Abstract

Wujud sebuah konsep mesti dapat menjawab pertanyaan secara filosofis. Sebagai bangsa yang mayoritas beragama Islam, eksistensi perbankan syariah merupakan wujud cita-cita yang sudah lama dipendam. Eksistensi hukum perbankan syariah di Indonesia tidak hanya menyuguhkan legalitas implementasinya tetapi juga linealitas dengan nilai sumber utama hukum Islam yaitu Al-qur’an dan hadis. Tulisan ini selain menarasikan aspek ontologisnya, juga menyajikan sudut epistemologis dan aksiologisnya sehingga tulisan ini menjadi sangat penting sebagai pintu masuk menyelami dinamika hukum perbankan syariah di Indonesia. AbstractThe form of a concept must be able to answer questions philosophically. As a nation that is predominantly Muslim, the existence of Islamic banking is a manifestation of long-buried ideals. The existence of sharia banking law in Indonesia not only presents the legality of its implementation but also the lineality with the main source values of Islamic law, namely the Al-quran and hadith. In addition to narrating the ontological aspects of this paper, this paper also presents its epistemological and axiological angles so that this paper becomes very important as an entry point to explore the dynamics of Islamic banking law in Indonesia.

Abstract

Islamic fiqh is an evolving legal system influenced by the various fiqh madhhabs that have emerged since the early days of Islam. This diversity has contributed significantly to the application of Islamic law in the contemporary world. This study aims to analyze the historical development of the main fiqh madhhabs (Hanafi, Maliki, Shafi'i, and Hanbali) and their influence on the practice of Islamic law in the context of legal pluralism and fiqh reform in Muslim countries. This research uses a historical and analytical approach by examining classical fiqh literature and the development of modern Islamic law. It analyzes fiqh texts, legal decisions, and Islamic legal policies implemented in various Muslim countries. The results show that fiqh madhhabs played an important role in the formation of diverse Islamic legal systems. The influence of these madhhabs can be seen in the application of sharia law in various Muslim countries, despite differences in its recognition and implementation. In addition, the fiqh madhhabs also contribute to the socio-political dynamics in Muslim societies. This study asserts that despite the challenges in adapting fiqh to the modern era, a flexible and inclusive approach to fiqh can be a solution in dealing with global legal issues. Fiqh reforms that take into account the social context and needs of Muslim societies can enhance the relevance and justice of Islamic law in the contemporary era.

Abstract

Marriage in Islam is a social and spiritual institution that has a strong legal dimension. Islamic law regulates marriage comprehensively, starting from the pillars and conditions, objectives, to the annulment of marriage. Understanding the concept of Islamic marriage law is very important to ensure the continuity of family life in accordance with Islamic law and moral values. This research uses a qualitative-descriptive approach with a library research method. Data were collected through a review of primary and secondary sources, such as the Qur'an, hadith, classical and contemporary fiqh books, as well as Islamic legal literature and relevant legislation, including the Compilation of Islamic Law (KHI). It was found that the law of marriage in Islam includes five kinds of laws based on individual conditions: obligatory, sunnah, permissible, makruh, and haram. A valid marriage according to Islam must fulfill five main pillars, namely the prospective husband, prospective wife, guardian, two witnesses, and ijab qabul. The rights and obligations of husband and wife are regulated proportionally to maintain family harmony. Islam also establishes prohibitions on marriage in order to maintain the sanctity of the relationship and accommodate the resolution of household conflicts through divorce, khulu', and fasakh. The concept of marriage law in Islam emphasizes the importance of justice, responsibility, and protection of the human rights of each partner. These values have high relevance in the dynamics of modern life and become a strong normative foundation in the formation of a sakinah, mawaddah, wa rahmah Muslim family. In addition, the flexibility of Islamic law in responding to social situations makes it relevant to be applied in pluralistic national and international legal systems.
