Abstract

On November 29, 2017 the deed inbreng was signed by shareholders of PT Timah (Persero) Tbk (TINS), PT Aneka Tambang (Persero) Tbk (ATNM) and PT Bukit Asam (Persero) Tbk (PTBA) and approved the transfer of government shares to PT Indonesia Asahan Inalum (Persero) as well as evidence that the BUMN Mining Holding is officially formed. In the EGMS conducted by the three SOEs, it was agreed that the amendment to the articles of association was also related to the transfer of majority ownership from the original Republic of Indonesia to the ownership of PT Inalum (Persero) whose entire shares were owned by the State. The legal basis used by the government in forming the SOE holding is contained in Government Regulation Number 72 of 2016 concerning Amendment to Government Regulation Number 44 of 2005 concerning Procedures for Participation and Administration of State Capital in State-Owned Enterprises and Limited Liability Companies.

Abstract

The legal and political realities that have developed in Indonesia to date, there is a phenomenon that makes us all worried and uneasy. major illness experienced by our nation and country today, namely corruption and terrorism. This phenomenon is more or less closely related to what is called moral degradation in the realm of politics. moral values ​​and norms (morality) which of course in this case, have to do with political phenomena in terms of nationality, state or power. The focus of research is the existence of ethics in this case concerning human actions or behavior in terms of moral values ​​and norms (morality), which are connected with one aspect of human life, namely politics. This study aims to provide a rather enlightened generation of the nation to avoid bad deeds and to obey the applicable rules, especially in the realm of politics and understand the existence of Indonesian-style national political ethics which are considered not at all contrary to the teachings of Islam. The research method used is a qualitative method. The approach used in this study is as follows: First, the philosophical approach to values, morals or actions. Second, the interpretive approach / interpretation. Third, the juridical approach to state administration. Based on the analysis outlined in the discussion, the researcher concludes that Pancasila is a logical transcendental requirement for the implementation of all legal procedures in Indonesia which is used as a guideline for making laws and regulations, which will then be used as an instrument to assess and regulate whether a behavior or act it can be said good or bad. Likewise, the existence of Islam as a product of Allah (Almighty God) is a system of religious morality that is used by Muslims as an instrument to assess or measure whether a behavior or deed can be said to be good or bad. If the two systems of morality are linked, then it turns out that between one another (substantially or in principle) there is no trace of contradiction.

Abstract

Sebelum terbentuknya Otoritas Jasa Keuangan (OJK), untuk tercapainya sebuah sistem perbankan yang sehat dan stabil, bank dalam melaksanakan tugasnya tidak luput dari pengawasan Bank Indonesia yang bertindak selaku bank sentral. Kedudukan Bank Indonesia sebagai bank sentral, mempunyai tujuan untuk mencapai dan memelihara kestabilan nilai rupiah. Penelitian hukum normative ini mengkaji dua hal yaitu pelaksanaan fungsi pengaturan dan pengawasan oleh Bank Indonesia terhadap perbankan setelah dibentuk dan pelaksanaan fungsi pengaturan dan pengawasan oleh Otoritas Jasa Kewenangan (OJK) terhadap perbankan. Bank Indonesia secara yuridis masih memiliki otoritas dalam pengaturan dan pengawasan perbankan walaupun telah hadir Otoritas Jasa Keuangan (OJK). Hal ini dikarenakan, Pengawasan macroprudential tetap saja menjadi kewenagan dari Bank Indonesia, sebagaimana diatur dalam penjelasan Pasal 7 Undang-Undang OJK mengenai tugas dan wewenang Bank Indonesia, yang menyatakan bahwa lingkup pengaturan dan pengawasan macroprudential merupakan tugas dan wewenang Bank Indonesia. Sedangkan fungsi Otoritas Jasa Keuangan (OJK) adalah penyelengaraan sistem pengaturan dan pengawasan yang terintegrasi terhadap keseluruhan kegiatan di sektor keuangan dalam hal termasuk pada sektor perbankan.Kata kunci: Otoritas Jasa Keuangan (OJK), Bank Indonesia, perbankanKeywords: Financial Services Authority (OJK), Bank  Indonesia, banking

