level of poverty, thus more permissive they are towards corruption, as well as the society’s lack of knowledge about negative effects of political dynasty. The people in Banten seems don’t fully acknowledge that political dynasty is degrading the essence of democracy and prone to corruption practice. In 2016, Banten helds sixth position in Indonesia in their level of poverty, and the second lowest in Java. Based on statistical data, until 2017 the amount of people with poverty in the cities and rural areas has increased.This research used qualitative research method in explanative manner, where the target of this research was to explain the social permissive reasoning phenomenon in the society of Banten as an inherited poverty of a political dynasty which prone to corruption, with several facts that supported data and research analysis which can be used to understand issues derived from such phenomenon.

Abstract

Until the end of 2019, Indonesia's ranking in the International Transparency Anti-Corruption Institute is still stagnant. Has not moved significantly in its ranking. The ranking is based on aspects of the ease of investing in a country. Significant influential factors are bureaucracy and corruption against Indonesia's low ranking. Bureaucracy and corruption are two things that are closely related, especially in carrying out the duties of bureaucrats. Various bureaucratic pathologies have caused bureaucracy to be ineffective and inefficient in carrying out government functions. For this reason, the commitment to eradicate corruption in Indonesia is very important because from the time of Sukarno's administration to Joko Widodo, corruption continued and Indonesia has always ranked first in Asia as the most corrupt country. And spread from Sabang to Merauke.Quite a number of laws and regulations in Indonesia were made as an effort to eradicate corruption. This is a manifestation of the commitment of the Indonesian government to eradicate corruption, but there are still legal loopholes that can be misused by corruptors to escape the law trap. Various attempts have been made by the Government of Indonesia to eradicate corruption, one of which is by establishing an Anti Corruption Agencies. Then in the era of globalization which is characterized by digitalization was taken by the Government to eradicate corruption, which is increasingly massive both from the impact and the actors. This shows that efforts to eradicate corruption along with the progress of information technology, especially based on communication technology (e-Gov).This study was conducted qualitatively using a variety of secondary materials both in the form of literature and internet sources compiled descriptively, with the aim of increasing new understanding of how efforts to eradicate corruption through electronic governance, as one solution in preventing corruption so that Indonesia's competitiveness is improved.

Abstract

Pemilihan Umum langsung merupakan pilar pertama dalam ber Demokrasi di Indonesia , dengan menganut  sistem one man, one vote dimana mengharuskan siapapun yang menginginkan kursi politik  dipemerintahan harus mendapat suara pemilih terbanyak. Kehadiran relawan menjadi penting bagi massa yang mendukung salah satu calon baik di Pilkada maupun Pilpres. Fenomena kemunculan deklarasi relawan ini mulai bermunculan setidaknya bisa kita lihat dari berbagai pemberitaan dimedia massa dan media sosial. Kehadiran relawan politik sebagai manifestasi dari meningkatnya partisipasi aktif warga masyarakat dalam berdemokrasi substantial.Relawan politik yang bergerak secara offline maupun online mampu meningkatkan partisipasi masyarakat yang menjadi kunci kehadiran model pemerintahan demokrasi ekstra parlementer.  Dengan menggunakan pendekatan kualitatif-deskriptif, peneliti bermaksud menggambarkan bagaimana peran relawan politik dalam konstelasi politik Indonesia.  Hasil penelitian ini  menunjukkan Fenomena relawan politik  Dalam Konstelasi Politik Indonesia  seolah-olah telah menjadi pilar utama pelembagaan demokrasi dengan caranya masing-masing bergerak sendiri untuk mendukung candidat masing-masing sehingga  dapat menjadi titik  awal dari dinamika transformasi nilai-nilai politis yang bernuasa patrimonial, oligarkis menuju volunterisme dan partisipatoris.

