Abstract

Purpose of the study:This study aims to analyze the legal politics of Pancasila as an ideology to eradicate radicalism in Indonesia.Methodology:The method employed in this study is a normative legal method using statutory, conceptual, and case approaches.Results:This study found that the fundamental problem in preventing radicalism within the framework of a rule of law is the inability to comprehend (ground) the basic values of ideology and the state constitution in a complete manner (kaffah) to manage and maintain the Unitary State of the Republic of Indonesia. The isolation and divides that negate the constitutional foundation and the ideal foundation in managing and maintaining the dignity of the nation's and state's sovereignty are another form of error in guiding the steps on the journey of the nation and the Indonesian State to the gate of bankruptcy as a sovereign nation and state. Applications of this study:This research can be used by academics and practitioners in philosophical of law so that they can create an instrument to strengthen Pancasila as an ideology to combat radicalism. Novelty/Originality of this study:Legislation may not immediately have an impact on changes and habits of people's behavior. Society does not abide by the law as autonomous individuals because principally, they are all social creatures. The social structure of a living society, called semi-autonomous social fields (SASF), gives rise to external regulations (national law) that are examined and interpreted. Therefore, the result of the encounter (clash) of internal rules with external rules in society is the formulation of strategic objectives of society that are constrasting with those originally intended by legislators.

Abstract

The existence of Baduy community in Lebak Regency is classified into 3 (three) groups, namely: a. Inner Baduy (Urang Kanekes); b. Outer Baduy (Urang Panamping); c. Baduy Dangka. In general, it can be described that the first group called the Baduy Dalam (Urang Kanekes) community is a society that obeys the entire rules or rules set by Pu'un (Kepala Adat). Baduy Dalam community lives in 3 (three) villages of Cibeo, Cikartawana, and Cikeusik. Related to the custom law in Baduy Dalam, for its adherents there is the enforcement of customary law, that is with the enforcement of customary criminal law for the offenders are subject to strict sanctions.One is the customary criminal society Baduy Dalam which provides social crime penalties for the community Banduy In violation of customary law. Philosophically Social work penalty is in harmony with the fifth principle of Pancasila, which is social justice for all the people of Indonesia, in which the value of hard work is included. In carrying out the social work crime, the convicted person is required to work hard in serving the crime. Social work crime is the "indigenous culture" of the Indonesian nation, because in Indonesian customary law is not known criminal deprivation of independence, namely imprisonment and imprisonment. The conformity of values adopted by the Indonesian nation with the values of social work crime is a driving force in the successful implementation of social work crime.

Abstract

The problem of juridical the award judge number: 56 / Pid / 2010 / PT.SBY, has not followed the legal formal in KUHAP as article; 183, 184, 185,186, 187, 191, 192, 194, 195, 196, 197, 199, 200, 202. The award the judge also could not prove a whole elements of a mistake. Judge only prove a small portion of element of the mistakes made by the defendant. The problem of sociological the award judge number: 56 / Pid / 2010 / PT.SBY, not capable of being description assurance of fairness and expediency. The award judge only description a form of unprofessional judge cutting off. The award judge only prove mistrust construction think of judge in understanding the iniquity of the defendant, therefore the award the judge was not salutary.

