Abstract

Asas Nasionalitas merupakan salah satu asas yang terdapat dalam Hukum Tanah Nasional yang menyatakan bahwa seluruh bumi, air, dan ruang angkasa termasuk kekayaan alam yang terkandung di wilayah negara Indonesia hanya warga negara Indonesia yang dapat mempunyai hubungan sepenuhnya. Asas ini berlaku bagi seluruh warga negara Indonesia tak terkecuali bagi seorang warga negara Indonesia yang melakukan perkawinan campuran dengan warga negara asing. Asas Nasionalitas mempunyai fungsi menjaga kedaulatan wilayah Negara Kesatuan Republik Indonesia. Bagi seorang warga negara Indonesia pelaku pernikahan campuran Asas Nasionalitas mempunyai fungsi strategis yaitu sebagai pelindung hak kebendaan warga negara Indonesia dalam konteks Hukum Tanah Nasional. Mahkamah Konstitusi telah memperjelas fungsi Asas Nasionalitas dengan menyatakan menolak petitum permohonan Pemohon judicial review perkara nomor 69/PUU-XIII/2015 yang berkaitan dengan pasal Asas Nasionalitas dalam Hukum Tanah.

Abstract

Keberadaan Pancasila sebagai sumber dari segala sumber hukum dalam praktiknya masih sajamendapat pertentangan, baik oleh masyarakat maupun penyelenggara negara itu sendiri.Penghinaan terhadap lambang-lambang negara masih banyak dilakukan. Oleh karena itu, perludilakukan pengkajian apakah materi muatan dalam UU Nomor 24 Tahun 2009 tentang Bendera,Bahasa, dan Lambang Negara, serta Lagu Kebangsaan sudah selaras dengan nilai-nilai yangterkandung dalam Pancasila atau belum, mengingat undang-undang ini merupakan saranapemersatu, identitas, dan eksistensi bangsa yang menjadi simbol kedaulatan dan kehormatannegara sebagaimana yang diatur dalam konstitusi Indonesia. Metode yang digunakan adalahmetode yuridis normatif dengan menganalisis konsep dan peraturan perundang-undangan yangterkait dengan topik. Data yang digunakan adalah data sekunder yang didapat melalui studipustaka dan dianalisis secara kualitatif. Berdasarkan hasil penelitian bahwa materi muatan UUNomor 24 Tahun 2009 banyak mengalami tabrakan dengan peraturan lainnya dan kurang sesuaidengan asas-asas pembentukan peraturan perundang-undangan yang baik. Selain itu, jugaterdapat beberapa pasal dan ayat yang kurang sesuai dengan nilai-nilai Pancasila sehingga perlu adanya upaya harmonisasi dari badan negara yang memiliki kewenangan untuk itu terhadapperaturan perundang-undangan lainnya yang terkait dan terhadap nilai-nilai Pancasila itu sendiri.

Abstract

The appointment mechanism of constitutional court judges represents a critical intersection between judicial independence and democratic legitimacy. In Indonesia, the tripartite nomination model involving the President, the House of Representatives, and the Supreme Court was originally designed to embody checks and balances. However, recent institutional developments raise concerns regarding structural vulnerabilities within this design. This article examines whether Indonesia’s appointment model adequately safeguards judicial independence or instead generates institutional dependency. Employing normative juridical analysis combined with a functional comparative approach, the study compares Indonesia’s system with those of Germany and South Korea, both of which operate centralized constitutional review mechanisms. This article argues that Indonesia’s fragmented yet majoritarian appointment structure structurally produces appointment dependency, distinguishing it from the institutionalized political constraint models found in Germany and South Korea. While political involvement in judicial selection is not inherently incompatible with judicial independence, the absence of supermajoritarian consensus requirements and structured public scrutiny increases the risk of majoritarian capture. The article proposes a reconstruction of Indonesia’s appointment design through the introduction of qualified majority requirements and institutionalized public deliberation mechanisms. Such reforms aim to recalibrate the balance between democratic legitimacy and judicial autonomy within Indonesia’s constitutional framework.

