Abstract

Abstract: The increase in COVID-19 cases and the limited availability of personal protective equipment cause residents to be prone to contracting COVID-19 and lose some of their rights as consumers of education programs. This study analyzes the legal protection of resident’s rights fulfilment during a pandemic in Indonesia. This normative study using the statute approach is prescriptive and applied in nature. The data sources used are primary, secondary, legal and non-legal materials collected using literature study and confirmation techniques. The legal materials were analyzed using a syllogistic method of deductive mindset.The findings conclude that the resident's right fulfilment is not optimal at present. To achieve legal protection ideals, Indonesian universities as educational service providers must provide all forms of PPE and the reserves during the education period. Setting resident’s status as workers in teaching hospitals can result in the implications of providing incentives and determining working hours.Keywords: Legal Protection, Resident’s Rights, Pandemic Abstrak: Penelitian ini bertujuan untuk menganalisis perlindungan hukum di Indonesia dalam pemenuhan hak residen selama masa pandemi. Residen harus melaksanakan tugas belajar mengajar dan peningkatan kasus positif COVID-19 tidak berbanding lurus dengan ketersediaan alat pelindung diri. Residen rawan terjangkit COVID-19 dan terlanggarnya beberapa hak sebagai konsumen dari program pendidikan.Metode penelitian yang digunakan adalah normatif, dengan pendekatan  undang-undang. Sifat penelitian bersifat preskriptif dan terapan. Sumber penelitian berupa bahan hukum primer, sekunder, dan non-hukum, dengan teknik studi kepustakaan serta melakukan konfirmasi. Teknik analisis bahan hukum dengan metode silogisme melalui pola pikir deduktif.Dapat disimpulkan bahwa kondisi kekinian berkenaan pemenuhan hak residen adalah belum optimal. Dari segi idealitas perlindungan hukum, Indonesia yang saat ini menganut masih university-based, universitas sebagai penyedia jasa pendidikan harus menyediakan segala bentuk APD dan cadangannya dalam penggunaan harian selama masa pendidikan. Penetapan status residen sebagai pekerja di RS Pendidikan, dapat berimplikasi terhadap pemberian insentif dan penetapan jam kerja.Kata Kunci: Hak Mahasiswa Peserta Program Pendidikan Dokter Spesialis, Masa Pandemi, Perlindungan Hukum

Abstract

The Constitutional Court (MK) has read out Decision Number 91/PUU-XVIII/2020 regarding the submission of judicial review from several parties regarding Law Number 11 of 2020 concerning Job Creation (UU Cipta Kerja). The decision essentially states that the Job Creation Law is contrary to the 1945 Constitution of the Republic of Indonesia and does not have conditionally binding legal force as long as it does not mean that "no corrections have been made within 2 (two) years since the decision was pronounced." This research is a normative legal research by examining the laws and regulations and related to the social conditions that exist in society. However, the Employment Creation Law is still valid until it is established according to the grace period stipulated in the decision. If no repairs are made during the stipulated time, the Job Creation Act becomes permanently unconstitutional. Abstract

The objective of this study is to objectively analyze and examine the legal protection of the community regarding the status of area land in West Lampung Regency. This research is sociolegal because it only determines law as a social phenomenon. This research was conducted in West Lampung Regency the research location was in Sukapura Village, Sumberjaya District, West Lampung Regency, and in the location of the forest land in the disputed area. The results of the authors can be concluded, firstly, that the regulation of tenure over forest area land in West Lampung Regency cannot provide legal protection for indigenous peoples because, in several findings, it is known that the land and the holder of rights over it are recorded for the first time in the registration book. Second, the regulation of valid land tenure rights in order to provide protection to the community regarding the status of forest area land in West Lampung is to check the status of the land. In the event that the means of proof as referred to in paragraph 1 are not available or are no longer available, proof of rights can be carried out based on the fact that the land parcel in question has physically been in possession for twenty years or more consecutively by the applicant for registration and preliminary introduction with conditions.

Abstract

Globalisasi dan kemajuan teknologi dewasa ini telah mengakibatkan krisis ideologi dan erosi rasa cinta tanah air (nasionalisme) pada generasi muda atau remaja akibat penetrasi ideologi asing dan penyebaran paham-paham radikal. Sebagai upaya untuk menangkal penetrasi ideologi asing dan menjaga ketahanan ideologi, maka diperlukan upaya kolaboratif antara perguruan tinggi dengan masyarakat salah satunya melalui kegiatan pengabdian kepada masyarakat. Kegiatan pengabdian ini akan diselenggarakan di SMA Negeri 4 Semarang dengan judul “Sosialisasi Nilai-Nilai Pancasila Bagi Generasi Milenial: Pancasila Dulu, Kini, dan Nanti.” Kegiatan pengabdian ini dilaksanakan dengan memberikan ceramah dan melakukan diskusi interaktif dengan tujuan memberikan sharing knowledge, sosialisasi nilai-nilai Pancasila, dan internalisasi nilai-nilai Pancasila kepada siswa SMA Negeri 4 Semarang. Melalui kegiatan pengabdian ini diharapkan dapat terjadi: (1) Peningkatan pemahaman di kalangan siswa SMAN 4 Semarang mengenai nilai-nilai luhur Pancasila dan pentingnya untuk menjaga eksistensi nilai-nilai tersebut dalam kehidupan; (2) Internalisasi nilai-nilai Pancasila dalam diri siswa SMAN 4 Semarang sehingga dapat terbentuk rasa cinta tanah air dan rasa kebangsaan sekaligus menangkal potensi penetrasi ideologi asing dan paham-paham radikal di kalangan siswa SMAN 4 Semarang; (3) transfer knowledge mengenai peluang dan tantangan Indonesia dalam dinamika perkembangan global dan Era Revolusi Industri 4.0 sehingga dapat membuka cakrawala pengetahuan dan mempersiapkan siswa SMAN 4 Semarang menggapai peluang dan menghadapi tantangan tersebut.

