Abstract

Indonesia’s forest fires have caused a serious haze problem nationally and in the Southeast Asian region, which has caused harm to the rights to life, health and a healthy environment, work, education, and many others. The forest fires largely stem from harmful slash-and-burn methods of land clearing, done at large scales by corporations. Judicial mechanisms have proven ineffective to deter violating corporations and bring justice to victims. From a legal standpoint, Komnas HAM’s quasi-jurisdictional powers allow it to act as a non-judicial grievance mechanism for victims in the haze crisis and against violating corporations. However, issues with the non-binding nature of its reports and mediation, inability to compel violating corporations to participate in its investigation and mediation, as well as declining trust in Komnas HAM’s integrity may prove to be significant barriers to the effective exercise of jurisdiction and the provision of effective remedies to victims. Komnas HAM and ELSAM’s national human rights plan, issued in 2017, is a step in the right direction. However, further steps are required from a legislative standpoint to broaden Komnas HAM’s mandate for it to effectively perform its functions, in the haze crisis and beyond.

Abstract

Majelis taklim (known as taklim assemblies or taklim council) in Central Kalimantan uses different references in conveying and discussing fiqh material. This leads to a mixture of ideologies, for example, there are indications of deception in using fiqh references. Hence, the research aimed to find out the pattern of fiqh references used by Majelis Taklim in Central Kalimantan. It used empirical legal research with a sociological juridical type and a socio-legal approach. The research showed the fiqh references used by the majelis taklim  appear with various ideologies. And, four fiqh reference patterns were found, including the tendentious, the comparative and a mixture of ideologies or non-schools of thought, the pattern with organizational ideology, and the pattern referring towards the Syafi'i school of thought. From the four characteristics, it seems that the tendentious fiqh pattern, either tarjih maqasid or malat al-af‘al, more likely leads to bringing mudharat (negative) and, even, not given benefit for Muslim community as a whole. However, in practice, there are indications of deception that may not be aware of by the public. If this tendentious pattern accepts ideological pluralism would certainly not be problematic. But, in reality, they are seen as splitting-bamboo politics with a scenario according to their interests and status to promote their ideology. Also, it needs to highlight the comparison of fiqh and a mixture of ideologies or non-schools of thought. It is believed that this pattern has its benefits. On the other hand, people who are less well prepared on az-zari‘ah, will deal with their problems, which may lead to ideological chaos.

Abstract

Abstract. This paper aims to explain how political public sphere occurs in Republika media. Mass media as a public sphere ideally provides space for audiences to get balanced information and news related to developing political issues. Not being an apartus of power or entrepreneurs, but bridging public interests. This study uses qualitative research with a critical paradigm.  The findings of this study are that Republika provides political public sphere for various political party backgrounds, news for Islamic and nationalist based parties are given the same space. Mass media as a public sphere is often used by rulers and businessmen for their political interests. Journalists as professional journalists can interact directly with politicians, with the limitation of not being allowed to led to the political publicity of the former owner of the Mahaka Group who became Minister of BUMN of the Republic of Indonesia. Keywords: Mass media, republika, public sphere, politics. Abstrak. Tulisan ini bertujuan untuk menjelaskan bagaimana ruang publik politik yang terjadi di media Republika. Media massa sebagai ruang publik idealnya memberikan ruang bagi khalayak untuk mendapatkan informasi dan berita yang seimbang terkait isu-isu politik yang berkembang. Tidak menjadi apartus kekuasaan maupun pengusaha, namun menjembatani kepentingan-kepentingan publik. Kajian ini menggunakan penelitian kualitatif dengan paradigma kritis. Temuan penelitian ini Republika memberikan ruang publik politik bagi berbagai latar belakang partai politik pemberitaan untuk partai berbasis islam maupun nasionalis diberikan ruang yang sama. Media massa sebagai ruang publik kerap digunakan oleh penguasa dan pengusaha untuk kepentingan politik mereka. Wartawan sebagai jurnalis profesional dapat berinteraksi langsung dengan politisi, dengan batasan tidak boleh masuk dalam struktur partai. Disisi lain ditemukan adanya pemberitaan yang mengarah kepada publisitas politik mantan pemilik Mahaka Grup yang menjadi Menteri BUMN Republik Indonesia. Kata Kunci: Media masa, republika, ruang publik, politik.

Abstract

This study examined new religious patterns and behaviours in Indonesian Muslims during the New Normal era. This new religiosity is an impact of government regulations and recommendations from community organisations regarding social and physical distancing restrictions due to the spread of Covid-19. This study used a sociological approach to analyse changes in religious and social behaviour of Indonesian Muslims in public spaces qualitatively. This study found five main aspects that indicate a new form of religiosity for Indonesian Muslims in the New Normal era, namely; a shift in worship practices from a public space to a private space, a decrease in the capacity of the physical space that has an impact on decreasing the routine of worship, the emergence of new challenges for the authorities and public policy to prepare an area for more personal religious activities, the disappearance of symbolic worship practices, and finally, the blurring of abangan Muslim groups based on waqi'iyah (contemporary/contextual) ijtihad. These findings are analysed using the theory of public space from Jurgen Habermas's. This study proposes a new pattern of religiosity for Indonesian Muslims in the New Normal era, i.e., the adjustment of Shari'a by way of independent legal reasoning to maintain a wider maslahat, public welfare.

Abstract

This article examines the attempt by Muhammadiyah to respond to the issue of returning to the primary sources -the Qur'an and the hadith -to resolve modern problems. The focus will be on the concept, method and source of ijtihad (legal reasoning) used by Muhammadiyah. The author will argue that Muhammadiyah faces several problems in formulating a method to reinterpret the Qur'an and the hadith and these will be critically analysed.DOI: 10.15408/sdi.v10i1.643
