Abstract

Perjanjian kerjasama untuk pembelian unit rumah dengan skema KPR sangat dibutuhkan masyarakat karena harga rumah yang tinggi untuk itu dilakukanlah Kerjasama untuk penjualan unit rumah dari developer kepada bank dan kerjasama dengan bank memberikan fasilitas modal kerja konstruksi kepada pengembang . Penelitian dengan pendekatan yuridis normatif yang bersifat deskriptif dimulai dari bentuk kerjasama mengenai penjualan unit rumah, KPR, peranan notaris dalam proses kerjasama antara pengembang dan bank. Tujuan penulisan ini adalah pengembangan ilmu hukum dalam bidang Hukum Kenotariatan yang berkaitan dengan perjanjian antara para pihak ,bentuk kerjasama dan peranan notaris sebagai pejabat umum dalam penyaluran kredit KPR.

Abstract

Bank syariah memainkan peran penting dalam sistem keuangan Indonesia dengan menawarkan alternatif yang bebas dari praktik riba dan unsur yang dilarang dalam Islam. Penelitan ini berfokus pada konsep dan penerapan Akad Pembiayaan Murabahah di PT Bank Syariah X Tbk serta peran Notaris dalam pelaksanaannya. Akad Pembiayaan Murabahah sebagai salah satu bentuk pembiayaan pada perbankan syariah yang berbasis jual-beli, yang mana memungkinkan bank untuk memberikan fasilitas kepada nasabah dengan memberitahukan harga serta keuntungan secara jelas. Dalam penelitian ini, pendekatan normatif  digunakan dengan analisis kualitatif terhadap data sekunder. Hasil dari penelitian ini adalah bahwa Akad Pembiayaan Murabahah adalah salah satu akad yang paling sering digunakan pada PT Bank Syariah X Tbk. Akad Pembiayaan Murabahah banyak digunakan untuk pembiayaan yang bersifat konsumtif. Dalam Akad Pembiayaan Murabahah, Notaris berperan penting dalam memastikan legalitas akad dengan melalui pembuatan akta autentik yang bentuknya sesuai dengan ketentuan perundang-undangan yang berlaku dengan tetap memperhatikan prinsip-prinsip syariah.

Abstract

Penerbitan obligasi lama tahun 1950 merupakan langkah pemerintah dalam mengatasi defisit keuangan negara yang tidak stabil di awal kemerdekaan Indonesia. Pastisipasi besar masyarakat dalam membangun kembali bangsa pasca kemerdekaan tercermin dari terjualnya seluruh obligasi lama 1950 yang keseluruhannya bernilai Rp. 1.000.000.000 (1 miliar rupiah). Ketentuan pembayaran obligasi oleh pemerintah kepada pemegang obligasi lama paling lambat 40 tahun sejak obligasi tersebut terjual dengan ketentuan sebesar bunga 3 % setiap tahunnya. Akan tetapi pada tahun 1978 pemerintah mengeluarkan surat edaran terkait pembayaran kembali obligasi lama dengan ketentuan dinyatakan daluwarsa apabila paling lambat 5 tahun sejak pengumuman tersebut dikeluarkan pemegang obligasi lama 1950 tidak menggunakan hak tagihnya. Kenyataannya sejak tahun 1983 obligasi lama 1950 dinyatakan kadaluwarsa, hingga kini tecatat kurang lebih 220 pemegang obligasi atau ahli warisnya mengajukan upaya mendapatkan Kembali pembayaran piutangnya. Salah satunya dengan adanya Putusan Pengadilan Tinggi Padang Nomor 216/Pdt/2022/Pt Pdg yang memutus bahwa pemerintah berkewajiban melakukan pelunasan utangnya sejumlah Rp.66.000.000.000 (enam puluh enam miliar rupiah) setelah dikonversi dengan emas dan ditambahkan bunga 3 % setiap tahunnya. Penelitian ini dilakukan secara doktrinal dengan analisis data secara kualitatif serta pengolahan data berdasarkan pemahaman peneliti terhadap data yang diperoleh dan selanjutnya dinarasikan untuk memperoleh simpulan penelitian. Hasil Penelitian diperoleh bahwa hubungan hukum yang terbentuk pemerintah sebagai penerbit obligasi lama yang bertindak sebagai debitur dengan pemegang obligasi lama yang bertindak sebagai kreditur didasarkan pada Undang- Undang Nomor 13 Tahun 1950 Tentang Pinjaman Darurat. Masa berlaku hak tagih bagi obligasi lama 1950 tersebut secara jelas telah diatur bahwa pelunasan kembali akan dilakukan paling lambat 40 tahun. Akan tetapi dikarenakan adanya percepatan pembayaran pada tahun 1978 sebagaimana Keputusan Menteri Keuangan KMK 466a/1978 dengan masa tunggu 5 (lima) tahun sejak keputusan tersebut dikeluarkan sebelum dinyatakan daluawarsa.hal ini selaras dengan UU perbendaharaan negara sebagai lex spesialis mengenai daluwarsa ditentukan selama 5 tahun untuk menggunakan hak tagihnya.

