Abstract

West Nias Regency as a new autonomous regions is required to issue a policy in the regulation of local revenue sources that are not entirely dependent on central government funding. In this study, there are several issues to be discussed include the formulation of regulation of financial resources within the framework of the general areas of regional autonomy, policy and policy implementation has been done by the Government of West Nias, the obstacles faced by the Government of West Nias Regency. The regulation of financial resources especially regional revenue has been established to provide broad authority to local goverments to levy local taxes and retribution, the policy of goverment west nias regency explore potential revenue has been estabished by means of issue a local regulation although not all of these legal products formed. The Policy of Government West Nias in running facing external and internal obstacles.

Abstract

ABSTRACTPractice to action discriminative as collision of light human right in law order have been arranged in section 28B sentence (2), section 28I sentence (2) Indonesian constitution 1945 post amendment, then section 1 number 1 of constitution No. 40/2008 about discrimination disposal, race and ethnical, then discrimination context as collision of human right have been assured in section 1 number 3 of constitution no 39 the year 1999 about human right, so that action diskriminative has ought to be punishable if it has done. hence to action discriminative can be given sanction of imprisonment at longest one (1) year or penalty fine maximum one hundred million rupiahs according to at section 15 and 16 of constitution No. 40 the year 2008 about discrimination disposal race and ethnical. Refers such a of action perpetrator discriminative instead seldom be punished and their case have never been brought to justice of human right as justice judging about collision human right. Action discriminative as collision of light HAM cannot be judged in HAM justice domain, caused existence of historical reason that is, in Statute Roma 1998 adopting existence of four badness numbers which can be judged in ICC among others, badness of genosida, crimes againt humanity, badness of war and badness of aggression however doesn't coronate to collision of light HAM like action discriminative as collision of light HAM as which included in DUHAM 1948. Reason of yuridis, according to section 4 constitution No. 26 the year 2000 about justice of human right expresslies state that collision of human right which can be judged in justice of human right is collision of heavy HAM that is badness of genosida and badness to humanity outside from the badness justice of HAM doesn't have authority to investigate breaks and judges it, then reason of basis yuridis as presentation of the forming of constitution justice of human right in judging is special for collision of weight HAM which can be judged in justice of human right but not to collision of light HAM.Keyword : analysis yuridis, action discriminative, and light collusion human right.

Abstract

The development of Indonesia state administration law is indicated when the government manage the people by using the law order with determine the decision about prohibition or by the issuance of permit system. Quanun based on the Law of Aceh Government is “Regulations in local regulations that rule the government administration and the society living of local area in Aceh. Generally, the type and several of sanctions is recorded and determine clearly in the administration rule. There are any sanction in administration law, i.e. government coercion, withdraw the advantage decision (subsidy permit, payment), coercion fee by government, and administration fine. The policy on concept of administration sanction in Quanun according to the description of Act No. 11 of 2006 concerning to Aceh Government indicates that Quanun is a rule that override the other rules by follow the principles of Lex Specialis derogaat Lex Generalis. Asrticle 18 of Constitution of 1945 is a law base for the implementation of local autonomy by provides the local head with wide authority, real and accountable.

Abstract

ABSTRACTLocal government system as the consequence of the democratric country that adheres to the deconcentration, decentralization and local autonomy principles goves the right to the local governments to significantly take care of their own domestic affairs as optimal as possible. The supervisory function of the members of regional legislative council was comprehensively regulated, but it was only limited to checks and balance without law enforcement authority. The implementation of the supervisory function of the members of regional legislative council against the peformance of the City Government of Medan in 2011 has not owned the ideal controlling system yet. The actions taken by the members of regional legislative council were merely in the forms of recommendation, criticism, suggestion and continuous monitoring.Keywords: upervision, Regional Legislative Council, Performance, City Government of Medan, Local Autonomy

Abstract

Didalam UUD 1945 sekurang-kurangnya terdapat 2 (dua) sendi sebagai dasar konstitusional pembentukan peraturan perundang-undangan, yaitu sendi kerakyatan (demokrasi) dan sendi negara berdasarkan atas hukum. Kegiatan membentuk peraturan perundang-undangan merupakan tugas pertama dan utarna didalam membangun sistem ketatanegaraan yang demokratis. Kehadiran lembaga perwakilan rakyat merupakan suatu keniscayaan didalam negara demokrasi, dimana dengan prinsip perwakilan ini, lembaga perwakilan rakyat memiliki legitimasi dari seluruh rakyat untuk menjalankan hak dan kewajiban rakyat dalam berbagai bidang kehidupannya yang dapat terlihat dari berbagai peraturan perundang-undangan yang dibentuk untuk mengatur hak dan kewajibannya, sehingga prinsip bahwa seluruh peraturan perundang-undangan harus dibentuk secara demokratis dapat diwujudkan.

