Abstract

Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis tentang perlindungan hukum pembeli lelang dari pelaksana lelang dan Badan Pertanahan Nasional (BPN) dan untuk mengetahui dan menganalisis upaya hukum yang dapat dilakukan oleh pembeli lelang untuk mempertahankan hak keperdataan atas obyek lelang; Menurut peneliti; (1) Dalam Putusan Pengadilan Negeri Denpasar Nomor 83/Pdt.G/2008/PN/Dps, pemenang lelang membeli tanah berdasarkan sertifikat yang semestinya telah dimusnahkan dan karena sertifikat tersebut cacat secara hukum, maka pembeli lelang tidak mendapatkan perlindungan hukum. Akan tetapi, perlindungan hukum yang dapat diterapkan dalam perkara sertifikat ganda yaitu perlindungan hukum secara represif, sehingga dapat memberikan perlindungan yang secara nyata; (2) bahwa upaya hukum yang dapat dilakukan pembeli lelang dalam perkara sertifikat ganda pada Putusan Pengadilan Negeri Denpasar Nomor No.83/Pdt.G/2008/PN.Dps adalah upaya hukum peninjauan kembali ke Mahkamah Agung.

Abstract

Trade security measures (safeguards) are government policies of importing countries to recover serious losses or prevent the threat of serious losses to domestic industries as a result of a surge in imports of similar goods are directly competitive. The purpose of this study is to analyze safeguard regulation in international trade, and to analyze the implementation of safeguards to protect domestic industries. This research is a normative legal research with a statute approach, a conceptual approach and a comparative approach. The technique of collecting legal materials is conducted by literature study. The analysis of legal materials was carried out in a qualitative descriptive manner. The results show that the safeguard arrangement is intended as a legal basis for the government to take security measures to recover serious losses and / or prevent the threat of serious losses from the domestic industry as a result of a surge in imports of similar goods which are directly competitors to domestic industrial products. The implementation of safeguards by importing countries is carried out by the Trade Safeguard Committee through stages, namely starting from investigation and evidence, determining the existence of a loss or threat of loss, and implementing security measures.

Abstract

This research was conducted to find out how the directors' accountability mechanism caused by an error or negligence caused the limited company to go bankrupt and how the legal consequences on the bankruptcy of a limited liability company. This type of research was classified as a normative legal research or also called doctrinal research, namely research that examined the law as a separate system that was separate from various other systems in society so as to provide a boundary between the legal system with other systems. The approach method used was the statutory approach; and Conceptual Approach. In principle, the Board of Directors was not personally responsible for acts committed for and on behalf of the company based on its authority. The scope of conduct that would be personally accounted for by the directors of the company was negligence because the directors did not fulfill the contents of the agreement and mistakes because the directors commit acts against the law. Bankruptcy of a Limited Liability Company was the bankruptcy of itself, not the bankruptcy of its management, even though the bankruptcy was due to the negligence of its management. So that management should not be held liable jointly for any losses due to negligence and could only be held accountable if the company's assets were not sufficient to cover losses due to bankruptcy Article 90 paragraph (2) of the Limited Liability Company Law).

Abstract

This research aims to find out the authority and process and mechanism of land acquisition for private interests in terms of building the smelter facility of PT. Amman Mineral Nusa Tenggara (AMMAN) in the industrial area of Maluk Village, Maluk District, West Sumbawa Regency which is a National Strategic Project regulated in the Presidential Regulation of the Republic of Indonesia Number 18 of 2020 concerning the 2020-2024 National Medium Term Development Plan. In carrying out the development agenda (national priority) of the 2020-2024 RPJMN, Strategic Priority Projects (Major Projects) are prepared, namely 9 industrial areas outside Java and 31 smelters. In this regard, in terms of solving problems or answering problems, empirical normative types are used by using 3 approaches, namely the Conceptual Approach, the Statute Approach and the case approach by collecting data which includes data Primary and secondary data were studied and analyzed using qualitative-descriptive analysis. By using this method, the author is finally able to answer the existing problems, namely land acquisition for private interests in terms of the construction of PT. Amman Mineral Nusa Tenggara (AMMAN) based on Law Number 2 of 2012 concerning Land Acquisition for Public Interest for the construction of a smelter is carried out through 4 stages, namely the planning stage, the preparation stage, then the implementation stage and the results delivery stage. As for the process of implementing compensation for land acquisition for the public interest, the construction of the smelter PT. AMNT starts from the stages of inventory and identification of land tenure, ownership, use and utilization. After the inventory was carried out, the implementing team then carried out an assessment of compensation for community land which included the area of land required in this land acquisition.

