Abstract

Pidana mati merupakan sanksi yang terberat diantara semua jenis pidana yang ada dan juga merupakan jenis pidana yang tertua, terberat dan sering dikatakan sebagai jenis pidana yang paling kejam dan yang paling kontroversial dari semua sistem pidana, baik di negara-negara yang menganut Common Law, maupun di negara-negara yang menganut Civil Law. Salah satu fenomena paling penting dari pidana mati adalah kondisi masa tunggu. Dalam kondisi ini, terpidana berada di posisi tidak pasti karena menunggu eksekusi mati. Pemerintah pada dasarnya tidak memiliki rumusan yang pasti siapa yang akan dieksekusi, melihat data di bawah ini, maka lama masa tunggu dari terpidana mati sangat bervariasi. Kebijakan Pemerintah (Political Will) di bidang hukum yang belum memadai karena pengaruh politik atau tekanan internasional dan juga karena hingga sampai saat ini Indonesia belum memiliki Sistem Hukum Nasional Indonesia yang komprehensif, integral dan sesuai dengan karakter, falsafah, dan budaya serta adat istiadat Indonesia.

Abstract

Smoking is not a cultural heritage of the Indonesian nation. Smoking is a habit that begins in adolescence. WHO data confirms that adolescents have a high tendency to smoke. Initially, smokers were under the age of 18, around 7.2 percent in 2013 and increased to 9.1 percent in 2018. Teenage students are more likely to smoke than adults. It is believed that 1 in 4 drug addicts started as addicted to cigarettes. In contrast, 90 percent of them started being addicted to drugs when they were 18. Because the brain is still developing until the age of 25, if, at that time, the brain was familiar with nicotine, cigarettes would be a gateway to addiction to other compounds, especially alcohol and illegal drugs. This qualitative descriptive study aims to determine what causes cigarette addicts to become drug addicts. The study results show that many factors cause a common thread between cigarette addicts and drug addicts, starting with the desire to try, pressure from peer groups or peer groups, being trapped and eventually falling into drug abuse. The low price during the massive promotion of cigarettes by sponsoring various school activities is considered a supporting factor.

Abstract

Human rights are the most important part of the rule of law. Every individual must respect and uphold the human rights of other individuals regardless of age. Human rights are meant not only in the real world but also in cyberspace. The development of technology has a negative impact, namely the birth of crimes that utilize technology, one of which is sexual crimes against children, namely child cyber grooming.  Method: This study uses normative juridical research type. In this study, the formulation of the problem is whether child cyber grooming is a sexual crime in the digital era. And what is the criminal liability for perpetrators of child cyber grooming? Result: Childcyber grooming is a sexual crime against children using technology. This is because in its implementation it uses things that contain elements of sexuality. Perpetrators of child cyber grooming can be charged using the Pornography Law and the ITE Law.

Abstract

Penyalahgunaan Narkotika telah menyentuh berbagai elemen masyarakat, mulai dari kalangan anak-anak, remaja hingga deawa. Peredaran bebas dan penyalahgunaan narktoika bergeriliya dengan mudah yang disebabkan oleh berbagai faktor. Baik faktor internal (dalam diri) maupun faktor eksternal (luar diri). Dampak negatif yang ditimbulkan oleh para penyalahgunaan narkotika mempengaruhi generasi bangsa dalam memajukan Negara Indonesia, tak jarang penyalahgunaan Narkotika turut merenggut banyak korban kematian. Sehingga, dalam hal ini peredaran dan penyalahgunaan Narkotika merupakan suatu hal yang cukup serius dalam hal penanangan maupun pemberian hukumnya. Perkara yang cukup kompleks ini tentu dalam pengungkapan kejahatannya perlu upaya yang ekstra seperti dengan memperhatikan media elektronik, dan juga kesaksian-kesaksian guna mempercepat pengusutan perkara tindak pidana narkotika

Abstract

This research aims to analyze the public prosecutor's considerations in proving the elements of the article so that children are categorized as narcotics providers and the public prosecutor's considerations in proving the elements of the article regarding children as perpetrators of narcotics providers. This research is empirical research carried out at the Sidenreng Rappang District Prosecutor's Office. The data obtained is then processed and analyzed using a qualitative descriptive method, namely a method where data is collected, compiled, interpreted and analyzed so as to provide complete information according to the problems faced. The results of this research are: 1) The child's public prosecutor's considerations in making a child's demand letter pay attention to the best interests and future for the child, then in its implementation it refers to juridical reasons related to applicable legal rules and non-juridical ones related to the child's personal, social, family and environment. children and the impact of children's actions on society and the state, as well as children's attitudes in undergoing the trial process; 2) There is conformity in the demands and decisions regarding the proven element, namely the element of providing, even though the element of control is not included in the judge's consideration as an element that is fulfilled in the proof of the indictment in the child's public prosecutor's claim, so even so, the public prosecutor's claim is proven in the element of providing in Article 112 paragraph (1) and paragraph (2) of Law Number 35 of 2009 concerning Narcotics, this strengthens the position of the claim that the claim is appropriate).

