Abstract

ABSTRACTLand banking, or bank tanah, provides a solution when government land ownership is unattainable. It involves acquiring land for future development needs. This study aims to determine the role of land banking within Government Regulation (Perpu) No. 2 of 2022 concerning Job Creation (Perpu CK) and the legal certainty of land banking in land acquisition. Employing a normative juridical approach, research concludes that Article 125, paragraph (4) of the Perpu CK states that land banking aims to execute land planning, acquisition, management, utilization, and distribution. The establishment of a Land Banking Agency is intended to allocate land for national development and public interest, aiming to prevent intermediaries manipulating land prices that could hinder land acquisition or clearance processes for development.Keywords: Land Bank; Agrarian LawABSTRAKBank tanah atau land banking menjadi solusi saat pemerintah tidak bisa memiliki lahan tanah. Bank tanah adalah praktik membeli atau mengambil alih tanah yang nantinya dikembangkan untuk memenuhi kebutuhan pembangunan. Tujuan penelitian ini untuk mengetahui kedudukan bank tanah dalam Perpu Nomor 2 Tahun 2022 tentang Cipta Kerja (Perpu CK) dan kepastian hukum bank tanah terkait pengadaan tanah. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian disimpulkan bahwa berdasarkan Pasal 125 ayat (4) Perpu CK disebutkan bahwa bank tanah bertujuan untuk melaksanakan perencanaan, perolehan, pengadaan, pengelolaan, pemanfaatan, dan pendistribusian tanah. Dibentuknya Badan Bank Tanah untuk mengadakan tanah bagi pembangunan nasional dan kepentingan umum, dan  diharapkan dapat mencegah timbulnya Calo yang memainkan harga tanah yang dapat menghambat proses pengadaan atau pembebasan lahan untuk pembangunan.Kata Kunci: Bank Tanah; Hukum Agraria

Abstract

Skandal dalam pelanggaran undang-undang telah sering terjadi, khususnya dalam bidang Corporate Social Responsibility (CSR) atau sering disebut tanggung jawab sosisal dan lingkungan. Dimana banyak perusahaan dengan sadar melanggar dengan tidak melakukan kewajiban CSR, dalam UUPT pasal 1 ayat 3 telah di terangkan kewajiban perusahaan dalam pemberian CSR terhadap masyarakat dan lingkungan sekitar. Namun dalam praktiknya banyak perisahaan yang masih dengan sengaja melanggar undang-undang tersebut. Penelitian ini menggunakan metode penelitian hukum normative, dengan menggunakan pendekatan perundangan-undangan dan pendekatan doctrinal, pendekatan perundang-undangan digunakan sebagai metode kajian dengan melihat ketentuan peraturan perubndang-undangan tentang CSR yang berlaku di Indonesia, dengan mengedepankan pada pendapat-pendapat para ahli tentang CSR, pendekatan tersebut menggunakan sumber data sekunder dengan bahan hukum primer. Hasil penelitian menunjukan bahwa kasus Pelanggaran Perdaata Corporate Social Responsibility menunjukkan bahwa pertanggung jawaban CSR dalam hukum di Indonesia masih memiliki ruang untuk di kembangkan, terutama dalam jenis sanksi yang dapat dijatuhkan kepada perusahaan. Pemberian sanksi yang lebih tepat bagi perusahaan yang melanggar, dapat menjadi upaya untuk meningkatkan kepatuhan penerapan CSR di Indonesia.

Abstract

ABSTRACTThe role of  notary is  using the cyber notary concept to create a service is fast, precise and efficient, but notarial deeds use cyber notary not have perfect proof like authentic deeds. The research methodology used in research is normative juridical because regulated in statutory regulations that regulate concept of cyber notaries. The technique used library research, which a way of obtaining data through library research. The results of research indicate that notarial deeds use electronic deeds not have all  documentation that original deeds have. The notary not meet the criteria for authenticity his deed as regulated in Article 1868 of the Civil Code. Notarial deeds made electronically lack the legal certainty regulated in the UUJN in connection with the new UUJN, the ITE Law.Keywords: Notary Deed; Cyber Notary; EIT LawABSTRAKPeran notaris dalam menggunakan konsep cyber notary agar tercipta suatu pelayanan jasa yang cepat, tepat dan efesien, tetapi akta notaris yang menggunakan cyber notary tidak memiliki pembuktian yang sempurna layaknya akta otentik. Metodologi penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dikarenakan telah diatur dalam peraturan perundang-undangan yang mengatur mengenai konsep cyber notaris. Teknik yang dipergunakan yaitu dengan Penelitian Kepustakaan (Library Research) dimana suatu cara memperoleh data melalui penelitian kepustakaan. Hasil penelitian ini menunjukkan bahwa akta notaris yang menggunakan akta elektronik tidak memiliki semua dokumentasi yang dimiliki oleh akta asli. Notaris tidak memenuhi kriteria dalam keaslian akta nya yang diatur dalam Pasal 1868 KUHPerdata. Akta notaris yang dibuat secara elektronik kurang memiliki kepastian hukum diatur dalam UUJN sehubungan dengan UUJN yang baru, UU ITE.Kata Kunci: Akta Notaris; Notaris Siber; UU ITE

