Abstract

Pluralisme merupakan kosa kata baru bagi orang Indonesia, meskipun pengalaman dalam hal pluralisme ini sudah lama ada. Kosa kata ini semakin menjadi asing di tengah masyarakat, terlebih sejak keluarnya fatwa MUI tahun 2005 yang menolak ide pluralisme keagamaan. Indonesia dengan ribuan pulaunya tentu saja menganut pluralisme karena perbedaan kultur dan nilai budaya yang ada. Pluralistic state adalah sebuah kenyataan. Bagaimana Perguruan Tinggi Keagamaan Islam (PTKI) di Indonesia menghadapi problem pluralisme ini? Bagaimana pula posisi perguruan tinggi ini di tengah mayoritas umat Islam sebagai penduduk dominan di negeri ini? Dengan orientasi baru sebagai pluralistic university, PTKI mampu merevitalisasi perannya dalam negara Indonesia modern. Hubungan antar unsur civitas academica di dalamnya tidak lagi merefleksikan bentuk relasi atas-bawah melainkan lebih sebagai hubungan sejajar dari berbagai bentuk asosiasi yang beragam. Hanya dengan perspektif pluralistis inilah, kajian-kajian yang dilakukan di dalamnya akan mampu merefleksikan Islam sebagai raḥmah lil-‘ālamīn.

Abstract

This article aims to analyze various legal traditions working within the implementation of Islamic law after special autonomy in Aceh. Although Aceh's legal system follows the national legal system derived from civil law, diverse legal traditions still exist. The scope of this study is limited to the interaction of Aceh's legal traditions by taking the construction of juvenile and immoral criminal law and describing the social authorities who also operate the legal tradition to the parties in the case. This study presents the results using a case study model. Data obtained from interviews and documentation, analyzed using an interlegality approach. Based on the results of data analysis, it was found that the dialectic of legal traditions is determined by the role of actors acting as companions for victims to ensure that the rights of victims are not neglected. The traditions of Islamic law, customary law, and laws for protecting women and children are used interchangeably. The effort to combine these three legal traditions was carried out to obtain justice and guarantee the fulfillment of the victim's civil rights, such as the right to continue education, to relieve the trauma caused by the psychological pressure. The amalgamation of legal traditions in Aceh is an effective way to achieve justice for women and children and the construction of new laws to develop a national legal system that favors the interests of victims.

Abstract

As one of the Asian countries substantiating Islam as the official state religion, Malaysia always faces a dilemma in its encounter with international law, amid the dominance of municipal (national) and Islamic laws. Until now, many norms of international law seem to be apprehensively accepted. In fact, the existence of Islamic law, constitutionally recognized  as having an equal position with Common Law, often works as a barrier to the influence of international norms. Here, the segregation between British Common Law and Islamic law has played a major role in building the country's behavior in facing international law. Particularly, in redressing hard cases, international legal norms (such as international human rights law) are still difficult to get in and provide a positive influence in the national legal system. This paper focuses on the interaction between these three legal traditions of international, municipal and Islam in the face of rising Islamic conservatism supported by Malaysian Islamic parties in recent decades. Because legal segregation and compartmentalization between British common law and Islamic law had been chosen as the framework of legal pluralism in this country, the redress of the hard cases involving the meeting among the three laws --such as the case of apostasy, divorce due to apostasy, purdah etc.--, more often than not has led to the marginalization of international norms. This brings the consequence of the need to review the pattern of legal pluralism in this country, where relationship between different legal traditions is analyzed using bottom-up and non-state oriented perspectives. And it can only be done if the jurisprudence of legal pluralism in Malaysia can benefit the principles of Higher Law in its legal orientation; namely, the principles of universal justice, morality, and fairness, and not in the mere proximity to the character and the logic of official state law.

Abstract

Keeping in mind the Indonesian Government's policy regarding legal pluralism, this article will take a closer look at how the Government deals with the existence of both Islamic law and customary law (adat). The adoption of "state law pluralism", especially by the New Order regime since 1970s, has had an evident impact on the way the state handles the institution of adat and Islamic law (shari'ah). The question is what is the motive behind employing this strategy? This is a question that necessitates more a socio-political approach in the study of comparative law, drawing on a number of regulations and acts related to adat and Islamic law as the primary sources.DOI: 10.15408/sdi.v14i2.545

