Abstract

Abstrak: Penelitian ini dilatarbelakangi tidak diketahuinya secara jelas ‘illah doktrin idah baik dalam Al-Qur’an maupun hasil kajian para pakar, sehingga eksistensi doktrin idah berpotensi dipertanyakan kembali terlebih dikaitkan dengan teknologi modern. Oleh karena itu, masalah yang dikaji adalah bagaimana ‘illah idah dalam Al-Qur’an beserta kondisi sosial yang melatarbelakanginya dan bagaimana relevansi ‘illah tersebut dengan doktrin idah dikaitkan dengan zaman sekarang dalam perspektif ushûl al-fiqh. Penelitian ini menggunakan pendekatan ushûl al-fiqh kontekstual. Hasil yang ditemukan adalah Al-Qur’an ternyata tidak mengatur ‘illah doktrin idah. Interpretasi para pakar terhadap doktrin ini pun tidak dapat disebut ‘illah melainkan hikmah adanya doktrin idah. ‘Illah idah yang tepat berdasarkan proses al-sibr wa al-taqsîm adalah etika atau kesopanan. Etika atau kesopanan selalu relevan dengan zaman, tidak terbatas waktu, tidak terikat kondisi dan berlaku pada setiap orang. Berdasarkan ‘illah tersebut dan sesuai dengan kondisi sekarang serta melalui kajian maqâshid al-syarî‘ah dan qiyâs, idah tidak hanya masih wajib dijalani mantan istri, tetapi mantan suami pun wajib menjalaninya sebagaimana Nabi Muhammad pun menjalani idah sepeninggal Khadijah. Masa idah yang wajib ditempuh mantan suami adalah menyesuaikan dengan masa idah mantan istri. Abstract: The background of this research is found the ‘illah of idah doctrine which is not clear so far according to the Al-Qur’an and the result of experts research, so existence of idah doctrine become a question marks if related with modern technology. Therfore, the focus in this research that how ‘illah‘iddah according to the Al-Qur’an and social conditions underlying the ‘illah of ‘iddah, and also the relevance of ‘illah of idah with ushûl al-fiqh perspective. This research used ushul fiqh contextual approach. The result finding that the Al-Qur’an does not regulate the ‘illah of idah doctrine. The interpretation of experts about this doctrine does not as ‘illah but they just said the hikmah (benefit) of ‘illah. The exact of ‘iddah is related to the process of al-sibr wa al-taqsîm which is ethic or good manners. Ethic (good manners) is always relevant any period, any conditions, unlimited time and applies to any one. Based on ‘illah is relevant with right now condition and also study of maqâshid al-syarî‘ah and qiyâs, idah is not just for ex-wife but ex-husband also do this ‘iddah in same manner as the prophet Muhammad did ‘iddah after the death of Khadijah. The phase of idah for ex-husband is the same as the phase of idah for ex-wife. Kata Kunci: ‘Illah,hikmah, idah, ushûl al-fiqh.

Abstract

The main motivation of this article is to explore the trend of modern people in using of technology development in some sectors especially in government bureaucracy. The purpose of  this article is to discuss the existence and e-government law status in logical benefit. Normative study in Islamic law is done by the primary, secondary, tertiary case that can be displayed through the inductive and deductive method used by contextual approach model. Analysis data were done by the content analysis that was supported by adaptional-participational theory. E-government is a contemporer problem that can be seen in the study of laws pertaining to ritual obligations. The present of e-government is to increase the efectiveness to work in giving the best service to Indonesian people. There are some advantages that can be gotten and proved empirically by the implementation of e-government. The problems were limited the number of qualified human resources and infrastructure to support of the e-government. The government’ attention to the implementation of e-gov is very important. Therefore, significantly, e-gov is as the information publication medium, interaction, and transaction forum. These advantages could be primary, logically, and it was not in contradiction to the Islamic law. At the present, e-gov should be applied in the real life. Meanwhile, if the process and outcome of the implementation of e-gov can be found some distortion, so e-gov is a activity that is forbidden to be done.

