Abstract

This study aims to examine the implementation of the partnership agreement between the Indonesian Pos Agent and PT Pos Indonesia (Persero) as well as the legal protection provided to PT. Pos Indonesia if there is a default from the postal agent. The research method used is an empirical legal method with a Fact, Sociological and Legislative approach. The results of this study indicate that the implementation of the partnership cooperation agreement between Pos Indonesia agents and PT Pos Indonesia (Persero) faces several problems, both in the operational and non-operational sections. One of the problems outside of operations is an error in the weight of the scales made by the postal agent which causes losses. In this case, PT. Pos Indonesia is given preventive and repressive legal protection. Preventive legal protection is carried out to prevent negligence, while repressive legal protection is carried out through reprimands, sanctions and compensation until the termination of the agreement permanently.

Abstract

Pengembangan potensi koperasi yang ada di Bali khususnya untuk Koperasi Konsumen Kumbasari perlu mendapatkan perhatian. yang mana saat ini banyak menghadapi tantangan. Pengabdian Kepada Masyarakat yang dilaksanakan oleh Universitas Warmadewa ini bertujuan untuk memberikan pendampingan dan pembinaan yang diharapkan agar koperasi di Bali khususnya yang bergerak di bidang serba usaha dapat terus tumbuh dan berkembang sehingga dapat memberikan manfaat dan kesejahteraan bagi anggotanya maupun masyarakat sekitar. Koperasi Konsumen Kumbasari di Pasar Kumbasari Denpasar Barat dibentuk untuk mewujudkan agar di Denpasar memiliki koperasi yang dilatarbelakangi oleh kesadaran penuh bahwa koperasi merupakan wadah perekonomian rakyat dalam demokrasi, ada beberapa permasalahan pada koperasi ini yang perlu mendapat perhatian yakni pertama, tata kelola manajemen yang masih manual Kedua, adanya permasalahan kredit yang disebabkan masih lemahnya format perjanjian simpan pinjam. Dari data yang diperoleh maka diperlukan suatu manajemen administrasi yang berbasis IT bagi Koperasi Konsumen Kumbasari Kota Denpasar melalui pendekatan pembinaan serta adanya model perjanjian simpan pinjam yang tepat sehingga dapat mengatasi permasalahan kredit bermasalah.

Abstract

Perkembangan pesat pinjaman online (pinjol) di Indonesia memberikan kemudahan akses dana tunai secara cepat, namun juga memicu pelanggaran hak konsumen yang meluas, terutama melalui praktik penagihan utang yang agresif dan tidak etis seperti intimidasi, pelanggaran privasi data, serta teror psikologis. Penelitian ini bertujuan menganalisis mekanisme perlindungan hukum bagi konsumen dalam penagihan pinjaman online serta mengidentifikasi bentuk pelanggaran asas perlindungan konsumen berdasarkan regulasi di Indonesia. Dengan metode yuridis normatif dan pendekatan perundang-undangan, penelitian mengandalkan sumber hukum primer (UUPK 1999, UU ITE, UU PDP 2022, berbagai POJK OJK) serta sumber sekunder (buku, jurnal, laporan resmi). Hasil penelitian yaitu perlindungan hukum dilaksanakan melalui mekanisme preventif (pengaturan ketat OJK mengenai bunga, modal minimum, pembatasan akses CAMILAN, serta sertifikasi debt collector) dan represif (sanksi administratif hingga Rp15 miliar serta pidana berdasarkan KUHP, UU ITE, dan UU PDP). Namun, terdapat kesenjangan signifikan karena maraknya pinjol ilegal melakukan pemerasan dan doxing, merusak martabat konsumen, serta kepercayaan terhadap ekosistem fintech. Diperlukan penegakan sanksi yang lebih tegas oleh OJK dan kepolisian serta tanggung jawab penyelenggara platform terhadap tindakan pihak ketiga menjamin kepastian hukum dan menjaga harkat manusia di sektor jasa keuangan digital.

Abstract

Transportation is currently divided into three types, namely land transportation, sea transportation and air transportation. Nowadays, many people prefer to use air transportation since air transportation can travel long distances in a relatively shorter time. However, it is not infrequently for airlines to cause losses to consumers, especially to people with disabilities. Where as fact people with disabilities should get special treatment. Therefore, these problems can be examined as follows: 1) how is the legal protection for people with disabilities in the positive law in Indonesia? 2) What is the regulation of the rights of consumers with disabilities as airplane passengers? This presentation used normative research methods to find whether there are legal rules according to legal norms or not, whether there are norms in the form of orders or prohibitions in accordance with legal principles or not and whether one’s actions are in accordance with legal norms or not by using a legal and conceptual approach. This research required a source of secondary legal material as the main legal material. People with disabilities have the right to receive special services and facilities while at an airport or aircraft. The government has made legislation as a form of legal protection for people with disabilities. Nevertheless, the government must be more assertive in order to avoid discrimination against people with disabilities. Furthermore, it is not only the government that must provide legal protection for people with disabilities but also the community. The community must change the mindset about people with disabilities who are considered unable to do anything, and they must help people with disabilities to get equal treatment before the law.