Abstract

Problem in Article 56 related creditors separatist and preferential is suspension execution goods guarantee for 90 days after debtor stated insolvent , which then can shortened to 2 months . The main obstacles faced creditors separatist is ambiguity about product insolvency — including determination and statement —which causes difficulty in do execution. Theory of justice dignified emphasize importance certainty law and accessibility information as part from solution practical For problem This is for overcome obstacle mentioned , it is suggested existence reformulation in product insolvency and increase transparency as well as accessibility minutes , so that creditors separatist can utilise 2 month period with more effective . Legislators are expected can add editorial regarding the deadline delivery information insolvency as well as ensure easy and transparent access​ For increase justice in the process of execution guarantee.

Abstract

Pengampunan pajak (tax amnesty) adalah kebijakan pemerintah untuk meningkatkan penerimaan negara dan memberikan kesempatan kepada wajib pajak yang belum patuh untuk melaporkan hartanya. Dalam program tax amnesty tahun 2016, aset yang diperoleh antara 1985–2015, termasuk tanah dan bangunan, dapat diakui tanpa dikenakan sanksi perpajakan tertentu jika dilaporkan sebelum tenggat waktu. Notaris memegang peranan penting dalam mendukung kelancaran pelaksanaan program ini, khususnya dalam pembuatan akta otentik terkait pengalihan hak atas tanah. Akta pernyataan dan peralihan nama diperlukan untuk mengalihkan kepemilikan harta yang sebelumnya atas nama pihak lain ke nama wajib pajak. Peran notaris bukan hanya sebagai pembuat akta, tetapi juga sebagai penjamin kepastian hukum dan validitas dokumen perpajakan dalam konteks pengampunan pajak. Penelitian ini menggunakan pendekatan normatif-yuridis dengan menelaah peraturan perundang-undangan dan praktik pelaksanaan tax amnesty. Hasilnya menunjukkan bahwa sinergi antara kebijakan fiskal dan profesi hukum seperti notaris merupakan kunci keberhasilan program tax amnesty serta peningkatan kepatuhan wajib pajak di masa depan.

Abstract

Modernisasi pelayanan pertanahan berbasis elektronik merupakan sarana peningkatan indikator kemudahan pelayanan publik kepada masyarakat. Hal tersebut diterapkan dengan mengoptimalkan pemanfaatan teknologi informasi dan komunikasi. Untuk menjamin kepastian hukum hak atas tanah, maka dilakukan kegiatan pendaftaran tanah yang merupakan rangkaian kegiatan administrasi pertanahan dalam mengumpulkan serta mengolah data fisik dan yuridis. Permasalahan yang dibahas ialah bagaimana tahapan dan kendala yang dihadapi dalam pendaftaran tanah tanah untuk pertama kali secara elektronik dalam hukum pertanahan nasional. Jenis penelitian ini adalah deskriptif analitis. Untuk jenis data yang digunakan dalam artikel ini adalah data sekunder. Tahapan penerbitan sertifikat elektronik ada 2 tahapan yaitu yang pertama penerbitan sertifikat elektronik untuk pertama kali dan yang kedua penerbitan dilakukan melalui penggantian sertifikat analog menjadi sertifikat elektronik untuk tanah yang sudah terdaftar. Kendala yang dihadapi yaitu keengganan masyarakat untuk mendaftarkan tanahnya yang disebabkan oleh beberapa hal. Modernization of electronic-based land services is a means of increasing indicators of ease of public service to the community. This is implemented by optimizing the use of information and communication technology. To ensure legal certainty of land rights, land registration activities are carried out which are a series of land administration activities in collecting and processing physical and juridical data. The problem discussed is how the stages and obstacles encountered in registering land for the first time electronically in the national land law. This type of research is analytical descriptive. The type of data used in this article is secondary data. There are 2 stages in the issuance of electronic certificates, namely the first is the issuance of electronic certificates for the first time and the second is the issuance is carried out by replacing analog certificates with electronic certificates for registered land. The obstacle faced is the reluctance of the community to register their land.