Abstract

Dasar bagi hakim dalam menilai alat bukti sebagai dasar dalam mengabulkan gugatan perkara waris serta kewenangan pengadilan dalam memutuskan perkara waris harus sesuai dengan ketentuan Perundang – Undangan  dan asas – asas umum yang berlaku dan tepat. Tentang perkara waris dimana setelah pewaris meninggal, harta warisan yang berupa harta bersama belum dibagi. Pewaris menikah sebanyak 3 (tiga) kali semasa hidupnya, dan meninggalkan 2 (dua) orang istri serta 6 (enam) orang anak kandung. Penulis tertarik untuk meneliti lebih lanjut tentang, Pertama kompetensi absolut Pengadilan Negeri yang mengadili dan Kedua tentang alat bukti, yaitu dengan adanya alat bukti apakah yang dijadikan dasar oleh hakim dalam mengambil keputusan. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan analisis yuridis normative dengan spesifikasi penelitian inventarisasi Perundang – Undangan dan teori hukum. Jenis dan sumber data meliputi data primer berupa bahan hukum primer yaitu putusan Pengadilan Negeri dan Perundang – Undangan, bahan hukum sekunder berupa teori hukum dan bahan hukum tersier yang mendukung penelitian ini, pustaka dibidang hukum, hasil penelitian, artikel ilmiah, dokumen – dokumen hukum. Penyajian data dalam bentuk uraian – uraian yang tersusun secara deskriptif dan naratif. Berdasarkan penelitian dari aspek filosofis, aspek teoritis dan aspek yuridis ditemukan bahwa dasar untuk menentukan kompetensi absolut dan alat bukti dalam perkara waris atas pembagian harta bersama adalah Undang[1] Undang No. 2 Tahun 1986 Tentang Peradilan Umum dan yang dijadikan alat bukti adalah surat sebagai bukti otentik. Berdasarkan hasil penelitian yang dilakukan diperoleh bahwa, kompetensi Absolut Pengadilan negeri dalam memutuskan perkara Waris Atas Pembagian Harta Bersama berdasarkan pada Undang – Undang yang berlaku  yaitu Undang – Undang No. 2 Tahun 1986 Tentang Peradilan Umum. Hakim dalam menentukan pembuktian  berdasarkan hasil pemeriksaan persidangan tersebut telah diperoleh fakta – fakta hukum bahwa alat bukti yang dijadikan sebagai dasar dalam memutuskan perkara yaitu alat bukti otentik berupa surat.

Abstract

This study explores the integration of customary law and government regulations in environmental protection, emphasizing the role of community perceptions in shaping effective legal frameworks. Marginal ecosystems, such as coastal areas, urban fringes, and sacred natural sites, often face vulnerability due to fragmented governance systems that fail to coordinate customary practices with formal legal structures. The research investigates how integrating local traditions and state regulations can enhance biodiversity conservation, improve community engagement, and ensure the long term sustainability of environmental management efforts. Findings reveal that when customary laws are formally recognized and incorporated into state regulations, they significantly enhance the legitimacy and effectiveness of conservation policies. Communities in regions like Bali, Indonesia, and Pacific Islands have shown that hybrid legal approaches, which respect traditional ecological knowledge, result in greater participation and trust in conservation activities. However, challenges such as administrative complexity, lack of standardized guidelines, and the need for adequate funding and support for community based governance hinder the full potential of this integration. The study highlights the importance of simplifying legal processes and fostering mutual understanding between customary practices and formal regulations to achieve successful ecosystem protection. This research emphasizes the need for policy reforms that ensure the inclusion of customary law in environmental governance frameworks, ultimately promoting a more inclusive, adaptive, and sustainable approach to managing marginal ecosystems.

Abstract

Global warming and the increasing demand for electricity have strengthened the urgency to introduce environmentally friendly technologies at the community level. Kebondowo Village, located in Banyubiru Sub-district, remains limited in nighttime lighting access and relies heavily on conventional electricity, indicating the need for an efficient and sustainable renewable-energy alternative. In response to this condition, Universitas Diponegoro initiated the Iptek Desa Binaan Undip (IDBU) program through the installation of solar-powered street lights across seven hamlets from July to August 2025 as an early effort to support the development of an environmentally friendly village. The objectives of this program were to improve the quality of village lighting, reduce dependence on conventional energy, increase community awareness of renewable energy use, and evaluate the level of public acceptance of the installed technology. The evaluation was conducted using surveys and semi-structured interviews with 40 adult residents, representing diverse professions and age ranges from 28 to 69 years old (mean age 48), to assess user perceptions, perceived benefits, and expectations for program sustainability. The results showed a highly positive response, with 97% of respondents agreeing with the installation of solar lighting and reporting direct benefits, including improved comfort, safety, and energy efficiency during nighttime activities. Furthermore, most residents expressed their expectation for the expansion of solar-powered street lights across all hamlets. These findings confirm that renewable-energy technology has a high level of social acceptance, effectively improves the community’s quality of life, and holds strong potential to be developed as a sustainable program based on rural community empowerment.

Abstract

Simultaneous general elections in 2024 in Indonesia are expected to improve the quality of democracy and public participation. However, its implementation was faced with various challenges, including problems with the implementation, participant participation, and errors in vote counting. This research aims to identify the basis of election law, explore the problems that arise, and develop effective resolution strategies. Through normative analysis and sociological juridical approaches, this study finds that the orientation of organizers, the preparation of attributes, and adequate infrastructure facilities are the keys to overcoming problems. The implications of this election include improving the quality of democracy, higher public engagement, and transparency and accountability in the electoral process. The results of this research are expected to provide insights and recommendations for election organizers and other stakeholders to create more democratic elections
