Abstract

During the COVID-19 pandemic, the Sambas Religious Court reported 760 domestic violence cases within a year in Sambas West Kalimantan. The violence was often used to maintain and reinforce the subordination of women to men. This study aims to determine the causes of violence against women. The descriptive qualitative method with an empirical sociological approach is applied in this study. This study involves stakeholders related to violence against women in the region as participants. The findings of this study are during the COVID-19 pandemic, from 2019-2020 violence against women increases from 450 to 760 cases. The violence occurs due to challenges and limitations especially economic problems that families face as the consequences of the pandemic. This study also finds that imbalanced power relations between men and women due to a lack of awareness of gender equality become the root cause of the violence.

Abstract

Maraknya praktek pernikahan dini di masyarakat, serta undang-undang yang mengatur juga masih menjadi perdebatan, baik itu menurut Islam atau hukum Indonesia (Hukum Positif). Pada dasarnya, Hukum Islam tidak mengatur secara mutlak tentang batas umur perkawinan. Kematangan mental, fisik, kedewasaan berpikir dan ekonomi merupakan modal penting dalam mempersiapkan pernikahan. Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan sudah mengatur tentang batas usia pernikahan, yaitu 19 tahun untuk laki-laki dan 16 tahun untuk perempuan. Secara pengertian yang di maksud dengan pernikahan dini adalah pernikahan yang usianya kurang dari batas usia minimal menikah. Masalah yang muncul masih terdapat di masyarakat menikahkan anaknya di bawah umur dengan alasan-alasan yang mendesak yang mengakibatkan psikologi anak terganggu. Berdasarkan alasan tersebut penulis merasa tertarik untuk mengkaji lebih dalam tentang “Early Age Marriage ditinjau dari UU Perkawinan No. 1 Tahun 1974 dan Analisis Konsep Hukum Islam”. Metode penelitian ini menggunakan jenis penelitian kepustakaan (library Research). Sifat penelitian ini deskriptif analitik yaitu tertuju pada pemecahan masalah yang ada pada masa sekarang melalui kajian kepustakaan dalam konsep UU Perkawinan No. 1 tahun 1974 dan konsep analisis hukum Islam. Sedangkan fokus pembahasan di dalam tulisan ini adalah 1. Bagaimana pandangan Hukum fositif Indonesia tentang pernikahan dini 2. Bagaimana pernikahan dini dalam Konsep Hukum Islam di Indonesia 3. Apa faktor yang melatarbelakangi terjadinya pernikahan dini. 4. Apa dampak psikologis dari pernikahan dini pada anak. 5. Rekomendasi Penulis kepada pembaca. Tidak dapat dipungkiri bahwa pernikahan dini itu mempunyai dampak negatif dan positifnya, apabila dalam perkara itu dapat maslahat dan kerusaka, maka menolak kerusakan harus didahulukan atas pengambilan manfaat, jadi sebaiknya pernikahan dini itu harus dicegah mulai dari sekarang.

Abstract

This study talks about the ethnicity of the Southeast Asian community known as Malay Muslims. However, in the trail of pedestrians there are social gaps that are influenced by mindsets and politics that cause Muslims to be divided so that they are marginalized in certain countries, especially in Asian countries. Islamic historians argue that Southeast Asian Islam is categorized as a cultural area that is quite influential from the seven regions of Islamic culture in the world, such as Malaysia, Pattani and the Philippines. The focus in this discussion is How are Modern Islamic Traces and Thoughts in Malaysia, Pattani (Thailand) and in Mindanou (Philippines)?. The method used in this study is a qualitative type of literature while the approach used in this study is a historical approach. The results of this study are the occurrence of tensions between Malay Muslims in Malaysia, Thailand and the Philippines is caused by religious, ethnic, cultural and political issues brought into the state so that the conflict is getting hotter and until now there is no solution for peace for Asian countries that conflicted.