Abstract

The focus of the study in this article is regarding the position of Intellectual Property Rights as the object of waqf from a juridical perspective. This article is included in the type of normative legal research because in this article the author makes law the subject of study, and the approach used in this article is of course the legal approach. Based on the results of the study and analysis, the authors conclude that, juridically, the Endowment of Intellectual Property Rights (IPR) has obtained legal legitimacy in Indonesia. In addition to being regulated in Law Number 41 of 2004 concerning Waqf, IPR waqf has also been confirmed in several laws in the field of IPR, both before the Waqf Law was issued and after the Waqf Law was issued. Intellectual Property Rights can be transferred as long as the transition does not conflict with the prevailing laws and regulations in society, including by way of waqf. This is because IPR is a movable intangible object, IPR material appears as a form of appreciation for intellectual activities that are born from human thought to create something new or original, both in the fields of science, technology, literature and the industrial sector.

Abstract

A lack of proper interpretation of Decentralisatie Van Het Onderwijs or education decentralization in practice has led to confusion in understanding the legal aspects of education decentralization to oversee the targeted acculturation of Indonesian citizens. Decentralisation Van Het Onderwijs, a Dutch education reform law, was the impetus for this study, which seeks to shed light on the role that decentralization plays in the process of cultural assimilation. Through an examination of the decentralization concept associated with Law No. 23 of 2014 concerning regional government, the legal meaning of education decentralization is determined. Of primary importance is creating an educational framework, which includes teaching student’s values such as morality and respect for others. This framework can only be established through a well-resourced educational system. When it comes to education, moral training, character development, and social responsibility are all part of formal education. Only traditional religious schools, such as pesantren, can provide all of this information.

Abstract

The abortion controversy that developed until now is different between countries and between cultures. The Abortion Controversy that occurred in the community involved various parties, both the government and the ulama. The implementation of Government Regulation No. 61/2014 and the MUI fatwa form the basis for obtaining an abortion. The Fatwa of the Indonesian Ulema Council which firmly said that the initial abortion law was haram but in an emergency was permissible. This type of research used by the author in this study is the type of normative legal research, namely legal research conducted by examining library materials, secondary data or library law research. This type of normative legal research is used because the focus of the study in this study is because in this study it will examine the relevance of the MUI Fatwa with Government Regulation No. 61 of 2014 related to the ability of abortion to fetal rape cases. From the results of the analysis it is concluded that the government (PP) No.61 of 2014 concerning obtaining abortion is considered as the first step in protecting women's and reproductive rights. This Government Regulation is in line with MUI Fatwa Number 4 of 2005 which allows the abortion of wombs for reasons that are justified both medically and in Islamic law. Abstract

The expansion of a new autonomous region in its regulations does not include aspects of fulfilling the environment as a requirement for regional capacity so that it contradicts one of the environmental principles, namely the principle of sustainability. Therefore, the author wants to analyze the new concept of the environment in which this concept aims to make the environment an important part or main prerequisite in terms of regional expansion. The method used in finding the legal concept of regional expansion, especially on the fulfillment of environmental aspects, is by studying and analyzing environmental philosophy and determining its meaning so that it needs to be a consideration in order to fulfill the requirements for new autonomous regions to be expanded. Regarding the legal concept of regional expansion in the environmental field, it begins with determining the environment and nature, ways to respect the environment, clarity on the moral status of animals and plants, restoration of nature, and considering environmental sustainability for future generations. Referring to the philosophical aspect, the author includes environmental aspects as a basic requirement for regional capacity in the formation of an area, especially for the expansion of preparatory areas. Thus, the existence of the environment can still be felt along with the times.

Abstract

Abstract: The Plato's conception of the rule of law states that good governance is based on good law. The organization also spreads to the world of Supreme Court justices, the election caused a decadence to the institutional status of the House of Representatives as a people's representative in the government whose implementation was not in line with the decision of the Constitutional Court. Based on the decision of the Constitutional Court No.27/PUU-XI/2013 explains that the House of Representatives no longer has the authority to conduct due diligence and suitability (elect) to prospective Supreme Judges proposed by the Judicial Commission. The House of Representatives can only approve or disapprove candidates for Supreme Court Justices that have been submitted by the Judicial Commission. In addition, the proportion of proposed Supreme Court Justices from the judicial commission to the House of Representatives (DPR) has changed, whereas previously the Judicial Commission had to propose 3 (three) of each vacancy for the Justices, now it is only one of each vacant for Supreme Court Judges. by the Supreme Court. The House of Representatives no longer has the authority to conduct due diligence and suitability (elect) to prospective Supreme Judges proposed by the Judicial Commission. The House of Representatives can only "approve" or "disagree" the Supreme Judge candidates nominated by the Judicial Commission.