Abstract

Majelis taklim (known as taklim assemblies or taklim council) in Central Kalimantan uses different references in conveying and discussing fiqh material. This leads to a mixture of ideologies, for example, there are indications of deception in using fiqh references. Hence, the research aimed to find out the pattern of fiqh references used by Majelis Taklim in Central Kalimantan. It used empirical legal research with a sociological juridical type and a socio-legal approach. The research showed the fiqh references used by the majelis taklim  appear with various ideologies. And, four fiqh reference patterns were found, including the tendentious, the comparative and a mixture of ideologies or non-schools of thought, the pattern with organizational ideology, and the pattern referring towards the Syafi'i school of thought. From the four characteristics, it seems that the tendentious fiqh pattern, either tarjih maqasid or malat al-af‘al, more likely leads to bringing mudharat (negative) and, even, not given benefit for Muslim community as a whole. However, in practice, there are indications of deception that may not be aware of by the public. If this tendentious pattern accepts ideological pluralism would certainly not be problematic. But, in reality, they are seen as splitting-bamboo politics with a scenario according to their interests and status to promote their ideology. Also, it needs to highlight the comparison of fiqh and a mixture of ideologies or non-schools of thought. It is believed that this pattern has its benefits. On the other hand, people who are less well prepared on az-zari‘ah, will deal with their problems, which may lead to ideological chaos.

Abstract

This paper aims to examine the conflict of authority between the alternative and the cumulative conditions stipulated in Law Number 1 of 1974 concerning Marriage, especially under the polygyny permit section. In this normative study, the problem is focused on the alternative conditions that determine the cumulative conditions and the analysis took into account the critical legal studies and adz-Dzari’ah theories, revealing that the alternative conditions are not appropriate to be determinant that allows polygyny to take place. Instead, these conditions are supposed to be additional or optional. Conversely, the more appropriate condition as the polygyny permit determinant is cumulative. Similarly, in the analysis of the adz-Dzari’ah theory, when the alternative condition is the determinant, it will bring harm instead, meaning that it is included in the category sadd adz-Dzari’ah (prohibited or even forbidden). It is advisable to make the cumulative conditions the determinant of polygyny permits because it carries more benefits that allow for easier polygyny as it is included in the category fath adz-Dzari'ah. If there are requirements, they are still within reasonable limits that can be pursued. In addition, polygynous marriage can be performed before the Marriage Registrar witnessed by the first wife.

Abstract

This research endeavors to explore the contextual shifts in Hamka’s perspectives on hisab-ru’yah and his methodological approach to legal reasoning. It adopts a normative legal research methodology with a conceptual framework. Primary legal sources are drawn from Hamka’s book “Saya kembali ke Ru’yah”. These sources are scrutinized through the lenses of uṣūl al-fiqh and the sociology of knowledge. The findings of this study indicate that the transformation in Hamka’s thinking stemmed from profound childhood experiences and culminated in a notable enlightenment during his participation in the International Islamic Conference in Malaysia. Ultimately, his stance evolved dramatically, concluding unequivocal support for the practice of ru’yah (moon sighting). Furthermore, there are also figures within Muhammadiyah who endorse both ru’yah and istikmāl (completing the lunar month if the moon is not sighted). This support has fortified Hamka despite facing considerable criticism. From the perspective of uṣūl al-fiqh (principles of Islamic jurisprudence), Hamka’s shift in legal reasoning appears primarily theoretical, although he does not explicitly delineate the specific theory involved. This can be inferred from his interpretation of the hadith of ru’yah in alignment with the principles of manṭūq (explicit meaning) or dilālah al-‘ibārah (indicative meaning). In expressing his views, Hamka incorporates the opinions of scholars, indicating his reliance on the qaulī method. His personal joy during fasting and holiday celebrations concurrently reflects his alignment with the maṣlaḥah theory, enhancing unity and cohesion. However, this unity can only be fully realized under government regulation as the ūlīl amr (ruler), particularly concerning the outcomes of ru’yah and istikmāl. Such submission, beyond mere compliance, also falls within the realm of maṣlaḥah al-mu’tabarah (considered public interest). This research underscores the necessity of approaching legal provisions from multiple perspectives, rather than a singular viewpoint, to achieve the intended legal spirit and realize genuine benefits. Hamka’s methodology exemplifies him as a contextual integrative Muslim.

