Abstract

Homeless children as a social issue, especially in urban society, in the view of experts and related the organization and departments do not have a uniform similarity of opinion or definition for that matter. In this context, home less children are seen as a social Clearly a social problem that requires an Appropriate methods of settlement in accordance with the expectations of all stakeholders. The research method used a sociological Juridical approach by solving research problems using the data consisting of legal secondary materials or legal regulations used to implement the data to primary data. The results of the research are: 1) Factors that can influence the municipal government in tackling the problems of children who are abo ve the social environmental factors, the Community Culture, the Migration Factor The three factors are the reality that can not be avoided by the city g o v e r n m e n t t h a t will c a u s e t h e c hild homeless children in Samarinda City. 2) The legal Efforts undertaken by the municipality in a different context from the development undertaken by the Samarinda City Regulation No. 16 of 2002 are not yet applicable, with the improvement of the Samarinda City Regulation No. 7 of 2017 the which is implemented a development w ith the current realities

Abstract

ABSTRAKAnak jalanan sebagai suatu permasalahan sosial kemasyarakatan khususnya masyarakat perkotaan. Karakteristik anak jalanan di Kota Samarinda pada dasarnya menunjukkan ciri tersendiri. Hal ini dimaksudkan bahwa dari cara bekerja di jalanan dapat diidentifikasikan berdasarkan asal mereka yakni: yang berasal dari Madura, Jawa, Buton, Banjar dan Sulawesi (suku pendatang) pada umumnya bekerja di jalanan sebagai pengemis anak, pengemis tua, pengemis cacat dan pengamen, sementara untuk mereka yang penduduk lahir dan berdomisili di Samarinda dengan keluarganya (Banjar) biasanya bekerja sebagai penjual koran, pedagang asongan dan tukang bersih-bersih mobil. Permasalahan dalam penelitian yaitu: Bagaimana pola pendekatan kebijakan hukum Pemerintahan Kota Samarinda dalam mengatasi anak jalanan? Bagaimana upaya hukum yang dilakukan oleh Pemerintahan Kota Samarinda dalam penertiban anak jalanan sebagai dampak dari pembangunan perkotaan di Kota Samarinda? Metode penelitian yang digunakan dalam mengatasi anak jalanan dalam perspektif hukum adalah Yuridis Normatif. Hasil Pembahasan bahwa terkait Peraturan Daerah Kota Samarinda di mana Peraturan Daerah Kota Samarinda Nomor 16 Tahun 2002 harus dirubah dan dikaji ulang secara materiil karena tidak sesuai dengan pola hidup masyarakat Kota Samarinda saat ini dan Undang-undang Nomor 35 Tahun 2014. Keberadaan anak jalanan sebagai suatu permasalahan perkotaan perlu untuk mendapatkan perhatian serius dari semua pihak, terutama bagi instansi/dinas pemerintahan yang terkait dalam pengambilan kebijakan mengenai anak jalanan.Kata kunci: Peranan Pemerintah, Penertiban, Anak Jalanan ABSTRACTStreet children as a social problem, especially the urban community. Characteristics of street children in the city of Samarinda basically shows its own characteristics. It is intended that on the way to work on the streets can be identified based on their origin ie: those from Madura, Java, Buton, Banjar and Sulawesi (tribal settlers) generally work on the streets as a beggar child, the old beggar, beggar disabled and singers street, while for those people born and living in New York City with his family (Banjar) usually work as newspaper sellers, hawkers and cleaner cars. Problems in the research are: What is the pattern of policy approach of Samarinda City Government in overcoming street children? How is the legal effort made by Samarinda City Government in controlling street children as the impact of urban development in Samarinda City? The research method used in overcoming street children in legal perspective is Juridical Normative. Result Discussion that related to the Regional Regulation of Samarinda City in which the Regulation of Samarinda City Number 16 of 2002 should be changed and reviewed materially because it is not in accordance with the pattern of life of the people of Samarinda today and Law Number 35 of 2014.Keyword: Role of Government, Control, Street Children

Abstract

The hierarchy of laws and regulations in Indonesia is regulated in Law Number 12 of 2011 concerning the Establishment of Legislations, in principle lower regulations may not conflict with higher regulations. However, in Law Number 12 of 2011 concerning the Formation of Legislations, there are weaknesses, which have implications for the implementation of laws and regulations in Indonesia. This study uses a normative juridical approach, using a statute approach and a case approach. The finding in this article is that the reconstruction of the hierarchy of laws and regulations needs to be done by placing Pancasila as the highest basic norm, which can become the truth in the entire legal system in Indonesia.

Abstract

The president possesses the prerogative right to appoint and dismiss his government personnel without having to seek approval from other branches of power. In practice, the president often does not use the rightfully because of the coalition consequences of the multiparty party system, which also has implications for the practice of appointing ministers and deputy ministers. Therefore, the president is not independent to choose figures for strategic political positions. This study examined the Indonesian president's prerogative right in appointing ministers after the amendment to the 1945 Constitution. This study used doctrinal legal research with statutory regulations, conceptual approaches, and comparative approaches. This study concludes with two points. First, the presidential system is rigid compared to the more flexible parliamentary system. The presidential system also tends to be more prone to causing immobility and deadlock. A multiparty system has implications for inconsistency in governance with a presidential system of government. Second, the combination of a multiparty system has implications for the president's prerogative right not being used effectively. Thus, a reconstruction of the model of minister appointment is required. The appointment should no longer be the absolute authority of the president. The president must involve other institutions that represent the people as a form of checks and balances.DOI: https://doi.org/10.22304/pjih.v10n2.a6

Abstract

In Indonesia since the reforms, political participation of women, especially women's representation in decision-making becomes an important agenda of government and the legislature. affirmation and strengthening policies continue to be pursued. In the representation of women in decision-making, of course we have followed with a mindset, as well as the ability of the competent. But the fact is, we are very concerned about the condition of women's political participation tends to be a bit of strength. Social and cultural processes, are more likely to exclude women, is considered negative for the condition and behavior. Therefore, efforts need to change the mindset (mind-set) of society on women's lives.

