Abstract

Pemberian izin pertambangan pasir yang semula ada pada kewenangan Bupati/Walikota mengalami perubahan setelah diberlakukannya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Berdasarkan Pasal 14 Ayat (1), kewenangan Bupati/Walikota di bidang pertambangan mineral dan batubara yang diatur Undang-Undang Nomor 4 Tahun 2009, sejak tahun 2016 dialihkan ke tingkat pemerintah provinsi dan keberadaan Dinas ESDM di kabupaten dihapuskan. Tujuan penelitian ini adalah untuk mengetahui perubahan dan dampak yang terjadi akibat pelaksanakan usaha penambangan pasir dalam wilayah usaha pertambangan berdasarkan Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah dengan penelitian normatif. Berdasarkan pembahasan dapat disimpulkan bahwa izin pelaksanaan usaha penambangan pasir dalam wilayah usaha pertambangan berada dalam kewenangan pemerintahan provinsi dan keberadaan Dinas ESDM di kabupaten dihapuskan. Dengan demikian, pemerintah provinsi mengambil alih Izin Usaha Pertambangan (IUP) pasir dari tangan pemerintah kabupaten dan perizinan pertambangan pasir diurus melalui Dinas ESDM Provinsi. Pemindahan kewenangan tersebut dapat menyebabkan terganggunya koordinasi dalam pengelolaan pertambangan yang menyebabkan tidak tercapainya sasaran kerja. Untuk itu disarankan untuk menerbitkan produk hukum turunan pada saat masa transisi, sehingga tak ada keterlambatan pada pelayanan publik.

Abstract

Baitul Maal wat Tamwil (BMT) was established and developed with a gradual process of legal legality, namely BMT in which its legal entity was not yet known, BMT that had not had a legal entity, and BMT that had a diverse legal entity. This writing aimed at analyzing the concept of legal strengthening of BMT in Indonesia. This type of legal research was normative legal research on legal principles and legal systematics. Based on the discussion, it was concluded that BMT could be a legal entity because it had fulfilled the requirements requested by legislation, namely the general rule of Article 1653 of the Civil Code which stated that in addition to genuine civil fellowship, the law also recognized assembly of people as legal entity, both held or recognized by the government, or the assembly was accepted as permitted, or had been established for a specific purpose that was not contrary to law or good morality. Juridical considerations for BMT institutions were legal legality for every sharia economic activity and the variety and partial legal norms of BMT.

Abstract

Baitul Maal wat Tamwil (BMT) is a non bank financial institution that operates based on sharia principles. As an alternative financial institution, BMT can support the acceleration of national economic growth, but BMT was established and developed with a gradual process of legal legality. BMT status is determined by the number of assets owned, the BMT has a different legal status according to the stages of the number of assets, and is subject to various and partial laws in accordance with the stage of legal status. The purpose of writing is to explain the philosophical basis of the need for legal entities and the formulation of legal norms of BMT as a legal strengthening of populist economic institutions in Indonesia. This type of legal research is normative legal research on legal principles and legal systematics. Based on the discussion it was concluded that the philosophical basis of the need for legal entities and the formulation of legal norms regarding BMT in Indonesia as a legal strengthening is for legal certainty so that can provide recognition, protection, and facilities for the development and benefits of BMTs for micro and small entrepreneurs who do not receive financing services from bank financial institution.

Abstract

Legal awareness is related to lawful compliance, the thing that recognizes it is that in lawful compliance there's a fear of sanctions. Legitimate mindfulness that there are no sanctions, could be a definition from the lawful community with respect to the appraisal, which has been carried out deductively, the values contained in humans around the existing law or around the law that's anticipated to exist. The inquire about goes up against individuals based on instrumental and standardizing points of view. This investigate strategy is standardizing lawful inquire about, specifically lawful investigate conducted by investigating library materials. Based on the examination that has been done, it can be concluded that open legitimate mindfulness influences legitimate compliance either straightforwardly or by implication. Abstract

