Abstract

Tujuan penelitian yaitu mengetahui supply chain dan farmer’s share usahatani telur ikan terbang nelayan patorani. Penelitian ini akan dilaksanakan di Kecamatan Galesong Kabupaten Takalar, Teknik penentuan sampel dilakukan secara purposive, pengumpulan data dalam penelitian ini dilakukan dengan cara penggunaan data primer dan sekunder dengan cara observasi dan wawancara kepada nelayan dan pedagang dan melakukan penelusuran berbagai kepustakaan yang relevan dengan tujuan penelitian, serta penggunaan data sekunder. Data primer yang telah diolah lebih lanjut dan disajikan baik oleh pihak pengumpul data primer atau pihak lain, dalam bentuk tabel, diagram dan sebagainya. Data yang terkumpul akan ditabulasi dan selanjutnya dianalisis dengan menggunakan pendekatan kuantitatif. Penelitian ini mengembangkan kerangka analisis usaha tani dalam persfektif supply chain dan farmer’s share. Hasil penelitian menunjukkan bahwa rantai pasok usahatani telur ikan terbang di Kecamatan Galesong Kabupaten Takalar pada periode covid-19, dimulai dari produsen dalam hal ini nelayan patorani, kemudian selanjutanya disalurkan ke Papalele sebagai penyedia modal nelayan kemudian ke pedagang pengumpul, dan ke pedagang pengumpul pengolah selanjutnya dijual ke eksportir setelah telur ikan terbang diolah terlebih dahulu. Terdapat dua saluran pemasaran dan nilai farmer’s Share 79 dan 89 % dan dapat dikatakan efesien

Abstract

Critical legal studies sebuah aliran yang berkembang di Amerika Serikat dengan metodenya dekonstruksi hukum. Dalam memandang masalah hukum, critical legal studies hukum tidak dapat dipisahkan dari politik dan hukum tidaklah netral dan bebas nilai. Karenanya hukum di dalam pembuatan hingga pemberlakuannya selalu mengandung pemihakan-pemihakan terhadap kelompok-kelompok tertentu. Dalam pandangan Meuwissen ada lima dalil kefilsafatan hukum, yaitu filsafat hukum adalah filsafat, karena itu ia merenungkan semua masalah fundamental dan masalah marginal yang berkaitan dengan masalah hukum. Pada dasarnya filsafat itu mempunyai dua unsur. Unsur yang pertama, unsur internal yang meliputi struktur ilmu pengetahuan dan metodologi. Unsur yang kedua, adalah unsur eksternal yang meliputi ilmu dan nilai yang meliputi agama etika, dan ideologi. Oleh karena itu, lima dalil tantang filsafat hukum yang dikemukakan oleh Meuwissen, merupakan pengertian dan kerangka dasar dari filsafat yang dijadikan bahan kajian untuk kerangka berfikir menuju esensi dari filsafat hukum. Hukum yang berada di tengah-tengah masyarakat tidak lepas dari perenungan dan perumusan nilai-nilai yang bersifat mendasar dari hukum itu sendiri.

Abstract

This study aims to determine the form of farmer household income strategies and household income capital in Kendena Village, Baraka District, Enrekang Regency in dealing with vulnerability. The research was carried out from November to December 2020 which was located in Kendenan Village, Baraka District, Enrekang Regency. Determination of informants is done by purposive sampling method or deliberately by taking 10%. The data collected in this study consisted of two types, namely primary data and secondary data. The results of the study show that the livelihood strategies used by farmers in Kendenan Village are of the same type of work and some are not the same type of work, and have different priorities. The classification of livelihood strategies in Kendenan Village includes 1.) Engineering of agricultural livelihoods is carried out by intensifying and extensifying agriculture. The strategy of expanding agricultural land (extensification) in Polo Slope Village is still possible for lowland rice farmers because the available land is still large. 2.) Double income pattern. The dual role of livelihood carried out by farming households, husband and wife each work in the same sector, husband and wife work but in different sectors, one member of the household has more than one type of work, each family member chooses another job , usually increase household income to survive. 3.) Spatial engineering is an effort carried out by mobilizing/moving residents both permanently and circularly (migration) in order to seek livelihood sources elsewhere. Farmers who migrate circularly in Kendenan Village, commute every day to earn a living outside the village so they can increase their income to meet their family's living needs.

Abstract

This research aims to reveal stability Friedrich Carl Von Savigny’s thoughts on the existence of annual sale and purchase customary love establishment. This research uses legal research methods, namely research carried out on legal norms that develop in society. The approach used is a conceptual and historical approach. The types and sources of data used in this research are primary and secondary data. The results of this research show that the teachings of the historical school initiated by Von Savigny emphasize that law is a reflection of the soul of the people that grows together with the people’s growth of the people and becomes strong together with the people’s strength. Furthermore, in the end, it dies if the nation loses its nationality. Thus, adherents of the historical school reject the view that law is made by an authorized institution, such as by making laws. Meanwhile, customary law that exists in Madurese society as the customary law of the Madurese people in some villages, such as “annual purchase and sale,” as the customary law of the community is maintained in the practice of annual purchase and sale of a plot of land that is perhaps not found in other areas in Indonesia. It is similar to the historical school, namely that law grows together with the growth of society and becomes strong together with the strength of society. Furthermore, in the end, it dies if the nation loses its nationality. This condition is recognized as existing by the constitution of the Indonesian legal state as regulated in Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia.

Abstract

This research aims to analyze Indonesia's presidential system of government through mechanisms of popular control over the president. In a presidential system of government, the president holds full executive power, separate from the legislative and judicial branches. This power must be balanced with strong control mechanisms to prevent abuse of power. One important form of oversight that often receives insufficient attention is direct popular control over the president. The method employed in this research is a juridical-normative method with statutory and conceptual approaches, supported by primary and secondary legal sources, with legal materials collected through literature study. The findings of this research indicate that mechanisms of popular control over the president remain weak, both through legal and political instruments. The impeachment mechanism stipulated in Article 7A of the 1945 Constitution of the Republic of Indonesia is extremely complex. Meanwhile, the oversight function of the House of Representatives (DPR) as the people's representative also does not operate optimally due to the dominance of oversized coalitions, which cause parliament to tend to favor the government. Strengthening popular control functions is not intended to weaken presidential power, but rather to ensure that executive power operates in an accountable and transparent manner while remaining subject to the principle of popular sovereignty, so that Indonesia's presidential system becomes more democratic and enjoys strong legitimacy in the eyes of the people.

Abstract

This study aims to conduct an in-depth analysis comparing the legal mechanisms of constitutional amendment in Indonesia and South Africa. The research employs a normative juridical method with a comparative law approach. Primary data is sourced from the authoritative texts of the 1945 Constitution of the Republic of Indonesia (UUD 1945) and the Constitution of the Republic of South Africa, 1996. Data analysis is conducted qualitatively using content analysis techniques on provisions related to constitutional amendments in both supreme legal documents. The research findings reveal fundamental differences in the constitutional amendment paradigms of both countries. First, Indonesia adopts a rigid amendment system implemented by the People's Consultative Assembly (MPR) with very strict quorum and approval requirements. Second, South Africa adopts a more flexible and differentiated system, where Parliament acts as the constituent authority, with varying approval levels depending on the substance of the amended provisions ranging from simple majority to two-thirds, and even involving the Provincial Council for certain matters. Third, despite different approaches, both countries affirm the principle of constitutional supremacy. These mechanistic differences reflect Indonesia's strategic choice to prioritize consensus and constitutional stability, while South Africa emphasizes constitutional adaptability and responsiveness to socio-political developments.
