Abstract

Proportionality is a legal principle not only requires equility of the rights and obligations among parties based on competing values, but also has purpose to deliver justice among parties. This principle is in line with the Al Musawah principle in the Islamic contract or agreement which it also has the same goal: ad ‘adl wa tawazun. This principle is the implementation of the principle of good faith, the principle of transactions based on honesty including in terms of determining the profit margin. The research significance are to provide enhance knowledge about proportionality principle in Islamic crowdfunding in Indonesia, especially in financing contract in Islamic financial technology as a new business innovation scheme. This paper in order to promote the impartial perception and to harmonize the Islamic law and Indonesian laws. The type of the research is legal research. The research methods apply the conceptual approach to the the Islamic crowdfunding under proportionality principle in financing contract.

Abstract

The Covid-19 pandemic in Indonesia has occurred for 2 years and has become a difficult task for health services. People who are infected, with the number of infections in Indonesia continuing to soar. This condition requires health service facilities and health workers to extra work to provide treatment for Covid-19 patients as a top priority. Healthcare facilities are starting to be selective in providing health services. The formulation of the problem raised is the problem with health services for the community and how the role of BPJS Health and the government in handling health services. The research method used is normative juridical, namely by analyzing the laws and regulations in force in Indonesia, using a conceptual approach, and legislation. The conclusion of this research is rules and regulations are needed to deal with cases, namely the Regulation of the Minister of Health of the Republic of Indonesia Number 19 of 2021 concerning the Second Amendment to the Regulation of the Minister of Health Number 10 of 2021 concerning the Implementation of Vaccination in the Context of Combating the Pandemic. Abstract

While polygamous marriages in Southeast Asia have been studied through various lenses, significant research gaps persist in understanding these practices within the Malaysian and Indonesian contexts. This study comparatively investigates the interpretation of ‘ḍarar shar’ī’, a requirement to contract a polygamous marriage in Malaysia and Indonesia. The study utilized doctrinal study on relevant legislation and case law accompanied by semi-structured interviews. The findings from the doctrinal study are supported by information acquired through semi-structured interviews with Sharia court judges in Malaysia that were selected using a purposive approach. The secondary data were assembled using the library research approach and later analyzed using the thematic and content analysis approach. This study discovers that Malaysia and Indonesia have minor differences in deliberating the concept of harm attached to polygamy application. This is attributed to the different conditions for allowing polygamy in both jurisdictions. The study also discovers that, unlike the other conditions of polygamy, the Syariah court has no specific guidelines in deliberating on the possibility of ḍarar shar’ī before it can grant permission to allow for polygamous marriage. Abstrak:Meskipun perkawinan poligami di Asia Tenggara telah dikaji melalui berbagai sudut pandang, masih terdapat kesenjangan penelitian yang signifikan dalam memahami praktik-praktik ini dalam konteks Malaysia dan Indonesia. Artikel ini mengkaji secara komparatif tentang penafsiran ‘ḍarar shar’ī’ sebagai salah satu syarat untuk memasuki pernikahan poligami di Malaysia dan Indonesia dengan tujuan untuk membuat pedoman tentang penafsiran hukum atas konsep ‘ḍarar shar’ī’. Penelitian ini mengadopsi metode kualitatif yang memanfaatkan studi doktrinal dan wawancara semi terstruktur. Temuan dari studi doktrinal didukung oleh informasi yang diperoleh melalui wawancara semi-terstruktur dengan hakim pengadilan Syariah di Malaysia yang dipilih dengan menggunakan pendekatan purposif. Data sekunder dikumpulkan dengan menggunakan pendekatan penelitian kepustakaan dan kemudian dianalisis dengan menggunakan pendekatan analisis tematik dan isi. Studi ini menemukan bahwa Malaysia dan Indonesia memiliki sedikit perbedaan dalam mempertimbangkan konsep kerugian yang melekat pada penerapan poligami. Hal ini disebabkan oleh kondisi yang berbeda untuk membolehkan poligami di kedua yurisdiksi. Studi ini juga menemukan bahwa tidak seperti kondisi poligami lainnya, pengadilan syariah gagal dalam mempertimbangkan kemungkinan ‘ḍarar shar’ī’ sebelum dapat memberikan izin untuk mengizinkan pernikahan poligami.

Abstract

A community service program (PKM) entitled "Skincare Product Dispute Resolution" was successfully implemented in Ngadi Village, Mojo District, Kediri Regency, involving village cadres, youth organizations, and community members, particularly housewives as skincare consumers. This PKM aims to provide solutions to skincare product disputes through five stages: outreach, training, technology implementation, mentoring, and sustainability evaluation. The outreach program began with a presentation on halal skincare products and consumer protection against misleading promotional practices, delivered by speakers from the Sharia Research Group (SReG) and the Non-Governmental Consumer Protection Organization. This program also includes in-kind and in-cash contributions, including training to improve customer service quality, ensure raw material quality standards and production processes comply with international standards, and ensure product information transparency. In addition, a loyalty program and transportation cost incentives were provided to affected consumers. PKM partners played an active role in providing information and inviting the community to participate in this activity. The implementation of this activity is expected to strengthen consumer trust and ensure protection of consumer rights related to skincare products.

Abstract

The rapid expansion of cross-border electronic commerce (e-commerce) has generated complex challenges for national tax systems, particularly with respect to the imposition of income tax on digital export activities. Indonesia’s income tax regime applies the worldwide income principle to resident taxpayers; however, its implementation remains largely grounded in traditional concepts of physical presence, which are increasingly incompatible with digital business models. This study aims to analyze the legal implications of income taxation on export activities conducted through cross-border e-commerce platforms and to examine regulatory responses within the Indonesian tax framework. Using a normative legal research method with statutory, conceptual, and comparative approaches, this study finds that although Law Number 7 of 2021 on the Harmonization of Tax Regulations has introduced the concept of significant economic presence, the absence of detailed implementing regulations limits its operational effectiveness. This condition weakens tax administration, increases the risk of tax avoidance, and creates unequal tax treatment between conventional and digital business actors. Accordingly, adaptive and technology-oriented tax regulation aligned with international standards is required to ensure legal certainty, tax equity, and sustainable state revenue.
