Abstract

Qanun Number 10 of 2018 concerning Baitul Mal is the legal basis for the Baitul Mal to carry out its functions and authorities in managing and managing zakat, waqaf, and religious assets. However, the functions and authority of the Baitul Mal have not been fully implemented, including the lack of socialization from the Baitul Mal so that there are still muzaki who do not submit their zakat to Baitul Mal, in collecting and utilizing zakat there are still many obstacles faced by Baitul Mal. The obstacles faced in the management of zakat by Baitul Mal Aceh include inadequate quality of implementing human resources, capacity, inadequate organizational structure, regulatory aspects that are not in line between regional levels and aspects of socialization and institutional understanding of the community. The efforts made by Baitul Mal to overcome the obstacles faced in the management of zakat are preparing implementing regulations from the Aceh Qanun regarding Baitul Mal, strengthening institutions and personnel (capacity building), expanding the socialization of the roles and functions of Baitul Mal Aceh, Regency / City Baitul Mal and Baitul Village mall, and build cooperation and coordination with all related agencies.

Abstract

Al-Hallaj's expression which says "Ana al-Haq" (I am the Truth) is interpreted by scholars as something that is very far from the lines of monotheism. The negative view of the fiqh scholars towards the misguided thought of Al-Hallaj is not appropriate, because of their lack of understanding of the nature of Sufism, especially the problem of dzuq and wijdan. The concepts of Hulul, Nur Muhammad and Wihdatul Adyan are the philosophical concepts of al-Hallaj which are the result of his contemplation of science and the circumstances of the surrounding community which are considered too holding onto things beyond the essence of human obligations as servants of God. Most fiqhi groups disbelieve in it, arguing that it is said that humans are united with God. However, there are also many scholars who accept it and defend the thoughts of Al-Hallaj. Imam Al-Hallaj's words are the basis of Dzuq and are in a state of being sick or drunk with God's love.

Abstract

The modern era is marked by advances in science and technology, which can bring prosperity to mankind. However, behind modern progress, there is a bad side that has greatly affected the inner side of Muslims. Modern negative impacts can be felt by the attitude of love for the world which gave birth to materialism and hedonism that occurs in various levels of society. The influence of technological sophistication, the sparkle of the world due to industrial progress and the development of western science that is rationalist, secularist, and materialistic have completely covered the eyes of the hearts of believers. walled in the eyes of the heart and mind in understanding the Divine Essence. The use of Sufism in this modern era is to improve our relationship with Allah and the Messenger, and our good relationship with fellow servants of Allah and His creatures. The main function of Sufism is to recognize the evils of passion. Because of this desire, it becomes the cause of various immoral actions such as ujub, arrogant, jealousy, angry and so on. To treat this liver disease, mental rehabilitation therapy is carried out in the form of spiritual education so that the heart can be clean from the impurities of lust and can know God.

Abstract

Article 4 of West Aceh Qanun No.13 of 2011 about Disaster Management says that the implementation of disaster management aims to provide protection to the public from the threat of disaster, aligning the legislation that already exists, ensure the implementation of disaster management in a planned, integrated, coordinated, and comprehensive, appreciate the local culture, building and public participation. However, in practice the function structure, substance and legal culture in disaster management has not been effective because it is still faced with mIany obstacles that affect the effectiveness. The implementation of disaster management in Aceh Barat District have not been fully implemented yet effective considering the functioning of the three elements of the legal system became a major element of disaster management.In fact, if all three elements of a functioning legal system with another implementation of disaster management can be effective as effective as can be seen in the alignment of the substance elements Qanun No.13 of 2012 on the disaster management with other legislation.Effective functioning legal culture provide an understanding of the legal community as integration through community participation and socialization legislation implemented through institutional legal authorities.Factors which become obstacles in the disaster relief efforts in Aceh Barat District include inadequate institutional performance and disaster management officials, the low awareness of disaster risk and low understanding of both the law and public administration officials to the disaster rules

Abstract

Fungsi Legislasi Dewan Perwakilan Rakyat kabupaten  Aceh Barat dalam Perspektif Siyasah Syar’iyyah. Dewan Perwakilan Rakyat memiliki fungsi legislasi, fungsi anggaran, dan fungsi pengawasan. Implementasi hukum Islam dalam hukum nasional ialah melalui proses legislasi yaitu pembentukan peraturan Perundang-undangan atau pembentukan Qanun. Hasil penelitian menunjukkan bahwa, Pertama, Fungsi legislasi DPRK Aceh Barat berpedoman pada Qanun Aceh No. 5 Tahun 2011 tentang Tata Cara Pembentukan Qanun, dan Peraturan Pemerintah Republik Indonesia No. 12 Tahun 2018 tentang Pedoman Penyusunan Tata Tertib Dewan Perwakilan Rakyat Daerah Provinsi, Kabupaten, dan Kota. Penyusunan Naskah Akademik merupakan penentuan isi materi muatan yang akan diimplementasikan dalam pembentukan Qanun. Selama periode Tahun 2014-2018, usulan pembentukan Qanun hanya berasal dari pihak Eksekutif, maka fungsi legislasi Dewan perwakilan rakyat kabupaten  Aceh Barat belum seluruhnya dapat terimplementasikan dalam pembentukan Qanun. Kedua, Perspektif Siyasah Syar’iyyah terhadap fungsi legislasi Dewan perwakilan rakyat kabupaten  Aceh Barat yang berpedoman pada Qanun Aceh No. 5 Tahun 2011 tentang Tata Cara Pembentukan Qanun, Asas-asas materi muatan pembentukan Qanun berkaitan dengan Prinsip-prinsip Siyasah Syar’iyyah dan Maqasid Syari’ah (tujuan syari’at Islam). Dari segi Formil, adanya Badan Musyawarah merupakan bagian dari penerapan Prinsip Musyawarah dan adanya Rapat Dengar Pendapat Umum juga merupakan Prinsip dari AlAdalah/Keadilan dalam Siyasah Syar’iyyah. Dari segi Materil, penerapan Prinsip Siyasah Syar’iyyah dapat diterapkan dalam pembentukan Naskah Akademik dengan memperhatikan landasan Filosofis, Sosiologis, dan Yuridis.