Abstract

Kasus Penyalahgunaan Narkoba dapat ditinjau dari berbagai dimensi, antara lain dimensi Hukum, dimensi Sosial, dan dimensi Kesehatan. Ketiga dimensi tersebut disatu titik, memiliki keterpaduan dan saling mendukung/ menguatkan. Namun di sisi lain, terdapat perbedaan yang sangat signifikan, bahkan saling berseberangan. Sisi perbedaan yang paling mencolok adalah penetapan status orang yang menggunakan/ menyalahgunakan Narkoba, menurut dimensi kesehatan adalah orang sakit (korban) yang harus diterapi dan rehabilitasi sesuai standar kesehatan. Namun yang melihat dari dimensi Hukum, maka orang yang menyalahgunakan Narkoba adalah pelaku tindak pidana sebagaimana diatur dalam Undang Undang, khususnya Undang Undang nomor 35 tahun 2009 tentang Narkotika dengan ancaman pidana yang berat. Ketika kasus Narkoba yang melibatkan anggota Polri, yaitu Kompol Yuni dan sebelas anak buahnya di Polsek Astana Anyar Bandung, ditinjau dari ketiga dimensi diatas, maka sesungguhnya Kompol Yuni bukan hanya sebagai pelaku tindak pidana Penyalahgunaan Narkoba, namun sekaligus sebagai korban.

Abstract

Health professions recognized autonomously by law consist of (1) the medical profession, (2) nursing, and (3) midwifery. These three health professions have different legal principles, so both types of professions have professional autonomy. The professional autonomy of health professions has consequences for various aspects of the existence of health profession stakeholders, such as their position, function, tasks, authority, and legal responsibilities. One of the legal aspects of health profession stakeholders is the legal standing of each health profession stakeholder. The law does not regulate the legal standing of health profession stakeholders in healthcare services, resulting in a legal vacuum regarding the legal standing of these health profession stakeholders. Do health profession stakeholders have equal or different legal standing in healthcare services from the perspective of the principle of legal equality? The research method used is the juridical-normative research method, which examines primary, secondary, and tertiary legal materials. The research conclusion is that the legal standing of health profession stakeholders is the same and equal from the perspective of the principle of legal equality. The suggestion presented is that legislators need to amend healthcare laws, medical practice laws, nursing laws, and midwifery laws to regulate and establish the legal standing of health profession stakeholders as the same and equal based on the principle of legal equality.

Abstract

The elements of the object of a criminal offense are acts carried out by distributing and/or transmitting and/or making accessible electronic information and/or electronic documents. The elements of criminal liability for perpetrators of criminal acts of cyber bullying must fulfill the elements regulated in Article 27 paragraph (3) of the ITE Law. Even though the highest criminal threat for cyber bullying is only four years in prison, the consequences of this act are very detrimental to the victim, both material and immaterial losses. The crime of cyber bullying can be seen as a result of relatively weak legal consequences or legal instruments. The problem faced is what kind of consequences are experienced by people who have become victims of cyber bullying. In Supreme Court Decision Number 120/Pid.Sus/2017/PN Lbo and Supreme Court Decision Number 95/Pid.Sus/2020/PT Gto, what is the criminal responsibility for those who carry out bullying behavior via social media? A normative legal research approach is used in this research. In conclusion, the impacts experienced by victims of cyber bullying include feeling hurt and afraid, often blaming themselves for the events they experienced, self-harm , experiencing sadness, and even thoughts and intentions to commit suicide. Criminal Responsibility of Perpetrators of Bullying Through Social Media in the Supreme Court Decision Number 120/Pid.Sus/2017/PN Lbo and Supreme Court Decision Number 95/Pid.Sus/2020/PT Gto the defendant of the crime of cyber bullying fulfills the element of responsibility as a subjective element, the defendant able to take responsibility for his actions, and the defendant does not have mental disorders or mental illness according to the Supreme Court decision.

Abstract

Business decisions taken by the Board of Directors are solely an obligation for the Board of Directors so that SOE can grow sustainably, stably, and have high competitiveness, but an unavoidable reality is that a business entity does not only experience profits, but is also faced with phases of loss. Business decisions that have been made with full calculation and prudence are still not free from business risks that can result in the SOEs they manage experiencing losses, so that they are categorized as detrimental to state finances and lead to criminal justice processes. This study aims to (1) analyse losses in SOEs that can be qualified as state financial losses and (2) analyse what business decisions made by the President Director of SOEs are categorized as fulfilling the elements of corruption in criminal cases in the Central Jakarta District Court Decision Number 15/Pid.Sus-TKP/2019/PN.Jkt.Pst. This research uses normative juridical research methods using statute approach, conceptual approach, and case approach. The results showed that separated state assets are state assets originating from the state budget to be used as state equity participation in SOEs. State assets that become capital in the form of shares are no longer state assets. State assets in SOEs are limited to the ownership of the company's shares, so that if there is a loss in the SOE Persero, this is not a state loss, but a loss of the SOE. The business decisions made by the President Director of the SOE are categorized as fulfilling the elements of corruption due to a series of actions by Karen that do not entirely reflect the principle of prudence in making decisions, nor do they fully fulfil the elements of Article 97 paragraph (5) of the Limited Liability Company Law.
