Abstract

Metode Work From Home (WFH) menjadikan rumah sebagai tempat kerja sekaligus lingkungan kerja sehingga dapat dimaknai bahwa rumah harus memenuhi unsur-unsur tempat kerja dan faktor-faktor yang mempengaruhi lingkungan kerja yang memiliki sumber-sumber bahaya dan berpotensi menimbulkan kecelakaan kerja atau Penyakit Akibat Kerja (PAK). Jika pekerja mengalami kecelakaan kerja saat WFH maka berhak untuk mendapatkan manfaat dari Jaminan Kecelakaan Kerja (JKK). Persoalannya dalam peraturan perundang-undangan yang berlaku hanya mengatur pemberian manfaat JKK terhadap kecelakaan kerja yang bersifat konvensional sehingga menimbulkan kekaburan norma jika diterapkan pada peristiwa kecelakan kerja saat WFH. Berdasarkan hal tersebut maka perlu diketahui apa peristiwa yang dapat diklasifikasikan sebagai kecelakaan kerja saat WFH dan bagaimana prosedur pelaporan klaim JKK terhadap pekerja yang mengalami kecelakaan kerja saat WFH. Metode penelitian yang digunakan dalam penelitian ini ialah yuridis normatif dengan pendekatan konseptual dan perundang-undangan dilengkapi dengan bahan hukum primer, sekunder dan bahan non-hukum yang dianalisis secara preskriptif menggunakan interpretasi ekstensif dan gramatikal. Hasil penelitian menunjukkan bahwa peristiwa yang dapat diklasifikasi kecelakaan kerja atau PAK saat WFH ialah peristiwa yang memiliki hubungan kausalitas dan terkait dengan hubungan kerja. Prosedur pelaporan klaim JKK terkait kecelakaan kerja saat WFH dapat merujuk pada PP Nomor 44 Tahun 2015 jo. PP Nomor 82 Tahun 2019 dan diatur lebih lanjut melalui Permenaker Nomor 5 Tahun 2021. Pembeda dalam prosedur pelaporan klaim JKK antara kecelakaan kerja konvensional dengan kecelakaan kerja saat WFH ialah adanya keluarga pekerja yang berada di rumah bersama pekerja yang bertindak sebagai pelapor sekaligus saksi.

Abstract

Perjanjian kerja dibutuhkan sebagai landasan kerja dalam upaya perlindungan bagi pekerja/buruh dan pengusaha. Terdapat peristiwa hukum adanya pelaksanaan perjanjian kerja berbentuk surat pernyataan kerja yang dilakukan pada praktek perjanjian kerja sebuah perusahaan yang bergerak di bidang event keolahragaan. Tujuan penelitian ini adalah untuk mengetahui keabsahan surat pernyataan kerja sebagai suatu bentuk dari perjanjian kerja antara pemberi kerja dan pekerja. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian normatif. Surat pernyataan kerja antara pekerja dengan PT X tidak memenuhi syarat formil perjanjian kerja dalam Pasal 54 UU Ketenagakerjaan sehingga dinyatakan cacat formil sebagai perjanjian kerja dan tidak bisa dijadikan sebagai dasar hubungan kerja. Hubungan kerja antara PT X dengan pekerja tetaplah ada namun hanya berdasarkan kesepakatan lisan atau perjanjian kerja secara lisan. Perjanjian kerja yang dilakukan merupakan perjanjian kerja untuk waktu tertentu. Perjanjian kerja untuk waktu tertentu harus dibuat secara tertulis berdasarkan Pasal 57 UU Ketenagakerjaan, Perjanjian kerja yang dibuat secara tertulis haruslah memenuhi syarat formil yang diatur dalam Pasal 54 UU Ketenagakerjaan. Surat pernyataan kerja tidak memenuhi ketentuan Pasal 54 UU Ketenagakerjaan sehingga cacat formil sebagai dasar hubungan kerja. Dalam hal tidak sempurnanya surat pernyataan kerja sebagai dasar hubungan kerja, memungkinkan adanya perselisihan hak. Setiap perselisihan hubungan industrial yang terjadi harus diupayakan perundingan Bipartit. Perundingan Bipartit adalah perundingan antara pemberi kerja dan pekerja untuk mencapai mufakat. Tahap lanjutan apabila Bipartit gagal, adalah perundingan Tripartit melalui mediasi dengan peran mediator sebagai penengah yang netral. Mediasi berhasil apabila tercapai kesepakatan antara dua pihak. Apabila gagal, mediator mengeluarkan anjuran tertulis untuk ditanggapi.

Abstract

This research aims to analyze the rights of employees who voluntarily resign and whose wages have not been paid, through a case study of the Supreme Court decision number 318 K/Pdt.Sus-PHI/2023. This type of research is normative with a legislative, case, and conceptual approach. The technique for collecting legal materials is done through literature study and analyzed using a prescriptive technique. The research findings indicate that the judge's consideration of applying Article 50 of Government Regulation 35/2021, supported by the available evidence, states that employees who voluntarily resign are still entitled to unpaid wages and holiday allowances (THR), as well as severance pay. The research also concludes that employees who voluntarily resign should also be entitled to compensation for rights. The legal consequence of this decision is the annulment of the previous ruling, which rejected the lawsuit in its entirety. Consequently, the Defendant is obligated to pay the unpaid wages and THR, as well as the severance pay, to the Plaintiffs.

Abstract

This article examines a community service program focusing on legal empowerment and advocacy for Indonesian Migrant Workers (IMWs) in Brunei Darussalam. IMWs often experience legal vulnerability due to limited awareness of labor rights, migration regulations, and access to legal assistance, as well as challenges in social adaptation within the host country. The program was implemented through legal education sessions, participatory discussions, and advocacy assistance involving migrant worker communities. The results indicate a significant improvement in legal awareness, understanding of rights and obligations, and social adaptation skills among participants. From a legal perspective, community-based legal empowerment serves as a strategic approach to strengthening protection mechanisms, preventing labor disputes, and enhancing the overall well-being of Indonesian migrant workers abroad.

Abstract

The purpose of this study is to analyze the regulation of the right to disconnect in France as an instrument for protecting workers' mental health and to identify the urgency of its regulation for workers in Indonesia. This study uses a normative legal method with statutory, comparative, and conceptual approaches through the examination of primary, secondary, and tertiary legal materials related to labor law, occupational safety and health, and the protection of workers' rights in the digital era. The findings show that France has explicitly regulated the right to disconnect in the Code du Travail as a form of protection for workers' rest time, private life, and mental health. Meanwhile, Indonesia does not yet have an explicit regulation that recognizes workers' right to refuse work or communication outside working hours, so protection against psychosocial risks such as stress, work exhaustion, and burnout has not been fully guaranteed. The recommendation from this study is the need to establish a specific regulation on the right to disconnect in Indonesia as part of labor law reform, while maintaining a balanced consideration of both workers' and employers' interests.
