Abstract

The rapid growth of cryptocurrency trading in Indonesia presents both opportunities and systemic risks to the national financial system. Cryptocurrency exchanges, as digital asset intermediaries, remain vulnerable to fraud , cyberattacks, market manipulation, and regulatory uncertainty. This study examines the legal framework for exchange protection, highlighting the absence of integrated regulation combining financial security, consumer protection, and technological governance, despite the transfer of authority from Badan Pengawas Perdagangan Berjangka Komoditi or Bappepti to Otoritas Jasa Keuangan (OJK) or Financial Services Authority. Using a normative juridical approach and comparative analysis of Japan and Singapore, the findings show the need for an adaptive and integrated regulatory model that strengthens transparency, accountability, and consumer trust while supporting financial innovation. Establishing such a framework is essential to mitigate systemic risk, reinforce public trust and ensure sustainable financial development aligned with global governance standards and the Sustainable Development Goals (SDGs).

Abstract

Artificial Intelligence (AI) is reshaping the legal profession by enhancing research speed, document review, and case analysis. Yet, its integration also raises pressing concerns over accountability, data privacy, and ethical standards. This study addresses the research problem: How should Indonesia regulate AI in law to balance innovation with justice and human rights? Three guiding questions inform the analysis: (1) What is the extent of AI adoption by Indonesian legal practitioners? (2) What legal and ethical risks arise? (3) What regulatory responses are most suitable for Indonesia’s plural legal context? Adopting a socio-legal methodology, data were collected through literature review, in-depth interviews, and an online survey of 102 practitioners. Findings show that 38% of respondents currently use AI tools, mainly for legal drafting and research, but skepticism persists. Advocates in Semarang reported errors in AI-generated contracts, illustrating unresolved accountability gaps under existing laws. Judges highlighted risks of bias and opacity if AI expands into case management without safeguards. The novelty of this research lies in its empirical evidence: it is the first Indonesian study to combine practitioner perspectives with regulatory analysis, moving beyond conceptual debates. By linking adoption patterns to deficiencies in the ITE Law, PDP Law, and PERMA No. 1/2019, the study reveals concrete vulnerabilities in legal practice. The study concludes that interim sectoral measures such as PERADI guidelines and judicial ethics updates are urgently needed while developing a comprehensive AI law. Responsible governance is essential to ensure AI strengthens, rather than undermines, fairness, transparency, and the rule of law.

Abstract

This study discusses the implementation of the Free Nutritious Meal (MBG) Policy in Pare District, Kediri Regency. The focus is on legal and socio-normative aspects of the policy. This study uses a qualitative descriptive approach. The data are taken from statutory regulations, government documents, academic literature, policy reports, and relevant media publications. The findings show that several factors support the implementation of the MBG policy in Pare. These factors include the commitment of local government, support from schools and other local institutions, and public acceptance of the program. In Pare, community values such as mutual assistance and local participation also help the program run at the local level. However, the implementation of the MBG policy still faces several problems. The main problem is regulatory uncertainty. This can be seen from unclear institutional mandates, incomplete operational standards, weak oversight mechanisms, and limited public participation in monitoring and evaluation. Food distribution also remains a challenge, especially when coordination among actors is not yet strong. From a legal perspective, the MBG policy needs clearer implementing regulations and stronger accountability mechanisms. From a socio-normative perspective, the program also needs to consider local conditions, community participation, and equal access to nutritious food. In Pare District, legal certainty and community support must work together so that the policy can be implemented in a fair, accountable, and sustainable manner. This study argues that the effectiveness of the MBG policy does not depend only on food provision. It also depends on regulatory certainty, institutional responsibility, public oversight, and the consistent enforcement of service standards. These elements are important to ensure that the MBG policy supports child nutrition, public welfare, and social justice, aligning with Sustainable Development Goals (SDGs) 12: Responsible Consumption and Production.

Abstract

Perlindungan hak cipta atas lagu dan/atau musik dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta masih menghadapi tantangan serius di Indonesia, terutama terkait pelanggaran Hak Moral dan Hak Ekonomi pencipta lagu. Indonesia bahkan pernah mendapat kritik internasional akibat lemahnya perlindungan hukum terhadap hak cipta, terbukti dengan dimasukkannya Indonesia dalam Watch List oleh IIPA dan USTR sejak tahun 2000 karena tingginya tingkat pembajakan di pasar domestik. Penelitian ini bertujuan untuk menganalisis dua permasalahan utama: mekanisme permohonan izin dan pembayaran royalti kepada pencipta lagu, serta konsekuensi hukum bagi pelaku yang menampilkan lagu tanpa izin dan tidak memenuhi kewajiban hak cipta. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan studi kasus serta analisis kualitatif. Hasil penelitian menunjukkan bahwa mekanisme perizinan dan pembayaran royalti dilakukan melalui Lembaga Manajemen Kolektif Nasional (LMKN), yang bertugas menghimpun dan mendistribusikan royalti berdasarkan data karya yang didaftarkan pencipta. Sementara itu, pengguna karya yang menggunakan lagu secara komersial tanpa izin dan tanpa membayar royalti dapat dikenai sanksi hukum berupa gugatan perdata (ganti rugi), pencabutan izin lisensi jika ada perjanjian, serta pidana denda sesuai ketentuan Pasal 113 ayat (2) UU Hak Cipta. Implikasi penelitian ini menegaskan pentingnya kepatuhan hukum dalam penggunaan karya cipta musik guna melindungi hak-hak pencipta secara adil dan berkelanjutan.

Abstract

Bank Indonesia melarang penggunaan virtual currency sebagai alat pembayaran yang sah sejak 2014, namun perkembangan penggunaan Bitcoin masih marak. Rumusan masalah penelitian ini adalah: Bagaimana perlindungan hukum dan kepastian hukum penggunaan virtual currency? Penelitian ini menggunakan penelitian kualitatif dengan jenis penelitian hukum yuridis empiris, dimana penelitian hukum implementasi dikaitkan dengan ketentuan hukum normatif pada setiap peristiwa hukum tertentu yang terjadi dalam masyarakat. Penggunaan virtual currency dalam transaksi elektronik sebagai alat pembayaran telah memiliki kepastian hukum menurut Pasal 21 ayat (2) Undang-Undang Nomor 7 Tahun 2011 tentang Mata Uang dan Pasal 1541 KUH Perdata. Penggunaan virtual currency melanggar hukum berdasarkan Pasal 21 ayat (1) Undang-Undang Nomor 7 Tahun 2011 tentang Mata Uang, PBI No. 17/3/PBI/2015 tentang Kewajiban Penggunaan Rupiah Di Wilayah Negara Kesatuan Republik Indonesia dan Pasal 34 PBI 18/40/PBI/2016 tentang Penyelenggaraan Pemrosesan Transaksi Pembayaran. Simpulan penelitian ini bahwa penggunaan virtual currency dapat merugikan karena nilai yang tidak pasti, namun masih berpeluang adanya transaksi menurut Pasal 1542 KUH Perdata. Saran bagi pemerintah diharapkan adanya pengaturan khusus terkait dengan peredaran virtual currency dan pengguna harus lebih berhati-hati dalam menggunakan virtual currency.
