Abstract

This study aims to analyze the Islamic family law practices related to polygamy in the social, cultural, and legal context of Indonesia. The research method used is literature analysis and case studies to understand the implementation of polygamous practices and their impact on individuals, families, and society. The results show that polygamy in Islamic family law has complex implications. Although allowed in Islam, polygamy often causes controversy and conflict in contemporary society. The negative impacts of polygamous practices include injustice towards women and children, tension in family relationships, and complexity in inheritance arrangements and parental responsibilities. However, some views see polygamy as a solution to specific social problems, such as gender balance and protection for women without partners, as indicated by BPS data showing fewer men compared to women aged 60 and above, suggesting that men who wish to practice polygamy should marry older women. The analysis of Islamic family law practices related to polygamy emphasizes the need for a balance between understanding religious teachings, universal humanitarian values, and local socio-cultural contexts. This research underscores the importance of regulating polygamous practices within a fair legal framework that protects the rights of all parties involved to minimize negative impacts and maximize the social benefits of such practices.

Abstract

Konsep Sakinah menurut Sayyid Sabiq ialah bahwa dengan menikah yang dianjurkan oleh islam, demi kelangsungan hidupnya manusia melakukan yang ada dalam dirinya yaitu berupa fitrah. Keluarga sakinah adalah harapan setiap pasangan setelah pernikahan, butuh dipersiapkan sejak pasangan pengantin ingin melaksanakan pernikahan. Selain itu juga, dalam pernikahan perempuan terjaga dari laki-laki yang bernafsu pada dirinya. Dengan membentuk pernikahan juga terdapat kasih sayangnya seseorang ayah dan ibu, maka dari itu kedua orang tua mengajarkan anak-anaknya dengan baik. Allah swt meridhoi pernikahan seperti inilah dan diimpikan oleh setiap orang beriman hingga dapat mewujudkan keluarga yang sakinah, mawaddah dan warahmah. Hal-hal yang harus dipersiapkan dari sebagian kecil dalam pernikahan untuk menuju keluarga sakinah seperti, pasangan pengantin memiliki pemikiran yang matang untuk menikah, baik secara fisik dan mental, memahami hak dan kewajiban antara suami dan istri, memiliki ekonomi yang mencukupi, dan memahami pentingnya rumah tangga sakinah dan masalah-masalah yang akan dilewati setelah pernikahan. Cara dalam memilih pendampimg hidup yaitu: (1) Memiliki lingkungan yang baik, (2) Istri yang dapat memperoleh anak, (3) Mendapatkan ketenangan ketika memandangnya, (4) Perawan lebih diutamakan, dan (5) menikahi yang seimbang dengan dirinya. Mengaja keharmonisan dalam berumah tangga yaitu: hak dan kewajiban antara suami istri dan bersama-sama.

Abstract

This study comprehensively evaluates the implementation of governance in Sharia cooperatives in Indonesia, focusing on decision-making, transparency, and justice. In the context of rapid economic growth, Sharia cooperatives are expected to be an alternative financial pillar, adhering to Sharia principles and promoting economic justice and sustainability. However, previous research has identified several obstacles, including a lack of transparency, low member participation, challenges in implementing Sharia principles, and structural issues. In-depth literature reviews, such as those by Wahyudin et al. (2022) and Nurhidayati (2018), cover the dimensions of Sharia cooperative governance, highlighting crucial factors affecting governance quality. This study employs a descriptive analytical method, collecting data from literature, official documents, and recent publications. The analysis indicates that many Sharia cooperatives have not fully implemented effective governance, requiring improvements in transparency, member participation, Sharia principle application, and structural enhancements. The conclusion emphasizes the urgency of improving the quality of Sharia cooperative governance to effectively contribute to sustainable and inclusive economic development in Indonesia. The implications of this research involve recommendations for enhancing Sharia cooperative governance, providing valuable guidance for stakeholders, and enriching scholarly literature in the fields of cooperatives and Sharia economics.

