Abstract

The use of Peer to Peer Lending (P2P Lending) has been increasing rapidly since the Covid-19 pandemic in Indonesia, online loan has become a financing option for individuals and business entities. However, the facts showed that some P2P Lending providers operate without proper licenses from the Financial Services Authority (OJK), resulting in huge disadvantages for the borrowers as a result of illegal P2P Lending. This paper will analyze the legal aspects of P2P Lending in terms of risks, from its legality to supervision, and the role of associations in building a sustainable fintech ecosystem. Legal risks should be differentiated from investment risks in which from the user side, especially the borrowers, it is important to act proactively to check whether P2P Lending providers are legal and registered with OJK for risk management. This paper uses normative research by referring to some P2P Lending prevailing laws and regulations in Indonesia as well as factual facts. There are two types of approaches used, namely the statute and conceptual approach, to obtain the desired research results.Bahasa Indonesia Abstrak: Penggunaan Peer to Peer Lending (P2P Lending) sangat berkembang pesat sejak pandemi Covid-19 di Indonesia, pinjaman online menjadi salah satu opsi pembiayaan baik bagi individu sampai dengan badan usaha. Akan tetapi, fakta menunjukan bahwa cukup banyak penyelenggara P2P Lending yang beroperasi namun tidak memiliki izin resmi dari Otoritas Jasa Keuangan (OJK), yang pada akhirnya mengakibatkan banyak pengguna yang merasa dirugikan akibat P2P Lending ilegal. Tulisan ini akan menganalisis aspek hukum dari P2P Lending dari segi risiko, legalitas sampai dengan pengawasan, serta peranan asosiasi dalam membangun ekosistem fintech yang berkelanjutan. Risiko hukum harus dibedakan dari risiko investasi dari sisi pengguna terutama peminjam, sangatlah penting untuk berperan proaktif mencari tahu penyelenggara P2P Lending legal dan terdaftar di OJK dalam rangka manajemen risiko. Jurnal ini menggunakan penelitian normatif dengan mengacu pada ketentuan hukum dan peraturan P2P Lending yang berlaku di Indonesia. Ada dua jenis pendekatan yang digunakan yaitu pendekatan undang-undang dan konseptual, guna mendapatkan hasil penelitian yang diinginkan.

Abstract

The beauty industry is growing faster than ever. Naturally, this is the result of people wanting to look good and be at their best. When it comes to the environment, the beauty industry can be a pretty ugly place. The beauty industry produces 120 billion units of packaging a year. Most of the packaging is not recyclable. Consumers are demanding sustainability and beauty brands are up to the challenge. In fact, some brands have integrated sustainability issues to their production process, the next question whether the consumers especially in Indonesia are ready for these changes? This paper will discuss whether the consumers in Indonesia are ready for the sustainable trend and also discuss how the packaging of their beauty products can be managed properly which includes the waste management system in Indonesia. Sustainability is not limited to the production process but also covers the way of consumers manage the waste of their beauty products. Multiple stakeholders have their own interests and roles in order to make things work properly from the regulator, private sectors and also consumers. For this paper, the Author adopts a normative research by referring to some prevailing laws and regulations in Indonesia and Korea in terms of waste management policies. Further, the Author refers to statute and also comparative approaches in order to get the expected results.Bahasa Indonesia Abstrak: Industri kecantikan saat ini berkembang dengan sangat pesat dibanding periode-periode sebelumnya. Tidak dapat dipungkiri bahwa hal ini dikarenakan adanya urgensi bagi orang-orang untuk tampil sebaik mungkin. Ketika bicara tentang lingkungan, industri kecantikan pun memiliki sisi gelap di mana industri kecantikan menghasilkan 120 miliar kemasan setiap tahunnya dan kebanyakan kemasan tersebut tidak dapat didaur ulang. Konsumen saat ini menuntut adanya konsep keberlanjutan dan beberapa brand sudah menunjukkan beberapa upaya untuk memenuhi permintaan konsumen. Pada kenyataannya, beberapa brand telah mengintegrasikan konsep keberlanjutan dalam proses produksi, pertanyaan sebelumnya apakah konsumen terutama di Indonesia telah siap untuk berpartisipasi dalam tren keberlanjutan ini dan bagaimana kemasan produk kecantikan dapat dikelola dengan baik dilihat dari sisi sistem pengelolaan sampah di Indonesia. Pada dasarnya konsep keberlanjutan tidak hanya terbatas pada proses produksi melainkan juga mencakup bagaimana konsumen mengelola sampah kemasan produk kecantikan mereka. Dalam hal ini, beberapa pemangku kepentingan memiliki kepentingan serta perannya masing-masing untuk memastikan konsep ini berjalan dengan baik dari sisi pembuat kebijakan, sektor swasta dan juga konsumen. Artikel ini akan berfokus pada penelitian normatif dengan mengacu pada ketentuan hukum dan peraturan yang berlaku di Indonesia maupun Korea sebagai perbandingan dalam pengelolaan sampah secara umum. Selanjutnya, digunakan dua jenis pendekatan, yaitu pendekatan asas-asas hukum serta perbandingan hukum, untuk mendapatkan hasil yang diinginkan.