Abstract

AbstractIntroduction to The Problem: The waqf land disputes which occurred on Jl. Keranggan, Palangka Raya City with an area of 580,000 m2 occurred because of the inter-Nazhir case, where the old Nazhir brought the certificate of the donated land so that the new Nazhir could not carry out his duties optimally. Therefore, this study aims to determine and analyze the role of Nazhir in overseeing the settlement of waqf land disputes on Jl. Keranggan, Palangka Raya City.Design/Methodology/Approach: This field research used qualitative methods. There are 1 nazhir subjects and 2 informant. The data were collected through observations, interviews, and documentation. It applied source triangulation for data validation. The data analysis covered data collection, reduction, display, and concluding drawing.Findings: The result of this study is that the role of nazhir in over seeing the settlement of waqf land disputes has been role in carrying out their duties and obligations to care for and maintain the ridht to the waqf land, because the nazhir is the person who is responsible for maintain the rights to the waqf land, because the nazhir is the one who is responsible for the waqf land.Paper Type: Research Article or General ReviewKeywords: Dispute settlement, roles of nazhir

Abstract

Koroketon Beti is a customary gift that a prospective groom is obligated to give to his bride-to-be, equivalent to the Islamic concept of a dowry. The Regulations of Dayak Siang Murung Customary Law in Murung Raya Regency stipulate in Article III that Koroketon Beti can be fulfilled through a monetary payment. This research aims to investigate the shift from the traditional requirement of providing specific goods to the current practice of monetary fulfillment in this customary law. This study employs a normative legal research approach, focusing on the inventory of Dayak Siang customary law and Islamic law in Tanah Siang District, Murung Raya Regency, Central Kalimantan Province. The research findings indicate that the provision of Koroketon Beti in customary marriages is a mandatory requirement and a sign of respect from the prospective groom to the bride. This shift reflects the inevitable dynamics of culture, which must be managed wisely to preserve traditional values in modern life. Textually, Islamic law does not mandate the provision of Koroketon Beti; instead, it requires a dowry. However, the practice of providing Koroketon Beti is permissible as it does not contradict Islamic law and has been a long-standing custom.

Abstract

This study discusses the tendency of the Muara Teweh Muslim Dayak community, who prefers bapalas in resolving fighting disputes over other legal remedies. Bapalas is a traditional dispute resolution of fights with the help of mantir and community leaders and is attended by the families of both parties. In the Dayak community, there are various bapalas, such as midwives bapalas, marriages bapalas, births bapalas, death bapalas, and fights bapalas. This research focuses on studying the fight bapalas as an alternative dispute resolution for fights in the community. Fighting is part of criminal law, usually resolved through litigation by repressive settlements. However, it is different in the Muslim Dayak community in Muara Teweh. They prefer to settle the dispute through this bapalas tradition. The research was conducted using empirical legal research methods using an Islamic law approach. The theory used is the theory of ‘urf and the concept of iṣlāḥ in Islam. The study result indicates that the Muslim Dayak community in Muara Teweh prefers this settlement because, first, it has become customary law that has been passed for generations. Second, bapalas minimize the grudges between the conflicting parties. Third, compared to other resolutions, primarily through litigation, bapalas are much easier dan more effective in resolving conflicts, especially in terms of time. This dispute resolution model aligns with Islamic law according to 'urf and the concept of Islam.‘Urf can be a source of law as long as it does not conflict with sharia and is in line with the sadd al-żarī‘ah method, which means if the customs in society can prevent or block the harm, then it is allowed. It is also in line with the concept of iṣlāḥ that bapalas is a conflict resolution method that can eliminate and stop hostility and conflict between humans.

Abstract

Tulisan ini ingin mengkaji dan menyajikan penggunaan maqashid al-shari‘ah sebagai alat analisis yang metodis sebagai bahan/alat analisis dalam sebuah karya ilmiah. Banyaknya orang-orang yang menggunakan metode maqashid al-shari‘ah sebagai alat analisis tidak mengetahui bahwa dalam menggunakan metode tersebut ada beberapa tahapan yang perlu dilakukan sebelum menggunakan metode maqashid al-shari‘ah sebagai alat analisis. Metode penulisan ini merupakan penulisan library research di mana unsur-unsur metode maqashid al-shari‘ah sebagai bahan analisis dalam penulisan akademis. Hal ini tentu harus dilihat dari beberapa literatur penggunaan metoe maqashid al-shari‘ah dalam memberikan arahan bagi orang-orang dalam menggunakan metode tersebut perlu adanya sistematika dalam penggunakannya sebagai alat analisis
