Abstract

Asas berperkara (perdata) di pengadilan adalah berbiaya,namun penyelesaiannya dilaksanakan secara cepat, sederhana dan berbiaya ringan. Biaya yang dibebankan oleh pengadilan adalah biaya kepaniteraan dan biaya materai, biaya saksi, ahli, juru bahasa  juru sumpah, biaya pemeriksaan setempat, biaya pemangilan dan perbuatan hakim lainnya. Pada perkara prodeo berdasarkan pelaksanaan putusan perkara perdata No. 182/Pdt.g/2013/Pn.Mks yang telah mempunyai kekuatan hukum tetap (inkracht van gewijsde) ditemukan hingga saat ini masih mengalami kendala dalam pelaksanaan eksekusinya ; sehingga tujuan dari pelaksanaan putusan yang berkekuatan hukum tetap yakni dijalankannya eksekusi dengan berdasarkan asas peradilan yang berlaku di Indones     ia sebagaimana yang diatur oleh Undang-Undang Pokok Kekuasaan Kehakiman q2 HHHcepat, sederhana dan biaya ringan tidak berjalan sebagaimana mestinya dan tidak efektif. Kata Kunci : Perkara perdata, prodeo, eksekusi

Abstract

Cyber-Terrorism masuk dalam kategori kejahatan lintas batas negara yang terorganisir dan telah ditetapkan sebagai kejahatan luar biasa.Analisa menunjukan bahwa Cyber-terrorism merupakan bentuk transformasi terror yang dilakukan oleh teroris dengan menjadikan jaringan internet sebagai alat atau sasaran serangan. Jenis kejahatan ini bermetamorfosis menjadi kejahatan yang bersifat lintas negara. Pelakunya bisa berasal dari wilayah negara mana saja yang berakibat hukum pada identitas yang berimplikasi pada penentuan jurisdiksi pengadilan. Akibat makna-makna negatif yang dikandung oleh perkataan "teroris" dan "terorisme" para teroris umumnya menyebut diri mereka sebagai separatis, pejuang pembebasan, militan, mujahidin, dan lain-lain. Dengan rangkian jalur yang cukup maju ini maka dibutuhkan kerjasama yang bersifat global atau internegara. Salah satu solusinya setiap negara harus melakukan sinkronisasi tentang peraturan perundang-undangan yang khusus mengatur tentang Cyberterror.

Abstract

Reading socialization in fostering a culture of literacy in children is carried out as part of community service. This activity was carried out to raise awareness of the importance of reading in building a literacy culture in children. The increasingly rapid development of technology by presenting features that pamper its users encourages children and teenagers to prefer opening social media rather than reading books. The aim of this activity is to; (i) increasing awareness of the importance of instilling the habit of reading books as a means of improving personal quality, (ii) educating the public about the importance of enjoyable learning activities in order to optimize the child's growth and development process, and (iii) providing a comfortable reading place for the community

Abstract

 The Industrial Era 4.0 in Indonesia is characterized by automation and easy connections. Technological advances have had a major impact on changes in people's habits. According to Article 28G paragraph (1) of the 1945 Constitution of the Republic of Indonesia, every person has the right to protection of himself, his family, his honour, honor and dignity, as well as the property he controls. The ease of transactions using online payment media has triggered cyber crimes such as data theft, hacking and system break-ins which are increasing along with the increasing use of digital technology. Cybercrime, such as personal data leakage, identity theft, and financial loss, can have a major impact on society and organizations. The research method used is normative juridical. The conclusion of this research is the effectiveness of implementing laws to protect personal data in Indonesia, how these regulations can ward off cyber crimes which are increasingly widespread in Indonesia based on applicable laws and regulations from the threat of fear of doing or not doing something that is a human right.”  This can be corrected by adopting several personal data regulations from several developed countries which have proven effective in preventing public data leaks which pose a very high risk to banking and company accounts. The formulation of Effective Regulations on the protection of personal data from Cyber Crime must consider the Essence and Scope of Personal Data, the principles of data protection, the obligations of the managing organization, the rights of Individuals, Supervision and law enforcement and the Harmonization of integration with applicable witnesses such as: administrative fines, Restrictions or Prohibitions on Operations, criminal liability, civil damages, and publication of violations

Abstract

This study aims to examine the differences and tangents related to the Object of Dispute (OOD) in the perspective of the State Administrative Court (PTUN) Procedural Law and the Civil Procedure Law. In judicial practice, the determination of OOD is crucial because it concerns absolute authority between two different judicial regimes. This research uses a normative juridical method with a legislative and conceptual approach, and is analysed qualitatively. The results of the study show that although the PTUN and the civil courts both handle legal disputes, the fundamental differences lie in the type of legal subject, the nature of the object of the dispute, and the underlying principles. On the other hand, there are potential tangents in the case of objects that are civil in nature but are issued by state administrative bodies or officials, which gives rise to jurisdictional overlaps. Therefore, it is necessary to affirm norms and harmonize the regulation of absolute authority to avoid legal dualism that is detrimental to justice seekers. This research makes a theoretical and practical contribution in strengthening the boundaries of the absolute competence of the judiciary in Indonesia

Abstract

This study examines the role of international cooperation in anti-terrorism law enforcement in response to the complexity of terrorism threats that are transnational and transnationally organized. Using normative research methods that focus on the analysis of laws and regulations and international legal instruments, this study examines the effectiveness of cooperation mechanisms between countries in strengthening law enforcement and preventing acts of terrorism. The findings of the study show that international cooperation, through intelligence exchange, legal harmonization, extradition, and technical capacity building of law enforcement officials, makes a significant contribution to strengthening the effectiveness of anti-terrorism law enforcement. However, challenges in the form of differences in political interests, domestic legal constraints, and state sovereignty issues are still the main obstacles. This study recommends strengthening inclusive cooperation mechanisms based on respect for international norms as a strategic step to deal with the dynamics of terrorism threats globally. Thus, international cooperation is not only a tool of law enforcement but also a key element in terrorism prevention strategies.
