Abstract

Artificial intelligence (AI) offers the potential for a great improvement in patient care, both in diagnose and disease treatment, and a consequential reduction in healthcare costs, a part of opportunities and challenge are ahead. The use of AI in medicine was significantly developed in some countries. Indonesia as a modern country also has a great change in promoting the use of AI. The study aims to propose on designing the legislation for the use of AI in Indonesian medical practices. The method used in this research is normative juridical approaches with descriptive analysis. The data used are primary legal material namely the Indonesian Penal Code and Law No. 36 of 2009 on Health Law. Meanwhile, the secondary legal material used are books, journals, and other legal documents. The results show that designing the new legislation as the guidance and basis for the use of AI shall give a good impact on the development of health services as practices among other countries. Moreover, Health Act 2009 clearly supported the use of advance technology’s product in medicine. Yet, the application of AI facilitates interpretation follows with high accuracy and speed for medical diagnoses.

Abstract

One of the manifestations of the government's alignment with the protection and development of MSMEs is the issuance of Law Number 20 of 2008 concerning Micro, Small and Medium Enterprises (UU MSMEs). Protection of MSME products is protection for products consisting of goods and/or services. Every product, both goods and services, has material and immaterial wealth. Intellectual Property Rights (IPR), especially trademarks, are immaterial wealth for MSME products that need legal protection. This study aims to analyze the role of the Kebumen district government in accommodating the registration of MSME product brands. This study uses a normative juridical method with a qualitative approach. The legal materials used in this study include primary and secondary legal materials. Primary legal materials are Law Number 20 of 2016 concerning Marks and Geographical Indications, Regulation of the Regent of Kebumen Number 71 of 2016 concerning Position, Organizational Structure, Duties and Functions, as well as Work Procedures for the Department of Manpower and Cooperatives, MSME (MSME Kebumen Regent Regulation). Secondary legal materials are journaled articles, law books and websites. The results of the study indicate the role of the Kebumen Regency Government in accommodating trademark registration on MSME products in Kebumen Regency through the KUMKM Service and the KUMKM Integrated Business Service Center (PLUT). Activities carried out are in the form of socialization, consulting services, training, and assistance for MSMEs in trademark registration at the DJKI to protect the law and develop MSMEs.

Abstract

After the peaceful agreement signed by the Indonesian government with the government of Aceh, special autonomy was granted for Aceh and provided additional space for the two governments to improve the relations. Islamic law was fully effected after the assignment of Law No. 22 of 1999 concerning Regional Autonomy and amended by Law No. 11 of 2006 concerning the Law of the Government of Aceh, which provides a legal basis for the Privileges and Application of Islamic Law in Aceh. This research aims at analyzing the history and current existence of Islamic law in Indonesia and its contradiction with human rights. As an effort to enforce Sharia law, the regional government, besides pouring it into regional regulations or what is called Qanun, also forms institutions tasked with ensuring the proper implementation of Islamic Sharia law in Aceh. The research used normative legal research with a statute approach. The data are taken from secondary data. The results found that there were no human rights violations in applying Islamic law in Aceh.

Abstract

There are various number of foreigners owned a property business in Indonesia which is then rented out. But in reality, there are still many parties who violate the lease, namely by way of leasing transactions carried out at foreign banks. So that the tax issued can be lower than it should be. The purpose of this study is to determine how the tax provisions for foreigners on rental property ownership in Indonesia and how the crime of tax evasion. From the point of view of criminal law, this is a violation of tax evasion which is regulated in the KUP Law, articles 38-40. The method used in this research is normative juridical which examines the normative aspects of legislation, namely legal research conducted by examining primary legal materials and secondary legal materials. In the implementation of taxes, there are many obstacles in the form of violations and tax evasion. In taxation, foreign nationals are also subject to domestic and foreign taxes. In the event of tax evasion on house rent by a foreigner, it can be criminally processed as regulated in the KUP Law articles 38-40.

Abstract

Penganiayaan sering ditempuh sebagai jalan pintas dalam menyelesaikan perselisihan warga, oleh karena itu perlu dilaksanakan pendidikan hukum bagi warga Desa Giriwarno untuk meningkatkan kesadaran hukum melalui penyuluhan hukum dengan tema “Tindak Pidana Penganiayaan Dengan Aspek Hukumnya. Tujuan kegiatan ini adalah untuk meberikan pemahaman keapada masyarakat Giriwarno tentang pentingnya pencegahan terjadinya penganiayaan. Pnegabdian dilaksanakan menggunakan metode ceramah dan diskusi. Hasil dari kegiatan ini warga menjadi paham bahwa tindak pidana penganiayaan terbagi atas kategori ringan, berat dan berencana. Adapun berat ringan sanksi hukumnya mengikuti berat ringannya penderitaan yang dialami korban.