Abstract

Kegiatan pengabdian masyarakat yang bertemakan Pendidikan Kewirausahaan (Entrepreneurship) ini bertujuan untuk menciptakan wirausaha baru mandiri yang berbasis ipteks. Pemilihan tema dalam kegiatan pengabdian ini didasarkan pada kondisi faktual di masyarakat pada saat ini yang, menunjukkan angkatan kerja sangat tinggi yang tidak diimbangi dengan jumlah lapangan kerja sehingga berakibat pada tingginya angka pengangguran. Permasalahan yang dihadapi mitra sebagai Sekolah Menengah Kejuruan Muhammadiyah 2 Malang (SMK Muhammadiyah 2 Malang) adalah terbatasnya kegiatan diluar kurikulum yang menunjang wirausaha siswa, dan minimnya pengetahuan dan ketrampilan siswa mengenai seluk beluk wirausaha. Sehingga hal ini berakibat pada rendahnya alumni dan lulusan yang memilih wirausaha. Tujuan dari kegiatan pengabdian ini adalah untuk membentuk dan meningkatkan keterampilan wirausaha bagi peserta didik di lokasi Mitra. Target khusus yang ingin dicapai adalah terbentuknya komunitas siswa yang mandiri dan memiliki ketrampilan menjadi wirausaha mandiri. Kegiatan pengabdian ini dilaksanakan dalam bentuk seminar yang dilanjutkan dengan pelatihan dan pendampingan kewirausahaan. Mitra dalam kegiatan ini adalah SMK Muhammadiyah 2 Malang. Kegiatan diikuti oleh 110 peserta didik dan 15 orang guru dan Tenaga Kependidikan. Evaluasi dilakukan dengan pengisian kuesioner untuk mengetahui pemahaman peserta didik terkait pelaksanaan program dan juga melalui rekam hasil usaha sebelum dan setelah program pengabdian dilaksanakan. Hasil yang dicapai setelah dilaksanakannya program pengabdian ini adalah meningkatnya tingkat pemahaman dan ketrampilan peserta didik di bidang wirausaha, yang ditunjukkan dengan jumlah penjualan produk dan jasa wirausaha dilokasi mitra mengalami peningkatan.   Independent Youth Entrepreneurs As A Driving Force fot The Nation’s Economy This community service took education entrepreneurship or edupreneurship as the theme which aims to create independent entrepreneurship based on science and technology. The reason of taking this theme was on the factual condition of the rising numbers of job seekers in Indonesia comparing to the unequal stock of job vacancies which impacting on the highest numbers of jobless. Vocational school, as a formal education institution in developing students’ skills to work in their respective field, seems still focus on expanding students’ cognitive skills regardless assisting them with supplementary skills to support their competence. Hence, the team had been collaborating with one of Vocational Schools in Malang, East Java in providing entrepreneurship trainings for students in order to train them to be a skilled independent entrepreneur; besides, with some trainings and personal assistance, students were expected to create entrepreneur community at school as a school entrepreneur training center. The series of trainings materials had been participated by 110 students and 15 teachers. At the end of training series, questionnaire was given to the participants to evaluate their understanding of presented materials and identify some obstacles while developing their startup business. The results showed that some students have started their own business or collaborative business with some teachers and the presented materials had been well-implemented in expanding their business.

Abstract

Korupsi bukan saja bermakna merugikan keuangan Negara atau perekonomian Negara secara kuantitatif, korupsi merupakan perbuatan yang bertentangan dengan hak konstitusionalitas warga Negara untuk mendapatkan pekerjaan yang layak bagi kemanusiaan dan penghidupan yang layak bagi kemanusiaan. Korupsi merupakan perbuatan yang merongrong ideologi bangsa sebagai landasan dan arah keberlangsungan peradaban bangsa. Korupsi merupakan perbuatan yang dapat disejajarkan dengan bughot (pemberontakan) terhadap sendi-sendi keteraturan Negara hukum. Putusan hakim perkara korupsi merupakan hukum yang konkrit dan langsung mengikat untuk mewujudkan tujuan luhur dalam pembentukan Negara. Putusan hakim perkara korupsi menjadi risalah sejarah dalam membangun peradaban umat manusia untuk hidup sejahtera, tertib, cerdas, dan adil secara utuh. Hukum yang baik (bersumber dari nilai moralitas) dan hukum yang benar (bersumber dari nilai konstitusionalitas), harus dan wajib menjadi paradigm dalam membangun grand design hukum yang dapat mencegah dan memberantas korupsi di Indonesia. Paradigma desain putusan hakim perkara korupsi di Indonesia harus simetris dengan konsep Negara hukum yang sebenarnya. Putusan hakim perkara korupsi hakekatnya merupakan wujud Negara hukum yang mensejahterahkan rakyatnya. Putusan hakim perkara korupsi yang menjamin kepastian hukum yang adil sebagai wujud ketertiban dan keteraturan dalam tata kelola pemerintahan yang baik dan benar. Putusan hakim perkara korupsi yang menjamin kepastian hukum yang adil mempunyai kekuatan sebagai alat centripetal dan centrifugal dalam mewujudkan keadilan social bagi seluruh rakyat Indonesia.Kata Kunci : hukum, korupsi, baik, benar

