Abstract

Correctional Institutions are institutions implementing the criminal system whose function is to develop correctional inmates, including, in this case, women who are serving sentences and required to participate in the entire series of training activities in correctional institutions. In this case, the effectiveness of coaching prisoners can provide a good role model for others, especially prisoners of female, children, and the elderly. Then, the supporting factors can be used as examples to become even better in the future, and better solutions can be found for factors that can hinder development. This research aims to determine the pattern of coaching females, children, and elderly prisoners and to determine the factors that inhibit and support coaching. Synergy is needed between all parties involved, starting from prisoners, correctional officers, and related agencies, in cooperating with each other in carrying out training for female, child, and elderly prisoners to overcome problems in the implementation of training for female, child, and elderly prisoners, For this reason, it is necessary to carry out treatment and guidance to achieve better goals, and if the convict leaves, he will create an independent character and have a better leadership spirit.

Abstract

The development of restorative justice as an alternative approach in criminal law has gained increasing attention. However, its application in special criminal offenses remains limited and controversial due to their serious nature and strict legal frameworks. This study aims to analyze the compatibility between the theoretical concept of restorative justice and its practical implementation in handling special criminal offenses, particularly in relation to legal norms and enforcement policies. It also provides a comparative perspective by examining its application in narcotics, corruption, and sexual violence crimes. The research employs a normative juridical method with statute, conceptual, and case approaches, using secondary data from legislation, official policies, and selected court decisions, analyzed descriptively. The findings indicate that although restorative justice is normatively recognized, its implementation remains restricted, selective, and inconsistent. In narcotics cases involving users, it is relatively more applicable through rehabilitation, while in corruption and sexual violence crimes, its application is more limited due to public interest considerations and strict victim protection requirements. This study concludes that these limitations are influenced by rigid legal frameworks and the dominance of punitive approaches, highlighting the need for clearer regulations and adaptive legal policies.

Abstract

ABSTRAK Sistem peradilan pidana harus mencerminkan nilai keadilan terhadap pemidanaan bagi pelaku kekerasan seksual. Dalam perkara ini, tersangka sebagai pendidik telah melakukan kekerasan yaitu pemaksaan terhadap anak untuk bersetubuh dengannya. Putusan hakim menyatakan terdakwa terbukti melakukan kekerasan seksual berdasarkan Pasal 81 ayat (1), (3) dan (5) jo. Pasal 76D Undang-Undang Nomor 17 Tahun 2016 tentang Perubahan atas Undang- Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak jo. Pasal 65 ayat (1) KUHP. Rumusan masalahnya bagaimanakah pemidanaan terhadap pelaku kekerasan seksual dalam sistem peradilan pidana dikaitkan dengan Putusan Nomor 989/Pid.Sus/2021/PN.Bdg? Metode dalam penelitian ini adalah normatif di mana fokus kajiannya adalah data sekunder sehingga terlihat pertimbangan hakim dalam putusannya. Hasil penelitian menunjukkan bahwa pemidanaan terhadap terdakwa dalam kasus kekerasan seksual yang pada pokoknya hukuman mati dan pidana lain seperti denda, restitusi dan seterusnya tidak bertentangan dengan hak asasi manusia sesuai UUD NRI 1945 Pasal 28J ayat (2) dan Pasal 28I ayat (1) sehingga hak tersebut tidak absolut (non-derogable rights). Pemidanaan bagi pelakunya, harus diterapkan meskipun selama ini belum mampu memberikan efek jera dan komprehensif dalam penanggulangan tindak pidana, sedangkan hukuman kebiri kimia dan pembayaran restitusi diserahkan kepada terdakwa bertentangan dengan Pasal 67 KUHP. Diperlukan sinkronisasi di antara subsistem peradilan pidana khususnya pengadilan, didukung lembaga terkait sehingga pemidanaannya mencerminkan nilai keadilan sesuai ajaran hukum dan moral untuk kepentingan pelaku, korban serta masyarakat.Kata kunci: kekerasan; seksual; pemidanaan; sistem peradilan pidana. ABSTRACT The criminal justice system must reflect the value of justice in punishing perpetrators of sexual violence. In this case, the suspect, as an educator, had committed violence by forcing the child to have intercourse with him. The judge’s decision stated that the defendant was guilty of committing sexual violence according to Article 81 paragraphs (1), (3), and (5) in conjunction with Article 76D of Law Number 17 of 2016 on the Amendment to Law Number 23 of 2002 on Child Protection in conjunction with Article 65 paragraph (1) of the Criminal Code. The formulation of the problem is: how is the punishment of sexual violence perpetrators in the criminal justice system associated with Decision Number 989/Pid.Sus/2021/PN.Bdg? The method in this research is normative, where the focus of the study is secondary data so that the judge’s consideration in his decision can be seen. The results showed that the punishment for defendants in sexual violence is the death penalty. And other disciplines, such as fines, restitution, and so on, are not contrary to human rights compatible with the 1945 Constitution of the Republic of Indonesia Article 28J paragraph (2) and Article 28I paragraph (1), so these rights are not absolute (non-derogable rights). Punishment for the perpetrators must be applied even though, so far, it has not been able to provide a deterrent and comprehensive effect in tackling criminal offenses. At the same time, chemical castration and restitution payments are left to the defendant contrary to Article 67 of the Criminal Code. Synchronization between criminal justice sub- systems, especially the courts, supported by related institutions is needed so that the punishment reflects the value of justice compatible with legal and moral teachings for the benefit of the perpetrator, victim, and society.