Abstract

The number of people who have died from COVID-19 has also continued to increase, as has the number of people infected with the Corona virus (Covid-19). Until May 2021, which coincides with the Eid al-Fitr 1442 H, which is the custom of the people of Jakarta, to go home to stay in touch with family in the area. At that time, Jakarta was still in the red zone due to the spike in the spread of Covid-19 cases. The state, in this case the Government, must be present to protect its people, both those infected with COVID-19 and so that they are not infected with Covid-19. This protection is in the form of the issuance of a regulation in the form of a Covid-19 Handling Task Force Circular Number 13 of 2021 concerning the Elimination of Homecoming for Eid Al-Fitri in 1442 Hijri and efforts to control the spread of Covid-19 during the holy month of Ramadan 1442 Hijri to change the ignorance of the people towards the Covid-19 pandemic. This study uses a qualitative approach by prioritizing secondary data, to find out the background of the issuance of the telemudik policy. The conclusion drawn from this literature research is that the background behind the birth of the telemudik policy is the ignorance of the community towards the covid pandemic itself. The right solution for carrying out homecoming during the Covid-19 pandemic is telemudik not to reduce the essence of friendship and sharing and prepare the community for the New Normal. in the midst of the Corona pandemic.   Keywords: Public Ignorance, State Protection, Telemudik   Abstrak   Jumlah masyarakat yang meninggal dunia akibat covid-19 juga terus meningkat begitu pula dengan jumlah masyarakat yang terinfeksi virus corona (Covid-19). Sampai dengan bulan Mei 2021 bertepatan menjelang hari raya Idul Fitri 1442 H, yang secara adat kebiasaan masyarakat Jakarta, melakukan mudik untuk bersilahturahmi dengan keluarga di daerah. Pada saat itu, Jakarta masih dalam zona merah karena lonjakan sebaran kasus Covid-19. Negara dalam hal ini Pemerintah harus hadir melindungi masyarakatnya baik yang terinfeksi covid-19 maupun agar tidak terinfeksi Covid-19. Perlindungan tersebut berupa diterbitkannya Regulasi berupa Surat Edaran Satuan Tugas Penanganan Covid-19 nomor 13 tahun 2021 tentang Peniadaan Mudik Hari raya idul fitri tahun 1442 Hijriah dan upaya pengendalian penyebaran covid-19 selama bulan suci Ramadhan 1442 Hijriah untuk mengubah perilaku ignorance masyarakat terhadap pandemic Covid-19.  Penelitian ini menggunakan pendekatan kualitatif dengan mengutamakan data sekunder, untuk mengetahui apa latar belakang terbitnya kebijakan telemudik tersebut.  Kesimpulan yang ditarik dari penelitian kepustakaan ini bahwa yang melatarbelakangi lahirnya kebijakan telemudik adalah perilaku ignorance masyarakat terhadap pandemic covid itu sendiri Solusi yang tepat untuk melaksanakan mudik pada masa Pandemi Covid-19 adalah dengan telemudik untuk tidak mengurangi esensi bersilahturahmi dan berbagi dan mempersiapkan masyarakat menuju New Normal ditengah Pendemi Corona

Abstract

Buying and selling votes seems to be an endemic practice in many democracies and is not new. Money politics is essentially a disease of democracy in any country. There is a ghost of money politics hanging around every election. It manifests through the exchange of votes for money, goods or services offered by candidates or support teams to voters. Money politics has become a language that brings together interactions between politicians and voters and is the central point of campaigning in the General or Regional Elections in Indonesia. Money politics is a fraudulent act in General Elections, essentially the same as corruption. Money politics is not in rhythm and is compounded to hold elections. This study uses a qualitative approach to discuss how the relationship between the practice of money politics and electoral corruption is rampant at every democratic party in Indonesia in the current reform era. First, in this study's results, money politics is a typical Indonesian terminology. Second, criminal sanctions do not provide a deterrent effect for perpetrators. Third, an open proportional system opens the door for vote buying and selling.

Abstract

There seems to be something different from the results of Transparency International Indonesia (TII) including sextortion or sexual extortion in the Global Corruption Barometer Asia 2020. This is extortion in the form of violence or sexual harassment. Generally a form of abuse of power. Sextortion is different from the corruption we know in a legal context. In terms of regulations and institutions, the practice of sextortion or sextortion is a case that occurs quite a lot but is not yet known in corruption eradication institutions in Indonesia. Sextortion is a new area that opens everyone's eyes to the fact that corruption is not only about money. This study uses a qualitative approach to answer how the form of legal protection for victims of sextortion is rife lately in the educational environment. The conclusions of this study indicate that the form of legal protection for victims of sextortion in the educational environment is in the form of assistance, protection and recovery of victims by strengthening the legal aspect in the form of SOPs for Handling Sexual Violence in each educational institution as well as the installation of detection devices. The novelty of this research can be used for extensive interpretation of legal findings by judges to protect victims of sextortion. And the importance of education on strong self-protection awareness, boldly rejecting or saying no.

Abstract

Transparency International includes sextortion or sexual extortion in the Global Corruption Barometer Asia. According to the data above, Indonesia ranks first in the country with the number of cases of sextortion highest in Asia. The forms of corruption that most often adorn every government organization, which occur the most and are vulnerable to involving state officials, are extortion, gratification, and bribery. Other more surprising facts from GCB Asia 2020 research a new indicator, namely sextortion, and Indonesia ranks first in the highest sextortion cases in Asia. This term is still very common, which reveals that corruption is not just a matter of money. As for the problems that will be answered with a descriptive qualitative approach, first, in the perspective of criminal law, are the provisions governing sextortion adequate? Second, what can be done to prevent the prevalence of sextortion? This study found that first, the regulation of sextortion is adequate in Indonesian criminal law, which is identical and congruent with abuse of power. Secondly, prevention efforts are in the form of a moralistic system and community empowerment. Novelty: Integrate sextortion into the anti-corruption movement in the form of an anti-sexual harassment program to achieve wider awareness that sextortion is a form of corruption.

