Abstract

Penelitian ini bertujuan untuk menganalisis kewenangan dan perlindungan hukum dokter gigi dalam melakukan tindakan kegawatdaruratan medis selama program internsip. Program internsip dokter gigi dapat dipandang sebagai tahap peningkatan kualitas tenaga kesehatan profesional guna menerapkan kompetensi yang dimiliki dalam praktik di masa mendatang. Namun, pengalaman dokter gigi internsip dalam menangani kasus kegawatdaruratan masih terbatas sehingga tindakan tersebut sering kali mengandung risiko medis dan dapat memengaruhi kepercayaan pasien. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Analisis dilakukan terhadap berbagai peraturan, termasuk Undang-Undang Nomor 17 Tahun 2023 dan Peraturan Menteri Kesehatan Nomor 7 Tahun 2022. Hasil penelitian menunjukkan bahwa dokter gigi internsip memiliki kewenangan formal untuk melakukan tindakan kegawatdaruratan medis sesuai dengan Surat Tanda Registrasi dan Surat Izin Praktik yang dimiliki. Perlindungan hukum diberikan sepanjang dokter gigi menjalankan tugas sesuai standar profesi, standar pelayanan, serta standar prosedur operasional (SOP). Dalam keadaan darurat, dokter gigi diperbolehkan melakukan tindakan di luar kewenangan klinisnya demi keselamatan pasien dan dapat memperoleh pengecualian dari tuntutan tanggung jawab. Kesimpulannya, perlindungan hukum bagi dokter gigi internsip telah diatur secara normatif, namun upaya preventif masih perlu ditingkatkan melalui pengawasan rutin serta penguatan standar operasional di setiap wahana internsip.

Abstract

Untuk menganalisis layanan vaksinasi COVID-19 bagi masyarakat Indonesia dalam perspektif hak asasi manusia atas kesehatan dan tanggung jawab negara untuk memenuhi hak asasi manusia atas kesehatan dalam pelaksanaan vaksinasi, dilakukan penelitian terhadap kedua hal tersebut. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Beberapa hal yang ditemukan dalam penelitian ini, antara lain mengenai kebijakan pemerintah dalam pemberian vaksin Covid-19 yang menuai berbagai sudut pandang, termasuk sudut pandang hak asasi manusia. Dalam hal ini dinamika yang terjadi terhadap layanan yang diberikan cukup membuat pemerintah berhasil dan bertahan dalam melaksanakan kebijakan tersebut. Hal ini kemudian menjadikannya sebagai bentuk tanggung jawab negara dalam penanganan Covid-19 di Indonesia. Tanggung jawab yang diberikan tidak hanya sekedar memberikan vaksin, tetapi juga terdapat perlindungan hukum bagi masyarakat Indonesia yang telah divaksinasi. Hal ini juga karena melihat beberapa negara menerapkan hal ini yang didukung oleh instrumen hukum internasional dalam penanganan Covid-19 di Indonesia.

Abstract

Dalam praktiknya, proses pemasangan implan gigi merupakan bagian yang tidak terpisahkan dari praktik profesional dokter gigi. Namun demikian, dokter gigi juga perlu memperhatikan pedoman yang digunakan dalam pemasangan implan gigi. Selain pedoman yang bersumber dari aspek medis, perhatian terhadap pedoman dari aspek hukum juga sangat diperlukan agar dokter gigi dapat terhindar dari sanksi yang berpotensi menjeratnya dalam tindakan pemasangan implan gigi. Penelitian ini mengkaji secara yuridis normatif mengenai pemasangan implan gigi di Indonesia, dengan harapan dapat memberikan pemahaman yang lebih komprehensif kepada dokter gigi mengenai pengaturan regulasi yang berlaku, sehingga dokter gigi memperoleh perlindungan hukum. Hasil penelitian menunjukkan bahwa terdapat dua norma yang mengatur pemasangan implan gigi, baik bagi dokter gigi nonspesialis maupun dokter gigi spesialis. Pengaturan tersebut tercantum dalam Peraturan Konsil Kedokteran Indonesia Nomor 48/KKI/PER/XII/2010 tentang Kewenangan Tambahan Dokter dan Dokter Gigi, serta Keputusan yang dikeluarkan oleh Organisasi Profesi Persatuan Dokter Gigi Indonesia (PDGI) mengenai Kegiatan Ilmiah Terstruktur (KIT). Selain itu, dalam praktik pemasangan implan gigi, dokter gigi berpotensi menghadapi sengketa medis yang dapat berujung pada proses litigasi, baik pidana maupun perdata, serta dapat pula diselesaikan melalui mekanisme penyelesaian sengketa nonlitigasi.

Abstract

Abuse of official authority by Indonesian National Armed Forces (INAF) soldiers is a legal issue that is not only related to criminal liability, but also concerns the principles of the rule of law, judicial independence, and the protection of human rights. This study aims to analyze the conformity of the law enforcement process against INAF soldiers who commit abuse of official authority with the principles of the rule of law and examine the correlation between military criminal law and state administrative law from the perspective of detournement de pouvoir. The study uses a normative legal method with a statutory, conceptual, case, and comparative approach. Legal materials were obtained through library studies that include laws and regulations, court decisions, scientific literature, and other supporting documents, then analyzed qualitatively through legal interpretation and juridical analysis. The results of the study indicate that although the regulations regarding the criminal liability of INAF soldiers have a clear legal basis, their implementation does not fully reflect the principles of the rule of law. Problems are still found in the aspects of the independence of investigators, prosecutors, and military judges, the connectivity mechanism, and the orientation of jurisdiction that is based more on the status of the perpetrator than the character of the crime. This study also found that the concept of detournement de pouvoir provides a meeting point between military criminal law and state administrative law in assessing abuse of office. Therefore, military justice reform, strengthening the independence of law enforcement officials, and harmonizing legal regulations are needed to achieve transparent, accountable law enforcement that aligns with the principles of equality before the law, fair trial, and human rights protection.

Abstract

Background: The Indonesian National Armed Forces personnel’s criminal penalty is still mostly governed by the Dutch colonial law, the Military Criminal Code. It creates a vacuum between military criminal law and the present Indonesian legal order, especially following the enactment of Law No. 1 of 2023 about the Indonesian Criminal Code. The problem is not merely doctrinal but also socio-legal, because military punishment operates within military hierarchy, institutional culture, and broader public expectations of justice, because the military punishment works within the military hierarchy, institutional culture, public expectations of justice, and Islamic legal norms as a living legal system in Indonesian Muslim society.   Purpose:  This study reconceptualizes military punishment in Indonesia by examining the relationship between progressive law, Islamic legal ethics, and the institutional governance of soldier punishment   Methods: This study employs doctrinal legal research informed by socio-legal and interdisciplinary perspectives. It adopts a legislative, conceptual and socio-legal approach. Legal materials used to study the interplay between legal norms, military institutions and lived Islamic values include primary, secondary and non-legal materials that interpret, systematize and assess.   Results: The study indicates that military punishment should not be confined to retribution or institutional discipline. It is to be legal correction, moral instruction, rehabilitation, and public protection.  The study proposes a framework that integrates substantive justice, Islamic ethical evaluation, institutional accountability, and judicial independence in soldier punishment   Implication:  Military criminal law reform should be directed to a paradigm of sustainable justice, which reconciles military discipline and ethical accountability, legal certainty and social legitimacy, state power and Islamic lived values. Originality:   This study provides a socio-legal paradigm to connect progressive legislation, military ethics, Islamic lived law, and responsive government in improving Indonesian military punishment
