Abstract

Post-tsunami disaster in Aceh, legal issues on land are regulated by the Government Regulation in Lieu of Law Number 2 of 2007, which regulates among others on land that does not exist and/or unknown its owners and their heirs. The land is being taken care as  a religious treasure by Baitul Mal  with an order the Syar'iyah Court. This study applies juridical normative and sociological normative methods. From the field research it was found that the Government did not have data of lands with unknown owners and their heirs. It was known from decision of the Syar'iyah Court  of Banda Aceh which revealed that the fact was originated from the construction of the drainage where the land procurement committee did not know where to hand over the land acquisition fund.Key words: tsunami, land, Aceh

Abstract

Artikel ini bertujuan mengkaji mekanisme Penyelesaian Sengketa Tanah Waris Melalui Peradilan Adat Gampong (Desa) di Kecamatan Baitussalam, Kabupaten Aceh Besar, Provinsi Aceh. Metode penelitian merupakan yuridis empiris, data diperoleh melalui wawancara dan penelusuran kepustakaan. Hasil penelitian menunjukkan, mekanisme penyelesaian sengketa tanah waris melalui peradilan adat gampong di kecamatan Baitussalam berbeda-beda. Perbedaan tersebut disebabkan, setiap gampong memiliki kebiasaan dan mekanisme penyelesaian masing-masing yang sudah turun temurun. Di samping itu, pengetahuan perangkat adat, juga mempengaruhi penyelesaian sengketa. Padahal, kebijakan pemerintah melalui Qanun Aceh Nomor 9 tahun 2008, Peraturan Gubernur Aceh Nomor 60 tahun 2013, dan pedoman peradilan adat Aceh dari majelis adat Aceh yang menjadi acuan penyelesaian sengketa adat sudah tersedia.

Abstract

Treatment nasty case in Banda Aceh, Aceh province could also be implemented through Local Customary Courts. Settlement through customary courts always be informal or through peace way. On the other hand, Aceh Qanun No. 14 of nasty arranges it as well, in which the nasty cases will be resolved by the Syar’iyah Court. This study aimed to see, if the Local Customary Court has the authority to deal with nasty case, and whether the decision made by the Local Customary Court shall be final and tight. The study was conducted by interviewing Local Customary Court judges, Wilayatul Hisbah and Communities. The method used was a qualitative study. The result showed that both the Local Customary Courts and the Syar‘iyah Court have the same authority in handling the nasty case in Banda Aceh. In fact, sometimes, the local customary courts also resolve cases that have been categorized as adultery. Treatment cases of nasty, with local customary court have no final and strong legal force, because if the parties are not satisfied with the decision of the Customary Court, they can still bring the Government of Aceh in order to perform an amendment to the articles of those Qanun. Then, the special cases that are categorized as adultery should immediately be resolved by the Syar’iyah Court.

Abstract

Abstrak – Penelitian bertujuan menjelaskan penerapan Pasal 42 dan Pasal 43 UU No. 41 Tahun 2004 tentang wakaf di Kecamatan Cot Girek Kabupaten Aceh Utara dan menjelaskan hambatan nazhir dalam mengelola harta benda wakaf secara produktif di Kecamatan Cot Girek Kabupaten Aceh Utara. Penelitian menerapkan jenis yuridis empiris dimana data diperoleh melalui kajian lapangan dan kepustakaan. Hasil penelitian menunjukkan bahwa penerapan Pasal 42 dan Pasal 43 UU No. 41 tentang wakaf di Kecamatan Cot Girek Kabupaten Aceh utara yang dilihat belum terealisasikan dengan baik karena masih ada harta wakaf yang terbengkalai sejak lama dan belum diperuntukan sesuai amanah wakif. Pengelolaan dan pengembangan harta wakaf hanya sebatas tanah, karena masyarakat beranggapan bahwa harta wakaf hanya berbentuk benda yang tidak bergerak. Nazhir penangungg jawab harta wakaf dipercaya wakif dalam mengelola harta wakaf belum sepenuhnya mampu dalam melaksanakan pengembangan wakaf dengan produktif. Hambatan Nazhir dalam mengelola harta wakaf ialah kurangnya pengembangan tanah wakaf dikarenakan hilangnya Akta Ikrar wakaf, dana desa yang kurang untuk melakukan pembangunan aset wakaf, kebanyakan masyarakat lebih mengutamakan wakaf yang peruntukannya sesuai dengan kebutuhan desa, masyarakat masih menganggap pembangunan aset sarana keagamaan seperti madrasah atau PAUD yang belum dibutuhkan dan kurangnya pihak nazhir dalam mengelola harta wakaf. Disarankan kepada wakif agar membentuk sertifikat wakaf agar memiliki kekuatan hukum atas harta yang diwakafkan dan nazhir agar meningkatkan produktivitas dalam memanfaatkan harta wakaf sesuai peruntukan dan kemanfaatanya.Kata Kunci: Wakaf, Wakif, Nazhir, Produktif.

Abstract

Health care is a fundamental right of every citizen guaranteed by the constitution and various laws and regulations. However, in practice there are still cases of health care malpractice that often occur, either due to negligence, carelessness, lack of competence, or violation of professional standards. Such actions not only have an impact on the physical and psychological harm of patients, but also raise questions regarding the legal responsibility of the perpetrators, especially in the criminal realm. The problems in this study are how health care malpractice in the perspective of criminal law and how criminal liability for health care malpractice. This research uses normative juridical research method with statute approach and conceptual approach. The results showed that health care malpractice must be viewed as a criminal offence that can be subject to criminal liability in accordance with the provisions in the Criminal Code, Law Number 17 of 2023 concerning Health, and other regulations.

