Abstract

Desa dan warga desa sangat penting dalam penyelenggaraan pemilu kepala daerah. Desa menjadi lokasi praktik politik uang dalam bentuk jual-beli suara antara calon kepala daerah dan warga desa. Praktik politik uang di desa berbahaya karena dapat merusak integitas Pilkada. Penelitian ini merupakan penelitian sosio-legal dengan teknik pengumpulan data dilakukan dengan metode depth interview dan studi pustaka. Hasil penelitian menunjukkan bahwa faktor penyebab politik uang masih terjadi dipengaruhi oleh faktor budaya, kemiskinan, tingkat pendidikan, tingkat pemahaman hukum, tingkat pemahaman agama, lemahnya institusi pemerintahan, lemahnya institusi pengawasan dan lemahnya institusi partai dan kader politik. Oleh sebab itu, perlu dibangun Model Desa Anti Politik Uang dalam pilkada dengan Pelibatan dan pemanfaatan secara maksimal modal sosial dalam masyarakat untuk membentuk Gerakan Sosial Desa Anti Politik Uang.

Abstract

To ensure environmental sustainability, environmental management must be supported by the enforcement of environmental law through litigation process, whether on criminal, civil, or administrative aspects.  (In Indonesia, there are numerous cases of environmental losses, as well as examples of environmental damage that have been attempted on the court of mandalawangi, natural kallista and sungailiat cases.) The purpose of this research is to find out the extent of court decisions’s consistencies  on environmental cases Using normative legal research method, this research examined three court decisions form two different types of court, which are criminal court (Sungai Liat case) and civil court (Mandalawangi case and Kalistas case). It was found that these judicial decisions show inconsistencies. This condition may weaken the enforcement of environmental law in Indonesia. On the other hand, this difference in judgments may be apprehended as a new standpoint of environmental law in Indonesia. Keberlangsungan pengelolaan lingkungan hidup harus ditunjang dengan penegakan hukum lingkungan, baik melalui jalur peradilan maupun luar peradilan, baik yang bersifat perdata, pidana, maupun administrasi. Penelitian ini mengkaji tiga kasus lingkungan hidup yang diselesaikan melalui peradilan pidana dan perdata, yaitu Kasus Mandalawangi, Kasus Kallista Alam dan Kasus Sungailiat. Tujuan penelitian ini adalah untuk mengetahui problematika penegakan hukum lingkungan hidup di Indonesia, dan untuk mengetahui dampak dari konsistensi putusan hakim dalam perkara lingkungan di Indonesia yang berbeda-beda. Untuk mencapai tujuan tersebut, ketiga putusan hakim tersebut di atas dikaji dengan menggunakan metode penelitian hukum normatif. Hasil penelitin menunjukkan bahwa ketiga kasus tersebut diputuskan secara berbeda. Inkonsistensi tersebut dapat menjadi faktor pelemahan penegakan hukum lingkungan di Indonesia. Namun di samping itu dapat dimaknai sebagai suatu pandangan baru terhadap ketentuan lingkungan hidup di Indonesia.

Abstract

The Constitutional Court (MK) has read out Decision Number 91/PUU-XVIII/2020 regarding the submission of judicial review from several parties regarding Law Number 11 of 2020 concerning Job Creation (UU Cipta Kerja). The decision essentially states that the Job Creation Law is contrary to the 1945 Constitution of the Republic of Indonesia and does not have conditionally binding legal force as long as it does not mean that "no corrections have been made within 2 (two) years since the decision was pronounced." This research is a normative legal research by examining the laws and regulations and related to the social conditions that exist in society. However, the Employment Creation Law is still valid until it is established according to the grace period stipulated in the decision. If no repairs are made during the stipulated time, the Job Creation Act becomes permanently unconstitutional. Abstract

Water is a basic need in human life. The right to water is a basic human right because water is very necessary and a staple of life's welfare. The right to water is not only a matter of quantity but in urban society it has entered the realm of quality. The state is obliged to ensure that the community achieves universal access to clean water and proper sanitation. The right to quality water must be fulfilled, guaranteed and protected. The fulfillment of the right to quality water is not only carried out by the central government but also requires the participation of local governments. This research examines the extent of the role of the local government of Madiun City in fulfilling the right to quality water. The research method used is socio-legal research by collecting direct data on the people of Madiun City. The results of the study show that the local government of Madiun City plays an important role in fulfilling the right to quality water. In addition to ensuring that all local communities in the region have easy access to quality water, local governments also carry out monitoring of the quality of water used by the community.