Abstract

This type of corruption has become a growing phenomenon in Indonesian society. Policy corruption was born because of the existence of certain positions with legitimate authority based on the law, but there are personal interests in the midst of the interests of the community with malicious intentions to steal state money. At this point, it is seen how the relationship between power and corrupt practices has a tendency to increase in power, the higher the potential for corruption. Qualitative research by prioritizing secondary data, focuses on seeing how the phenomenon of policy corruption is in the perspective of corruption. The results of this study indicate that the phenomenon of policy corruption related to public officials, will continue to occur considering the greedy behavior that is tucked away in every policy-making process is reinforced by weak integrity. The potential for corruption is very high in the fourth type of public policy, namely public goods policy. Because this type of public policy is a transactional mode of realization of the government's budget and that means there is a flow of money. Logically, it can be accepted that one of the epicenters of corruption is the area where there is a circulation of money that is vulnerable to corrupt behavior from state officials.

Abstract

Korupsi di Indonesia bukan lagi sebagai masalah baru dalam persoalan hukum bagi suatu negara karena masalah korupsi telah ada sejak ribuan tahun yang lalu, baik di negara maju maupun di negara berkembang termasuk Indonesia. Bahkan masalah perkembangan korupsi di Indonesia saat ini sudah demikian parahnya dan menjadi masalah yang luar biasa karena sudah menjangkit dan menyebar ke seluruh lapisan masyarakat. Tindak pidana korupsi merupakan kejahatan luar biasa (extra ordinary crime) yang merusak dan mengancam sendi-sendi kehidupan bangsa. Tindak pidana korupsi pada zaman dahulu diatur dalam Kitab Undang-Undang Hukum Pidana yang karena dinamika yang berkembang dalam masyarakat, maka selanjutnya peraturan tersebut mengalami perubahan di mana lebih kepada bersifat khusus atau lex specialis yang selanjutnya kemudian diatur untuk pertama kali dalam Undang-Undang Nomor 31 Tahun 1999 jo. Perubahan Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi. Dalam perjalanannya kegiatan korupsi dilakukan oleh para pemegang kekuasaan tertinggi yang memiliki jabatan, yang mana jabatan tersebut kebanyakan merupakan hasil dari pemenang pemilu dalam suatu partai. Dalam UU PTPK. dinyatakan bahwa orang yang melakukan korupsi harus mengganti kerugian negara, dikarenakan dampak ekonomi dan sosial suatu wilayah yang ditimbulkannya pada keuangan negara. Pada perjalanannya penambahan vonis penjara bagi para koruptor yang berat tentu saja memberikan efek jera bagi para pelaku korupsi, yang di mana dengan hal tersebut diharapkan tindak pidana korupsi dapat berkurang.

Abstract

Korupsi sudah menjadi ancaman nyata bagi bangsa Indonesia. Dampaknya sudah sangat masiv sehingga pemberantasannya harus melibatkan seluruh lapisan masyarakat. Lembaga pendidikan baik perguruan tinggi maupun sekolah menengah atas mengambil peran dalam bentuk pencegahan dengan kegiatan penyuluhan perilaku anti korupsi dengan harapan timbulnya kesadaran untuk berperilaku anti korupsi . Penyuluhan ini bertipe kelompok yaitu kelompok dosen sebagai penyuluh dan kelompok siswa dengan jenjang kelas 10,11 dan 12 di beberapa Sekolah Menengah Atas di Bekasi sebagai peserta/sasaran penyuluh, yang telah berlangsung sejak tahun 2021 dan 2022. Dilakukan oleh kelompok dosen Universitas Bhayangkara Jaya sebagai penyuluh. Media penyuluhan dilakukan secara online karena sedang masa pandemic Covid-19 sehingga menyebabkan pertemuan tatap muka tidak mungkin dilakukan, dengan tahap adopsi yang hendak dicapai yaitu para siswa berupa upaya penguatan pendidikan anti korupsi berupa menerapkan perilaku anti korupsi di lingkungan sekolahnya dan timbulnya kesadaran untuk tidak melakukan korupsi di lingkungan keluarga dan sekolahnya. Karena Pendidikan Antikorupsi memiliki peran strategis dalam pencegahan korupsi, sehingga perlu dilakukan upaya penguatannya melalui kegiatan penyuluhan.