Abstract

Keanekaragaman harus menjadi kekayaan dan bukan hanya sekedar beda yang satu. Tulisan ini mencoba menjelaskan problem doktrin hukum formal Negara (Konstitusi) yang mengatur tentang hubungan antara Ras (Keturunan atau Etnik) yang ada di Indonesia. Hukum tentang pengaturan Ras (Keturunan atau Etnik) di Indonesia, tidak bisa dilihat dari perspektif  baik dan buruk saja, tetapi hukum pengaturan Ras (Keturunan atau Etnik) di Indonesia harus dilihat dalam perspektif benar dan salah. Antara ketentuan satu dengan yang lainnya masih saling bertentangan yang menjadi penyebab problem konstitusional ketidakteraturan hukum yang mengatur jaminan hak dan kewajiban bagi WNI ras dan etnis China secara sejajar dengan WNI asli. Pembedaan WNI asli dan tidak asli menjadi bukti problem ketidakteraturan hukum yang menjustifikasi Rasisme di Indonesia. Hal ini mengakibatkan perbedaan perlakuan dari penyelenggara Negara terhadap WNI tidak asli dari ras dan etnis China dalam bidang sosial, budaya, agama, kependudukan dan keimigrasian.

Abstract

This article aimed to discuss the Islamic law notes on child-friendly justice and the importance of protecting children's rights during the juvenile process. The reform of Juvenile Justice in Indonesia was based on the UN convention, where on January 26, 1990, in New York, the Indonesian Government signed the 1989 Convention on the Rights of Children. Thus, to protect children through criminal law, paying attention to the principles in the Convention on the Rights of the Child has been the norm. The Child Protection Law in Indonesia has regulated the age limit for a child who can be held accountable. The existence of provisions regarding the minimum age limit for children in the law is what is required by international documents, especially regarding the minimum age of criminal responsibility, namely at least 12 years. Such provisions are parallel to The Beijing Rules, which recommend an age limit that is not too low. The problem is the provision of the law that children under 12 years (meaning between 8-12 years) can still be processed for trial and can be subject to action. Even at the age of 8 years, it is still possible to process. The problem is whether the eight-year age limit needs to be higher. Even though they were not punished and were only subject to action, the experience during the process of being submitted to trial did not bring stigma and negative impacts for children of young age. Abstract

This article aimed to explain the ontology morality of corruption law in Indonesia from an Islamic value. The meaning of justice in the study of law contains the value of goodness and truth. The value of goodness has a home in the realm of 'taste,' which provides a foundation and direction towards the spirit of conscience. Philosophically, it must be done fundamentally, deeply, and thoroughly to the meanings of god's attributes in essence (ontology). The philosophical approach is one of the options for this article, besides the concept approach and doctrine (epistemology). Although realized, there is a firm limit to rational ability in providing the meanings of justice, certainty, and usefulness of the law. Limited ability shows 'dwarfity' and rational superiority under 'breadth' divine values and attributes. The ontology of legal morality in a country can be explored from its ideology, which is the source of basic values that guide the direction of the purpose of the establishment of a country. The constitution became a method to justify the realization of one's country's purpose. State ideology became the rail of formation, change, revocation, and enforcement of its laws. As a result, the goal of this analysis is to show how these religious beliefs strengthen legal frameworks, ensuring that corruption is viewed not only as a legal infringement but also as a serious moral breach that undermines society's well-being. To summarize, integrating Islamic moral concepts with corruption law increases the ethical foundations of legal systems, fostering both legal deterrence and moral accountability in governance.
