Abstract

The enactment of Law Number 11 of 2006 concerning the Government of Aceh has provided a legal basis for Aceh Province to revitalize traditional life in Aceh Province. As an inseparable part of the Aceh Province, Gampong Lamie, Darul Makmur District, Nagan Raya Regency is certainly part of the legal area of the Aceh Qanun No. 9/2008. The implementation of community service activities is carried out by the method of delivering materials directly by displaying materials in the form of Aceh Qanun No. 9 of 2008. Customs settlement of cases in Aceh is recognized by several regional regulations and policies. Article 13 paragraphs (2) and (3) of Aceh Qanun Number 9 of 2008 state that the settlement of 18 types of disputes/disputes between customs and traditions as referred to above is resolved in stages and law enforcement officers provide an opportunity for disputes/disputes to be resolved first. traditionally in the gampong (village) or other names. Abstract

Suspension of detention is regulated in Article 31 of Law no. 8 of 1981 concerningCriminal Procedure Law, which states that at the request of a suspect or defendant,an investigator or public prosecutor or judge, in accordance with their respectiveauthority, can hold a suspension of detention with or without a guarantee of moneyor a guarantee of person, based on the conditions. which is determined. Theserequirements are regulated in Article 21 paragraph (1) of the Criminal ProcedureCode or referred to as subjective requirements and Article 21 paragraph (4) KUHAPor so-called objective requirements. The subjective view carried out by the PoldaMetro Jaya investigators in suspending detention of a case (GA) is not in accordanceor continuous with Article 21 paragraph (1) of the Criminal Procedure Codeaccording to the author's subjective view. Against (GA) is charged with Article 4paragraph (1) jo. Article 29 and / or Article 8 of Law no. 44 of 2008 concerningPornography. The criminal regulation that ensnares (GA) is in the form ofimprisonment for more than five years. Abstract

An act against the material law in criminal law is that a person commits an act against the law living in society (unwritten law). So if a person's actions are not against an unwritten law, then he cannot be punished. The author wants to investigate whether the theft of loose palm oil in Lamie Village is an act against the law or not. The author's initial hypothesis is that in several plantations in Lamie Village, after harvest workers have finished harvesting palm oil where they work, there is a habit of harvesting workers choosing loose palm kernels that have fallen to the ground and then sold. The research method in this writing is through an empirical juridical approach. This research was conducted by enforcing or applying normative law into legal relationships in society. The results of the study said that all garden owners in Lamie Village with a land area of 3 ha and above allowed harvesters to take loose palm oil. So the harvester's actions are not against the unwritten law. Then, some garden owners whose land area is 3 ha and below must have prior permission from the garden owner. If the permit is given then it does not violate the unwritten law, but on the contrary if the permission is not given then the perpetrator may be subject to Article 362 of the Criminal Code concerning theft.

Abstract

Sosialisasi ini dilakukan dalam rangka pemenuhan Indikator Kinerja Utama (IKU) Universitas Teuku Umar poin 1 dan 3, yaitu membantu lulusan memperoleh pekerjaan yang layak dengan membekali kesiapan dalam menghadapi tes CPNS dengan berbagai regulasi yang ada saat ini dan menggerakkan dosen untuk berkegiatan di luar kampus dengan menggalakkan sosialisasi-sosialisasi yang berimbas pada kepentingan masyarakat umum. Harapannya dengan pembekalan tersebut mampu menghantarkan para peserta diterima menjadi abdi negara dalam upaya menjaring para pelayan publik yang prima serta cendekia Indonesia yang berwawasan, berketerampilan, dan berakhlak. Adapun metode yang penulis gunakan adalah presentasi menggunakan alat bantu slide power point dengan bobot materi berisi regulasi-regulasi yang harus diketahui oleh para peserta, strategi dan trik andalan dari para narasumber, cara mengelola waktu belajar dan tes yang apik, serta berisi bahasan-bahasan soal dengan mengangkat soal-soal yang pernah muncul di seleksi CPNS sebelumnya. Kemudian di akhir sesi ditutup dengan diskusi secara informal. Semua proses dilakukan melalui pemanfaatan media video conference zoom meeting. Hasil dari sosialisasi ini sangat dirasakan manfaatnya oleh para peserta, ini dapat diasesmen dari antusias dan intensitas pertanyaan yang diutarakan, bobot pertanyaan, kesungguhan untuk tetap standby mendengarkan meskipun sering terjadi system error disepanjang perjalanan sosialisasi, respon secara personal dari peserta kepada para narasumber, dan lainnya. Para peserta juga berharap akan ada sosialisasi lanjutan yang diselenggarakan demi kedalaman materi yang dikehendaki. Bahkan para peserta yang tidak sempat gabung karena memiliki kepentingan mendesak lain atau terlewat informasi, meminta secara personal kepada narasumber rekaman video meeting atau slide materi yang disampaikan. Abstract