Abstract

The objective of this research is to know the corruption on the uninterrutible power suply di DKI Jakarta in 2015 involving the members of Jakarta parliaments.The method of the it is library research taken from Gatra magazine published on August 2,2017.The results of the research are (1).The UPS project has been apointed to be involved the crime namely corruption,(2).The top director of PT.Offtarindo Adhiprima is involved in this project,(3).The corruption has been detected in 2015,(4).The innitial names of the legislators of the special region Jakarta MF and FZ and from the campany concerned are HL and PZ,(5).This case has been performed in Tipikor court state of Jakarta.The suggestions of the researcher are,(1).The antisipation and the control of the local government has to be maximized,(2).The payment of the project concered has to use electronic tools,(3).The acccused people has to be sentenced maximally,(4).The money being corrupted has to be payed by the accused people,(5). The acccused people has to be deleted from the personal staff.

Abstract

This research is willing to know about the role of the political party to the general election of the governor as the head of the province in East Kalimantan 2018 based on the regulation No.10,2016 about the general election of the heads of the regional either the couple governor, mayor or regent in Indonesia. The method of the research is qualitative by library research.The essential content of the general election regulation is democratic mechanism. The result of the research is that one of the political party in here Indonesia Struggle Democratic Party (PDI Perjuangan) announced by the chairman of the winning team, Verdiana, that (1).Who will register to be the candidate through this party has to register himself or herself by paying such an amount of money to show the seriousness to the candidate but she does not determine how much money to pay  and the requirements to fill out, (2).Besides the register payment there are some other requirements which are not yet explained.The suggestions are (1).The sum of the money to pay of te registeration has to be determined before , (2).The other requiements has to be declared soon

Abstract

Penulis menemukan masalah yang sering terjadi di beberapa apotek di Samarinda tentang penjualan obat keras golongan prekursor secara bebas yang dapat menyebabkan penyalahgunaan. Seringkali, penjualan obat keras golongan prekursor di apotek menimbulkan beberapa masalah yang tidak sesuai dengan peraturan perundang-undangan. Pengawasan ini berwujud dalam melakukan pengendalian dan pengaturan terhadap penjualan obat keras golongan prekursor, yang merupakan bahan baku dalam pembuatan obat-obatan yang berbahaya. Penelitian ini menggunakan metode penelitian normatif-empiris, yaitu penelitian hukum kepustakaan  yang berupa data sekunder seperti Perundang-undangan, jurnal-jurnal hukum dan buku-buku literatur. Serta observasi langsung melalui wawancara di lapangan dengan informan pasien atau konsumen. Hasil penelitian ini menunjukkan walaupun terdapat peraturan dan prosedur yang jelas pengawasan dan penjualan obat keras golongan prekursor masih terus terjadi. Hal ini mengindikasikan lemahnya pengawasan dan penegakan peraturan oleh pihak berwenang. Salah satu faktor utama yang menyebabkan permasalahan ini adalah kurangnya kompetensi dan pemahaman sumber daya manusia di apotek tentang peraturan dan risiko penyalahgunaan obat keras golongan prekursor di Samarinda.

Abstract

Equality before the law and the right to obtain defense from an advocate is a fundamental human right and one of the essential elements in achieving justice for everyone. The East Kalimantan regional government provides legal aid to the poor based on East Kalimantan Provincial Regulation Number 5 of 2019 concerning the Implementation of Legal Aid. This study discusses issues regarding the implementation and challenges of East Kalimantan Provincial Regulation Number 5 of 2019 concerning the Implementation of Legal Aid. The writing of this thesis employs empirical research methods, utilizing both primary and secondary data sources. The results of this study indicate that the implementation of East Kalimantan Provincial Regulation Number 5 of 2019 concerning the Implementation of Legal Aid in Samarinda City has been carried out in accordance with the established regulations, but it has not yet been fully felt by some segments of the community. The challenges in implementing the regulation include budget limitations, lack of public awareness about the existence of legal aid, and insufficient outreach.

Abstract

Based on the history of Indonesian state administration, there are two cases of impeachment that have occurred against active Presidents, namely President Soekarno and President Abdurrahman Wahid. However, it needs to be understood that the impeachment process is not as easy as the previous experience because it has been rigidly regulated in the 1945 Constitution of the Republic of Indonesia. The purpose of this research is to comprehensively explore the impeachment process as a form of Presidential accountability in a democratic state of law. This research is a doctrinal research, using a legislative approach and a conceptual approach. The results showed that impeachment as the President's responsibility contains two patterns, namely political and legal mechanisms. The political mechanism is when the President is demanded accountability by the DPR which is then submitted to the MPR, (a joint session between DPR and DPD) then the Constitutional Court examines, hears and decides. as for the involvement of the Constitutional Court as a form of legal mechanism. Political and legal mechanisms in the impeachment process involving the role of DPR, MPR (filled with members of DPR and DPD), and the Constitutional Court is a manifestation of the principle of checks and balances. The final result of the institution that decides the impeachment of the President and / or Vice President if proven guilty is the MPR, as a form of accountability to the people through its representatives in the MPR which contains representation of the people (DPR) and representation of groups in the region (DPD) by not also leaving the principle of the rule of law as reflected in the role of the Constitutional Court in examining, adjudicating, and deciding.
