Abstract

This study aims to conduct a study and analysis of the substance of Law Number 2 of 2012 concerning Land Acquisition for Development for Public Interest, in order to ascertain whether the law has met the basic values of the law, so that it can be seen to what extent its validity is valid from philosophical, juridical, and sociological reviews. This research is a normative or doctrinal legal research, using a statute approach, while the type of data is secondary, obtained from document review and literature study of primary, secondary and tertiary legal materials. The analysis technique uses an interactive model. The results of this study indicate that the land acquisition legal system or Law Number 2 of 2012 has validity from a juridical review, but does not have validity from a philosophical review and from a sociological review. Based on the results of the above research, it is recommended that the Government immediately revise Law Number 2 of 2012. Key words: validity, land acquisition, fair

Abstract

Various forms bulying is stiii happening to Indonesian children now, although it has been rules of law and supported by international convention which related with child protection. The extence the rules of law and that convention can't be delayed the existence of child buiying. The form of child bulying which the bumpiest are rapping physical and psychological violence which hamper the growth of child as an adult. Abstract

AbstractThe requirements of intention to create legal relation in an agreement have been a long debate between states both in common law and civil law countries. The absence of legal rules regarding guaranteed stock makes the guaranteed stock agreement a source of legal implementation in the UK. This article purposes to know the importance of the “intention” in guaranteed stock agreement to be applied in Indonesia. This is a normative legal research using comparative approach which compares the concept of intention in a guaranteed stock agreement in the UK with the concept of intention based on Indonesian contract law. Abstract

The purpose of this research is to analyze the responsibility of a notary and the legal consequences for a limited liability company that a foundation has established but violates the law on foundations. The research was conducted using doctrinal legal research methods. The results of the study show that: (1) Notaries as officials who are authorized in terms of doing authentic deeds, including the deed of establishment of limited liability companies established by foundations, have a great responsibility insofar as they concern the formal requirements of authenticating the deed. However, the notary is not responsible for the substance of the deed because it is the will of the parties themselves, so if what is violated is the formal terms of the deed, the notary can be sued for compensation and fines. (2) The legal consequence for the limited liability company is that it violates Article 7 of the Law on Foundations. It is null and void because the deed of an establishment violates the objective requirements of the legal terms of an agreement regulated in Article 1320 of the Civil Code. In addition, the legal status of a Limited Liability Company has been deemed to have never existed, causing all actions that have been carried out or carried out by the organs of the company to have no legal standing.

Abstract

This study discusses the law of transporting goods at sea by using a document of charge called Bill of Lading known in common law system is from the 16th century. The research is taken based on the empirical type by showing evidence obtained from the field then analyzed based on bibliography and theory which exists. The result of the research is that each of the international regulations studied does not describe explicitly what the rights and obligations of exporters and importers. However, the B/L contract on the back describes the rights and obligations of exporters and importers as "merchants". Then the results of research that Efficiency is achieved by reason if B/L has been published, No weight miscommunication, Parties abide by applicable legislation, Not falsely signing, Storing B/L in a safe place so as not to disappear, Consistent premises B/L not to be amended, Exporters researching weight standards of goods to be shipped according to ship type, Exporters studying freight forwarding companies in order to manage customs clearance, Selecting the right insurance company to be trusted, Paying attention to the cost of deviation for the benefit of shipping For carrier, Use safe payment method to avoid any more cost when transaction insecurity, Use Surrender B/L model to avoid loading time at loading and unloading ports, Checking documentation of payload including B/L whether complete or not to avoid arrest goods in Customs area, Conduct a container inspection to avoid leakage, and Prevent assignment to less competent workforce to handle cargo documents.

Abstract

This article aims to describe the relevance of the protection of intellectual property rights (IPR) in the perspective of the theory of economic analysis of law. The approach used is a historical approach (historical approach) using primary legal materials and secondary legal materials. The data collection technique used is the literature study technique. Based on the research results, it can be concluded that so far the focus of traditional economic analysts has only highlighted that inventors or holders of exclusive IPR are entitled to incentives or rewards for their findings. Apart from that, giving incentives is also to encourage people to make discoveries that are beneficial to human life. However, they did not highlight the high cost of accessing or using their findings. Even the cost of accessing IP exceeds the cost of the production margin of IP itself. In the perspective of the theory of economic analysis of law, the condition of unbalanced margins can cause injustice.