Abstract

Article 18B number [2] of the 1945 Constitution states that the State recognizes and respects customary law community units and their traditional rights as long as they are still alive and in accordance with community development and the principles of the Unitary State of the Republic of Indonesia, which are regulated by law. Article 18B, the Constitution provides the basis for the establishment of customary institutions as part of the policy for implementing regional autonomy in Aceh. Included in the Aceh autonomy policy is the establishment of customary institutions, including the Acehnese traditional assembly. the existence of the Aceh Customary Council, has been regulated in Chapter XIII of the Customary Institution Article 98 of Law Number 11 of 2006 concerning the Government of Aceh. In the process of monitoring the performance of the Aceh Customary Council, the Aceh Barat Regency has its own role in carrying out their duties and authorities as stipulated in Article 49 of the West Aceh Regency Qanun Number 5 of 2021 concerning the Aceh Customary Council, that the Aceh Regency Customary Council fosters and supervises the implementation of adat. based on Islam in the life of the people of West Aceh.

Abstract

The presence of the Sharia Court in Aceh Province has further strengthened the authority to implement Islamic law in this province. However, there are several things that must be considered so that the rule of law can be realized namely: structural, substantial and cultural aspects. Law enforcement will work if these three aspects are carried out continuously. Nevertheless, there are still a number of legal experts and legal practitioners who have not been able to accept the delegation of authority for criminal cases (jinayat) to the Sharia Court. In fact, the presence of the sharia court as a component of the legal integration mechanism in Aceh. This study will address this issue by examining many regions in Southwest Aceh, including the Syar'iyah Courts of Tapak Tuan, Meulaboh, and Calang, as well as the Province, which serves as the delegation of appeal cases. After all, this research encourages the Sharia Courts to work closely with government stakeholders to provide information and disseminate authority

Abstract

Pasal 2 ayat [1] dan Pasal 3 Undang-Undang Nomor 31 Tahun 1999 Jo Undang-Undang Nomor 20 Tahun 2001 tentang Tentang Pemberantasan Tindak Pidana Korupsi adalah Setiap orang yang secara melawan hukum melakukan perbuatan memperkaya diri sendiri atau orang lain atau suatu korporasi atau perbuatan menyalahgunakan kewenangan, kesempatan atau sarana yang ada padanya karena jabatan atau kedudukan yang dapat merugikan keuangan negara atau perekonomian Negara. Pelaku kejahatan korupsi adalah orang yang sedang mengalami kekeringan jiwa, kekeringan ruhani, serta buta mata bathin sehingga tidak mampu menahan hawa nafsunya dari perbuatan terlarang.Peran tasawuf dalam pencegahan tindak pidana korupsi dalam bentuk rehabilitas mental dan memberikan pendidikan ruhani kepada generasi muda dan aparatur penegakkan hukum. Melalui implementasi nilai-nilai tasawuf melalui berbagai praktik yang ada dalam Sufi, diharapkan memberikan pencegahan terhadap tindak pidana Korupsi.

Abstract

Panglima Laot in Qanun number 10 of 2008 concerning Customary Institutions in Aceh. Laot in Acehnese grammar means sea and Panglima itself means Leader. Panglima Laot in this case is part of the customary institutions in Aceh as a special region that has a distinctive regional implementation. Panglima Laot has existed since the reign of Sultan Iskandar Muda, who had a vital role in leading the army of his time. Citing this name, Panglima Laot today is more directed to the function of maintaining maritime order through upholding traditional values that are still believed by the fishing community in Aceh. However, the role of Panglima Laot is degraded by the functions and powers of law enforcement officials who have a more optimal role in carrying out this role. So it is important to study how to optimize Panglima Laot in the order of the Aceh coastal area. The research method used is sociological juridical or empirical juridical. Panglima Laot's urgency in building order among coastal communities in Aceh is reflected in the Regional Regulations which accommodate the role and function of the Panglima to always be involved in law enforcement, especially according to custom in Aceh. For this reason, optimizing the role of Panglima Laot can be carried out by placing capable human resources in exercising authority in that position, both in communication, public administration skills and also being trusted as individuals capable of upholding customary law by the people of the Aceh region.