Abstract

The community service program aims to assist in making the legality of business licenses with the Home Industry Food Production Certificate (SPP-IRT) for Cistik Sofia processed. For most of the people in Kalitengah Hamlet, Glagahombo Village, Tegalrejo District, Magelang Regency, currently many are starting to develop businesses in the field of processed snack products in the form of Cheesse Sticks. The processed food is used as an alternative business in improving the welfare of the residents. The program is carried out through assistance in the process of filing business legality stages. As for the implementation of this program, several stages of the SP-PIRT submission process have been carried out including filling out the application form, product laboratory testing, and sanitation testing.

Abstract

The purpose of the implementation of this service program is to increase the production and marketing of processed home-cooked food products, Cistik Sofia, in the Kalitengah Hamlet, Magelang. Most of people in Kalitengah, Glagahombo Village, Tegalrejo District, Magelang Regency are currently starting to develop their businesses in the field of processed snack products in the form of Cheese Sticks. Processed food is used as an alternative business for residents in improving their welfare. This service is carried out through mentoring and training. The results obtained from the implementation of this program, the partners are able to develop variations in product flavors, innovated on the packaging models, and found the new strategies on the marketing process through social media.

Abstract

Penelitian ini bertujuan untuk mengetahui pertimbangan hukum hakim dalam mengabulkan permohonan dispensasi kawin (Tinjauan Yuridis Penetapan Pengadilan Agama Temanggung No.352/Pdt.P/2022/PA.Tmg). Penelitian ini menggunakan metode yuridis normatif dengan pendekatan undang – undang, pendekatan konsep dan pendekatan kasus. Artikel ini menguraikan dan menelaah permasalahan, mengenai bagaimana penyelesaian dispensasi perkawinan berdasarkan asas keadilan dan apa pertimbangan Hakim dalam memberilam putusan yang menolak dalam hal dispensasi kawin dengan alasan yang mendesak. Hasil penelitian menunjukkan bahwa penyelesaian Dispensasi Perkawinan di Pengadilan Agama Temanggung didasarkan pada asas keadilan dan pertimbangan Hakim Pengadilan Agama Temanggung dalam memberi permohonan dispensasi kawin didasarkan pada Undang-Undang Nomor 16 Tahun 2019 dan peraturan terkait lainnya.

Abstract

Penelitian ini bertujuan untuk mengukur efektivitas pelaksanaan rehabilitasi narapidana narkotika bagi warga binaan pemasyarakatan di Lembaga Pemasyarakatan Kelas II A Magelang dan bentuk upaya yang dilakukan oleh pihak Lembaga Pemasyarakatan Kelas II A Magelang dalam mendukung program rehabilitasi narkotika. Penelitian ini merupakan penelitian deskriptif kuantitatif dengan populasi warga binaan pemasyarakatan peserta rehabilitasi narkotika di Lembaga Pemasyarakatan Kelas II A Magelang yang sudah bebas. Responden berjumlah 40 orang yang ditentukan dengan metode purposive sampling. Pengumpulan data dilakukan melalui lembar instrumen kuisioner yang diberikan kepada responden dimana setiap jawaban sudah mempunyai nilai yang ditentukan serta hasil wawancara petugas pemasyarakatan dari pihak Lembaga Pemasyarakatan Kelas II A Magelang. Hasil penelitian menunjukan bahwa pelaksanaan program rehabilitasi narkotika di Lembaga Pemasyarakatan Kelas II A Magelang sudah efektif dengan presentase 78,55%, serta bentuk upaya Lembaga Pemasyarakatan Kelas II A Magelang dalam mendukung program rehabilitasi narkotika berupa pemberian program pelatihan kerja kepada peserta rehabilitasi narkotika dimana pelaksanaannya sudah berjalan dengan baik dengan presentase 76,88%.

Abstract

Foreign direct investment (“FDI”) has become a hot topic in board meetings all over the world as modern businesses are seizing new opportunities within theglobalized economy. The modern economy functions ona larger scale than ever before, and companies are beginning to realize that failing to partake in foreigndirect investment could lead to their demise. FDI has been a key factor driving export-led growth in Southeast Asia. This research offers a comparative legal and critical analysis of the Foreign Direct Investment Regulation (FDI) and strategies of attracting FDI in Indonesia by learning from Singapore. Indonesia has been striving to attract FDI, and therefore on October2020 Indonesia ratified the Omnibus Law on JobCreation replacing 79 acts regarding investment. Nevertheless, this law has raised legal controversies andpublic protests. This research focuses finding a model ofFDI attraction for Indonesia through lessons learnedfrom Singapore in terms of how to attract FDI. Singapore have made remarkable FDI accomplishmentthrough their own ways. The result of this research isaims to deplore the reasons for the accomplishment, intending to find a better model for Indonesia than theOmnibus Law currently adopted. This research arguesthat Indonesia should reconsider the Omnibus Law approach by referring to the lessons learned from theexperience of Singapore’s success in attracting FDI.