Abstract

Penelitian ini mengeksplorasi tren penelitian ekonomi Islam melalui kajian sistematik literatur untuk memahami kontribusi dan perkembangan di bidang ini dalam konteks pembangunan berkelanjutan dan inklusif. Tren penelitian ekonomi Islam telah menunjukkan peningkatan signifikan dalam beberapa tahun terakhir, terutama dengan memperhatikan dinamika ekonomi global yang terus berkembang. Berbagai studi menunjukkan bahwa sistem ekonomi Islam memiliki potensi besar dalam mendukung pembangunan berkelanjutan dan inklusif di berbagai negara, terutama negara-negara mayoritas Muslim. Penelitian ini menggunakan pendekatan kualitatif dengan metode kajian literatur untuk mengumpulkan, mengidentifikasi, dan menganalisis berbagai temuan dari penelitian terdahulu. Data yang digunakan berasal dari artikel-artikel ilmiah yang diterbitkan dalam jurnal bereputasi antara tahun 2020 hingga 2024. Analisis bibliometrik menggunakan VOSviewer menunjukkan adanya tiga klaster utama dalam penelitian ekonomi Islam yang mencakup topik-topik seperti keuangan Islam, perbankan Islam, dan metodologi desain dalam keuangan Islam. Penelitian ini menemukan bahwa jumlah artikel dan sitasi terkait ekonomi Islam yang terindeks di Scopus mengalami fluktuasi dengan puncak artikel pada tahun 2018 dan 2021 serta puncak sitasi pada tahun 2018. Geografis, penelitian ini menunjukkan bahwa negaranegara seperti Amerika Serikat, Malaysia, Inggris, dan Indonesia merupakan kontributor utama dalam penelitian ekonomi Islam. Kesimpulan penelitian ini menunjukkan bahwa sistem ekonomi Islam memiliki potensi besar untuk mendukung pembangunan berkelanjutan dan inklusif, namun diperlukan penelitian lebih lanjut untuk mengatasi tantangan dan memperluas penerapannya dalam konteks ekonomi modern.

Abstract

This study examines the key factors that motivate young Indonesian women to engage in entrepreneurship, a field increasingly realized for its contribution to economic development and gender empowerment. In the face of ongoing unemployment and restricted access to traditional work, entrepreneurship is a feasible option, particularly for women aspiring for autonomy and economic contribution. This study investigates three primary variables—self-independence, economic status, and financial literacy—to analyze their individual and collective impacts on entrepreneurial drive among women aged 18–35 who had operated enterprises for a minimum of two years. Using a quantitative approach with multiple regression analysis, data were gathered from 107 respondents across 16 regions in Indonesia via structured questionnaires. The results show that these three factors have a big effect on young women's choices to start their own businesses, either on their own or at the same time. Self-independence, in particular, stands up as a key motivator. This shows a desire for personal freedom and a flexible work-life balance. Economic pressures and the capacity to utilize financial acumen also play a substantial role. The study adds to the field of research by giving real-world examples from Indonesia, where traditional gender roles still exist but are being challenged more and more by entrepreneurial activities. These results show how important it is to make regulations and initiatives that assist women become better entrepreneurs, learn about money, and get resources so that the economy is more open and long-lasting.

Abstract

This study explores the social actions of lecturers and students at PTIQ University Jakarta in responding to media news regarding the Hajj Financial Management Agency (BPKH). Using Weber's social action theory, the research emphasizes understanding the meaning behind individual actions, especially in media reception. Through interviews, focus group discussions (FGDs), and online engagement, the study identifies how Muslim audiences act critically and reflectively to verify, disseminate, and promote accurate information. Their efforts aim to counter public distrust and maintain institutional integrity. The findings highlight the role of Muslim social agents in shaping public discourse through ethical and constructive engagement with media. This phenomenon reflects a spiritual and value-driven orientation rooted in Islamic sociology, where social action is rational and guided by religious accountability. The study contributes to social action theory by integrating Islamic perspectives, emphasizing that social behavior in Muslim societies often reflects both worldly reasoning and ukhrāwī (afterlife) considerations.