Abstract

It is important to be careful when the directors assign the authority of substitution to someone else who will represent the company. The Directors shall set down in the Power of Attorney in specific and definite terms the scope of the legal activities authorized by the Power of Attorney. This does not, however, exclude the chance that the person who received the power of attorney might abuse that authority and cause damages for the agent of that power of attorney. In the Decision of the Supreme Court Number 4575 K/PDT/2022, the notary, who was the party who made the deed of power of attorney for the directors, bears responsibility for the legal ramifications of a forged directors' power of attorney on credit that has been disbursed. A normative-juridical research methodology with a case study approach was utilized to examine Supreme Court Decision Number 4575 K/PDT/2022. According to the study's findings, the credit agreement remained legally enforceable for the parties even though the power of attorney for directors was declared illegal because it failed to satisfy the subjective criteria for agreement validity. Therefore, even though the notary who created the forged power of attorney is not criminally liable, he is nonetheless held civilly liable for any losses brought on by the forged document.

Abstract

The emergence of digital and virtual assets has created new challenges for tax authorities, as taxpayers now possess not only traditional but also digital assets that can be accessed globally through the internet. This unconventional form of asset ownership raises questions about how tax authorities can effectively confiscate and liquidate crypto-assets to resolve tax liabilities. The lack of these mechanisms complicates tax administration and criminal law enforcement in the digital era. This study aims to examine the possibility of confiscating digital and virtual assets for tax purposes within Indonesia’s asset recovery framework. Using a comparative law approach, this article analyzes the potential use of crypto-asset confiscation for the settlement of tax arrears by referencing the latest European Union regulations on asset recovery and confiscation, particularly the Directive (EU) 2024/1260 of the European Parliament and Council on asset recovery and confiscation. The analysis shows that Indonesia currently lacks a system that enables the confiscation and recovery of digital assets for tax enforcement. Considering the shared civil law foundations and similar challenges faced by EU countries, the EU’s model provides a relevant reference point. Indonesia should consider adopting the European Union’s methodology for seizing and recovering digital assets to enhance its legal framework. Implementing the asset recovery and confiscation mechanisms established under Directive (EU) 2024/1260 could serve as a paradigm for Indonesia to efficiently confiscate taxpayers’ assets and strengthen tax compliance in the digital economy.

Abstract

Credit is a fundamental function of banks, playing a vital role in fund distribution and economic stimulation, as regulated by the latest Banking Law. Credit is defined as the provision of money or equivalent claims based on a loan agreement, with an obligation to repay with interest. Legal protection for creditors, especially in the execution of collateral, is essential for ensuring fairness and transparency. Execution, though not explicitly defined in Indonesian law, is understood as the implementation of a court decision or the sale of seized property. Property rights, encompassing both collateral rights and enjoyment rights, are central to banking practices for securing debt. Collateral, often in the form of mortgage rights over land, provides a legal guarantee for creditors. While collateral does not transfer ownership, it ensures that creditors' claims are protected in cases of debtor default. Collateral involving property encumbered with mortgage rights is prioritized in protecting banks' interests in credit facilities due to the high economic value of land, which generally appreciates annually. According to Article 4 of Law No. 4 of 1996 on Mortgage Rights Over Land and Land-Related Objects, the types of land rights that can be encumbered with a mortgage include ownership rights, cultivation rights, and building rights. The mortgage holder acts as a preferential creditor with superior rights compared to concurrent creditors (droit de préférence).

Abstract

Notary as a public official, is an honorary position that is given the trust to make authentic deeds as written evidence, as mandated by laws and regulations. As part of the people, it is possible for a notary to take part in political practices by running for the legislature. The Notary Position Law and the General Election Law prohibit the practice of dual positions. Therefore, notaries who are appointed as legislative members are required to take leave in accordance with the provisions of the Notary Position Law. However, the implementation of the position carried out by the substitute notary can be indicated as a disguised dual position. Thus, the idea of entrusting the notarial appointment decree to the Regional Supervisory Council during his/her tenure as a legislator was proposed.

Abstract

Banks are business entities that collect funds from the public in the form of credit or other forms in order to improve the standard of living of many people. Based on the Banking Law, credit is "the provision of money or similar bills based on a loan agreement (lending and borrowing) between the bank and another party in which case the borrower is obliged to pay off the debt after a certain period of time with a predetermined amount of interest." In credit agreements, the role of a Notary is required to have the authority to make authentic deeds. In this research the problems raised are: 1. What are the roles and responsibilities of a Notary in a Bank Credit Agreement? 2. What is the legal protection for Notaries in granting Working Capital Credit by Banks based on Supreme Court Decision Number 65 K/Pdt.2020? The form of this research is doctrinal research with data collection through literature study. Based on this research, it can be concluded that the Notary has the authority to make authentic deeds as evidence that has perfect evidential power and is also burdened with responsibility in carrying out his position. The presence of the Notary Honorary Council aims to provide guidance and protection for Notaries in carrying out their positions.
