Abstract

Industry 4.0 its a combination of automation technology and cyber technology that is inevitable especially for the advancement of industry in Indonesia. The hospitality of foreign investment is very necessary for investors to invest in Indonesia, especially the existence of legal protection for security of investments in the framework of industrial development 4.0. The form of legal protection provided by the Government of Indonesia is with various kinds of regulations that support foreign investment, one of which is Constitution Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, Constitution Number 25 of 2007 concerning Investment and Comunication Ministerial Regulations No 20 of 2016 concerning Protection of Personal Data and the existence of a Personal Data Protection legislation.

Abstract

This study aims to determine the obstacles in implementing social work sanction and compensation by law enforcers and the efforts that must be undertaken in order to achieve the objective of fair punishment. The approach method in this research is a sociological juridical approach. The research specifically used analytical descriptive method. The results of this study conclude that social work criminal sanction have not been implemented by law enforcers, this is because there is no clear regulation in the form of legislation as the legal basis, including the absence of an institution that functions to oversee the implementation of social work sanctiion and compensation. As for the efforts aside of the support for the establishment of laws and regulations so that social work sanction can be applied, is also by the courage of law enforcers to implement social work sanction, so that the objectives of fair punishment can be realized.

Abstract

This community service activity is organized by the Faculty of Law, Indonesian Computer University in collaboration with the Youth Organization Management, Padalarang District, West Bandung Regency. In the midst of the COVID-19 pandemic, the products of Micro, Small and Medium Enterprises (MSMEs) of the Padalarang District community continue to grow and become more diverse and almost every product has a brand, but the MSMEs brand owned has not been registered with the Directorate General of Intellectual Property. The method used is to conduct legal counseling through the media zoom meeting. The use of brands on MSMEs products can add higher selling value compared to unbranded products, MSMEs actors can be harmed if their products are used and even imitated in whole or in part by others because they sell well in the market. However, MSMEs actors cannot prevent and even sue because the mark has not been registered. Trademark registration is a must for MSME actors if they want to protect their rights to the mark. Trademarks to be registered are quite easy to use by utilizing online trademark registration, specifically for the registration of trademarks for MSMEs actors, the fees charged are lower than those of industrial marks. The legal protection of registered trademark rights is for 10 years and can be extended for the same time. Kegiatan pengabdian kepada masyarakat ini diselenggarakan oleh Fakultas Hukum Universitas Komputer Indonesia bekerjasama dengan Pengurus Karang Taruna Kecamatan Padalarang Kabupaten Bandung Barat. Ditengah pandemi covid 19 produk Usaha Mikro Kecil dan Menengah (UMKM) masyarakat Kecamatan Padalarang terus berkembang dan semakin beragam serta hampir setiap produknya memiliki merek, akan tetapi merek UMKM yang dimiliki tersebut belum terdaftar pada Direktorat Jenderal Kekayaan Intelektual. Metode yang digunakan yaitu dengan melakukan penyuluhan hukum melalui media zoom meeting. Penggunaan merek pada produk UMKM dapat menambah nilai jual lebih tinggi dibandingkan dengan produk tanpa merek, pelaku UMKM dapat dirugikan jika produknya digunakan bahkan ditiru secara keseluruhan maupun sebagian oleh orang lain karena laku dipasaran. Akan tetapi pelaku UMKM tidak dapat mencegah bahkan menuntut dikarenakan merek tersebut belum didaftarkan. Pendaftaran merek menjadi suatu keharusan bagi pelaku UMKM jika ingin terlindungi hak atas merek tersebut. Merek yang akan didaftarkan cukup mudah dengan memanfaatkan pendaftaran merek secara online, khusus untuk pendaftaran merek pelaku UMKM biaya yang dikenakan lebih rendah dibanding dengan merek industri. Pelindungan hukum hak atas merek terdaftar selama 10 tahun dan dapat diperpanjang dengan waktu yang sama.

Abstract

Society as users of health services organized by hospitals are entitled to receive services in plenary by not getting any difference of legal entity of hospital managers. The main goal of health care hospitals include the preventive, curative, rehabilitative and promotive to all levels of society in accordance with the socio-economic function that prioritizes social functioning compared with economic function. The legal entity of hospital management in the form of foundations, associations and limited liability companies. Research in this paper is a normative juridical research, which studied the approach of legislation (the statute approach) means that a problem will be seen from the legal aspect by studying the legislation. And also the method by way of literature study (library research). The research concludes that there are three (3) legal entity that manages private hospitals are more widely used by the public, namely foundations, associations and limited liability companies. Limited liability company that manages the hospital has the main purpose for profit or economic function takes precedence while legal entities of foundations and associations in managing hospitals prioritize socio-economic functions.