Progressive law enforcement in the settlement of cases in Indonesia can be found in law enforcement in Aceh, namely through the stipulation of the Governor of Aceh Regulation Number 9 of 2008 concerning Fostering Traditional Life and Customs. There are 18 cases/disputes that are the scope of handling, including Khalwat. Various efforts have been made to absorb the law that lives in society, none other than to achieve the goal of law in orderly society. Conceptions of law that conflict with the diversity of society can be seen as a failure to implement effective and efficient law. The competence of a decision-making official is a separate issue to pay attention to. Likewise the mechanism is implemented with good intentions, but whether it will have a good impact cannot be generalized in general. Given the competencies and insights that depart from different understandings, this can have a significant impact on the decisions taken. The role of community leaders as customary judges is a dilemmatic issue in law enforcement related to khalwat. The point of view of khalwat acts that are not only about violating the law, but also about moral violations is an important issue that must be properly processed.

Abstract

Panglima Laot in Qanun number 10 of 2008 concerning Customary Institutions in Aceh. Laot in Acehnese grammar means sea and Panglima itself means Leader. Panglima Laot in this case is part of the customary institutions in Aceh as a special region that has a distinctive regional implementation. Panglima Laot has existed since the reign of Sultan Iskandar Muda, who had a vital role in leading the army of his time. Citing this name, Panglima Laot today is more directed to the function of maintaining maritime order through upholding traditional values that are still believed by the fishing community in Aceh. However, the role of Panglima Laot is degraded by the functions and powers of law enforcement officials who have a more optimal role in carrying out this role. So it is important to study how to optimize Panglima Laot in the order of the Aceh coastal area. The research method used is sociological juridical or empirical juridical. Panglima Laot's urgency in building order among coastal communities in Aceh is reflected in the Regional Regulations which accommodate the role and function of the Panglima to always be involved in law enforcement, especially according to custom in Aceh. For this reason, optimizing the role of Panglima Laot can be carried out by placing capable human resources in exercising authority in that position, both in communication, public administration skills and also being trusted as individuals capable of upholding customary law by the people of the Aceh region.

Abstract

The Singkil District Court has now implemented this regulation before the existence of Covid-19 in Indonesia. However, the fact that it was found that the electronic trial process at the Singkil District Court, especially in cases of default, was still not effectively carried out due to several obstacles experienced so that the trial process could not be applied due to the principle of speed. This study aims to examine the effectiveness of implementing defaults based on PERMA No. 1 of 2019, in the field of civil law and find out what obstacles and solutions are experienced by the litigants in the Singkil District Court. The research method used is empirical research, namely by using facts obtained through interviews and looking at real behavior through direct observation. The results of the study show that the application of E-court in PERMA No. 1 of 2019 in default cases at the Singkil District Court has not been fully implemented, because there are many obstacles that hinder electronic trials in default cases so that the trial process is very slow. It can be concluded that the application of E-court in default cases at the Singkil District Court is not fully in accordance with PERMA No 1 of 2019.

Abstract

The resolution of minor criminal acts that occur in Indonesian society can usually be achieved through several channels, one of which is through deliberation. The concept of deliberation itself is regulated in Aceh Qanun Number 9 of 2008 concerning the Development of Customary Life and Customs. So that the formulation of the problem in this study is how effective and constraining the resolution of cases through deliberation in the crime of theft in. The purpose of this study is to determine the effectiveness and constraints in resolving cases through deliberation in the crime of theft in the family. The method used is empirical juridical with a statutory approach and a case approach.The results of the study found that deliberation in the crime of theft in the family tends to be effective to be carried out because of the issue of morality and values that are still upheld. And the constraints in resolving cases through deliberation in the family are related to personal relationships between the parties who are families who tend to be more sensitive to being accessed by third parties in their resolution, so a persuasive approach is needed.