Abstract

Households in the modern era experience many challenges and problems, so that many households in their journey end up in a messy household. Husbands or wives and even children no longer feel comfortable in the house, so each of them looks for pleasure and an antidote for the anxiety he faces. From this background, the writer wants to explain scientifically about the sakinah family in the study of Islamic law. This research is a literature study by taking sources from books, journals and other literature that support this research. The findings of this study explain that in theory the Sakinah family is different from its practice in society. The application of the sakinah family can be grouped into three groups, First, to obey religious advice, Second, to create a sakinah family, Third, to develop Islamic da'wah.

Abstract

Poligami dalam Islam merupakan permasalahan perkawinan yang paling banyak diperdebatkan di masyarakat sekaligus kontroversi. Baru-baru ini di media masa masyarakat indonesia di hebohkan dengan adanya wacana Qanun : poligami di legalkan di Provinsi Aceh karena maraknya pernikahan sirri di kalangan abdi Negara yaitu Pegawai Negeri Sipil (PNS). Dalam masyarakat poligami sangat ditolak dengan berbagai macam argumentasi baik yang bersifat normative, psikologis bahkan selalu dikaitkan dengan ketidakadilan gender dalam rumah tangga. Melihat fenomena tersebut penulis menelusuri poligami dalam kajian tataran sosiologis yuridis, yang akhirnya dapat memberikan kesimpulan bahwa, Hukum Perkawinan dalam Islam membolehkan bagi seorang suami melakukan poligami dengan syarat kematangan, yakin atau kuat mampu berlaku adil terhadap istri-istrinya, sebagaimana yang di isyaratkan al-qur’an dalam surat al-Nisa’, [4]: 3 yang artinya “maka jika kamu takut tidak akan mampu berlaku adil, maka kawinlah seorang istri saja”. Kebolehan poligami ini bukan anjuran tetapi salah satu solusi yang diberikan dalam kondisi khusus kepada mereka (suami) yang sangat membutuhkan dan memenuhi syarat tertentu. Secara umum metode penelitian ini yang digunakan adalah penelitian normatif, yaitu penelitian yang diarahkan dan difokuskan terhadap penelitian bahan-bahan pustaka, yang ada kaitannya dengan masalah konsep keadilan dalam poligami, sebuah kajian yuridis.

Abstract

Imam Syafi’i berpendapat bahwa perkawinan akibat hamil diluar nikah adalah sah, perkawinan boleh dilangsungkan ketika seorang wanita dalam keadaan hamil. Baik perkawinan itu dilakuan dengan laki-laki yang menghamilinya ataupun dengan laki-laki yang bukan menghamilinya. Argumen Imam Syafi’i tentang kebolehan perkawinan tersebut adalah karena wanita tersebut bukanlah termasuk golongan wanita yang haram untuk dinikahi. Bayi yang lahir akibat hubungan diluar nikah nasabnya kembali kepadanya. Sedangkan menurut Imam Ahmad Bin Hambal berpendapat bahwa perkawinan hamil di luar nikah dilakukan dengan laki-laki yang menghamilinya tidak boleh. Sedangkan perkawinan hamil di luar nikah dengan laki-laki yang bukan menghamilinya itu haram hukumnya. Dari pendapat dua tokoh ulama tersebut ada perbedaan pendapat sehingga menarik untuk dibahas. Jenis penelitian ini adalah library research, penelitian yang digunakan penelitian normatif, yaitu penelitian yang diarahkan dan difokuskan terhadap penelitian bahan-bahan pustaka. Fokus kajian ini adalah bagaimana pendapat Imam Syafi’i dan Imam Ahmad bin Hambal tentang hamil di luar nikah dan status nasab anak. Dari fokus kajian menyimpulkan bahwa setiap mazhab khusus mazhab Imam Syafi’i yang digunakan di Indonesia, sepakat bahwa batas minimal kehamilan adalah enam bulan, apabila seorang wanita dan laki-laki kawin lalu melahirkan seorang anak dalam keadaan hidup dan sempurna bentuknya sebelum enam bulan, maka anak tersebut tidak bisa dikaitkan dengan nasab atas nama suaminya.

