Abstract

The problems of interaction between humans and digital technologies based on artificial intelligence cannot be regarded as resolved. The aim of this study is, through the generalisation of various viewpoints on the interaction between humans and artificial intelligence, to find an answer to the question of whether the digital revolution represents another, albeit radical, improvement in human life, one that may nevertheless displace humans from the pinnacle of evolution, or whether it constitutes something that is destined to replace humans altogether. The following methods were employed: logical analysis, observation, sociocultural analysis, synthesis, comparison, induction, forecasting, and generalisation. The results obtained indicate that three key problems in the interaction between humans and artificial intelligence have been identified. First, there is a declining human capacity to control digital technologies due to their revolutionary development. Second, there is an incorrect assessment of, or even a complete disregard for, the negative consequences of the total digitalisation of all spheres of life. Third, humans tend to overestimate their ability to control digital technologies based on artificial intelligence. In order to ensure further interaction between humans and the artificial intelligence they have created, the study proposes measures aimed at counteracting the criminalisation of artificial intelligence.

Abstract

Economic, social and geographical disparities have led to the emergence of a digital divide between regions, which ultimately has resulted in an inequality of access to public services, which is one of the rights of citizens that must be fulfilled by the government. This study aims to analyze the effect of the digital divide on the inequality of access to digital public services in traditional society specifically. This is as well as the local government strategies ensuring inclusiveness of access  and overcoming injustice in public services in terms of Martha Nussbaum's theory of justice. This research is a socio-legal research and interdisciplinary prescriptive study using functional comparative law. Collaboration between local governments and the private sector is a key aspect of facilitating access to public services in areas that are not covered by internet access. The lack of access to digital public services is a form of injustice, is a violation of human rights and relates to the concept of a welfare state. Examined according to Martha Nussbaum's theory of justice, internet access is a fertile capability whose fulfillment determines the fulfillment of fundamental rights in turn (central capabilities). The goal of the rule of law is to create substantive freedom for those in traditional society to develop their lives. This theory places the state as an active entity that must strive to meet the needs of the community regarding digitalization and public services. This research shows that reality has shifted in the context of fulfilling the right to digitalization, which is highly dependent on the private sector, which is not in line with the theory of justice. Therefore, a system change must be made, namely that the development of digitalization must be in line with the expansion and improvement of internet access. The state must take a central role in fulfilling these needs.

Abstract

Indonesia's notary law framework remains normatively fragmented, as the Notary Law (UUJN) requires physical presence while the Electronic Information and Transactions Law (ITE Law) recognizes electronic signatures as legally binding instruments. This contradiction prevents notaries from issuing authentic electronic deeds, creates legal uncertainty, and structurally excludes vulnerable populations including remote communities, migrant workers, and micro-enterprise operators from accessing civil legal services. This study examines the normative legitimacy of electronic signatures within the Indonesian notary system, identifies the structural consequences of regulatory fragmentation on vulnerable populations, and proposes a justice-oriented harmonization framework for inclusive digital notarial services. Employing normative juridical methodology with statutory, conceptual, and comparative approaches, this study analyzes Indonesian legislation alongside regulatory experiences from the Netherlands, Brazil, Rwanda, Singapore, and Turkiye. The findings reveal three critical issues: normative contradiction between the UUJN and the ITE Law regarding remote appearance and authentication standards; the absence of explicit statutory recognition of cyber notary mechanisms; and disproportionate structural barriers to civil legal access for vulnerable populations produced by regulatory ambiguity. Harmonization requires legislative amendment, institutional infrastructure development, and justice-oriented governance design that ensures digital notarization expands rather than reproduces existing structural inequalities in access to legal services.