Abstract

Kehadiran sistem perbankan syariah resmi pada tahun 1992 sejalan dengan terbitnya Undang-Undang Nomor 7 tahun 1992 tentang Perbankan yang membahas mengenai sistem bagi hasil sebagai ciri khas dari bank syariah. Kepastian hukum mengenai eksistensi perbankan syariah memicu kelahiran bank-bank dengan sistem syariah termasuk yang berada di bawah naungan BUMN. Adanya penggabungan 3 (tiga) bank syariah BUMN Indonesia yaitu Bank Rakyat Indonesia Syariah (BRI Syariah), Bank Negara Indonesia Syariah (BNI Syariah), dan Bank Mandiri Syariah menjadi Bank Syariah Indonesia (BSI), menimbulkan kegelisahan terkait mekanisme peralihan nasabah yang senantiasa mengedepankan perlindungan hak-hak nasabah berdasarkan Undang-Undang Nomor 40 tahun 2007 tentang Perseorang Terbatas. Penelitian ini bertujuan untuk memberikan informasi terkait perlindungan hukum bagi nasabah pasca berdirinya Bank Syariah Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan konseptual dan pendekatan perundang-undangan. Adapun hasil penelitian adalah pertama, proses migrasi nasabah Bank Syariah Indonesia telah rampung untuk seluruh wilayah Indonesia. Seluruh produk dan layanan dari tiga bank syariah tersebut sudah bisa dilayani dalam satu sistem pada Bank Syariah Indonesia. Kedua, dengan adanya pelayanan satu sistem dari BSI ini menandakan bahwa Bank Syariah Indonesia sekarang memiliki satu core banking system, satu kode bank, satu pelaporan keuangan, satu enterprise data dengan nama Bank Syariah Indonesia. Sehingga penulis menyimpulkan bahwa penggabungan ini menggunakan sistem auto-migrasi dengan dasar hukum pada Pasal 28 ayat (1) Undang-Undang Nomor 10 tahun 1998 tentang Perbankan dengan memperhatikan aspek perlindungan hukum terhadap data nasabah, sehingga kepercayaan nasabah terhadap Bank Syariah Indonesia tetap terjaga.AbstractThe presence of the official Islamic banking system in 1992 was in line with the issuance of Law Number 7 of 1992 concerning Banking which discussed the profit-sharing system as a characteristic of Islamic banks. Legal certainty regarding the existence of Islamic banking triggered the birth of banks with a sharia system, including those under the auspices of SOEs. The merger of 3 (three) state-owned Islamic banks in Indonesia, namely Bank Rakyat Indonesia Syariah (BRI Syariah), Bank Negara Indonesia Syariah (BNI Syariah), and Bank Mandiri Syariah into Bank Syariah Indonesia (BSI), caused anxiety regarding the customer transition mechanism that always prioritizes the protection of customer rights based on Law Number 40 of 2007 concerning Limited Partnerships. This study aims to provide information related to legal protection for customers after the establishment of Bank Syariah Indonesia. The research method used is normative juridical with a conceptual and statutory approach. The results of the study are first, the migration process of Bank Syariah Indonesia customers has been completed for all regions of Indonesia. All products and services of the three Islamic banks can already be served in one system at Bank Syariah Indonesia. Second, the existence of one system service from BSI indicates that Bank Syariah Indonesia now has one core banking system, one bank code, one financial reporting, and one enterprise data under the name Bank Syariah Indonesia. Thus, the author concludes that this merger uses an auto-migration system with a legal basis in Article 28 paragraph (1) of Law Number 10 of 1998 concerning Banking by taking into account aspects of the legal protection of customer data, so that customer trust in the Bank Syariah Indonesia is maintained.