Abstract

The purpose of this study is to analyze the legal status of an immature child with dual citizenship. This type of research that is used is normative law research that investigates the systematics of law. This systematic research of law is carried out against the regulations of laws or laws written according to the topic that has been raised. The results of the research show that the legal status of a minor child with dual citizenship in connection with inheritance is to remain entitled to inherit the property of land in Indonesia without interference from others even though the status of the child still has 2 (two) citizenships and still has not been able to choose one of the nationalities between Indonesia or another country. Therefore, basically any citizen of the child/s descendants cannot prevent or remove the child's inheritance.

Abstract

The legal protection of children's human rights in the education sector in Indonesia must be the government's main concern. The law provides for the rights children must receive, including the right to education. This is because during the COVID-19 pandemic, governments have found it difficult to provide educational legal protections to children. This article uses normative legal research to examine the legal protection of children's right to education during the COVID-19 pandemic and the role of states in realizing children's right to education.

Abstract

Tujuan penelitian ini adalah untuk menganalisis kewenangan Pemerintah Daerah Kota Surakarta dalam penerbitan Surat Bukti Kepemilikan Bangunan Gedung (SBKBG). Metode penelitian menggunakan metode hukum normatif dengan melakukan penafsiran hukum dan konstruksi hukum melalui norma hukum yang berlaku. Pengumpulan data menggunakan studi hukum kepustakaan dengan data sekunder berupa bahan pustaka seperti buku, literatur dan jurnal hukum yang terkait. Teknik analisis data menggunakan analisis kualitatif. Hasil penelitian menunjukkan bahwa Pemerintah Kota Surakarta mengeluarkan Perda No. 14 Tahun 2023 tentang Pajak Daerah dan Retribusi Daerah di mana dalam Pasal 1 No. 53 menyebutkan bahwa Surat Bukti Kepemilikan Bangunan Gedung (SBKBG) adalah surat tanda bukti hak atas status kepemilikan Bangunan Gedung yang bertujuan untuk menjamin kepastian dan ketertiban hukum dalam Penyelenggaraan Bangunan Gedung, setiap Bangunan Gedung harus memenuhi persyaratan administratif dan persyaratan teknis Bangunan Gedung. Persyaratan administratif Bangunan Gedung dimaksudkan agar diketahui lebih rinci bahwa untuk mendirikan Bangunan Gedung, perlu ada kejelasan status tanahnya, kejelasan status kepemilikan Bangunan Gedungnya, maupun kepastian hukum bahwa Bangunan Gedung yang didirikan telah memperoleh persetujuan dari Pemerintah Daerah dalam bentuk Bangunan Gedung. Kewenangan dalam penerbitan SBKBG untuk memberikan payung hukum bagi pihak terkait dalam penyelenggaraan bangunan gedung di wilayah Surakarta yang dimulai dari perizinan, perencanaan, pelaksanaan konstruksi, pemanfaatan, kelaikan bangunan gedung agar sesuai ketentuan sehingga keselamatan penghuni dan lingkungan dapat terwujud

Abstract

The amendment of the 1945 Constitution of the Republic of Indonesia brought significant changes to the structure of state institutions, particularly in the separation of powers. The Constitutional Court, as an institution holding judicial power, has the authority to conduct judicial review based on Article 24 paragraph (2) of the 1945 Constitution. The Constitutional Court Decision No. 90/PUU-XXI/2023 sparked polemics because it was considered a positive legislative decision, which shifted the Court's role from negative legislator to positive legislator. This has created a new phenomenon in the Indonesian constitutional law system, especially regarding the position of the Constitutional Court and the validity of the constitution. This research aims to analyze the effect of the decision on the state institutional system in lawmaking. Using a normative legal approach, this research finds that the decision shows the weakness of the checks and balances system and legalizes a new norm regarding the age of presidential and vice-presidential candidates that does not reflect the interests of society. As a result, the expected substantive justice is not achieved, loosening democracy, and undermining the authority of lawmaking institutions. Therefore, it is necessary to review the authority of the Constitutional Court to prevent abuse of power.

Abstract

A political party is an institution that is necessary in the democratic world; if you have chosen a democratic system to regulate the life of the nation and state, one of the essential instruments in democracy is the institution of political parties. Political education is a significant activity in a nation based on democracy because democracy and the democratization process require absolute conditions for political public education; how the function of political education by the Indonesian Democratic Party of Struggle in Purworejo Regency is by Law Number 2 of 2011 concerning Amendments to Law Number 2 of 2008 concerning Political Parties. This study aims to analyze the implementation of norms related to the function of political education by DPC PDI Perjuangan in Purworejo Regency. This research uses an empirical approach. This study uses a qualitative descriptive analysis method with a case approach. The data used in this study are primary data obtained directly by researchers in the field through respondents through observation, interviews, and questionnaire distribution, as well as secondary data, namely data obtained or obtained from information or knowledge obtained indirectly, including official documents, books, and research results in the form of reports. The data collection techniques used in this study are field studies and literature studies. The result of this study is that there are seven political education activities carried out by PDI Perjuangan Purworejo Regency, namely, political education through socialization, political education through social, political education through art and culture, political education through religion, political education through party wing organizations, political education through seminars, political education through party schools.