Abstract

External oversight of constitutional judges is a crucial element in maintaining the integrity and accountability of the constitutional judiciary system. The urgency of this oversight lies in its ability to prevent the abuse of power, enhance transparency, and strengthen public trust in the judiciary. In this context, external oversight functions as a control mechanism that helps ensure constitutional judges perform their duties in accordance with principles of justice and applicable law. However, effective external oversight requires an ideal and comprehensive model. The ideal oversight model should include key elements such as the independence of the oversight body, transparency of the oversight process, clear procedures for reporting and handling complaints, and accountability of the oversight body to the public. Additionally, public involvement in the oversight process is crucial to ensure that the oversight reflects the general interest. This study aims to evaluate the urgency of external oversight of constitutional judges and to develop an ideal oversight model that can enhance the effectiveness of external control. By implementing this model, it is hoped that the constitutional judiciary system can operate more fairly and accountably, and maintain public confidence in the constitutional judiciary.

Abstract

Bank tanah bila dilihat dari tugas dan kewenangan nya terdapat tumpang tindih dengan Dinas Pertanahan Aceh. Dimana Dinas Pertanahan Aceh diberi kewenangan oleh pemerintah pusat diantaranya adalah untuk pemberian izin lokasi dan pengelolaan tanah eks Hak Guna Usaha, namun hari ini kewenangan yang sama tersebut juga diperoleh oleh bank tanah, dengan demikian secara pelaksanaan akan menjadi problematika baru dalam pemberian izin lokasi dan pengelolaan tanah yang berkaitan dengan tanah eks Hak Guna Usaha khususnya di Propinsi Aceh Kabupaten Bireuen. Penelitian ini adalah penelitian hukum yuridis empiris dengan sifat penelitian deskriptif analitis. Lokasi penelitian ini adalah Kantor Pemerintah Kabupaten Bireuen / Dinas Pertanahan Kabupaten Bireuen Desa Cot Gapu Kecamatan Kota Juang. Data yang digunakan data primer dan sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Teknik dan alat pengumpulan data dilakukan dengan studi kepustakaan dan studi lapangan dengan melakukan wawancara. Analisis data dilakukan dengan metode analisis kualitatif. Dari hasil penelitian yang dilakukan dapat disimpulkan, Faktor-faktor terjadinya tumpang tindih kewenangan antara Dinas Pertanahan Kabupaten Bireuen dengan bank tanah berkaitan pemberian izin dan pengelolaan tanah eks Hak Guna Usaha antara lain : pertama, Pemberian kewenangan yang sama oleh Pemerintah Pusat terhadap Dinas Pertanahan Aceh dengan bank tanah perihal pengelolaan tanah dan pemberian izin lokasi tanah eks Hak Guna usaha. Kedua, Adanya ketidakpastian mekanisme yang diberikan pemerintah pusat kepada pemerintah aceh khususnya perihal pengaturan, pengelolaan dan pemanfaatan tanah di Aceh. Ketiga, Hadirnya bank tanah mengeliminasi mandat yang sebelumnya di berikan kepada Dinas Pertanahan Aceh khususnya Kabupaten Bireuen. Keempat, Fungsi dan peran bank tanah tidak sesuai dengan amanat Undangundang Tanah eks Hak Guna usaha yang dikelola oleh bank tanah yang seharusnya didistribusikan untuk masyarakat melalui program Reforma Agraria yang dalam hal ini Pemerintah Daerah menjadi panitia pelaksana, nantinya akan berubah menjadi kepentingan bisnis dan komersial bila pemberian dan penetapan izin dilakukan oleh bank tanah. Solusi tumpang tindih agar terlaksana dengan baik antara Dinas Pertanahan Aceh dan bank tanah dalam pemberian izin lokasi dan pengelolaan tanah eks Hak Guna Usaha, hendaknya pemerintah memperhatikan beberapa faktor kesuksesannya, yaitu: pertama, Dinas Pertanahan Aceh sebagai pelaksana aksi, hendaknya pemerintah memberikan satu aturan yang pasti agar tidak terjadi kerancuan hukum. Kedua, Dinas Pertanahan Aceh diberikan kewenangan secara penuh oleh Pemerintah pusat seperti telah tertuang dalam Mou Helsinki dalam pengelolaan dan pemberian izin berkenaan tanah eks Hak Guna Usaha mengingat Dinas Pertanahan yang lebih memahami kepentingan masyarakat luas khususnya masyarakat yang hidup dan tinggal di sekitar tanah eks Hak Guna Usaha. Ketiga, Pemerintah harus lebih teliti dan berhati-hati dalam membuat suatu regulasi hukum khususnya terkait tanah eks Hak Guna Usaha agar tidak terjadi tumpang tindih antara satu Instansi dengan yang lain. Dengan demikian terjamin dan tercapainya sebesar-besar kemakmuran rakyat