Abstract

This research aims to discuss democratic values and democratic interactions in customary law in Wajo Regency. This research uses a qualitative approach with normative juridical methods as stated in the constitution of the Republic of Indonesia. The results and discussion of this research show that democratic values cannot be separated from positive law, including customary law. As part of the Unitary State of the Republic of Indonesia, Wajo Regency also applies democratic values both in leadership in the district area and in customary areas. This can also be seen in the realization of the protection of people's constitutional rights in the field of customary law. This research tries to conclude that in Wajo Regency, the government of the Republic of Indonesia guarantees constitutional rights which originate from basic norms such as democratic values which are also implemented in local customary law. This research recommends that healthy democracy can occur in Wajo Regency regardless of collaboration between government and community elements.Keywords: Democracy; Customary Law; Wajo RegencyAbstrakPenelitian ini bertujuan untuk membahas nilai-nilai demokrasi dan interaksi demokrasi dalam hukum adat di Kabupaten Wajo. Penelitian ini menggunakan pendekatan kualitatif dengan metode yuridis normatif yang tertera dalam konstitusi Negara Republik Indonesia. Hasil dan pembahasan penelitian ini menunjukan bahwa nilai demokrasi tidak dapat dipisahkan dari hukum positif termasuk juga hukum adat. Sebagai bagian dari Negara Kesatuan Republik Indonesia, Kabupaten Wajo juga menerapkan nilai-nilai demokrasi baik dalam kepemimpinan di wilayah kabupaten dan juga di wilayah adat. Hal ini juga dapat dilihat dalam perwujudan perlindungan hak-hak konstitusional masyarakat di bidang hukum adat. Penelitian ini mencoba menyimpulkan bahwa di Kabupaten Wajo, pemerintah Republik Indonesia menjamin hak konstitusi yang bersumber dari norma-norma dasar seperti nilai-nilai demokrasi juga diterapkan dalam hukum adat setempat. Penelitian ini merekomendasikan agar terjadi demokrasi yang sehat di Kabupaten Wajo terlepas dari kolaborasi elemen pemerintah maupun masyarakat.Kata Kunci: Demokrasi; Hukum Adat; Kabupaten Wajo

Abstract

The swift advancement of the sharing economy has introduced novel issues in company regulation and equity, particularly in a Muslim-majority nation such as Indonesia. The Qur'an establishes a framework of principles, including justice, transparency, and cooperation, pertinent to contemporary business activities. This study aims to uncover legal concepts in the Qur'an applicable to the sharing economy and to explore how Indonesian rules may be modified to accord with these principles. The employed study methodology is qualitative, incorporating a literature review that utilises primary sources from the Qur'an and Islamic law, alongside a normative legal framework to examine legislation pertinent to the sharing economy sector in Indonesia. The study's findings suggest that adopting the sharing economy business model aligns with Qur'anic principles, including equitable profit distribution, the prevention of exploitation and uncertainty (gharar), and the significance of accountability and responsibility in commerce. In summary, implementing legal principles derived from the Qur'anic perspective can facilitate the establishment of equitable and transparent regulations that promote the development of the sharing economy while fostering social welfare and confidence among business entities and consumers. This study underscores the necessity of aligning contemporary rules with sharia principles to establish a just, sustainable, and Qur'anic business environment.

Abstract

Role of Ethics Qur’anic toward Islamic Economic Sistem. In the discourse of conventional economics, ethics in economic activity does not have an important role in his studies even denied. This view is based sphere of ethics that is different from the economic sphere. Ethics is more inclined to religious values are just talking about good-bad and the world hereafter. While the economy discussing with the sistem and the material welfare. In contrast to conventional economics, Islamic economics is the view that ethics plays a role in the economic activity, even ethics and economics can’t be separated. Abstract

This study examines the transition from the Indonesian Financial Accounting Standard (PSAK) 109 to PSAK 409 in the context of zakat management in Indonesia. The change in standards reflects the Sharia Accounting Standards Board's (DSAS) efforts to enhance the relevance, reliability, and transparency of financial reporting by zakat management institutions. PSAK 409 introduces a more comprehensive approach to the recognition, measurement, presentation, and disclosure of zakat funds, emphasizing accountability and compliance with Sharia principles. This research adopts a qualitative approach through literature review and in-depth interviews with zakat managers and Islamic accounting practitioners. The findings indicate that the implementation of PSAK 409 has the potential to improve transparency and public trust in zakat institutions, although it faces challenges such as technical readiness, understanding of the new standards, and the need for training among stakeholders. Furthermore, PSAK 409 is seen as aligning zakat reporting with principles of good governance and Sharia integrity, thus supporting the strengthening of the Islamic economic system in Indonesia. The study recommends intensified socialization and training on PSAK 409, as well as collaboration among regulators, academics, and zakat institutions to ensure an effective and sustainable transition.