This community service activity aims to assist partners in increasing the understanding of educators and education personnel of the Merdeka Belajar Curriculum and the Mover School Program. The method of implementing the service is in the form of educational activities in the form of counseling which was carried out on February 5-17, 2023 with an activity workflow of four stages, namely: planning stage, implementation stage, evaluation stage, and reporting stage. This activity has been completed by meeting the predetermined achievement targets. These achievements can be seen from the enthusiasm of the participants in participating in counseling activities and being active in question and answer activities and discussions. In reviewing the evaluation of activities, the implementation team considered that the implementation of this service activity could not be separated from the maximum support from partners through the preparation of facilities during the event and the enthusiasm of participants in participating in counseling activities. The inhibiting factors of the activity include: time constraints, participant attendance that is not optimal, and the remote location of partners, far from the city and in an internet blind spot.

Abstract

Pemerintah daerah Kabupaten Ogan Komering Ilir melakukan pengendalian dan pengawasan minuman beralkohol sebagai upaya dalam memberikan perlindungan serta menjaga kesehatan, ketertiban, dan ketentraman masyarakat dari dampak buruk terhadap penyalahgunaan minuman beralkohol. Pengendalian dan pengawasan terhadap pengedaran dan penjualan minuman beralkohol dilakukan terhadap (a) perizinan, (b) kegiatan usaha penjualan semua klasifikasi dan golongan minuman beralkohol, (c) wilayah dan lokasi peredaran, (d) mekanisme peredaran, (f) tempat penyimpanan, (g) kelayakan usaha, dan (h) volume penjualan. Pemegang izin penjualan minuman beralkohol harus melaksanakan kewajiban dan larangan sebagaimana yang diatur dalam Pasal 23 dan Pasal 25 Perda Kabupaten OKI Nomor 8 Tahun 2017. Apabila pemegang izin penjualan minuman beralkohol melanggar kewajiban dan larangan tersebut, dapat dikenai sanksi administratif dan sanksi pidana, begitu juga dengan penjual minuman beralkohol yang tidak memiliki izin penjualan minuman beralkohol. Tujuan penelitian ini adalah untuk mengetahui penerapan sanksi Peraturan Daerah Nomor 8 Tahun 2017 Tentang Pengendalian Dan Pengawasan Penjualan Minuman Beralkohol di Kabupaten Ogan Komering Ilir. Jenis penelitian ini adalah penelitian hukum empiris yaitu suatu metode penelitian hukum yang menggunakan fakta-fakta empiris yang diambil dari perilaku verbal yang didapatkan dari wawancara maupun perilaku nyata yang dilakukan melalui pengamatan langsung. Beberapa razia rutin yang telah dilakukan oleh Pihak Kepolisian Resort Kabupaten OKI atau Satpol PP ditemukan penjual minuman beralkohol yang tidak memiliki izin untuk menjual minuman beralkohol dan tempat hiburan karaoke yang menyalahi izin. Sanksi terhadap pelaku penjualan minuman beralkohol berupa himbauan dan minuman beralkohol yang didapatkan dalam razia tersebut disita untuk dimusnahkan.

Abstract

Islamic banks have the opportunity to realize the government's expectations as stated in the policy of regulatory changes with the priority of cooperatives, micro, small and medium entrepreneurs or the people's economic system that provides opportunities to all levels of society without discrimination. The axiological content that underlies the operation of Islamic banks is also a separate force in efforts to develop the overall economy of the community. This research aims to examine the role of Islamic banking as a social institution in strengthening micro, small and medium enterprises (MSME or known as UMKM in Indonesia). The type of legal research used in this legal writing is normative legal research with a statutory approach. The statutory approach is carried out by examining all laws and regulations related to the role of Islamic banking in strengthening MSMEs.  The results of the research found that Islamic banking must be able to act as a social institution in addition to being a commercial institution. Acting as a social institution that can maximally improve the economy of MSMEs through al-qardh and al-qardh al-hasan financing. Both of these financing models are based on non-profit lending contracts.
