Abstract

The issue of the dismissal of regional heads is often discussed in several expert circles because, if examined carefully, several juridical issues need to be comprehensively studied. The involvement of the central government in the process of dismissing regional heads is actually counterproductive to the paradigm of regional autonomy. Regional autonomy is oriented towards the independence of a region to manage its regional affairs. This paper discusses the pattern of impeachment of regional heads in Indonesia using the regional autonomy paradigm approach. The type of research used is doctrinal legal research (black letter law), which focuses on determining the law on certain issues. The results showed that there are four patterns of impeachment of regional heads and/or deputy regional heads. First, the process of dismissing a regional head involves the role of the Regional People’s Representative Council (DPRD) and the Central Government. Second, the dismissal involves the roles of the DPRD, Central Government, and Supreme Court. Third, the temporary dismissal of regional heads only involves the role of the Central Government. Fourth, dismissal occurs through the DPRD’s right of interpellation and investigation if evidence of criminal law is found. This shows that the pattern of dismissal of regional heads and/or deputy regional heads is centralized and even negates the spirit of regional autonomy because the DPRD does not have a role in dismissing regional heads. Apart from that, there are no clear provisions regarding public involvement in the impeachment process, which tends to have political nuances, making it neither accountable nor transparent.

Abstract

This study aims to examine the form and extent of effectiveness of legal protection provided to cleaning service workers on campus from the perspective of the Manpower Law. Cleaning service workers play a crucial role in maintaining cleanliness and creating a comfortable atmosphere on campus, but their position is often vulnerable due to being tied to contract work systems or outsourcing mechanisms. This study uses a normative-empirical juridical approach, combining analysis of laws and regulations, legal theory and doctrine, and empirical findings obtained through interviews and field observations. The results show that, normatively, Law Number 13 of 2003 concerning Manpower, as amended by Law Number 6 of 2023, provides a strong basis for legal protection for workers, including outsourced workers. However, its implementation on campus has not been optimal. Various violations of workers' normative rights have been found, such as below-standard wages, lack of social security, violations of leave rights, and weak implementation of occupational safety and health (K3). The main factors contributing to weak legal protection include a lack of oversight by universities and the Department of Manpower, low legal awareness among workers and service providers, and a lack of internal complaint mechanisms within educational institutions. Effective legal protection not only ensures legal certainty but also realizes social justice and respect for human dignity, as embodied in the values of Pancasila and the ideals of national labor law.

Abstract

This study seeks to explore comprehensively the application of Article 33 paragraph (3) of the 1945 Constitution, which governs the state’s authority over land ownership, through philosophical, historical, and sociological lenses. Philosophically, the notion of state control over the earth, air, and natural resources underscores the role of the state as the supreme steward entrusted with managing these assets for the collective welfare of its citizens, rather than as a private proprietor. This principle reflects the ideals of social justice that were abolished in the values of Pancasila. Historically, the transformation from the colonial concept of domein verklaring to the UUPA system illustrates a shift in the paradigm of land management in order to affirm the nation's rights to natural resources. Sociologically, the state is present as a regulator to guarantee fair land distribution and the protection of community rights, including customary rights, amidst the dynamics of economic growth and urbanization. The constitutional mandate contained in Article 33 paragraph (3) of the 1945 Constitution affirms that every land governance policy should prioritize the prosperity of the people by ensuring harmony between private rights and collective interests, while simultaneously preventing the concentration of ownership and potential land-related disputes.

Abstract

Land certificate disputes are a frequent legal issue in Indonesia, in line with the increasing demand for land, its high economic value, and the position of certificates as legal evidence of ownership rights and the object of state administrative decisions. Various problems such as overlapping certificates, administrative errors, and overlapping authority between the State Administrative Court (PTUN) and the District Court, often give rise to legal uncertainty and have implications for social unrest in society. Therefore, this study focuses on a juridical-normative analysis of the role and authority of PTUN judges in examining and deciding cases related to land certificate disputes. The results show that PTUN judges play a strategic role as testers of the legality of land administration decisions, guarantors of legal certainty, and protectors of community rights through judicial oversight mechanisms. On-site inspections by judges are crucial as an effort to objectify field facts and enforce the principle of legality. This study emphasizes the need for regulatory synergy and increased integrity of the land bureaucracy so that legal protection and substantive justice for land rights are truly realized.

Abstract

Adolescents are a vulnerable group who are highly at risk of experiencing various forms of violence, particularly sexual violence that often occurs within close environments such as families, schools, and social communities. This community service program aimed to enhance students’ legal awareness and knowledge regarding the prevention of sexual violence in schools through a legal education campaign at SMKN 20 Samarinda. The program was conducted over six months, involving 40 participants consisting of student council members, flag-raising troop members, and class representatives from grade XI. The implementation employed a participatory-educative approach, combining legal counseling, interactive lectures, group discussions, and experience-sharing sessions. The activities were carried out in two stages: the first focused on socialization and education about the forms and impacts of sexual violence, while the second involved expert legal speakers who provided in-depth understanding of legal protection and reporting mechanisms. The results showed an improvement in students’ comprehension of sexual violence concepts, their awareness of self-protection rights, and their courage to report incidents of violence occurring in their surroundings. Moreover, the program fostered empathy and social concern among students to build a safe and violence-free school environment. This initiative is expected to serve as an initial step in developing a culture of legal awareness and child protection within educational settings and as a preventive model that can be replicated in other schools.

Abstract

This study examines the urgency of regulating legal sanctions under Article 157A of Law Number 6 of 2023 on Job Creation in strengthening worker protection and ensuring legal certainty in employment termination practices. The absence of explicit sanction norms for violations of termination of employment provisions has created a normative gap that weakens enforcement mechanisms and disrupts the balance of protection between employers and workers. This research employs a normative legal method with statutory and conceptual approaches to analyze the coherence of Article 157A within the labor law sanction system. The findings indicate that Article 157A remains general in nature and lacks operational sanctioning power when compared to other provisions in the labor cluster, particularly Articles 185–189, which explicitly regulate administrative and criminal sanctions. Consequently, the provision tends to be non-self-executing and ineffective in preventing arbitrary termination practices. This study contributes conceptually by proposing the reconstruction of more specific and proportional sanction norms, combining administrative sanctions and fines as ultimum remedium, to enhance enforceability, legal certainty, and balanced protection in industrial relations. The research underscores that effective labor protection requires not only substantive rights regulation but also clear and enforceable sanction mechanisms to achieve justice and legal certainty in Indonesia’s employment law system.

Abstract

This study analyzes legal protection for indigenous peoples in disputes over land ownership and utilization with oil palm plantation entrepreneurs through a normative study of customary rights, the principle of legal certainty, and dispute resolution mechanisms based on Indonesian agrarian law. Constitutionally, Article 18B paragraph (2) and Article 33 paragraph (3) of the 1945 Constitution recognize the rights of indigenous peoples and emphasize that control of natural resources by the state must be directed to the greatest possible prosperity of the people. However, in practice, the granting of Cultivation Rights (HGU) and plantation business permits often gives rise to structural conflicts due to weak administrative recognition of customary areas and unequal bargaining positions. This study uses normative legal methods with a statutory, conceptual, and case approach, including analysis of Constitutional Court decisions and PTUN jurisprudence. The results of the study indicate that legal protection for customary rights is still declarative and does not provide substantive legal certainty. Strengthening legal protection requires regulatory harmonization, formal recognition of customary areas, and reform of dispute resolution mechanisms based on agrarian justice and the principle of the public trust doctrine.