Abstract

Mediation is an alternative form of dispute resolution. Mediation has grown and developed, running fast, the desire of humans or the community to resolve disputes quickly, and satisfying both parties to the dispute, According to PERMA No. 1 of 2016 concerning Procedure for Mediation in the Court determining that Mediation is a way to settle disputes peacefully, quickly, right, and effective, can open wider access to the parties to the dispute to obtain a settlement of the case, and get a sense of justice. Accounts payable is an agreement that creates rights and obligations between creditors and debtors who are reciprocal. Accounts payable is regulated in Chapter Thirteenth of the Third Book of the Civil Code, in Article 1754 of the Civil Code. The problem is how is the application of mediation in resolving disputes over debt defaults in the Gianyar District Court? And what are the factors that influence the success of mediation in the Gianyar District Court? The research used is empirical legal research, which is looking at society in the real sense. And the problem approach used is the approach of cases in the Gianyar District Court. The conclusion obtained from this study is that the application of mediation in the Gianyar District Court is in accordance with Supreme Court Regulation No. 1 of 2016, and the factors that hinder the mediation process in the Gianyar District Court, namely both litigants do not come in the mediation process so the mediation process failed.

Abstract

The activity of buying and selling using the dropshipping system is a trading activity in which the seller does not have stock of the goods he is selling, but only promotes goods through images uploaded to his or her online shop. If the seller gets an order from a consumer, the seller cannot directly confirm the condition of the goods to be sent to the consumer because the supplier who will send it uses the seller's identity. This study aims to determine and study legal protection for consumers in buying and selling via electronic media using the dropshipping system, and to find out and study the legal consequences that arise if there is default in buying and selling via electronic media using the dropshipping system. The results showed that legal protection for consumers in buying and selling through electronic media using the dropshipping system can be done in a preventive and repressive manner, and the legal consequences that arise if there is default in buying and selling using the dropshipping system, namely the loss suffered by consumers is the responsibility of the seller because The seller is the party who makes a direct agreement with the consumer, not the supplier. Therefore, the public is expected to be more careful in conducting transactions via electronic media so that they do not suffer their own losses.

Abstract

Economic transactions have been integrated with internet technology which is often called e-commerce. Although it has been arranged in such a way to protect the rights of consumers, the use of standard agreements in e-commerce transactions still has the risk of large losses to consumers. Based on the background of the problems above, this research was conducted with the aim of elaborating the responsibilities of business actors to consumers in the event of default in the Go Food transaction using e-commerce and describing sanctions for Go Food businesses that apply fraudulent use of e-commerce. Referring to the formulation of the problem, this study was designed using a normative research approach. The method used in the processing of legal materials, namely analytical descriptive data analysis methods. In accordance with the results of data analysis, the responsibility of business operators for defaults in Go Food transactions using e-commerce was to return Go-Pay balances. Sanctions for Go Food businesses that apply cheating in using e-commerce, which result in losses to consumers, were not only limited to the dismissal of partners, but sanctions could also be imposed on irresponsible business actors. The sanctions in question could be in the form of civil, criminal or administrative sanctions.

Abstract

The validity of a marriage if carried out according to the laws of religion and their respective beliefs and recorded in accordance with the applicable laws and regulations, so as to obtain a deed as proof of a marriage. However, in many societies that do not register their marriages, the consequences will have an impact on children born; therefore there is a need for legal protection. The formulation of the problem in this study (1) how is the position of children born of marriage not recorded? (2) How is the legal protection of the inheritance rights of children born of marriage not recorded? This study aims to determine (1) the position of children born of marriage not listed, (2) legal protection of inheritance rights of children born to marriages not recorded. The method used is a type of normative legal research with a legal approach and a conceptual approach. Conclusions from the results of the study are the position of children born from unregistered marriages that are legal if they have fulfilled the requirements of their respective religions and beliefs, but the marriage does not have legal force and children born do not receive legal protection regarding their inheritance rights. The extramarital child will inherit if there is authentic evidence in the form of a birth certificate as legitimate written evidence.