Abstract

Abstract Increased sexual violence against children can jeopardize the survival of a nation, child development will be disrupted if experienced sexual violence. The government has an important role to protect children as assets of the next generation one of the forms of protection as a deterrent effect for perpetrators of sexual violence against children by giving a weighting penalty with chemical castration punishment. Even though the Indonesian State is not an Islamic State, the majority of the population is Muslim, so that in every decision of the laws and regulations, especially those related to chemical castration punishment are in connecting with Islamic law. This study uses a normative juridical method, which is assessed by the the statute approach meaning that a problem will be seen from the legal aspect by examining the laws and regulations, in addition to that also by the method of library research. The results of this study concluded that the chemical castration penalty contained in Articles 81 and 82 of Constitutions Number 17 Year 2016 Regarding the Establishment of Government Regulation in Lieu of Law Number 1 Year 2016 Regarding the Second Amendment of Law Number 23 Year 23 concerning Child Protection. Chemical castration according to Islamic Law is unlawful based on the Qur'an and Sunnah which is the highest legal source of Islamic law. In various books of the hadith Bukhari and Muslim explained that Rasulallah SAW forbade castration to humans.

Abstract

Domain names can be obtained through Registration & Decision (Dispute Resolution Service Provider - DRSP). The new ITE Law recognizes the existence of domain names as a result of registration at a Foreign Registrar (Art. 24 paragraph (3)). The ITE Law needs to consider the principles in resolving domain name disputes, including DRSP; therefore, there is a need to harmonize the ITE Law with global regulations and practices. The legal issue that arises is what principles can be considered in resolving domain name disputes under the ITE Law? This research is descriptive-analytical, using the normative juridical method. The data obtained were analyzed using a qualitative juridical approach. The research results show that there are several principles needed to be considered in resolving domain name disputes, including what stated in the DRSP decision, i.e., the principle of legal certainty, the Lawrence Lessig “Architecture” principle, which can be applied regarding the recognition, and implementation of decisions by DRSP domain name dispute resolution service providers, as well as the principle of recognition of the ITE Law. These principles need to be considered to be able to follow the development of best practices in the ICT community related to domain name ownership and the online dispute resolution system by DRSP, which is regulated by ICANN in the UDRP and the Registry Agreement and Registrar Agreement in accordance with the theory of “Code” or “Architecture” of Lawrence Lessig. AbstrakNama domain dapat diperoleh melalui pendaftaran & putusan (Dispute Resolution Service Provider-DRSP). Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) baru mengakui eksistensi nama domain hasil pendaftaran pada registrar asing (Pasal 24 ayat (3)). UU ITE perlu mempertimbangkan prinsip-prinsip dalam penyelesaian sengketa nama domain termasuk DRSP, oleh karena itu perlu adanya harmonisasi regulasi dan praktik global. Permasalahan hukum yang muncul adalah prinsip apa saja yang dapat dipertimbangkan dalam menyelesaikan sengketa nama domain berdasarkan UU ITE. Penelitian ini bersifat deskriptif analitis, menggunakan metode yuridis normatif. Data yang diperoleh dianalisis secara yuridis kualitatif. Hasil penelitian menunjukkan bahwa beberapa prinsip yang perlu dipertimbangkan dalam penyelesaian sengketa nama domain termasuk putusan DRSP adalah prinsip kepastian hukum; prinsip “architecture” Lawrence Lessig yang dapat diterapkan terkait pengakuan dan pelaksanaan putusan penyedia layanan penyelesaian sengketa nama domain oleh DRSP; serta prinsip pengakuan oleh Undang-Undang ITE. Prinsip-prinsip tersebut perlu dipertimbangkan agar mampu mengikuti perkembangan best practices pada masyarakat Teknologi Informasi dan Komunikasi (TIK) terkait kepemilikan nama domain berikut sistem penyelesaian sengketa secara online oleh DRSP yang diatur oleh Internet Corporation for Assigned Names and Numbers (ICANN) dalam Uniform Domain Name Dispute Resolution Policy (UDRP), perjanjian registri, dan perjanjian registrar sesuai dengan teori “code” atau “architecture” dari Lawrence lessig.

