Abstract

Sesuai dengan teori bahwa no money laundering without core crime (tidak ada kejahatan Pencucian Uang tanpa adanya Tindak Pidana Asal), maka terdapat hubungan erat antara Tindak Pidana Pencucian Uang dengan tindak pidana asalnya. Permasalahan muncul pada proses penuntutan terkait dengan apakah harus dibuktikan keduanya ataukah cukup dengan pembuktian Tindak Pidana Pencucian Uang tanpa terlebih dahulu membuktikan tindak pidana asalnya. Pasalnya, dalam pengaturan tentang penindakan perkara pencucian uang secara khusus terdapat dalam Pasal 69 Undang-Undang No. 8 Tahun 2010 tentangPencegahan dan Pemberantasan Tindak Pidana Pencucian Uang mengatur perihal dalam melakukan penyidikan, penuntutan serta pemeriksaan di sidang pengadilan terhadap perkara Tindak Pidana Pencucian Uang, tidaklah wajib membuktikan terlebih dahulu tindak pidana asalnya.

Abstract

The United States government has been campaigning to encourage people to take HIV testing and thus get treated. It is puzzling that more than 50% of States have HIV-specific criminal laws that criminalize both exposure and transmission. At the same time, there is an increased tort law to seek financial compensation for unwanted HIV exposure and transmission. While both laws the moral claim of protecting people from HIV infection, this paper is trying to find an answer to the following inquiry: What is the difference of the moral reading between the use of criminal law and tort law in addressing HIV prevention in the United States? This paper uses the traditional descriptive comparison between criminal law and tort law under the American legal system with a nationwide jurisdictional scope. This paper measures the difference using the frame of reference of Ronald Dworkin's law, morality, and interpretation theory. Both criminal law and tort law have been developing similar liability principles regarding HIV exposure and transmission under the United States' common law tradition. For HIV prevention itself, both criminal law and tort law play a marginal role in gaining public health purposes in reversing the HIV epidemic. Criminal law has been scrutinized as not aligned with the purpose of law where misconceptions exist in both substantive dimension and the underlying moral claim. Tort law, on the other hand, suffers an even less moral claim on public health purposes. However, tort law maintains a consistent narrow sense of financial liability.

Abstract

This study compares the COVID-19 legal trends among 10 ASEAN countries during March 2020-September 2021. The study is an explanatory project with quantitative approach in comparing the number of legislation in South East Asia. The study aims to obtain a credible quantitative report from the region. The report would be beneficial to future qualitative reasoning when in-depth individual country's pandemic profile is taken into account. The comparison examines the Covid Law Lab database, a joint collaboration between the World Health Organization (WHO), United Nations Development Programme (UNDP), the Joint United Nations Programme on HIV/AIDS (UNAIDS), the O'Neill Institute for National and Global Health Law and Georgetown University. Globally, among 4,880 Titles adopted in 192 countries, 1493 (31%) Titles are under the topic of 'movement and distancing restriction', followed by 470 (9%) Titles on 'state of emergency'. In ASEAN, 'movement and distancing restriction' remains the most legislated topic. The Philippines is recorded as the most legislating country in the region (150 Titles), followed by Myanmar (139 Titles) and Indonesia (138 Titles), while the least legislating country is Brunei Darussalam (1 Title). This study finds that COVID-19 legal trends in ASEAN is divergent to some extent from the global picture. Nonetheless, 'movement and distancing restrictions' legal topic is prevalent in the region and has led the 10 countries to its current pandemic situation.

Abstract

Former inmates who have completed their sentences and have been declared free, which includes any individual, face significant challenges in securing employment to meet their livelihood needs. The same situation applies to individuals who have undergone non-prison rehabilitation for drug abuse. Parallel to the experiences of former inmates and non-prison rehabilitation, the concept of diversion has been introduced for juvenile offenders who are prospective job applicants. Both diversion and non-prison rehabilitation share the characteristic that the suspected perpetrators of criminal acts do not undergo punishment through the usual criminal justice system. However, these individuals still face stigma and difficulties similar to those encountered by former inmates in general. This study aims to explore the comparative impact of diversion and non-prison rehabilitation in relation to the right to employment. Specifically, the study focuses on a comparison within the private education sector. Using a comparative approach, this research seeks to provide a sharper perspective on diversion and non-prison rehabilitation as features of modern criminal law in Indonesia. The study finds that within the private education sector, diversion and non-prison rehabilitation offer a more favorable framing for the subjects, supported by philosophical factors inherent in private educational institutions. Policies implemented by the private education sector play a crucial role in ensuring the preservation of the right to employment by educational institutions.

Abstract

Legal design adalah pendekatan inovatif yang menggabungkan prinsip desain dengan hukum, bertujuan untuk menjadikan hukum lebih mudah dipahami, inklusif, dan efektif. Pada konteks hukum publik, pendekatan ini semakin relevan untuk menjawab tantangan regulasi yang kompleks dan sulit diakses oleh masyarakat. Artikel ini mengkaji bagaimana metode design thinking—melalui tahapan empati, perumusan masalah, ideasi, prototipe, dan pengujian—dapat diintegrasikan dalam proses legislasi dan perumusan kebijakan publik. Penelitian ini menggunakan metode studi literatur dan studi kasus penerapan legal design oleh Pemerintah Finlandia. Berdasarkan kerangka teori hukum sebagai proses (legal process theory), tulisan ini menekankan pentingnya partisipasi publik, keterbacaan, dan uji coba regulatif sebagai bagian dari proses hukum yang deliberatif. Legal design dapat meningkatkan legitimasi, akuntabilitas, dan efektivitas hukum publik dengan menempatkan warga negara sebagai pengguna utama regulasi.

Abstract

Indonesia's National Health Insurance (Jaminan Kesehatan Nasional, JKN) has integrated healthcare financing and administration into a single national system, yet the institutions responsible for resolving healthcare disputes remain divided across multiple jurisdictions. This institutional divergence has become increasingly significant as healthcare disputes now extend beyond medical negligence and insurance reimbursement to encompass administrative decision-making, contractual relationships, professional accountability, and the constitutional right to health. This article examines whether Indonesia's existing judicial framework remains capable of adjudicating disputes generated by an integrated healthcare system. It first analyses the legal characteristics of disputes arising under JKN and the fragmentation of their resolution across existing institutions. It then evaluates the institutional limitations of the current framework through doctrinal and comparative legal analysis. The article argues that the principal challenge lies not in the absence of legal remedies but in the allocation of adjudicatory jurisdiction. Although existing institutions perform legitimate statutory functions, no single forum possesses the institutional capacity to resolve the interconnected legal and technical issues presented by contemporary healthcare disputes. It concludes that a specialized health court represents a constitutionally compatible institutional response to the evolving demands of Indonesia's healthcare governance and access to justice.