Abstract

Penelitian ini beretujuan untuk menemukan jawaban terhadap dua isu hukum utama yaitu apakah dasar pertimbangan hakim dalam memeriksa dan mengadili perkara perbuatan melanggar hukum dalam perjanjian Kerjasama pengelolaan Villa Stanly? Dan Langkah hukum apakah yang dapat dilakukan oleh Pemilik PT. PMA untuk melindungi kepentingan keperdataannya yang dirugikan dalam perjanjian Kerjasama pengelolaan Villa Stanly?. Peneliitian ini merupakan penelitian hukum normativf dengan menggunakan pendekatan konseptuan, pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan Bahwa dalam sengketa keperdataan yang dicari adalah kebenaran “formil” maka majelis hakim dalam mempertimbangkan putusan berpedoman pada legalitas kepemilikan berdasarkan bukti sertifikat sebagaimana ditentukan dalam UUPA dan PP Nomer 24 tahun 1997 tentang pendaftaran tanah, bahwa bukti terkuat dan terpenuh dalam legaliitas kepemiliikan hak atas tanah adalah sertifikat. Sehingga Gugatan PT. PMA ditolak meskiipun seluruh dokumen pendukung yang menunjukkan secara materil adalah hak milik Warga Negara Asing yang diperuntukkan sebagai asset PT.PMA. Bahwa untuk melindungi kepentingan keperdataannya yang dirugikan dalam perjanjian kerjasama pengelolaan hotel/Vila Stanly, maka pihak WNA selaku pemilik PT. PMA dapat melaporkan pihak WNI berdasarkan pasal 372 KUH Pidana dan atau Pasal 378 KUH Pidana.

Abstract

Penelitian ini bertujuan untuk meneliti “ bagaimana perlindungan hukum bagi tenaga kerja asing , Apa saja sanksi hukum bagi pemberi kerja yang tidak membayar dana kompensasi penggunaan tenaga kerjaasing. Untuk meneliti permasalahan di atas, maka penulis mengunakan metode penelitian nomatif dengan pendekatan perundang undangan (statute aproach). Hasil Penelitian membuktikan bahwa Perlindungan hukum terhadap Tenaga Kerja Asing pasca berlakunya Peraturan Pemerintah No. 34 Tahun 2021 sangat maksimal yaitu Pemberi Kerja Menunjuk Tenaga Kerja Warga Negara Indonesia sebagai Tenaga Kerja Pendamping untuk Tenaga Kerja Asing (TKA). Memberikan Pelaksanaan pendidikan dan pelatihan bagi Tenaga Kerja Pendamping untuk Tenaga Kerja Asing (TKA). Memberikan Pelatihan Bahasa Indonesia bagi Tenaga Kerja Asing (TKA) difasilitasi pemberi kerja. Memulangkan Tenaga Kerja Asing (TKA) setelah perjanjian kerja berakhir. Menjamin pelindungan Tenaga Kerja Asing (TKA) melalui jaminan sosial Tenaga Kerja Asing (TKA) bekerja lebih dari enam (6) bulan dan asuransi kurang dari enam (6) bulan. Sanksi hukum bagi pemberi kerja yang tidak membayar dana kompensasi penggunaan tenaga kerja asing adalah berupa sanksi denda, sanksi penghentian sementara proses permohonan RPTKA dan Pencabutan RPTKA.