Abstract

This article explains how the Existence of the Marriage Agreement in the Sambas Community of the Indonesia-Malaysia Border. Based on the pros and cons of the Sambas Malay Society, especially about the marriage agreement regarding taklik talak as a marriage agreement in Islam. With qualitative research methods that are phenomenological observations in the field, the author wants to describe how the existence of divorce taklik talak as a marriage agreement in Islam itself and its practice in the Sambas Malay Community and the reasons for the pros and cons of religious leaders. Almost every prospective husband and wife in marriage to the Sambas Malay Community does not say sighat taklik talak by the husband to his wife after the ijab qobul consent. Sighat taklik talak only knowing that it has been written or listed in a marriage book without being notified to the husband and wife. Although divorce taklik talak has written in the marriage certificate is not an obligation to say. Still, once taklik talak has said, the taklik talak cannot be revoked again. If an agreement with a husband and wife did not fulfil by one of the parties, then the other party has the right to submit the matter to the Religious Court to resolve it. The study concludes that the pros and cons of divorce taklik talak as a marriage agreement in Islam cause a lack of knowledge about Marriage Law Number 1 of 1974 article 29 regarding marriage agreements and the Compilation of Islamic Law (KHI) Article 46 concerning taklik talak. And the lack of socialization of related parties from KUA through religious counsellors and BP4 in Sambas.

Abstract

Islam has its own views regarding women's equality. For example, it can be seen from the more prudent and far-sighted Islamic efforts to strive for women's equality on the one hand without eliminating that womanly nature on the other. Islamic society in this and other problems, is subject to what has been stipulated by Islamic law. Based on the above problems, what needs to be studied in this paper is how women are in the perspective of Islamic law, as the main study is the source of the law, rights and obligations of women in Islamic law. This study uses a literature approach that discusses relevant books on feminism and is filtered in Islamic law or sharia. This study concludes that in relation to the rights that women have, having a special responsibility to be implemented is not the same as that of men.

Abstract

Management in the management of zakat nationally was socialized after the issuance of Law Number 38 of 1999 concerning Zakat Management in Indonesia. However, in the course of the management of zakat management in Indonesia, there are problems in the formation of zakat management at the regional, district, sub-district and zakat managers in the form of community organizations. So that in zakat management the distribution of zakat is not right on target so that zakat management gets pros and cons in the community. The purpose of this study is to examine more deeply the implications of zakat management in Indonesia through the literature so that answers are obtained such as the contribution of solutions in this study. The methodology in this research is the type in this research is a qualitative research literature. While the approach in this study uses a normative juridical approach. The results in this study are the management of zakat management must be adjusted to the needs of those who are entitled to receive it according to the socio-economic conditions of Muslim citizens.

Abstract

This study aims to analyze how the practice of bird chirping competition with merger prizes and synchronization of registration ticket costs in the Alam Pesona Tebas Kuala field and how the bird chirping competition practice is based on Islamic law. This type of research is field research with descriptive qualitative research methods. The data collection techniques used are based on primary sources, namely interviews, observation and documentation in the field such as registration tickets, various kinds of prizes, chirping birds, informants, namely judges, participants, and the committee. And through secondary sources in the form of books related to this research. Based on the results of the research, it is concluded that the practice of the bird chirping competition with merger prizes and synchronization of registration ticket costs at the Alam Pesona Tebas Kuala field is a prize competition that prepares various kinds of prizes from several parties, namely from the sponsor, the committee in the form of a trophy and the participants in the form of cash collected from ticket purchases by participants. Based on Islamic law, the bird chirping competition is not in accordance with the principles of Islamic economics, which is to avoid maysir elements, because taking one of the competition prizes through the results of ticket purchases by participants is in the form of cash, so the law of cash prizes becomes haram. Because prize winners in the form of cash and trophies come from the committee, so the law to use the prizes is makruh