Abstract

This paper will address the development of Indonesian law in the post-independence era. In the following pages, this paper will demonstrate that changes in the country's political climate affected born the Islamic and adat (customary) courts,in spire of the inflexibility with which both legal traditions had weathered the political upheavals of the first half of the century. To this end, the place of both adat and religious courts in post-independence Indonesia will be analyzed in light of this political change. Two major avenues of investigation will be discussed. The first explains the debate between "pluralist" and "uniformist" groups regarding legal development in the young Republic of Indonesia, while the second discusses contentions between the so-called "secular nationalists" and "Muslims". The discussion provided in these sections is intended to provide a basis for understanding the legal controversies which unavoidably arose as a result of the shift from a colonial to a narional legal philosophy.DOI: 10.15408/sdi.v6i2.731

Abstract

This paper addresses the deficiency of the doctrinal approach in Islamic legal studies. There is an emergent need to comprehend Islamic law from the standpoint of its practical aspects: that is, how the law is intended to produce certain results, whether it gives expected results, and whether an identifiable result is consistent with the reason for the law as one might have expected. This paper examines the discourse of legal Islamization from the perspective of its practical aspects, that is, how the idea is developed, campaigned, and impregnated in Muslim societies. A study of the organizations Majlis Mujahidin Indonesia (MMI) and Gerakan Reformis Islam (Garis) shows that both groups had different concerns. While MMI focused on the theoretical legal system, Garis was more concerned with the practical realm of law; yet the two are the same in orientation as they are both concerned with how everyday life is regulated for Muslims.

Abstract

This article explains why Indonesian Ulama and Islamic jurists who oppose the Constitutional Court decision have failed to see the progressive norms in Islam and human rights. They argued that the decision determining that the children born out of wedlock have filiation not only with their mother but also with their father contrasted to and has no legal basis in Islamic jurisprudence. Therefore, this paper will provide the rationale of the  arguments of Islamic jurists, including Indonesian ulama, and the proponent  of the Indonesian Constitutional Court decision. In conclusion, Indonesian ulama and Islamic jurists have been embracing the conservatism point of view, that is static and textual thinking in interpreting the Ḥadith concerning the issue of a child out of wedlock. As a result, they did not accept another interpretation. Other interpretations are delivered by classical Islamic jurists like Ibn Taimiyyah and Ibrahim al-Nakhā'ī, who argued that a child out of wedlock has a civil relationship with their parents. Meanwhile, the proponent of the Indonesian Court decision adheres to the progressive point of view that considers the children's public interest.  Artikel ini menjelaskan mengapa para ulama dan ahli hukum Islam Indonesia yang menentang keputusan Mahkamah Konstitusi (MK) telah gagal melihat norma-norma progresif dalam Islam dan hak asasi manusia. Mereka berargumen bahwa keputusan yang menetapkan bahwa anak yang lahir di luar nikah memiliki hubungan nasab tidak hanya dengan ibunya tetapi juga dengan ayahnya bertentangan dan tidak memiliki dasar hukum dalam yurisprudensi Islam. Oleh karena itu, makalah ini akan memberikan dasar pemikiran dari argumen para ahli hukum Islam, termasuk ulama Indonesia, dan pendukung keputusan Mahkamah Konstitusi Indonesia. Kesimpulannya, para ulama dan ahli hukum Islam Indonesia selama ini menganut pandangan konservatisme, yaitu pemikiran yang statis dan tekstual dalam menafsirkan hadis tentang masalah anak di luar nikah. Akibatnya, mereka tidak menerima penafsiran lain. Padahal, ada penafsiran lain disampaikan oleh para ahli hukum Islam klasik seperti Ibnu Taimiyyah dan Ibrahim al-Nakhā'ī, yang berpendapat bahwa  anak di luar nikah memiliki hubungan keperdataan dengan orang tuanya.  Sementara itu, pendukung putusan MK menganut pandangan progresif yang mempertimbangkan kepentingan umum-anak-anak.

Abstract

Religious discussions among previous socio-religious scholars used to focus more on authority, righteousness, commodification efforts, and the pursuit of financial gains by religious figures. However, this seems less relevant in today's digital age, where people can access and share religious knowledge from various sources. This article aims to explore this phenomenon by examining the approach of a da'wah influencer, Ayu Momalula. She presents counseling da'wah content as a form of self-expression, creating an ideal Muslim woman figure for her social media followers. Using an exploratory qualitative method and online ethnographic approach, primary data was obtained from interviews via WhatsApp and Zoom, as well as from observation of content on her Instagram accounts and books. The study argues that Ayu Momalula's counseling da'wah activities aim to establish herself as an ideal Muslim woman, supporting her authority as a religious micro-celebrity. The article analyzes her subjectivity as a Muslim women micro-celebrity, highlighting her representation of a pious wife and modern mompreneur through content visualization on social media. This study suggests that Ayu Momalula actively promotes productivity in both work and preaching to her specific target audience.