Abstract

 AbstractGlobalization and the rise of international trade of goods and services influence human health - can be both positive and negative. In order to strike a balance between trade and health, policy coherence at the country level is the key to achieve it. The first step towards policy coherence is the development of a good understanding of the issues, based on the analysis of the situation from both a health and trade perspective. This paper discusses on how to strike a balance between trade and health by referring to the latest plain packaging case which brought to WTO dispute settlement forum. After a long process, finally the Panel ruled in favor of the respondent, in this case Australia for their plain packaging policy. The Panel found that there is no alternative measure that can achieve the same objective – for public health which allows Australia to continue the implementation of their plain packaging policy.   Abstrak Globalisasi dan perkembangan perdagangan internasional pada barang maupun jasa mempengaruhi kesehatan manusia, dalam hal ini pengaruh dapat bersifat positif maupun negatif. Untuk dapat menyeimbangkan kepentingan perdagangan dan perlindungan kesehatan, koherensi kebijakan di tingkat negara memegang peranan yang penting. Langkah pertama dalam koherensi kebijakan ini dapat dimulai dengan adanya pemahaman yang baik terhadap isu terkait dengan didasarkan pada analisa situasi dari sisi perdagangan maupun kesehatan. Tulisan ini membahas tentang bagaimana menyeimbangkan kepentingan perdagangan dan kesehatan dengan mengacu pada studi kasus plain packaging yang dibawa pada sistem penyelesaian sengketa WTO. Setelah melewati proses yang panjang, akhirnya Panel WTO berpihak pada responden/pihak tergugat dalam kasus ini yaitu Australia. Panel menyatakan bahwa tidak ada kebijakan alternatif yang dapat diterapkan untuk dapat memenuhi tujuan yang sama, yakni perlindungan kesehatan masyarakat yang mana memperbolehkan Australia untuk tetap melanjutkan penerapan kebijakan plain packaging yang sudah dimulai sejak tahun 2012.

Abstract

Repackaging products in share-in-jar is a process of dividing the contents of a product from its original size into several smaller containers. Such products are popular amongst consumers who are looking for product samples to try on before buying the actual product that tends to be costly. However, several business actors are selling share-in-jar products that do not conform with the applicable law, namely by failing to comply with the sanitary and hygiene requirements during the repackaging process and not providing detailed product information, therefore, resulting in consumer losses. In light of this, a controversy arose concerning legal protection for consumers who suffer losses as a result of the sale of cosmetics in share-in-jar and the legal liability of business actors for the losses incurred by consumers who use share in jar cosmetics. The objective of this research is to look into the consumer protection policies that develop as a result of violations of the Indonesian Law, as well as the legal culpability of business actors for infringing on consumers' rights while buying and selling cosmetics.