Abstract

ABSTRAK Pendaftaran dan putusan merupakan dasar hukum terbitnaya nama domain. Dalam Undang-Undang ITE hanya mengakui eksistensi Nama Domain (ND) hasil pendaftaran pada Registrar Asing (Ps. 24 ayat 3). Teknologi informasi membuka ruang baru yang dinamakan cyberspace. Nama domain termasuk dalam cyberspace yang kepentingannya melibatkan seluruh pengguna internet akan tetapi tidak semua negara mempunyai regulasi yang sesuai dengan perkembangan teori dunia maya. Metode yuridis normatif yang digunakan dalam penelitian ini dengan spesifikasi yang bersifat deskriptif analitis. Teori “Code” atau “Architecture” Lawrence Lessig dapat diterapkan terkait pengakuan dan pelaksanaan putusan penyedia layanan penyelesaian sengketa nama domain yang melibatkan pihak Warga Negara Indonesia. Konsep pengaturan hukum terkait pengakuan dan pelaksanaan putusan penyedia layanan penyelesaian sengketa nama domain asing di Indonesia, adalah yang mampu mengikuti perkembangan best practices pada masyarakat TIK terkait kepemilikan nama domain berikut sistem penyelesaian sengketa secara online yang diatur oleh ICANN dalam UDRP dan dalam Perjanjian Registri dan Perjanjian Registrar sesuai dengan teori “Code” atau “Architecture” dari Lawrence lessig. Kata kunci: putusan arbitrase asing; nama domain; sengketa kepemilikan ABSTRACT Registration and sentence are the legal basis for issuing domain names. In the ITE Law, it only recognizes the existence of domain names as a result of registration at the Foreign Registrar (Art. 24 paragraph 3). Domain names are included in cyberspace whose interests involve all internet users but not all countries have regulations that are in accordance with the development of cyber theory. juridical normative used in this research with descriptive analytical specifications. Lawrence Lessig's "Code" or "Architecture" theory can be applied regarding the recognition and implementation of decisions of domain name dispute resolution service providers involving Indonesian citizens. The concept of legal arrangements related to recognition andimplementation of decisions of foreign domain name dispute resolution service providers in Indonesia, are those that are able to follow the development of best practices in the ICT community related to domain name ownership and the online dispute resolution system regulated by ICANN in the UDRP and in the Registry Agreement and Registrar Agreement in accordance with the theory of "Code Or “Architecture” by Lawrence lessig. Abstract

The research aims to determine the analiysis of informed consent to the health staff legal protection at bandung regional public hospital. Informed consent is an agreement of medical action through a process of communication between the doctor and the patient about the agreement of medical action that the medical staff would do to the patient. The research method used is a juridical normative qualitative research method with a descriptive approach. Data collection techniques used are by way of literature studies related to the subject, interviews and field observations. The results of the research showed that in general the informed consent at bandung regional public hospital had been optimally implemented and in accordance with the SOP (Standard Operating Procedure) in the hospital and there was also a General Consent, it’s a general agreement of the patient. Informed consent that has been optimally implemented and in accordance with the regulations in this hospital could protect the health staff and medical staff in carrying out medical actions on patients. For the suggestion given by researchers about health staff and medical staff have to give the socialization about the procedures of informed consent and medical staff have to understand about statute of law that exist, especially to the health staff and the hospital regulations

Abstract

The press is an institution that actualizes one of the points of human rights, namely freedom of association and expressing thoughts orally and in writing. The existence of the press has its function for society, based on people's sovereignty by the principles of democracy, justice, and the supremacy of law as a concreteization of press freedom. However, this is not the case for the position of the student press which is considered not to be a legal entity because it is still within the campus structure. Apart from that, in their activities, students cannot regularly carry out journalistic activities because they still have academic responsibilities as students. With these two aspects, it seems as if student press institutions do not meet the legal standards of press institutions, so the protection they should protect becomes unclear. Even though it is under the auspices of the campus, the editorial activities of the student press are independent without interference from the campus. As a result, if the news is about issues that offend the campus, criminalization of the student press is inevitable, especially in defamation and hate speech. Using the normative juridical method, by analyzing qualitatively it can be understood that the position of the student press seems to be constrained from all directions, between its status as a student and on the other hand as a press which should hold freedom and responsibility according to its function. So, the opportunity for all kinds of intimidation, such as threats, repressive actions and even banning, is not impossible for the student press. In the absence of legal protection, student press activities in carrying out the press function of disseminating information are hampered.
