Abstract

Abstract: The Plato's conception of the rule of law states that good governance is based on good law. The organization also spreads to the world of Supreme Court justices, the election caused a decadence to the institutional status of the House of Representatives as a people's representative in the government whose implementation was not in line with the decision of the Constitutional Court. Based on the decision of the Constitutional Court No.27/PUU-XI/2013 explains that the House of Representatives no longer has the authority to conduct due diligence and suitability (elect) to prospective Supreme Judges proposed by the Judicial Commission. The House of Representatives can only approve or disapprove candidates for Supreme Court Justices that have been submitted by the Judicial Commission. In addition, the proportion of proposed Supreme Court Justices from the judicial commission to the House of Representatives (DPR) has changed, whereas previously the Judicial Commission had to propose 3 (three) of each vacancy for the Justices, now it is only one of each vacant for Supreme Court Judges. by the Supreme Court. Abstract

Public service is essentially part of the government's role in serving and fulfilling the interests of society. However, in practice, the implementation of public services has not been able to meet public expectations or public service standards stipulated in Law No. 25 of 2009, especially the implementation of public services by the Prosecutor's Office. The method used is socio-legal using a sample, namely the Prosecutor's Office in South Sulawesi. The problems that are present in three fundamental aspects that determine the quality of public services in the Prosecutor's Office starting from the pattern of public service delivery, the quality of human resources, and institutions indicate the need for improvements to excellent public services to realize good governance in Indonesia. Therefore, the conclusion that can be drawn is the implementation of the principles of sipakatau, sipakainge, and sipakalebbi in public services in the Prosecutor's Office is a solution to excellent public services.

Abstract

This study examines legal protection for trademarks of Micro, Small, and Medium Enterprises (MSMEs) in Parepare City. MSMEs in this region play a crucial role in the local economy, yet business actors' awareness of the importance of trademark registration remains low. Lack of knowledge about the benefits of trademark protection and perceptions of high costs and complicated procedures are the main obstacles. This research employs a normative-empirical method, using primary data from interviews with MSME actors and secondary data from legal literature. The findings highlight the need for education, assistance, and improved accessibility to trademark registration services. Education through training and seminars, assistance by legal consultants, and the use of digital systems such as e-filing can enhance awareness and ease the registration process. Trademark protection provides exclusive rights, prevents unfair business competition, and increases the competitiveness of MSMEs. With government support in the form of subsidies or assistance programs, it is expected that MSMEs will be better prepared to face global challenges and ensure business sustainability.

Abstract

Makassar City, as a central socio-economic hub in Eastern Indonesia, faces a development paradox that is rapid progress in industry, trade, and investment has simultaneously generated severe environmental pressures. Massive urbanization has led to the reduction of green spaces, an increase in waste production reaching 868 tons per day, and recurring floods caused by spatial violations. This study examines the implementation of Corporate Social Responsibility (CSR) through the lens of maslahah and ecological balance, aiming to achieve social and environmental justice. The research employs a field research design, utilizing normative and empirical juridical methods, which include observation, interviews, and document analysis based on legal frameworks such as Law No. 40 of 2007 and Makassar Regional Regulation No. 2 of 2016. The findings indicate that CSR in Makassar serves as an ethical, legal, and spiritual instrument for realizing maqāṣid al-sharī‘ah, particularly hifz al-nafs (protection of life) and hifz al-bi’ah (environmental preservation). CSR practices, including waste management and environmental education, embody the principles of dar’ al-mafāsid (preventing harm) and jalb al-masālih (promoting benefit), affirming CSR’s role in fostering collective welfare and ecological justice toward sustainable development grounded in Islamic values.

Abstract

Registered trademarks provide exclusive rights to their owners to protect their products or services from imitation and unfair competition. However, many MSME (Micro, Small, and Medium Enterprises) owners still do not understand the importance of trademark registration, perceiving that trademarks are only relevant for large companies and feeling that the registration process is complicated and costly. This research employs a qualitative method with a case study approach, conducting in-depth interviews with MSME owners in Parepare City and analyzing documents related to trademark registration. The research findings show the crucial role of trademarks in supporting product differentiation, enhancing competitiveness, and building consumer trust in MSME products. In addition, this article also examines the application of the principles of Islamic economic law in trademark protection, emphasizing the values of justice, transparency, and honesty in business. This study suggests that the government and related institutions should improve education and simplify the trademark registration process to support the development of MSMEs in Parepare City. By doing so, MSMEs are expected to more easily protect their trademarks, strengthen their product image, and increase their competitiveness in an increasingly competitive market. Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis tentang pelaksanaan praktik tukar menukar uang rusak dengan yang baru di kecamatan Soreang, kota Parepare dan untuk mengetahui dan menganalisis pandangan Hukum Ekonomi Syariah terhadap praktik tukar menukar uang rusak dengan yang baru di kecamatan Soreang, kota Parepare. Jenis penelitian ini adalah field research (penelitian lapangan) dengan menggunakan pendekatan deskriptif kualitatif. Data dalam penelitian ini terdiri dari dua, yaitu sumber data primer yang diperoleh dari hasil wawancara dengan penyedia jasa tukar uang dan penukar uang di kecamatan Soreang, kota Parepare dan data sekunder diperoleh dari buku, jurnal, internet dan penelitian terdahulu. Dengan teknik pengumpulan data dilakukan dengan observasi, wawancara dan dokumentasi serta mengolah data-data yang diperoleh dari lokasi penelitian. Hasil penelitian ini menunjukkan bahwa 1) Pelaksanaan tukar menukar uang rusak dengan yang baru pada kecamatan soreang kota Parepare bersesuaian dengan kaidah akad (al-Sharf), yaitu objek tukar mata uang sejenis. 2) Tinjauan Hukum Ekonomi Syariah terhadap tukar menukar uang rusak dengan yang baru di kecamatan Soreang, kota Parepare ditinjau menggunakan teori al-Sharf terhadap penukaran mata uang sejenis menunjukkan bawha dalam praktiknya terdapat unsur riba fadhl, yaitu terdapat kelebihan nilai tukar terhadap objek tukar (uang rusak) bagi penyedia jasa tukar.

Abstract

This study examines the moral decline in Indonesian politics by focusing on transactional political practices that contradict Islamic law. Practices such as corruption and abuse of power have diminished political integrity and public trust. Using a normative legal approach, this research analyzes relevant regulations and Islamic legal principles of justice (‘adl) and trust (amanah). The findings reveal that transactional politics not only violate existing laws but also contradict the objectives of Islamic law (maqāṣid al-syarī‘ah), which emphasize justice, integrity, and social responsibility. From the perspective of Islamic law, political power is a trust that must be exercised for the welfare of the people, not for personal gain. Therefore, moral reform in politics should begin with Islamic ethical education, strengthened public accountability, and strict law enforcement to restore politics as a means of upholding justice and promoting social welfare.