Abstract

This study aims to analyze the effectiveness of legal capacity-building for Temporary Land Deed Officials (PPATS) in the preparation of land deeds in Aceh Besar Regency, Aceh Province. The research employs an empirical juridical method with a qualitative approach, utilizing data collection techniques including interviews, observation, and document analysis. This approach enables a comprehensive examination of both the normative framework and its practical implementation in the field. The findings indicate that the effectiveness of capacity-building for PPATS remains suboptimal, as the existing programs are largely administrative, incidental, and insufficient in addressing substantive legal aspects. Several factors influence this condition, including the non-legal educational background of PPATS, prevailing community legal culture, limitations in training programs, weak institutional coordination, and social pressures encountered in the practice of land deed preparation. These challenges contribute to a low level of material competence and legal prudence among PPATS in carrying out their duties. Accordingly, there is a need for a more sustainable, contextual, and competency-based capacity-building model to enhance the professionalism of PPATS. Such an approach is essential to strengthen their substantive legal understanding, improve the quality of land deeds, and ultimately support the realization of legal certainty in land administration services.

Abstract

This study examines the effectiveness of mediation in resolving divorce cases at the Banda Aceh Sharia Court and the Jantho Sharia Court based on Supreme Court Regulation No. 1 of 2016. This study aims to analyze the implementation of mediation, identify factors influencing its effectiveness, and determine efforts to improve the effectiveness of mediation in divorce cases. The method used is a legal-empirical approach with a qualitative methodology through interviews and literature review. The research results indicate that the implementation of mediation has been in accordance with the provisions of Supreme Court Regulation No. 1 of 2016; however, its success rate remains low, rendering it ineffective. Factors influencing the effectiveness of mediation include the mediator’s competence, the parties’ strong desire to divorce, prolonged domestic conflicts, and the influence of religious figures within the community. Efforts to improve the effectiveness of mediation are carried out by enhancing the competence of mediators, educating the parties on the benefits of mediation, and optimizing the mediation process within the Sharia Court.

Abstract

Article 435 of Law Number 17 of 2023 concerning Health prohibits any person from producing or distributing pharmaceutical preparations, including cosmetics, that do not meet safety, efficacy, quality, and licensing standards. However, the circulation of cosmetics without distribution permits is still frequently found, including in Bireuen Regency. This condition indicates that law enforcement against illegal cosmetic business actors has not been optimally implemented. This study aims to analyze criminal law enforcement against business actors involved in the distribution of cosmetics without distribution permits within the jurisdiction of the Bireuen District Court, examine the obstacles encountered, and identify the criminological factors underlying the commission of such offenses. The research method employed is empirical juridical research using statutory, case, and criminological approaches through library research and field research conducted by interviews with the Indonesian Food and Drug Authority (BPOM), police, prosecutors, and business actors. The results of the study show that law enforcement against the distribution of cosmetics without distribution permits has not been effective due to weak supervision of digital trade, limited monitoring facilities, low public legal awareness, and relatively light criminal sanctions that fail to create a deterrent effect. From a criminological perspective, these offenses are influenced by economic factors, high public demand for instant cosmetic products, the development of social media and e-commerce, as well as weak supervision and social control. It is recommended that digital trade supervision be strengthened, inter-agency coordination among law enforcement institutions be improved, and stricter sanctions be imposed on offenders, particularly recidivists, in order to enhance public health protection and the effectiveness of law enforcement.

Abstract

Law Number 11 of 2012 on the Juvenile Criminal Justice System mandates that the resolution of juvenile cases should prioritize a restorative justice approach through diversion in order to ensure child protection and restore social relationships. One form of diversion is the return of children in conflict with the law to their parents for guidance and supervision within the family environment. Data from the North Aceh Resort Police for the period 2024–2025 indicate that all cases involving Children in Conflict with the Law were resolved through restorative justice, with the subsequent measure being the return of the child to their parents. This study aims to analyze the conformity of returning children to their parents with the principles of restorative justice and child protection, examine the balance of legal protection between child offenders and victims, and assess the considerations employed by investigators in implementing diversion at the North Aceh Resort Police. This research employs an empirical legal method with a socio-juridical approach. Data were collected through interviews with investigators from the Women and Children Protection Unit (PPA) of the North Aceh Resort Police, assistant investigators, officers of the Correctional Center (Bapas), and parents or guardians of the children involved, supported by a literature review of statutory regulations, books, scholarly journals, and previous studies. The findings reveal that the return of children to their parents through diversion reflects the principles of restorative justice and child protection by prioritizing rehabilitation, restoration, and the best interests of the child. This practice also provides balanced legal protection for both child offenders and victims through the involvement of all parties in the reconciliation process and the restoration of victims’ rights. Furthermore, investigators consider legal, social, and psychological factors, including the fulfillment of diversion requirements, the existence of a settlement agreement, and the family’s capacity to guide and supervise the child. It is recommended that the North Aceh Resort Police strengthen coordination with the Correctional Center, the Regional Technical Implementation Unit for Women and Children Protection (UPTD PPA), social workers, and the child’s family in order to enhance supervision, ensure continuous guidance, and support victim recovery following the implementation of diversion.