Abstract

This research was conducted to aim of exploring the role of notary in the formation of legal entity association as receiver from the Ministry of Maritime Affairs and Fisheries of the Republic of Indonesia’s distribution in accordance with Peraturan Menteri Kelautan dan Perikanan Republik Indonesia Nomor 2 Tahun 2021 Tentang Penyaluran Bantuan Pemerintah di Lingkungan Kementerian Kelautan dan Perikanan and to analyze the suitable form of receiver’s legal entity accordance with the requirements set by the Ministry. This research uses normative law and descriptive with descriptive qualitative as the type of research. The data collection methods used were library research and document analysis and conducted using qualitative analysis methods. The result of this study showed that the notary might acts in making the deed of association’s establishment or other legal entity desired by the public who comes to the notary with the procedures; making a deed of association to register the association until it can be registered at the database system of the Ministry of Law and Human Rights until it becomes valid. Notary plays a role in helping people who need assistance from the Ministry of Maritime Affairs and Fisheries to meet the requirements to give legal status to the establishment of their group.

Abstract

The land mafia periodically reviews the steps taken to avoid land disputes and conflicts, but in reality these actions are always illegal. One aspect of implementation is that the event must be organized, planned and executed by a group of individuals. In reality (das sein) there are many land mafias in Indonesia where this can result in land disputes due to legal actions carried out by these individuals through land mafia intermediaries. The aim of this research is to determine the eradication of the land mafia using Indonesian legal instruments. The research carried out is a normative juridical research type. Documentary/library research is used to collect data, especially by examining documents closely related to the criminal activities of the Land Mafia and obtaining information in the form of formal provisions and existing data. The results of the research show that through the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 16 of 2020 concerning the Organization and Work Procedures of the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency, Directorate General VII, Directorate General of Land and Land Acquisition, has a very important role in efforts to eradicate the land mafia in Indonesia. Land mafia refers to illegal activities such as forgery of documents, land misappropriation, extortion, and corruption in land transactions. Abstract

The Grundnorm is Hans Kelsen’s teaching that was integrated into his theory known as the Pure Theory of Law. The Grundnorm is the highest source of legal imperative, which is accepted by every individual human being, based on his free will to submit orders that are no longer debated because they are accepted as truth. The Grundnorm being the source of the validity of legal imperatives, it means that is the highest source of the validity of regulatory law within the scope of national and international law. This is the background of the justification of the Monism school, which is part of the teachings in the Legal-Positivism school. This paper aims to describe the relationship between The Pure Theory of Law as the basis for justifying the existence of Monism. It also seeks to answer whether Monism can still be the basis for justifying the existence of international law. The results showed that Immanuel Kant’s teaching about the developmental stages of human recognition of the universe culminated in the ratio-practical and became the source of the development of Hans Kelsen’s legal teaching on the Grundnorm. Based on Hans Kelsen’s teaching, the Grundnorm is a pre-supposed source of necessity that is formed based on free will, but it is not created through formal procedures by the state. When examined from a sociological perspective, Monism, as a doctrine in the Legal-Positivism school, presupposes the state of society that develops linearly and statically. Monism’s validity was questioned when fundamental changes occurred in state relations in the post-World War II era. These fundamental changes are further accelerated in the post-globalization era, which is based on the demand for justice in relations between states with international legal instruments.

Abstract

This study explores whether or not Law No. 7 of 2016 for the Protection and Empowerment of Fishermen, Fish Cultivators, and Salt Farmers discriminates against women. This law supports small fishermen since it requires the government to provide them with financial stability through harvest season output guarantees. On the other hand, we discovered that Law No. 7 of 2016, about the Protection and Empowerment of Fishermen, Fish Cultivators, and Salt Farmers, has discriminatory consequences damaging the welfare of female fishermen. Because of sociological and cultural bias, female fishermen are the most neglected segment in the fishing sector. This is in comparison to other individuals employed in the fishing industry. The Protection and Empowerment of Fishermen, Fish Cultivators, and Salt Farmers Act of 2016 do not recognise or compel affirmative action for women fishermen to have equal access to protection and empowerment programmes. Because the law seeks to protect and empower fishermen, fish farmers, and salt producers, this is the case. This makes it exceedingly challenging for female fishermen, who are already socially expected to remain at home and away from the fishing industry. This type of research is qualitative and collects data using a socio-legal methodology. This approach blends legal research with other types of research, including language and contextual research. People feel that patriarchal societies significantly impact the research topic, despite the fact that this is not a legal issue. The results of this study indicate that Law No. 7 of 2016, Concerning the Protection and Empowerment of Fishermen, Fish Cultivators, and Salt Farmers, Does Not Adequately Regulate the Fulfillment of the Rights of Women Fishermen. This is because the law only addresses the topic of empowerment and does not address the aspect of protection. Because Maritime Affairs and Fisheries Service employees consider fishermen to be ship owners and crews, women in Kendal Regency, who are equivalent to men in the fishermen's insurance plan, are not eligible for fishermen's insurance and hence cannot obtain it.
